Can You Deduct Unreimbursed Hurricane Damage on Your Taxes?

Yes—sometimes. An unreimbursed personal hurricane loss is generally deductible on a federal return only when the hurricane affected an area covered by a federally declared disaster. You claim the loss on IRS Form 4684, and you calculate only the portion for which insurance, aid, or another reimbursement is not reasonably expected. Ordinary personal casualty-loss limits usually apply, although a specific disaster may qualify for special rules.

When hurricane damage qualifies for a federal deduction

A hurricane is a casualty event, but that fact alone does not create a federal deduction for personal property. Under the post-2017 federal rules summarized in IRS Topic 515, a personal casualty loss is generally deductible only when it is attributable to a federally declared disaster and the damaged property is in the eligible area identified for that disaster.

As an Amazon Associate I earn from qualifying purchases.

The declaration is therefore a threshold question. Check the disaster declaration and its covered counties or other geographic areas before calculating the loss. IRS Topic 107 and the 2025 Form 4684 instructions require the disaster declaration number when you report a qualifying disaster loss.

  • Personal-use property: A home, household contents, or personal vehicle can qualify when the hurricane is tied to a federal disaster declaration covering the property.
  • Non-declared storms: A personal loss from a hurricane or other storm that is not connected to a qualifying federal declaration is generally not deductible under the current federal rules.
  • Business or income-producing property: These losses follow different reporting and limitation rules. Do not automatically apply the personal-use calculation or personal-loss thresholds to a rental, farm, or business asset.

A state emergency declaration, insurance-company designation, or news report is not a substitute for the federal declaration required for an ordinary personal casualty loss. The relevant event must be identified by its official disaster declaration.

What “unreimbursed” means

You cannot deduct the part of a loss that insurance or another source will reimburse. Subtract insurance proceeds, disaster assistance, and any other reimbursement received or expected when there is a reasonable prospect of recovery.

This rule also applies when your claim is still pending. If you reasonably expect an insurer, government program, contractor, lender, or another party to pay for part of the damage, that expected amount is not currently treated as an unreimbursed loss. A deductible, policy limit, excluded item, or denied claim may leave a genuinely unreimbursed balance, but keep the documents showing how you determined that balance.

Amount How it affects the claim
Insurance payment already received Subtract it from the casualty loss.
Insurance payment reasonably expected Subtract the expected recovery; the loss is not sustained to that extent while recovery remains reasonably expected.
Other disaster assistance or reimbursement Subtract the amount received or reasonably expected for the same damage.
Damage with no reasonable prospect of recovery May remain in the unreimbursed portion, subject to the other casualty-loss rules.

Do not simply use the amount you paid to repair the property. Repair invoices can help document the damage, but the tax loss is measured under the casualty rules and is limited by the property’s basis and value decline.

How to calculate the personal casualty loss

1. Establish the property’s adjusted basis

Adjusted basis is generally your tax investment in the property after relevant adjustments. For a home, that may begin with its purchase cost and include qualifying capital improvements, while prior depreciation or other basis adjustments reduce it. For contents and vehicles, use the records that establish what you paid and any applicable basis adjustments.

Publication 584 provides worksheets for a home, its contents, and vehicles. Use the worksheet that matches the property and retain the records supporting the figures.

2. Measure the decline in fair market value

For personal-use property that was not completely destroyed, the casualty amount is generally the lesser of:

  • the property’s adjusted basis immediately before the hurricane; or
  • the decrease in fair market value caused by the hurricane.

Fair market value means the property’s value immediately before the event compared with its value immediately afterward. The value decline must be attributable to the hurricane, not to unrelated market movement, deferred maintenance, or improvements made after the storm.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

3. Subtract reimbursement

Reduce the preliminary casualty amount by insurance proceeds and other recovery for which there is a reasonable prospect. This produces the unreimbursed amount before the personal casualty-loss thresholds.

4. Apply the personal-loss reductions

Under the ordinary federal rules, reduce each personal casualty loss by $100. Then reduce the combined personal casualty losses for the tax year by 10% of adjusted gross income (AGI). The amount remaining is the potential federal deduction, assuming the event qualifies and the required form is filed.

These reductions are not necessarily the final answer for every declared disaster. A disaster may receive a special “qualified disaster” designation with different treatment. Confirm the legal designation and the rules in the applicable version of Publication 547 and the Form 4684 instructions before applying the $100 and 10%-of-AGI limits.

Illustrative calculation

Suppose a hurricane damages a personal residence in a federally declared disaster area. The home’s adjusted basis is $300,000. Its fair-market-value decline caused by the storm is $130,000, so the preliminary casualty amount is $130,000 because that is less than the basis. Insurance and other assistance total $100,000, leaving $30,000 unreimbursed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Under the ordinary personal-loss rules, subtract $100, leaving $29,900. If AGI is $100,000, the 10% AGI reduction is $10,000, leaving a potential deduction of $19,900 before considering any other personal casualty losses, special disaster rules, or other filing details. The numbers are illustrative; your result depends on documented basis, valuation, reimbursement, AGI, and the event’s legal designation.

Which form reports hurricane damage?

Form 4684, Casualties and Thefts, is the core federal form. Personal-use property is reported in Section A. Publication 584 is a calculation workbook, not a replacement for Form 4684.

For a declared disaster, the form instructions require the disaster declaration number. Use the number associated with the declaration covering the property, rather than a general storm name or an insurance claim number.

Business and income-producing property is handled under different portions of the casualty rules and may require a different calculation. If the damaged asset was used partly for business and partly personally, separate the uses and follow the instructions for each category instead of putting the entire amount in the personal section.

Step-by-step: claiming the loss on your federal return

  1. Verify the declaration. Confirm that the hurricane is a federally declared disaster and that the damaged property is in the eligible area. Record the official disaster declaration number.
  2. Inventory the damage. List the home, contents, vehicles, and other affected personal-use property. Separate storm damage from pre-existing damage and later improvements.
  3. Document basis. Gather purchase records, settlement statements, improvement receipts, vehicle records, and any documents showing basis adjustments.
  4. Document value before and after. Obtain credible support for the property’s fair market value immediately before and after the hurricane. For significant real-estate losses, independent appraisal evidence may be useful; repair estimates alone do not automatically establish the tax loss.
  5. Determine recoveries. Record insurance payments, claim decisions, deductibles, grants, assistance, and amounts still reasonably expected. Do not include a recovery twice or deduct an amount that remains subject to a realistic reimbursement claim.
  6. Complete the personal worksheet. Use the appropriate Publication 584 worksheet for the home, contents, or vehicle. For each item, determine basis, value decline, the lesser amount, and the unreimbursed balance.
  7. Enter the loss on Form 4684 Section A. Include the required disaster declaration number and follow the current instructions for transferring the result to the rest of your federal return.
  8. Apply the applicable limitations. For an ordinary personal casualty loss, apply the $100-per-event reduction and the 10% AGI reduction. If the event is a qualified disaster, use the special rules that apply to that designation instead.
  9. Keep the evidence. Retain photographs, videos, inventories, appraisals, repair estimates, insurance correspondence, assistance records, and the worksheets supporting every amount.

File Form 4684 with the federal return for the year in which the loss is treated as sustained, unless you make the prior-year election described below. If you later receive reimbursement for an amount previously claimed, review the tax treatment of that recovery under the applicable IRS rules rather than assuming the original calculation remains unchanged.

Can you claim the hurricane loss on last year’s taxes?

Often, yes. When a loss is attributable to a federally declared disaster in an eligible area, you may elect to treat it as occurring in the immediately preceding tax year. This can let you file the claim on an original prior-year return or amend a prior-year return instead of waiting for the disaster-year filing.

The election is made through Form 4684 Section D. It must be filed by the applicable statutory deadline, so check the current form instructions for the event and the return being amended. The election is generally irrevocable once made, making the timing decision important.

Compare the two filing choices

Choice Return used Main decision point
Disaster-year treatment The return for the year the disaster loss is treated as sustained Defers the tax benefit to that year’s income and tax calculation.
Prior-year election The immediately preceding year’s original or amended return May accelerate the benefit, but requires Section D and compliance with the statutory deadline.

Compare the tax effect under both choices using the actual loss, AGI, filing status, and any special qualified-disaster rules. A prior-year election is not automatically better simply because it produces a faster refund.

Personal property versus business or rental property

The personal-use rules described above are designed for a home, household contents, or personal vehicle. Property used to produce income—such as a rental, farm, or business asset—belongs in a different category. The valuation, basis, reporting section, and interaction with income-producing activity can differ.

Maintain separate records when a property has mixed use. Allocate the damage between personal and income-producing portions using a reasonable, documented method, and follow the current Form 4684 and Publication 547 instructions for the income-producing portion. Do not assume that the $100 and 10%-of-AGI personal reductions apply in the same way to business property.

Common mistakes that delay or defeat a claim

  • Claiming an undeclared storm: A personal hurricane loss generally needs a federal disaster declaration under current federal law.
  • Deducting gross damage: Insurance and reasonably expected reimbursement must be removed before claiming the loss.
  • Using repair cost as the deduction: The personal calculation generally uses the lesser of adjusted basis or the hurricane-caused fair-market-value decline.
  • Ignoring the eligible area: A declaration may cover specific counties or other areas, not every location affected by the same storm.
  • Omitting the declaration number: Form 4684 requires the identifying number for a qualifying disaster.
  • Applying ordinary limits automatically: Qualified-disaster legislation can change the normal $100 and 10%-of-AGI treatment.
  • Choosing the prior-year election casually: Section D has a deadline, and the election can affect which year’s income and tax computation receives the loss.
  • Failing to separate property types: Personal, rental, and business assets may not use the same form section or calculation.

Records to keep

Keep a complete file showing that the event qualified, what was damaged, how basis was established, how value changed, and what reimbursement was available. Useful records include:

  • the federal disaster declaration and declaration number;
  • dated photographs or video of each damaged area and item;
  • purchase documents and capital-improvement records;
  • appraisals or other support for fair market value before and after the hurricane;
  • insurance policies, adjuster reports, payment statements, denial letters, and deductible calculations;
  • government-assistance applications and award or denial notices;
  • repair estimates, invoices, and proof of payment; and
  • the completed Publication 584 worksheets and Form 4684 calculations.

These records should be retained with the return documentation for the period required by your tax-record obligations. The more clearly each number connects to the damaged property and the hurricane, the easier it is to explain the claim if the IRS asks questions.

A practical decision checklist

  • Is the property personal-use, income-producing, or mixed-use?
  • Was the hurricane included in a federal disaster declaration?
  • Was the property inside the declaration’s eligible area?
  • What is the property’s adjusted basis?
  • What was the hurricane-caused decline in fair market value?
  • Which amount is lower: basis or value decline?
  • What insurance, aid, or other reimbursement was received or reasonably expected?
  • Does the event have qualified-disaster treatment that changes the ordinary personal limits?
  • Would disaster-year treatment or the Section D prior-year election produce the better result?
  • Can every amount be supported by records and entered on the correct Form 4684 section?

If the property is heavily damaged, jointly owned, inherited, used for business, or involved in a disputed insurance claim, the calculation can become fact-specific. In those situations, a tax professional can help apply the current Form 4684 instructions and determine whether the prior-year election is appropriate.
