Yes, but the answer depends first on whether you are the deceased owner’s spouse. A surviving spouse may generally roll an inherited traditional IRA into an IRA in their own name or elect to treat it as their own, subject to the applicable rules. A nonspouse beneficiary generally cannot roll the account into a personal IRA, but can usually arrange a direct trustee-to-trustee transfer to another inherited IRA that remains titled in the deceased owner’s name for that beneficiary. Required minimum distributions (RMDs) cannot be rolled over.
The quick answer
| Beneficiary | Can the inherited IRA become the beneficiary’s own IRA? | Can assets move to another institution? | Key restriction |
|---|---|---|---|
| Surviving spouse | Generally yes, if the spouse qualifies and elects owner treatment | Generally yes, through an eligible rollover or direct transfer | An RMD is not eligible for rollover |
| Nonspouse individual | No | Generally yes, by trustee-to-trustee transfer to another inherited IRA | The receiving account must remain titled in the deceased owner’s name for the beneficiary |
The governing details are in IRS Publication 590-B (2025) and the inherited-IRA discussion in IRS Publication 17 (2025). The transfer method, account registration, outstanding RMDs and beneficiary category all matter.

First identify your beneficiary status
Do not authorize paperwork until you know how the custodian classifies you. The rules are different for a surviving spouse, another individual, a trust, an estate or another nonindividual beneficiary. The deceased owner’s beneficiary designation and the account documents control the starting point.

A spouse who inherited the IRA may be able to choose between continuing as a beneficiary and becoming the owner. Publication 17 states that, when the requirements are met, a spouse inheriting a traditional IRA can generally roll it over or choose to make the inherited IRA their own. Publication 590-B also describes an owner election for a surviving spouse who is the sole beneficiary in qualifying circumstances.

Nonspouse individual
A child, sibling, friend or other person who inherited from someone other than a spouse generally cannot treat the IRA as their own. That means no regular contributions to the inherited account and no rollover into the beneficiary’s personal traditional IRA or Roth IRA. The person may, however, move the assets directly between custodians while preserving inherited-account status.
Nonindividual beneficiary
When the beneficiary is an estate, charity or certain trust arrangement, distribution rules can differ from those for an individual. Do not assume that a transfer option available to an individual beneficiary applies to a nonindividual recipient. The custodian and a tax professional should review the beneficiary designation and governing documents before any transaction.
What a surviving spouse can do
Elect to treat the IRA as your own
A qualifying surviving spouse may elect owner treatment. The account is then handled as the spouse’s IRA rather than as an inherited account. This can change when RMDs begin and which distribution rules apply, so the election should be evaluated against the spouse’s age, tax situation and prior distributions.

Keep beneficiary treatment
A spouse can often remain the beneficiary instead of making an owner election. This may be useful when the spouse wants inherited-IRA distribution rules to continue or wants to delay owner-level RMD consequences. The account must be administered under the applicable beneficiary schedule, and the custodian’s registration should clearly show that it is inherited.
Roll over an eligible distribution
An eligible distribution paid to the spouse may generally be rolled over within 60 days, provided the distribution is otherwise eligible. A direct trustee-to-trustee transfer is usually cleaner because the money moves between institutions without being paid to the spouse. Neither method permits an RMD to be rolled over.
What a nonspouse beneficiary can and cannot do
What is prohibited
- You generally cannot roll an inherited IRA into your own IRA.
- You cannot treat the inherited account as if you were its original owner.
- You generally cannot make new contributions to the inherited IRA.
- You should not request a check payable to yourself and assume that redepositing it within 60 days creates a valid rollover.
The 60-day rollover rule does not create a nonspouse beneficiary’s right to own the inherited IRA. The restriction is based on the inherited-account rules, not merely on the timing of the redeposit.
What is permitted
A nonspouse beneficiary can generally arrange a trustee-to-trustee transfer to another inherited IRA. The receiving account must be established and maintained in the deceased owner’s name for the benefit of the beneficiary. The IRS describes the required structure this way: “However, you can make a trustee-to-trustee transfer as long as the IRA into which amounts are being moved is set up and maintained in the name of the deceased IRA owner for the benefit of you as beneficiary.”

For example, an account may be registered in a form that identifies the deceased owner, the beneficiary and the inherited status. The exact wording varies by custodian, but removing the deceased owner’s name or registering the account as the beneficiary’s personal IRA can create a serious administrative and tax problem.
Transfer versus 60-day rollover
| Feature | Trustee-to-trustee transfer | 60-day rollover |
|---|---|---|
| Who receives the money first? | The receiving trustee or custodian | The individual receives the distribution |
| Typical timing | Arranged directly between institutions | Generally redeposited within 60 days |
| One-rollover-per-12-month rule | Does not apply to direct IRA transfers | Applies where the distribution is otherwise eligible |
| Nonspouse inherited IRA | Generally available if the inherited title is preserved | Does not turn the account into the beneficiary’s own IRA |
| RMD amount | Cannot be transferred as a rollover amount | Cannot be rolled over |
A trustee-to-trustee transfer is not a distribution paid to you. Because the funds move directly between trustees, the IRS does not count it as a rollover for the one-rollover-per-12-month limitation. That exemption does not erase the inherited-IRA titling rules or make an RMD transferable as a rollover.
RMDs must be handled before moving the rest
An RMD is not eligible for rollover. If an RMD is included in a distribution and you redeposit the full amount, the RMD portion remains ineligible and can be treated as an excess contribution or otherwise create a tax problem. Ask the custodian to identify and distribute any RMD before moving the remaining balance.

The beneficiary’s future schedule
After the owner’s year-of-death issue is resolved, the beneficiary’s schedule depends on the beneficiary category and other facts. Current rules distinguish, among others, a surviving spouse, an eligible designated beneficiary, another designated beneficiary and a nonindividual beneficiary. Eligible designated beneficiaries include a surviving spouse, the owner’s minor child, a disabled or chronically ill individual, and an individual who is not more than 10 years younger than the owner.
Do not apply a blanket “10-year rule” without checking the specific beneficiary category, the owner’s date of death and current IRS instructions. A distribution schedule can determine whether a transfer is practical and when taxable withdrawals must occur.

- Confirm the beneficiary classification. Tell both custodians whether you are the surviving spouse, another individual or a nonindividual beneficiary.
- Ask the receiving institution how it will register the account. For a nonspouse, require a registration that keeps the deceased owner’s name and identifies you as beneficiary. Do not accept a standard personal-IRA application if it changes the legal status.
- Determine the RMD amount first. Ask whether the deceased owner’s year-of-death RMD remains unpaid and whether any current beneficiary RMD is due. Separate those amounts from the balance to be transferred.
- Request a direct transfer. Use the receiving custodian’s inherited-IRA transfer form and follow its delivery instructions. A direct transfer avoids making the check payable to you.
- Have the custodians reconcile the transaction. Confirm the amount sent, the date received and the final account title. Ask whether investments must be liquidated or whether they can be transferred in kind.
- Keep a complete file. Save the transfer form, delivery confirmation, year-end statements, RMD calculations and any tax forms issued by either custodian.
IRS rules do not establish one universal processing time, fee schedule or paperwork list. Each custodian sets its own procedures, so ask for a written estimate and requirements before submitting the request.
Common situations and the correct path
You are a spouse moving the account from a bank to a brokerage
First decide whether to remain a beneficiary or become the owner. If you retain beneficiary status, open the receiving inherited account under the custodian’s spouse-beneficiary registration and transfer the non-RMD balance directly. If you elect owner treatment, the receiving account can be established as your IRA, subject to the custodian’s requirements and the applicable rollover or transfer rules.

You are an adult child changing custodians
Open an inherited IRA at the new institution using the deceased owner’s name and your beneficiary designation. Request a trustee-to-trustee transfer. Do not have the old custodian issue the proceeds to you personally, and do not title the new account solely in your own name.
The check already includes an RMD
Do not redeposit the RMD portion. Contact the custodian promptly to determine which part is the required distribution and which part, if any, is eligible for another transaction. Keep the distribution statement for your tax records.
The receiving custodian rejects the title
Stop the transfer rather than accepting a title that removes the deceased owner’s name. Ask the receiving institution’s inherited-IRA team to provide its approved registration format and have the sending institution verify that the two titles match the required beneficiary structure.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteTax and paperwork pitfalls
- Using a personal IRA application: This can accidentally convert a nonspouse inherited account into an improperly titled account.
- Moving the RMD: An RMD cannot be rolled over, even when the remaining balance can be transferred.
- Assuming “60 days” solves everything: The deadline applies to an otherwise eligible distribution; it does not authorize a nonspouse beneficiary to own the inherited IRA.
- Ignoring the year-of-death RMD: An unpaid owner RMD can remain due after death.
- Choosing spouse treatment without modeling RMDs: Owner and beneficiary treatment can produce different timing and tax results.
- Relying on an oral promise from a call center: Get the registration, forms and transfer instructions in writing.
When professional advice is warranted
Consider advice from a qualified tax professional or fiduciary adviser when the beneficiary designation is unclear, multiple beneficiaries are involved, a trust or estate is the recipient, the deceased owner’s RMD is unpaid, or you are deciding between spouse owner treatment and continued beneficiary treatment. Bring the IRA statements, beneficiary paperwork, distribution history and any custodian forms so the advice addresses the actual account rather than a generic rule.
Quick Recap
Final decision checklist
- Have you confirmed whether you are a spouse or nonspouse beneficiary?
- Will the receiving account preserve inherited status and the deceased owner’s name when required?
- Has the deceased owner’s year-of-death RMD been calculated and paid?
- Is any amount being moved an RMD that must stay outside a rollover?
- Are you using a direct trustee-to-trustee transfer rather than a check payable to yourself?
- If you are a spouse, have you compared owner treatment with continued beneficiary treatment?
- Do you have both custodians’ forms, delivery instructions and written confirmations?
