A supplier’s GST cancellation does not by itself answer whether the buyer can retain or claim input tax credit (ITC). You must satisfy the conditions in section 16 of India’s Central Goods and Services Tax Act, 2017 (CGST Act), and be able to prove the invoice, supplier reporting and communication, actual receipt of the goods or services, and the tax and payment trail. A cancellation made retrospectively creates additional risk, but the cancellation date alone is not a complete legal test.
What a supplier’s cancellation changes—and what it does not
GST registration can be cancelled prospectively or, where the statutory circumstances justify it, from an earlier date. Section 29 of the CGST Act contains the cancellation power: read the official section 29 text. A cancellation order made today may therefore state an effective date months or years earlier.

That creates two separate questions. First, was the supplier registered when it issued the invoice and made the supply? Second, is the retrospective effective date legally supported and relevant to the buyer’s credit for that tax period? The officer must examine the order and the underlying transaction; “the supplier was later cancelled” is not a substitute for that analysis.

In Gaurav Bansal v. Commissioner of GST & Anr., the court stated: “The registration cannot be cancelled with retrospective effect mechanically.” The judgment also recognised that retrospective action may affect customers’ ITC and that consequence should be considered where such action is intended and warranted. That ruling concerned the supplier’s registration and the facts of that petition, not an automatic declaration that every customer’s credit is valid or invalid.

This article reflects the statutory text and reported decisions available through 13 October 2026. A notice or assessment still turns on the relevant tax period, the wording of the cancellation order, and your evidence.
The section 16 eligibility test
Section 16 sets multiple conditions for ITC. A tax invoice is necessary, but it is not sufficient. Review the version of the law and restrictions that applied in the period for which you took or propose to take credit. The official text is available from the Central Board of Indirect Taxes and Customs (CBIC): CGST Act section 16.
| Condition to test | Questions for the invoice under review |
|---|---|
| Invoice from a supplier registered under the Act | What was the supplier’s registration status on the invoice and supply dates? What effective date appears in the cancellation order, and when was that order issued? |
| Supplier-furnished invoice details communicated to the recipient | Were the details furnished in the supplier’s prescribed return or statement and communicated through the GST system for the relevant period? Preserve the relevant portal and return records. |
| Receipt of goods or services | Can you demonstrate actual delivery, acceptance, use, or performance rather than only possession of an invoice? |
| Tax-payment requirement and other statutory restrictions | What evidence exists that the tax was accounted for and paid to the Government, subject to the Act? Have you checked the time limit, blocked-credit rules, and other restrictions applicable to that period? |
These tests are cumulative in practice. A genuine invoice can still face challenge if the supply was not received, the supplier did not furnish the required details, or the authority alleges that tax was not paid. Conversely, a later cancellation does not prove by itself that the supply was fictitious or that every statutory condition failed.

How to analyse one disputed invoice
1. Build a date-and-order timeline
Record, in one schedule, the invoice date, the actual supply or delivery date, the date the cancellation order was issued, and the order’s effective cancellation date. Add any date on which cancellation was stayed, set aside, or revoked. The distinction between an order date and an earlier effective date is often decisive to the argument, but it is not decisive without the statutory and factual context.
Confirm whether the supplier was shown as registered when the invoice was issued and whether the order purports to rewrite that status for an earlier period. Obtain the registration record and the complete cancellation order, including the reasons and the paragraph stating the effective date. Do not rely on a vendor’s informal message or a portal status screenshot without checking the order itself.
2. Verify invoice reporting and communication
Match the invoice number, date, taxable value, tax amounts, supplier GSTIN, and recipient details against the supplier’s reported data and the GST records made available to you. Keep copies of the return or statement in which the supplier furnished the invoice details, the communication or auto-populated record received by your business, and your own return in which the credit was claimed.

If the supplier’s data was amended, deleted, or never furnished, identify the dates and the specific discrepancy. A cancellation dispute should not obscure a separate reporting failure. The question is whether the statutory communication condition for the relevant tax period was met, not merely whether an invoice was printed.

Evidence must fit the transaction. For goods, assemble the purchase order or contract, invoice, dispatch documents, e-way or transport records where applicable, proof of delivery or receipt, warehouse or stock entries, production or consumption records, and payment evidence. Where movement of goods is central to the dispute, show who transported them, where they were received, and how they entered your business records.
For services, retain the engagement letter or purchase order, statements of work, deliverables, completion or acceptance records, timesheets or usage reports where relevant, correspondence, payment records, and documentation showing business use. There is no universal document that proves every service; the evidence should demonstrate performance and acceptance of the particular service invoiced.

CBIC’s invoice rules set core invoice particulars: Tax Invoice, Credit and Debit Notes. Those particulars support the claim, but an invoice alone does not prove receipt or performance.
4. Reconcile the tax and payment trail
Trace the amount from purchase ledger to bank or other permitted payment records, and reconcile the taxable value and GST with your accounting and GST returns. Preserve debit notes, credit notes, replacement invoices, and correspondence explaining any adjustment. If the authority alleges that the supplier did not pay tax, identify the records available to you and explain the commercial transaction; do not assert that the supplier’s payment can be proved merely by your own payment to the supplier.
5. Read the notice and orders for the actual ground of denial
Identify precisely what the officer says failed. Common grounds may include an invalid invoice, absence of supplier reporting, non-receipt, alleged non-payment, a fictitious supplier or supply, or the retrospective cancellation itself. Answer the stated ground with the matching evidence and legal submission.

Also compare the show-cause notice with the adjudication order and any appellate order. If the final order introduces a new reason without giving you a chance to respond, raise that procedural issue. In the reported Calcutta matter discussed below, the High Court set aside a non-speaking appellate order and required a reasoned decision; it did not finally award the buyer the credit.
6. Check the applicable time limits before filing or defending the claim
Section 16 contains time limits and period-specific restrictions. They have changed over time, so calculate the deadline using the tax period, the return year, and any amendment applicable to that period. A defensible invoice can still be out of time. Conversely, a pending dispute does not automatically extend a statutory deadline.
7. Treat revocation as a separate question
Section 16(6) addresses conditions and return-filing windows for a registered person whose own cancellation is later revoked. That provision concerns the person whose registration was cancelled and then restored. Supplier restoration therefore should not be described as an automatic cure for every recipient’s ITC issue. You still need to test the recipient’s invoice, receipt, reporting, payment, and timing conditions.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteWhat the reported court decisions actually decided
| Decision | Key facts reported | What the court decided | What it does not establish |
|---|---|---|---|
| Gaurav Bansal v. Commissioner of GST & Anr., Delhi High Court, W.P.(C) 327/2024, 29 February 2024 | The petitioner’s supplier registration had been cancelled retrospectively from 15 November 2017. | The court held that retrospective cancellation must rest on objective criteria and cannot be mechanical. On that petition’s facts, it modified the cancellation date to 30 June 2021. Read the judgment. | It did not decide a particular customer’s ITC entitlement or guarantee that every retrospective cancellation will be changed. |
| Shyamalmay Paul v. Assistant Commissioner SGST, Siliguri Charge, Siliguri & Ors., WPA 2192 of 2025, as reported by LiveLaw on 20 December 2025 | The supplier’s registration was cancelled after the invoice date but with retrospective effect from 12 October 2018. The reported reason for denying ITC focused on the invoice timing against that effective date. | The Calcutta High Court set aside a non-speaking appellate order and directed the authority to issue a reasoned order. Read the LiveLaw report. | The reported remedy was procedural. It does not establish final entitlement on every fact pattern, and the primary order should be read before relying on details beyond the report. |
When comparing cases, use the same six axes: prospective or retrospective cancellation and its effective date; supplier status on the invoice and supply dates; invoice reporting and communication; proof of receipt or performance and the tax trail; the exact ground and reasoning in the tax order; and whether the court decided substantive ITC entitlement or only required a properly reasoned decision.
Practical evidence checklist
- Supplier GST registration record and the full cancellation, revocation, stay, or appellate order.
- Invoice, purchase order or contract, and any amendment, debit note, or credit note.
- Supplier-return or portal records showing invoice details furnished and communicated for the relevant period.
- Proof of receipt for goods: transport and delivery records, inward register, stock or production entries, and correspondence.
- Proof of performance for services: engagement terms, deliverables, acceptance, usage, and business-purpose records.
- Ledger postings, bank or permitted payment records, and reconciliation to the GST return in which ITC was claimed.
- Copies of the show-cause notice, written reply, adjudication order, and appellate order, with proof of filing and hearing.
- A date schedule showing invoice, supply, reporting, payment, cancellation order, effective cancellation, revocation, and return deadlines.
How common fact patterns should be approached
| Fact pattern | How to analyse it |
|---|---|
| Invoice and supply occurred while the supplier appeared registered; cancellation was later made prospectively. | Focus on section 16 conditions, supplier reporting, receipt or performance, tax trail, and the applicable time limit. The later prospective cancellation is a fact, not a substitute for those tests. |
| Cancellation order was issued later but assigned an effective date before the invoice. | Obtain the reasons and challenge or defend the legal basis for the retrospective date. Show the supplier’s status when the transaction occurred, the actual supply, reporting, and payment evidence. The date discrepancy requires analysis; it does not produce an automatic result. |
| Invoice was issued after the effective cancellation date. | Risk is materially higher because the statutory requirement concerning a supplier registered under the Act must be tested against that date. Verify whether the order was stayed, set aside, or revoked and obtain professional advice before claiming or defending the credit. |
| Supplier’s cancellation was later revoked. | Read the revocation order and section 16(6) conditions. Restoration does not automatically validate the recipient’s credit; re-test the recipient’s own statutory conditions and deadlines. |
| Authority relies only on the retrospective cancellation and gives no reasoning on receipt, reporting, or the transaction. | Answer on the merits with your records and raise the need for a reasoned decision. The Calcutta report illustrates that a non-speaking appellate order can be set aside, but the next order still has to be addressed. |
Common mistakes that weaken an ITC defence
- Using the cancellation date as the only argument. A buyer must address every applicable section 16 condition and the actual allegation in the notice.
- Keeping only the invoice. An invoice does not, by itself, establish receipt, service performance, supplier reporting, or tax payment.
- Ignoring the effective date. Always distinguish the date the order was made from the date cancellation is said to take effect.
- Assuming portal visibility proves everything. Preserve the underlying return and communication records and reconcile them to your books.
- Calling a procedural win a final ITC win. Setting aside an unreasoned order generally means the authority must decide again; it is not necessarily a final declaration that credit is allowable.
- Relying on supplier restoration without checking section 16(6). The provision has its own conditions and filing windows and does not erase the recipient’s separate evidentiary burden.
- Missing the response deadline. File a complete reply within the notice period, request documents or a hearing where appropriate, and preserve proof of submission.
When to obtain professional advice
Consider a qualified GST practitioner or tax counsel when the cancellation is retrospective, the order alleges fraud or a fictitious supply, substantial credit is at stake, the supplier’s records are unavailable, or an adjudication or appeal deadline is running. Provide the adviser with the complete timeline, cancellation order, invoice trail, supply evidence, returns, payment records, and every tax authority order. Advice is most useful when it addresses the exact effective date and statutory period rather than treating all cancelled suppliers alike.
Bottom line
You may be able to claim or defend GST ITC on an invoice from a cancelled supplier, but eligibility depends on the full section 16 analysis and the facts. Establish the transaction, preserve reporting and payment evidence, scrutinise any retrospective effective date, and respond to the specific ground of denial. The Delhi and Calcutta decisions support careful, reasoned examination of cancellation; neither creates an automatic nationwide rule that every buyer wins or loses.
