Yes. In India, a person aggrieved by a GST adjudication order can generally file a first appeal under section 107 of the Central Goods and Services Tax (CGST) Act. Whether that route applies, what must be paid, and which arguments are available depend on the wording of the notice, the statutory provision cited in the order, the refund category, and the tax period. A refund rejection and a later demand alleging that an already-paid refund was erroneous are not the same proceeding.
Start by identifying exactly what the order does
The phrase “recovering an accumulated ITC refund” can describe two very different situations. Read the demand summary, the operative part of the order, and the provision cited by the officer before choosing an appeal category or drafting grounds.

| Situation | What normally happened | What to verify |
|---|---|---|
| Refund claim rejected or reduced | The proper officer examines a pending refund application and finds some or all of it inadmissible. | Whether the file contains an RFD-08 notice, your RFD-09 reply, and an RFD-06 refund order; whether any rejected amount was re-credited through PMT-03. |
| Refund already paid, then recovery demanded | The department later alleges that the amount paid as refund was erroneous and raises a demand. | The recovery notice, the legal section invoked, the computation of tax and interest or penalty, the refund payment record, and the opportunity given to reply and attend a hearing. |
| Adjustment or re-credit dispute | The department changes the amount debited from the electronic credit ledger or refuses a claimed re-credit. | The relevant ledger entries, the refund application, the order explaining the adjustment, and the rule relied on for re-credit. |
Refund Rules 92 and 93 describe the refund-side process: when a claim appears wholly or partly inadmissible, the officer issues RFD-08, the claimant replies in RFD-09, and the officer makes an RFD-06 order after considering the reply. The rules also provide for re-credit of a rejected amount through PMT-03. Rejection is treated as final for this purpose if the appeal is finally rejected or the claimant gives a written undertaking not to appeal.

The first appeal: section 107 and the filing clock
Section 107 of the CGST Act provides a first appeal to the Appellate Authority against a decision or order passed by an adjudicating authority. The ordinary period is three months from the date the order is communicated. The Appellate Authority may admit an appeal for a further period of up to one month when sufficient cause prevented filing within the ordinary period. That is a limited extension, not an open-ended power to condone delay.
Prove the communication date
Keep the portal notification, email, download history, physical service record, or other evidence showing when the order was communicated. The date printed on an order may differ from the date on which it became available to you. Calculate the three-month period from the legally relevant communication date and preserve the calculation in your file.
If the deadline has passed
File as soon as possible within the possible one-month condonation window and attach a clear explanation supported by evidence. Explain each day or period of delay, identify the event that prevented filing, and attach documents such as service records, medical material, system outage evidence, or internal authorisation records where relevant. The authority still has discretion; a late filing is not protected merely because an explanation is written.
Payment, pre-deposit and the recovery stay
An appeal requires payment of the amount you admit as payable and the statutory pre-deposit on the disputed amount. The GST Portal’s appeal FAQ describes the first-appeal minimum as 10% of the disputed tax. The live section 107 text also contains a statutory cap and rules for different components of a demand. Confirm the current cap, the tax-versus-interest-versus-penalty composition of your order, and whether amounts already paid are credited toward the requirement before remitting money.

Once the section 107 payment condition is satisfied, recovery of the balance is deemed stayed under the statute. Merely uploading an appeal does not create that statutory stay before the required payments are made. Keep challans, electronic liability ledger entries, and portal payment acknowledgements with the appeal record.
Separate admitted and disputed figures
- Reconcile the demand order with the electronic liability ledger.
- State the amount admitted, if any, and pay it through the prescribed mechanism.
- Identify the disputed tax base used for the pre-deposit calculation.
- List interest and penalty separately; do not silently treat every demand component as disputed tax.
- Check whether an earlier payment or debit has already reduced the balance.
If the order combines central, state, or integrated GST components, check the corresponding CGST, SGST or IGST provisions and the jurisdiction handling the appeal. State GST laws are generally parallel, but notifications, forms, officers and portal treatment can vary.
How to file the appeal on the GST portal
The GST Portal’s demand-order workflow uses the first-appeal form APL-01. Follow the portal labels currently displayed for your account; an order may be classified differently from a refund application.

- Choose the appeal service: select Appeal to Appellate Authority, choose the relevant demand order, and verify the order number, date and communication details.
- Complete APL-01: select the grounds, enter admitted and disputed amounts, upload the order and supporting documents, and provide payment details for the admitted amount and pre-deposit.
- Review before submission: ensure the tax period, refund amount, ledger figures, legal provisions and relief requested match the order and your annexures.
- Submit and save the acknowledgement: retain the submission reference and the final acknowledgement in APL-02. The appeal is treated as filed when the final acknowledgement is issued.
When the order is missing from the portal
The portal FAQ describes a process for an order that is not available electronically: supply a self-certified copy within seven days. Under the appeal rules, failure to provide the required copy within that period changes the effective filing date to the date on which the copy is submitted. Upload or deliver the copy exactly as instructed and keep proof of the date and method.

Build the record before writing grounds
An appeal cannot be assessed from the title alone. Assemble a complete, paginated record and map every factual assertion to a document.
- The complete recovery or refund order, demand summary and proof of communication.
- The show-cause notice, relied-upon documents, your reply, hearing notice, hearing minutes or record, and written submissions.
- The original refund application and attachments, sanction order, payment advice, refund category and relevant tax periods.
- Electronic credit ledger extracts, GSTR returns, invoices, credit notes, shipping or export records where relevant, and the ITC computation supporting accumulation.
- Workings for turnover, net ITC, adjusted total turnover and any formula used by the department or by you.
- Proof of admitted amounts, pre-deposit, prior debits, challans and portal acknowledgements, including APL-01 and APL-02.
- Correspondence showing requests for documents, adjournments, replies, personal-hearing requests and service of notices.
Label the source and period for every spreadsheet. A mismatch between the refund application, returns, purchase register and electronic credit ledger should be explained rather than left for the hearing.
Common substantive grounds to test against the order
These are issue categories for reviewing the record, not guaranteed arguments. Select only grounds supported by the notice, evidence and governing law.
ITC eligibility
Check whether the department disputes the underlying invoices, receipt of supplies, tax payment by suppliers, use in business, blocked-credit rules, time limits, or reversals. Trace each disputed invoice to the return period, ledger entry and supporting tax document. If the order relies on a mismatch, identify whether the mismatch is a timing difference, amendment, credit note, supplier filing issue or genuine ineligibility.

Refund formula and accumulated credit
Reperform the calculation for the exact tax period and refund category. Compare the department’s figures with the electronic credit ledger and the returns used in the application. Identify whether the disagreement concerns net ITC, turnover, zero-rated turnover, adjusted total turnover, exclusions, or an arithmetic error. Do not substitute a formula from another refund category or period.
Documentary and computational errors
List every invoice, return line, ledger debit and payment included or excluded by the order. A schedule showing the department’s figure, your corrected figure and the document proving the correction is more useful than a general assertion that the calculation is wrong.
Notice, hearing and reasons
Compare the allegations in the show-cause notice with the reasons finally used in the order. If the order introduces a new ground, ignores a material reply, refuses a requested hearing, or gives no intelligible calculation, identify the exact paragraph and the prejudice caused. Attach the submission or hearing request that proves the issue was raised.

Check the tax period, refund sanction date, payment date, notice date and the limitation rule cited by the officer. Confirm that the officer had jurisdiction and that the order invokes the provision applicable to an already-paid erroneous refund rather than a pending claim. A limitation or jurisdiction argument must be tied to the dates and text in the actual file.

What the Appellate Authority can do
Under section 107, the Appellate Authority may confirm, modify or annul the decision or order under challenge. The section does not permit the authority to send the matter back to the original adjudicating authority for a fresh decision. Procedural safeguards apply where enhancement or specified additional tax or ITC liability is proposed; read the notice of proposed enhancement and use the opportunity to respond.
Frame the relief precisely: annul the demand, reduce a quantified amount, correct a calculation, recognise a re-credit, or grant another legally available remedy. Filing an appeal does not guarantee a refund, cancellation or acceptance of any particular ground.
If recovery action continues
Check whether the admitted amount and required pre-deposit have actually been credited and whether the APL-02 acknowledgement has issued. Send the payment proof and acknowledgement through the prescribed channel if the recovery officer’s records have not updated. Keep notices, bank or ledger debits and communications showing any continuing recovery steps.
Do not assume that a pending appeal automatically reverses a debit already made. Ask the authority to apply the statutory stay to the balance after the payment condition is met, and obtain written confirmation of any adjustment or release. If coercive action or a disputed debit raises an issue outside the portal workflow, obtain advice promptly on the appropriate statutory or judicial remedy.
Further appeal to the Appellate Tribunal
Section 112 provides a further appeal against an order under section 107 or 108, generally within three months from communication and subject to statutory payment requirements. Tribunal commencement, notified filing dates and portal availability can change operationally. Check the current notification and filing instructions at the time a second appeal is considered; do not rely on an old form or an assumed start date.
A practical filing checklist
- Identify whether the order rejects a pending claim, adjusts a refund, or recovers an already-paid refund.
- Record the communication date and calculate the three-month deadline.
- Calculate admitted dues, disputed tax and the applicable pre-deposit under the current law.
- Collect the order, notice, replies, hearing record, refund file, returns, ledger and calculation schedules.
- Prepare grounds that answer each finding and cite the document supporting each correction.
- File APL-01 through the portal’s appeal service and submit any missing-order copy within seven days.
- Save the final APL-02 acknowledgement, payment proofs and every uploaded annexure.
- Monitor the stay, hearing notices and any request for additional information.
Because the outcome depends on the order’s statutory basis, tax period, refund type and evidence, a GST appeal professional or tax advocate can be useful where the amount is material, the deadline is close, or recovery has started. A current GST refund procedure handbook, including the January 2026 handbook published by the Telangana Commercial Taxes Department, may help with terminology, but verify that any edition and instructions remain current for your jurisdiction.
