Can You Switch Mortgage Lenders After You Apply or Lock a Rate?

Generally, yes. In the United States, applying for a mortgage, receiving a Loan Estimate, or locking a rate usually does not commit you to that lender. The Consumer Financial Protection Bureau (CFPB) says, “You’re not committed to any lender before you have signed final closing documents.” However, changing lenders means restarting much of the mortgage process, and that can put your rate, closing date, deposits and purchase contract at risk.

What applying, getting a Loan Estimate and locking a rate actually mean

A mortgage application starts underwriting and gives a lender information to price and approve your loan. The lender generally must provide a Loan Estimate describing the projected interest rate, points, lender credits, closing costs and other terms. Receiving that document is not the same as signing a final loan contract.

The CFPB’s consumer guidance states that a borrower is not committed to a lender before signing final closing documents. You can therefore continue shopping after applying or receiving a Loan Estimate, subject to the practical costs and deadlines discussed below.

A rate lock is narrower than a commitment to use a lender. The CFPB defines it this way: “A lock-in or rate lock on a mortgage loan means that your interest rate won’t change between the offer and closing, as long as you close within the specified time frame and there are no changes to your application.” The lock protects the quoted rate only under the written agreement’s conditions. It does not make the lender your only possible choice.

This explanation concerns most U.S. mortgages that use the Loan Estimate and Closing Disclosure process. Reverse mortgages, home-equity lines of credit and some other products use different disclosures and rules.

Can a rate lock be moved to a new lender?

Do not assume that an existing lock follows you. A lock is an agreement with the lender that issued it for a particular loan application. CFPB guidance does not establish a universal rule requiring one lender to honor or transfer another lender’s lock. A replacement lender must provide its own offer and its own written lock terms.

Before changing lenders, obtain these details from the prospective lender:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Whether the quoted rate is currently floating or locked.
  • The date and exact time the new lock expires.
  • The cost and availability of an extension if underwriting or closing runs late.
  • What changes to the application could reprice the loan.
  • Whether the rate, points or lender credits can change before closing and under what circumstances.

Regulation Z requires the Loan Estimate to state whether the interest rate is locked. If it is locked for a specific period, the estimate must disclose when that period ends. The rule also explains that the interest rate, points and lender credits may change unless the rate has been locked. Your signed lock agreement and the lender’s policies control the individual transaction.

What happens when you switch

The new lender generally has to perform its own application, verification, underwriting and closing preparation. Documents sent to the first lender may not satisfy the second lender’s requirements, and completed processing does not automatically transfer.

The CFPB warns that starting over can delay or endanger the closing. The risk is greatest when the purchase contract has a firm closing date, the seller is coordinating another transaction, or the replacement lender has a long underwriting queue.

Your first lock can expire

Typical lock periods described by the CFPB are 30, 45 or 60 days, although longer periods may sometimes be available. If the first lender’s lock expires before you close, the lender may offer an extension for a fee; policies and pricing vary. Ask for the extension terms before deciding whether staying is safer than switching.

Your new lender may need a fresh appraisal or other work

An appraisal, credit report, income verification and title work completed for one lender may not be accepted by another, or the new lender may require updates. Ask exactly which items can be reused and which must be ordered again. Do not count an appraisal as transferable until the replacement lender confirms that in writing.

Application and appraisal fees may not come back

Fees paid to the first lender are not automatically refundable. The CFPB says application and appraisal fees might or might not be refundable if you decide not to proceed. Review the fee agreement and request a written answer identifying each fee, whether it has been charged, and the conditions for a refund.

Deadlines that can make a switch dangerous

The 10-business-day intent-to-proceed window

After issuing a Loan Estimate, a lender may close the application as incomplete if you do not communicate your intent to proceed within 10 business days. If you return later, the process may have to restart. A closed application can therefore consume time you thought you had for comparing offers.

Tell the lender clearly, and in a method it accepts, whether you intend to proceed. Keep the message and confirmation. Expressing intent to proceed does not prevent you from later choosing another lender, but it can allow the current application to move forward while you make a final decision.

The purchase-contract closing date

Compare the new lender’s realistic underwriting and closing schedule with the date in your purchase contract, not merely its best-case estimate. Ask who will handle the file, what documents remain outstanding, and how quickly conditions are normally cleared. Notify your real-estate agent and other transaction parties before the change becomes a last-minute surprise.

Lock expiration and extension timing

Record the current lock’s expiration date and time in your calendar. Ask how many days before expiration an extension must be requested, whether an extension is guaranteed, and whether the fee is daily, fixed or based on the loan amount. A new lender’s processing estimate does not extend the first lender’s lock.

How to compare the existing and replacement offers

Compare like with like. A lower advertised rate can be offset by points, lender credits, fees, a shorter lock or a closing date the lender cannot meet. Request a Loan Estimate from the prospective lender and place it next to the current lender’s estimate.

Item Questions to answer
Loan type and term Are both offers the same fixed- or adjustable-rate product, term and occupancy assumptions?
Interest rate Is each rate locked or floating, and until what date and time?
Points and lender credits How much cash is required for points, and do credits reduce closing costs in exchange for a higher rate?
Lender and other closing costs Which fees are charged by the lender, and which are third-party charges that may recur?
Down payment and loan amount Are the assumptions identical? A different loan amount or down payment can change pricing and mortgage insurance.
Extension terms What does an extension cost, and can the lender decline to extend?
Closing timetable Can underwriting, appraisal, title and documents be completed before the contract deadline?

Look at the first page of each Loan Estimate for the rate-lock status and lock-end date. Then check the detailed costs and cash-to-close assumptions. Ask both lenders to explain any difference rather than comparing only the headline rate.

Step-by-step: switching without losing control of the transaction

  1. Read the current lock and fee documents. Write down the lock expiration, extension rules, rate-change conditions, fees already paid and refund provisions.
  2. Ask the current lender for written answers. Confirm the exact cost of extending, whether the lender can meet the contract date, and what conditions remain on the loan.
  3. Obtain the replacement lender’s Loan Estimate. Give the new lender the same loan amount, property, down payment, credit and occupancy assumptions so the comparison is meaningful.
  4. Get the new lock terms in writing. Confirm whether the rate is locked now or only quoted, the expiration date and time, extension cost, points, credits and repricing triggers.
  5. Verify the timetable. Ask for a realistic schedule for disclosures, appraisal, underwriting approval, conditions, closing documents and funding. Compare it with the purchase contract and any rate-lock deadline.
  6. Check sunk fees. Ask the first lender which application, credit, appraisal or other fees have been charged and whether each is refundable.
  7. Coordinate the handoff. Tell your real-estate agent, settlement agent and other relevant parties once the new lender is genuinely ready to proceed. Do not cancel the first application until you understand the new lender’s status and timing.
  8. Monitor the new file daily near deadlines. Promptly supply requested documents and obtain written confirmation when major conditions are cleared.

How credit checks are treated while shopping

The CFPB says mortgage credit checks made within a 45-day window are recorded on a credit report as a single inquiry for this shopping purpose. That means consulting multiple mortgage lenders during that period has the same inquiry treatment as consulting one, according to the CFPB. Do not extend that statement to checks outside the window or assume every credit-scoring model handles every type of inquiry identically.

To keep shopping organized, start the comparison period when you request serious quotes, keep a record of when each lender pulls credit, and provide consistent information to each lender.

When switching is more likely to make sense

The new offer is materially better after all costs

A lower rate may justify a change when the savings exceed new points, duplicate fees, any lost deposit and the cost of an extension. Calculate the difference using the same loan amount and term. Include the value of lender credits and the cash required at closing.

The current lender cannot meet the contract deadline

If the current file is stalled and the replacement lender can document a credible closing schedule, switching may reduce the risk of a missed closing. Get that schedule in writing and confirm the seller will accept any revised date before terminating the first process.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The current lender changed the terms unexpectedly

Ask why the rate, fees or approval conditions changed. Changes in loan amount, credit score, income verification, down payment, loan type or appraisal information can affect a lock. A new lender will evaluate those facts too, so compare the complete offers rather than assuming a switch eliminates the underlying issue.

When staying is usually safer

Closing is close and the current file is approved

Restarting a nearly completed loan can create more risk than a modest pricing difference. Ask whether the current lender can extend the lock or correct a documented error before abandoning the file.

The replacement lender is only quoting a floating rate

A verbal quote is not a locked offer. Until the new lender confirms the lock, the market can move and the final terms can differ.

Refundable-fee and timing questions are unresolved

Do not base the decision on an assumed refund or an unverified closing promise. Obtain written terms first, because neither the refund nor the timetable is universal.

What to do if the Closing Disclosure differs from the Loan Estimate

Compare the Closing Disclosure with the Loan Estimate as soon as you receive it. Check the interest rate, points, lender credits, loan amount, projected payments and closing costs. If the rate or fees differ, ask the lender to explain the change and identify whether it results from a permitted adjustment, a changed application fact or an error.

A discrepancy does not automatically require switching. First determine the cause, the corrected terms and the effect on your cash to close and monthly payment. If you are considering another lender, account for the time needed to produce a new Loan Estimate, satisfy conditions and reach closing.

Questions to ask before you make the decision

  • What is the exact lock expiration date and time?
  • What changes could cause the locked rate, points or credits to change?
  • What is the extension fee, and is an extension available?
  • Which fees have already been charged, and is each refundable?
  • Is the replacement rate locked or merely quoted?
  • Can the replacement lender close before the contract deadline?
  • Will the new lender accept the existing appraisal and other completed work?
  • What documents or underwriting conditions remain?
  • What are the total costs and cash-to-close under identical assumptions?

Bottom line for a U.S. home purchase

You can usually switch mortgage lenders after applying, receiving a Loan Estimate or locking a rate, because you are generally not committed until signing final closing documents. The trade-off is operational: the new lender’s process starts over, the old lock may expire, fees may be unrecoverable and a delayed closing can jeopardize the purchase. Compare complete Loan Estimates, obtain the new lender’s lock and timetable in writing, and make the change only after you understand the expiration, extension, refund and contract-deadline consequences.
