Sometimes. A tax authority, tribunal or court may accept a late response, objection or appeal, or remove a penalty, but relief is never automatic. The correct route depends on your country, the notice you received and the action that was due. A missed tax-return, payment, audit-information, objection, review or appeal deadline can each have different rules. Read the notice, identify its specific procedure, explain the delay with evidence and act as soon as you can.
The examples below show how this works in the United Kingdom, United States and Canada. They are jurisdiction-specific illustrations, not one worldwide rule. Before filing anything, confirm the country and authority shown on your notice and check the current instructions for that exact deadline.

First establish what deadline you missed
“Income tax response deadline” is not a technical term with one universal remedy. The document may require you to:
The Tool Desk
Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →- file a tax return or amended return;
- pay an assessed amount;
- answer an information or audit request;
- object to an assessment or determination;
- accept or request an internal review; or
- appeal a decision to a tribunal or court.
Those actions can have different decision-makers, forms, statutory limits and tests. A request to extend an appeal is not automatically an extension to pay tax, and a penalty-relief application is not necessarily permission to file a late return. Write down the authority, notice date, action requested, stated deadline and any appeal or review route printed on the notice.

Why the distinction matters
An authority may have discretion to admit a late appeal but no power to extend a payment date under the same application. In another process, the authority may decide a reasonable-cause request while a tribunal decides whether a late appeal can proceed. Treat the wording of the notice as controlling; do not assume that “extension,” “condonation,” “reasonable excuse” and “reasonable cause” are interchangeable labels.
How to request late relief
- Read the entire notice. Locate the section explaining disagreement, review, objection, appeal, reasonable-excuse or extension procedures. Record the issue date and the deadline calculated from it.
- Use the specified channel. If the notice requires a form, online service, written application or court filing, use that method. An informal telephone conversation may not preserve an objection or appeal.
- File the overdue document when the procedure allows. Some systems require the late objection or appeal to accompany the extension request; others require permission first. Follow the authority’s instructions rather than sending an unstructured letter.
- Give a precise chronology. State the original deadline, what prevented compliance, when the obstacle began and ended, and how quickly you acted afterward. Explain why the event made compliance impossible or impracticable, not merely inconvenient.
- Attach supporting records. Depending on the process, useful evidence can include medical or hospital records, death certificates, fire or flood reports, correspondence showing an online-service outage, postal tracking, disability-related evidence, travel or absence records and proof of when you submitted the response.
- Keep a complete file. Retain the application, notice, attachments, submission receipt, delivery confirmation and every decision. Note any further deadline in a calendar and monitor whether collection or payment continues.
These steps improve the record; they do not guarantee acceptance. Apply promptly even if you are still gathering evidence, provided the applicable rules permit a later supplement.
What decision-makers usually consider
Reason for the failure
Official guidance commonly focuses on whether circumstances outside your control prevented timely action. A serious, sudden illness, an unexpected hospital stay, a close relative’s death shortly before the deadline, fire, flood, theft, exceptional postal delay or a documented government online-service failure may support relief in the procedures that list them. Some guidance also recognizes certain disability or mental-health-related delays and reliance on another person who failed to file, but the facts and the particular obligation still matter.

Conduct before and after the deadline
Decision-makers can examine whether you took reasonable care before the deadline, whether you had an intention to comply or object, when you became able to act and how quickly you did so. A long unexplained gap after the obstacle ended weakens an application. Give dates rather than general statements such as “I was dealing with personal problems.”
Reasons that may not be enough
Examples of reasons rejected in the cited United Kingdom guidance include lack of funds, difficulty using an online system, not receiving a reminder and an ordinary mistake. The same guidance says that being too busy, having complicated affairs or an agent’s failure to act on time is not a reasonable excuse in the direct-tax late-appeal context. These are examples from particular HM Revenue & Customs guidance, not a universal rule, but they show why a bare assertion of oversight is risky.
Fairness and the other party’s position
Some statutes expressly ask whether granting extra time would be fair. An application should identify any facts relevant to fairness, such as whether the authority already has the information, whether the delay is short, whether the other side is prejudiced and whether the issue can still be decided on its merits. Do not claim that a short delay is automatically harmless; explain the actual circumstances.

United Kingdom: HMRC decisions, reviews and late appeals
For many HMRC decisions, the decision letter ordinarily gives 30 days to appeal or accept an offered review. The letter controls the specific route and calculation. If the deadline has passed, HMRC guidance says you need to provide a reasonable excuse. A late direct-tax appeal may require an application to the tax tribunal to admit it rather than a simple request to HMRC.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsIndirect-tax review and tribunal routes
For an indirect-tax review offer, HMRC’s guidance says a request for more time must be made within the 30-day offer period. If a tribunal appeal is late, you must ask the tribunal to admit it. Those instructions concern the described decision and review processes; they do not create a 30-day rule for every income-tax communication or every response to an information request.
Examples HMRC may treat as a reasonable excuse
- a close relative’s death shortly before the deadline;
- an unexpected hospital stay or serious illness;
- a failure of HMRC’s online service or your computer that prevented submission;
- fire, flood or theft that disrupted records or access;
- unpredictable postal delays;
- some disability or mental-health-related delays; and
- reliance on another person who failed to file, where the surrounding facts support the excuse.
HMRC’s internal direct-tax manual says the individual facts must be considered and gives examples such as sudden serious illness, unavoidable unexpected absence, destroyed records and exceptional postal delay. It also states that being too busy, complicated affairs and an agent’s late action are not reasonable excuses in that direct-tax late-appeal guidance. Because this is internal guidance for a particular procedure, do not apply it automatically to another HMRC process.

United States: IRS reasonable-cause penalty relief
The Internal Revenue Service describes reasonable-cause relief as potentially available when a taxpayer exercised “ordinary business care and prudence” in determining tax obligations but could not comply because of circumstances beyond the taxpayer’s control. The IRS may also remove penalties under statutory exceptions or administrative waivers.
This is primarily a penalty-relief framework. It does not establish a general extension for every IRS response, examination request, return or payment deadline. Read the notice to determine whether you are challenging a penalty, seeking additional time to provide information or appealing another decision. If the IRS denies penalty relief, follow the deadline and instructions in the rejection letter when appealing.

Extension to serve an objection
Section 166.1 of Canada’s Income Tax Act permits an application to the Minister to extend the time for serving an objection or making a specified request. The application must explain why it was late. Canada Revenue Agency guidance says to apply as soon as possible and no later than one year after the objection deadline for the described objection process.

The CRA describes criteria that include being unable to act during the objection period or having a bona fide intention to object then, fairness in granting the application and applying as soon as possible. The extension application is made with the objection and reasons. If the application is refused, or remains undecided for 90 days, the described process allows an application to the Tax Court of Canada.
Separate route for a late Tax Court appeal
Section 167 provides a different statutory route for an appeal to the Tax Court of Canada. The taxpayer applies for an order extending the appeal time and must give reasons for not appealing on time. Do not substitute the CRA objection-extension procedure for this court application.
Ordinary Canadian objection periods
| Taxpayer or action | Ordinary period described by CRA | Qualification |
|---|---|---|
| Qualifying individual objection | The later of one year after the return filing deadline or 90 days after the assessment or determination | Applies to the described CRA objection guidance; verify the notice and current rules. |
| Corporation objection | 90 days after the notice of assessment or determination | This is the ordinary objection period, not the late-extension outer limit. |
| Late objection extension application | As soon as possible and no later than one year after the objection deadline | The described statutory and CRA process requires reasons and an accompanying objection. |
| CRA extension application with no decision | 90 days before the described Tax Court step may be taken | This is a procedural trigger, not an automatic approval. |
The figures above are tied to the named Canadian procedures. They are not a general deadline for every tax-authority response.
Compare the main late-relief routes
| Missed action | Typical decision-maker | Possible test or basis | What to submit |
|---|---|---|---|
| Return or information response | Tax authority, under its specific filing or compliance rules | May involve a statutory extension, reasonable excuse or penalty process; not established universally | The overdue return or information, explanation, evidence and any required form |
| Penalty challenge | Tax authority, with an appeal route set out in the notice | Reasonable cause, statutory exception or administrative waiver in the applicable system | Penalty notice, factual chronology, supporting records and requested relief |
| Objection or internal review | Tax authority or review officer | Jurisdiction-specific extension criteria such as inability to act, intention, fairness and promptness | Objection or review request, extension application, reasons and evidence |
| Late tribunal or court appeal | Tribunal or court | Permission to admit a late appeal under the governing statute or rules | Appeal, application for extra time, reasons for delay and proof supporting them |
| Payment deadline | Often governed separately from the appeal process | Relief may require a payment arrangement, interest or collection application | Follow the payment or collection instructions; do not assume an appeal pauses collection |
Does requesting an extension stop payment or collection?
Not necessarily. The cited official materials do not establish a universal rule that an extension, objection, review or appeal suspends tax, interest, penalties or collection. Check the notice and local law before withholding payment. If the amount is due while your late-relief request is pending, ask the authority what must still be paid and whether a separate arrangement is available.
Common mistakes that reduce the chance of relief
- Sending the request to the wrong authority because the taxpayer assumes the body that issued a penalty also decides a court appeal.
- Describing the delay only as an “oversight” without dates, evidence or an explanation of why action was impossible.
- Waiting until the end of an outer limit even though the rules say to apply as soon as possible.
- Assuming an accountant, tax agent or software problem automatically transfers responsibility or qualifies as an excuse.
- Failing to submit the overdue objection or appeal when the procedure requires it to accompany the extension request.
- Believing that a pending request pauses payment, interest or collection without written confirmation.
- Ignoring a refusal letter’s separate appeal deadline.
When professional help is sensible
Consider jurisdiction-specific advice from a qualified tax adviser or tax controversy professional when the amount is substantial, a tribunal or court deadline is involved, several periods are affected, records are missing, or the authority has already rejected an extension. A professional can identify the correct procedural vehicle and preserve related rights, but representation does not guarantee that late relief will be granted.
