Borrower-paid private mortgage insurance (PMI), FHA or VA mortgage insurance, lender-paid mortgage insurance, escrowed homeowners insurance, force-placed insurance, and an escrow balance after payoff follow different rules. A charge that looks like “mortgage insurance” on a statement may therefore be governed by a cancellation rule, an escrow rule, or a servicing-error process.
This guide covers U.S. federal rules and CFPB consumer guidance current through October 2026. Your loan documents, investor requirements, state law, and loan program can add conditions. Start by identifying the line item, then compare the servicer’s ledger and dates with the rule that applies. If the account is wrong, send a written notice of error to the servicer’s designated address and request a specific correction, cancellation, accounting, or refund.

First identify the charge
Mortgage insurance generally protects the lender, not the borrower, if the loan goes into default. It is common with smaller down payments and with some government-backed loans. The name printed on a mortgage statement is not enough to determine whether a cancellation or refund is available.

| Charge or balance | What normally governs it | Possible remedy |
|---|---|---|
| Borrower-paid PMI on a covered conventional mortgage | Homeowners Protection Act (HPA) cancellation and termination rules | Stop future PMI when the applicable cancellation or termination conditions are met; recover unearned premiums when the account was not settled correctly |
| FHA or VA mortgage insurance | Program-specific requirements and the loan documents | Program-specific cancellation or termination treatment; do not assume the ordinary 80%/78% PMI rules apply |
| Lender-paid mortgage insurance (LPMI) | The loan’s insurance arrangement and disclosures | Review the note and disclosures; a monthly borrower-paid PMI cancellation request may not fit this arrangement |
| Escrowed homeowners or hazard insurance | Escrow accounting and servicing rules | Correct an improper disbursement, shortage, or other servicing error |
| Force-placed hazard insurance | Regulation X requirements for insurance placed by the servicer | Cancel the overlapping policy and refund or remove overlapping charges after proof of compliant coverage |
| Escrow funds remaining after full payoff | Regulation X, 12 CFR § 1024.34 | Return the remaining escrow balance within the rule’s stated period, subject to its terms and exceptions |
Do not call an escrow refund a PMI refund. They may appear near each other on an account, but they arise from different balances and different legal triggers.

When can borrower-paid PMI be cancelled?
For many mortgages covered by the HPA, the CFPB says a borrower may request PMI cancellation when the loan is scheduled to reach 80% of the home’s original value. A borrower may also request earlier cancellation after additional principal payments reduce the balance to that level. “Original value” generally means the lower of the purchase price or the original appraisal. After a refinance, it generally means the appraisal value used at the refinance.
Conditions for a borrower-requested cancellation
The 80% figure is a trigger to request cancellation, not an automatic refund guarantee. Common conditions described by the CFPB include:
- A written cancellation request to the servicer.
- A good payment history and a current loan.
- No junior liens, such as a second mortgage, that would prevent the required determination.
- Evidence, where required, that the property value has not declined below the level needed for cancellation.
- Compliance with any additional conditions in the mortgage documents and applicable HPA rules.
The scheduled first date on which you can request cancellation should appear on the PMI disclosure provided for the loan. If you cannot find that disclosure, ask the servicer for the applicable date and the information it used to calculate it.

Automatic termination at 78% and the midpoint rule
For a covered mortgage, PMI generally must be terminated automatically at the scheduled point when the balance reaches 78% of original value, provided the borrower is current. The CFPB also describes termination at the midpoint of the original amortization schedule when the borrower is current, even if the balance has not reached 78%. These are general HPA rules for covered loans; they are not a universal rule for FHA, VA, lender-paid, or otherwise excluded arrangements.
Cancellation is not the same as a premium refund
Cancellation or termination stops future PMI premiums. A refund asks whether money already collected was unearned or was charged after the effective termination date. You need the account dates to answer the second question.
Ask the servicer for a written accounting that shows:

- The PMI cancellation or termination effective date.
- Every PMI premium transaction before and after that date.
- Any premium disbursed after termination.
- The calculation of unearned premiums.
- The amount refunded or credited, the date of the refund or credit, and the method used.
- The reason for any charge that continued after the date you believe PMI should have ended.
CFPB examination material summarizes HPA provisions requiring return of unearned PMI premiums within 45 days of borrower-requested or automatic termination. Treat that as a rule to verify against your loan and account history, not as proof that every borrower is owed a payment. In an August 2024 consent order involving Fay Servicing, the CFPB described failures involving premiums disbursed after PMI termination and incorrect calculations of unearned premiums. That enforcement example supports checking the ledger and calculation; it does not decide another servicer’s liability.
Other insurance-related refund routes
Escrow balance after the mortgage is paid off
An escrow balance is money the servicer holds for items such as property taxes or homeowners insurance. It is not a PMI premium. Under 12 CFR § 1024.34(b)(1), except for the regulation’s specified exception, the servicer must return amounts remaining in an escrow account under its control within 20 days, excluding legal public holidays, Saturdays, and Sundays, after the borrower pays the mortgage in full.
If the check or electronic payment is late or missing, identify the payoff date, the escrow balance shown on the payoff or final escrow statement, and the amount you believe remains. Request the account history and the date and method of the return. Raise a failure to refund a qualifying balance as a servicing error rather than describing it as a PMI dispute.

Force-placed hazard insurance that overlapped your policy
Force-placed insurance is hazard coverage the servicer purchases after it has a reasonable basis to believe the borrower failed to maintain the coverage required by the mortgage. It is different from PMI.
If you actually had compliant hazard insurance during the period charged, send evidence such as the policy declarations page, an insurer confirmation, and the coverage dates. After receiving evidence of compliant coverage, Regulation X generally requires the servicer to cancel the force-placed policy and refund charges paid, or remove assessed charges, for the overlapping period within 15 days. The evidence must show that the policy met the mortgage’s requirements and was in force for the disputed dates.

The CFPB identifies several servicing errors that can be disputed in writing: a payment applied incorrectly, an improper fee, taxes or insurance premiums not paid on time, or failure to refund a qualifying escrow balance after payoff. An escrow analysis that creates an unexplained shortage or a disbursement that does not match the insurance bill may also warrant an account review, although the correct result depends on the documents and ledger.

How to dispute the charge step by step
- Read the statement closely. Copy the exact description, amount, transaction date, due date, and whether the item appears as a loan charge, escrow disbursement, insurance premium, or separate fee. Save the statement showing the disputed item.
- Collect the account records. Gather monthly statements, the PMI disclosure, amortization and payment history, the payoff statement, escrow analyses, insurance declarations, cancellation notices, and earlier correspondence. Use only copies when sending records.
- Match the issue to the correct rule. Use the HPA path for covered borrower-paid PMI; ask about program-specific treatment for FHA or VA insurance; use the force-placed path for overlapping hazard coverage; and use the escrow/payoff path for money left after full repayment.
- Calculate the dates. Mark the scheduled 80% request point, the scheduled 78% termination point, the effective cancellation date, premium disbursement dates, coverage dates, payoff date, and any refund date. A one-day difference can change whether a premium was earned.
- Write a focused notice of error. Identify the borrower, property, loan number, disputed transaction, and relevant dates. Explain why the charge appears wrong and state the exact remedy requested, such as cancellation of future PMI, correction of the principal or escrow balance, removal of force-placed charges, a specified refund, or a complete accounting.
- Use the servicer’s designated address. Many servicers maintain a special address for notices of error and information requests. Check the periodic statement, coupon book, or servicer’s website for that address. Sending the letter only to a payment-processing address can delay handling.
- Attach supporting copies and keep delivery proof. Include the records that establish the dates and coverage. Keep the letter, attachments, tracking or delivery confirmation, and a complete copy of the account ledger in one file.
- Review the response against the ledger. Check whether the servicer used the right effective date, included every premium, accounted for post-termination disbursements, and calculated the requested refund or credit correctly. For an insurance overlap, compare the force-placed policy dates with your declarations page.
- Escalate if the records still do not reconcile. Ask for a written explanation and the documents relied upon. If the issue remains unresolved, use the CFPB’s mortgage resources and consider a HUD-approved housing counseling agency. Verify a counselor’s approval status and terms directly before sharing documents or paying a fee.
The CFPB says a servicer generally has five days, excluding weekends and holidays, to acknowledge a properly submitted written notice of error. That acknowledgment is not the same as a decision on the amount owed, and the separate rules for cancellation, insurance overlap, or escrow return still control the underlying remedy.
What to put in the letter
A short, precise letter is easier to investigate than a general complaint. Include:
- Your name, property address, loan number, and current contact information.
- The exact statement line or transaction ID, amount, and date being disputed.
- The event you believe controls the dispute: reaching the HPA threshold, an automatic termination date, full payoff, or overlapping hazard coverage.
- The records attached and the fact each record establishes.
- The correction requested, including the amount or calculation if you can determine it.
- A request for the account history, effective date, and written explanation if the servicer disagrees.
Do not send original insurance policies, canceled checks, or irreplaceable documents. Redact unrelated account numbers and personal information from records that are not needed to identify the loan.
Common mistakes that weaken a dispute
- Applying the 80% rule to every loan. It is a general rule for many covered conventional PMI loans, not a universal FHA, VA, or lender-paid insurance rule.
- Confusing original value with today’s market value. HPA calculations generally use the defined original value, with a different treatment after refinancing; an appraisal-based earlier request can have additional conditions.
- Requesting a refund without identifying an effective date. A servicer cannot calculate unearned premiums without knowing when coverage should have ended and which payments were disbursed after that date.
- Calling force-placed insurance PMI. The 15-day overlap remedy belongs to Regulation X’s hazard-insurance provisions, not the HPA PMI thresholds.
- Assuming a payoff automatically means a PMI refund. A payoff may create an escrow refund, while PMI may have ended earlier or may have been part of a different insurance arrangement.
- Sending the letter to the wrong address. Use the designated notice-of-error address shown by the servicer, and retain delivery evidence.
- Stopping payments while the dispute is pending. A dispute letter does not itself change the payment obligations in the note. Continue following the loan documents unless the servicer or a qualified adviser gives different, case-specific direction.
How the main deadlines differ
| Figure | What it relates to | Qualification |
|---|---|---|
| 80% of original value | Borrower-requested cancellation of covered PMI | CFPB guidance reviewed August 28, 2026; eligibility conditions apply |
| 78% of original value | General automatic termination point for covered PMI | Borrower generally must be current; scheduled amortization matters |
| 45 days | Return of unearned PMI premiums after requested or automatic termination | Summarized in CFPB examination material; verify the loan’s coverage and transaction history |
| 20 days excluding legal public holidays, Saturdays, and Sundays | Return of qualifying escrow funds after full payoff | Regulation X timing applies to amounts remaining in an escrow account under the servicer’s control, subject to stated exceptions |
| 15 days | Cancellation and refund or removal of overlapping force-placed hazard charges after proof of compliant coverage | Regulation X hazard-insurance rule; the evidence must establish required coverage for the disputed period |
| Five days excluding weekends and holidays | General acknowledgment of a written notice of error | CFPB consumer guidance; acknowledgment is not the final account determination |
When professional help is sensible
Consider HUD-approved housing counseling when the servicer cannot explain the account, the loan changed hands repeatedly, the disputed amount is substantial, or foreclosure activity is underway. A counselor can help organize statements and frame the servicing issue, but the counselor cannot rewrite the loan contract. For a contested legal interpretation, threatened foreclosure, bankruptcy, or a potentially significant damages claim, consult a qualified attorney licensed in the relevant state.
Keep the dispute focused on records: the loan program, the charge type, the controlling event, the effective date, and the money that was actually collected or held. Those details determine whether the proper result is cancellation of future premiums, a refund of unearned premiums, removal of overlapping force-placed charges, or return of escrow funds.
