Generally, yes. For U.S. federal income tax, real estate taxes on a vacant rental property can usually remain a rental expense while the property is still held for income production and available for rent. A gap between tenants does not, by itself, end rental treatment.
The result changes if you withdraw the property from rental use, use it personally, stop making it available to renters, or list it for sale without continuing to hold it out as a rental. Mixed-use properties require an allocation between rental and personal portions, and a deductible expense does not automatically mean any resulting loss is currently usable.

What the IRS means by a “vacant” rental
Vacancy describes occupancy, not necessarily tax status. A property may have no tenant and still be an active rental if you continue to hold it for income production and keep it ready and available for a renter. The Internal Revenue Service draws that distinction in Publication 527, its guide to residential rental income, expenses, depreciation and limitations.
Publication 527 states: “You place property in service in a rental activity when it is ready and available for a specific use in that activity.” That standard focuses on readiness and availability rather than whether a tenant is physically occupying the property. The publication also says to continue claiming depreciation on property used in a rental activity when it is temporarily idle.

IRS Topic 414 explains that, for tax years 2018 through 2025, expenses of renting property are deductible when incurred in carrying on a trade or business, for production of income, or for the management, conservation or maintenance of property held for production of income. Rental real-estate income and expenses are generally reported on Schedule E (Form 1040).
When property taxes generally remain a rental expense
A normal turnover period is the clearest example. If a tenant moves out, you continue seeking a replacement tenant, and the home remains ready for rental use, the property taxes attributable to that rental activity generally belong with the rental expenses reported on Schedule E.
Indicators that the rental use continues
- The property is advertised or otherwise offered to prospective tenants.
- You are accepting rental inquiries or applications and are willing to enter a lease.
- The property is maintained and ready for the advertised rental use.
- You have not converted the property to a personal residence or another nonrental use.
- Your purpose remains earning rental income rather than holding the property for a different objective.
No minimum number of occupied days appears in the cited IRS guidance. The relevant question is whether the property is being held and made available for the rental purpose, not whether rent was collected every month.

| Property facts | How the federal analysis changes |
|---|---|
| Between tenants, still offered and ready for rent | Property taxes attributable to the rental activity generally remain rental expenses. |
| Withdrawn from rental use | Expenses may no longer qualify as rental expenses because the income-producing rental purpose has ended. |
| Listed for sale and not held out or available for rent | Publication 527 says the expenses are not deductible rental expenses. |
| Owner or family uses part of the property | Allocate shared taxes between rental and personal uses; only the rental share goes with Schedule E. |
| Activity is not operated for profit | Special not-for-profit rules apply, and rental expenses generally cannot be deducted as rental expenses. |
Property withdrawn from the rental market
A property that sits empty because you have stopped renting it is different from a property between tenants. For example, taking the listing down indefinitely, reserving the home for your own future use, or abandoning a genuine effort to find renters can indicate that it is no longer being held for income production. The tax treatment then cannot be justified solely by the fact that the property was once a rental.

Property listed for sale
Publication 527 specifically addresses a property listed for sale. If it is listed for sale and is not held out and available for rent, the publication says its expenses are not deductible rental expenses. Listing a property for sale therefore requires a close look at what use you are actually offering. The sale listing itself is not a substitute for continued rental availability.
Not-for-profit rental activity
If you are not renting the property to make a profit, Publication 527 applies different rules. Rental expenses generally cannot be deducted as rental expenses in that situation, although specified costs may be considered under personal Schedule A rules when you itemize. A property’s label as a “rental” does not, by itself, establish a profit-seeking activity.
How to handle the property-tax bill
Property used entirely as a rental
When the property is wholly held for rental, the real estate taxes attributable to that rental activity are generally reported as a rental expense on Schedule E, subject to the applicable reporting and limitation rules. Keep the property-tax statement and records showing the property’s rental status with your tax files.
Property with personal and rental use
Do not put the entire tax bill on Schedule E when you occupy the property, let family use it, or otherwise combine personal and rental use. Publication 527 instructs owners to divide shared expenses using a reasonable method. Room count and square footage are examples of methods it identifies.

Its duplex illustration shows the basic approach: an owner who rents one half and occupies the other deducts the rental half of the real estate taxes with the rental activity and treats the owner-occupied half under personal deduction rules. The same allocation principle applies to other shared-use arrangements, but the method should reflect the actual space or use.
Example of an allocation
Suppose a duplex has equal-sized units, one rented throughout the year and one occupied by the owner. If the annual real estate tax is $8,000 and the units are genuinely equal in size and use, a reasonable 50 percent allocation would associate $4,000 with the rental unit for Schedule E and $4,000 with the personal unit for personal tax treatment. The example illustrates the method; your percentage must follow your property’s actual layout and use.
Do not confuse rental deductions with the personal SALT deduction
The personal-use portion of property taxes follows personal deduction rules rather than Schedule E. Publication 527 for use in preparing 2025 returns states that the overall state and local tax deduction limit increased to $40,000, or $20,000 for married taxpayers filing separately. It also describes a reduction above modified adjusted gross income of $500,000, or $250,000 for married filing separately, with the limitation not reduced below $10,000, or $5,000 for married filing separately.

Those figures concern the personal state and local tax deduction calculation. They do not cap the rental allocation in the same way and should not be used to move personal taxes onto Schedule E. The applicable limit is year-sensitive, so verify the rule for the return year you are preparing rather than assuming the 2025 amounts apply indefinitely.

How to report the expense and evaluate the resulting loss
- Determine the property’s status for the tax year. Identify when it was occupied, vacant between tenants, withdrawn from rent, used personally, or offered for sale.
- Establish the rental-use portion. For an exclusively rental property, the rental portion may be the full amount. For mixed use, apply a reasonable allocation such as the relevant room-count or square-footage method.
- Report the rental share with the rental activity. Rental real-estate income and expenses are generally reported on Schedule E (Form 1040), as described by IRS Topic 414 and the Schedule E overview.
- Keep the personal share out of Schedule E. Follow the personal deduction rules for any owner-occupied or other personal-use portion.
- Apply the limitation rules after calculating the expense. Publication 527 discusses passive-activity, at-risk and rental-loss rules. A property tax amount can be a properly classified rental expense even when the resulting net loss cannot all be used in the current year.
The last step is important: “deductible expense” and “currently allowable loss” are separate questions. Passive-activity or at-risk limits can defer the benefit of a rental loss even when the underlying property taxes were correctly associated with the rental activity.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Records that support a vacant-property deduction
Your documentation should show both the amount of tax and why the property remained a rental during the vacancy. Retain:
- The property-tax bill, payment record and the tax year covered.
- Rental advertisements, listing dates, showing records or correspondence with prospective tenants.
- Evidence that the property was ready for occupancy, such as maintenance, repair or utility records.
- Lease termination and replacement-tenant records showing the vacancy was part of ordinary turnover.
- Personal-use dates and the floor-area or room-count calculation used for any allocation.
- Sale-listing records and notes explaining whether the property was also held out and available for rent.
- Workpapers connecting the rental share to Schedule E and identifying any personal share.
These records do not replace the tax rules, but they make the central factual question—continued rental availability—easier to substantiate.
Common mistakes and how to correct them
“There was no tenant, so I cannot deduct anything”
That conclusion treats occupancy as the test. A temporary vacancy can occur while the property remains ready and available for rental use. Review the advertising, readiness and income-producing purpose before disallowing the expense.

“The property used to be a rental, so every later tax bill is deductible”
Past rental use does not preserve rental treatment after a withdrawal, personal conversion or a sale-only period. Establish the property’s status for each relevant period.
“I can put the whole tax bill on Schedule E”
Personal use requires an allocation. Use a reasonable method supported by the property’s actual layout or use, and report only the rental share with the rental activity.
“Listing it for sale has no tax effect”
Publication 527 draws a specific boundary when a property is listed for sale and is not held out and available for rent. Determine which use you genuinely offered during the period.
“A rental deduction guarantees a current-year tax benefit”
Passive-activity and at-risk rules can limit the current use of a rental loss. Calculate the expense correctly first, then apply those separate loss limitations.
Federal guidance, tax years and state rules
Publication 527 (2025), identified by the IRS as for use in preparing 2025 returns, covers rental income and expenses, depreciation, personal and rental allocation, sale and not-for-profit situations, and limitations. The IRS forms listing records that publication on January 9, 2026. IRS Topic 414 describes rental income and expense reporting for tax years 2018 through 2025, while the Schedule E overview confirms the form’s rental-real-estate reporting purpose.
This is federal guidance. The cited IRS material does not settle state or local rules for the property-tax bill or a state income-tax return. Check the law for the property’s location and the specific federal return year before filing, particularly when the property changed use or was offered for sale.
When professional tax help is worthwhile
Consider qualified tax preparation help when the property had substantial personal use, changed from rental to sale, was rented below market, produced a not-for-profit result, or generated losses subject to passive-activity or at-risk limits. A preparer can help document the allocation and apply the rules to the exact dates and uses on your return. The need for help is fact-specific; no particular service or product is required by the IRS guidance.
