Usually, you do not appeal a GST notice itself. You normally reply to the notice using the form and procedure it specifies. An appeal generally becomes available only after an adjudicating authority has issued a decision or order that adversely affects you. For a first appeal under section 107 of the Central Goods and Services Tax Act, 2017, the normal limit is three months from the date the order is communicated, with a possible further one-month admission period if sufficient cause is shown.

Start by identifying the notice or order’s statutory section, form number, issuing authority, tax period, communication date and response deadline. Those details determine whether you should submit information, file a notice-stage reply, request a hearing, or prepare an appeal.

Notice versus appeal: the distinction that controls your next step

A GST notice is an allegation, proposal, request for information or procedural direction. It may ask you to explain a mismatch, produce records, pay tax and interest, or show why a proposed demand should not be confirmed. A notice is not automatically an appealable decision.

An appeal challenges a decision or order already passed by an adjudicating authority. The GST portal’s appeal guidance describes an appeal as a challenge to such a decision or order and indicates that an order must have been passed before an appeal is filed. In practical terms, the sequence is usually:

  1. Read and authenticate the notice.
  2. Submit the required reply and evidence by the date stated or the period prescribed for that notice.
  3. Attend a hearing or provide further clarification if requested.
  4. Review the adjudication order when it is issued and communicated.
  5. If the order is adverse, decide whether to file the appropriate appeal within the applicable limitation period.

Calling a notice an “appeal” too early can send you to the wrong form, miss the requested evidence and leave an adverse order unchallenged. Conversely, treating an adjudication order as if it were still only a notice can cause you to lose the appeal deadline.

How to identify the document

Check the heading, form number and statutory provision printed on the document or shown in your GST portal account. A summary of a demand notice uploaded electronically in FORM GST DRC-01 has a specific reply route: rule 142(4) provides for a reply in FORM GST DRC-06. Other notices can arise under different sections and may use different forms, response periods or hearing procedures.

Also record the GSTIN, tax period, issuing officer and the date and method of service or electronic communication. Keep the original PDF, portal download, email or other service record. The communication date can later control limitation for an appeal, while the date printed as a response deadline controls your immediate notice-stage action.

Is there one deadline to reply to every GST notice?

No. Indian GST law does not create one safe, universal reply deadline for every kind of notice. The period depends on the statutory section, form, allegation, issuing authority and the direction in the notice. A DRC-01 demand summary, an information request, a cancellation proceeding and a notice proposing an adjudication order are not interchangeable.

Follow the earliest clearly applicable date shown in the notice and the governing provision. If the document gives a hearing date, treat preparation and attendance as part of the response even if a separate written-reply date appears. If the notice is silent, ambiguous or internally inconsistent, obtain clarification through the official channel and seek professional advice rather than assuming that a commonly quoted number of days applies.

What to do when the deadline is unclear

  • Download the full notice and any annexures from the GST portal, not only the alert email.
  • Identify the section and form number and read the paragraphs describing the response method.
  • Check whether the document is a notice, a summary in DRC-01, a personal-hearing intimation or an order.
  • Submit a protective, point-by-point reply before the earliest defensible deadline while you verify any discrepancy.
  • Preserve the submission receipt, ARN, acknowledgement and time stamp.

A request for more time is not automatically granted. Make it in writing through the channel prescribed by the notice and continue preparing the substantive response while you wait.

Replying to a GST notice: a practical process

1. Build a notice map

Create a one-page control sheet containing the notice number, section, form, tax period, issuing authority, date of service, reply deadline, hearing date, amounts of tax, interest and penalty mentioned, and the portal location of every attachment. This prevents a reply to one period or allegation from being mistaken for a response to another.

2. Break the allegations into answerable points

Number each allegation exactly as it appears. For each point, state whether you accept, partly accept or dispute it; explain the legal and factual reason; show the calculation; and identify the attached record that proves it. If an allegation concerns a return mismatch, reconcile the relevant return, invoice register, electronic credit ledger and books rather than sending a general denial.

3. Assemble evidence that addresses the allegation

Useful records can include returns, invoices, e-way bills, contracts, ledgers, bank records, credit-note trails, reconciliation workings, correspondence and proof of tax payment. The exact set is fact-dependent; the aim is to connect every document to a specific allegation. Index the files, use consistent names and explain any difference between the notice’s figures and your books.

4. Use the prescribed form and channel

For a DRC-01 summary, rule 142(4) specifies FORM GST DRC-06 for the reply. Complete the portal fields, upload the signed or verified reply and supporting documents in the permitted formats, and save the generated acknowledgement. If the notice directs a different form or offline submission, follow that direction and retain proof of delivery.

5. Deal with a hearing

If a personal hearing is offered or scheduled, prepare a short speaking note tied to your numbered grounds and carry the same indexed evidence submitted online. Ask that your submissions and documents be taken on record. If you cannot attend, request an adjournment promptly under the applicable procedure; do not assume that silence will be treated as consent.

6. Verify closure or the resulting order

After filing, monitor the portal for a clarification request, hearing notice, acknowledgement or adjudication order. A reply does not itself cancel a proposed demand. Read the final order, its reasoning, the confirmed amounts and the date it was communicated. That document determines whether an appeal is available and when the limitation clock begins.

When can you file a first GST appeal?

Section 107(1) of the CGST Act allows an aggrieved person to appeal an adjudicating authority’s decision or order to the prescribed Appellate Authority within three months from the date the decision or order is communicated. The same provision covers decisions or orders under the CGST, State GST or Union Territory GST Acts through the applicable appellate authority.

For limitation purposes, treat the communication date as an urgent control date. Record when the order became available or was served, how it was communicated and the evidence of that event. Do not wait for a recovery notice or assume that a later conversation with the officer restarts the period.

Late filing: the narrow extra period

Section 107(4) permits the Appellate Authority to admit an appeal presented after the three-month period for a further period of one month if sufficient cause prevented timely filing. This is a discretionary condonation window, not an automatic extension. File as soon as possible, include a specific explanation supported by evidence and do not plan around receiving the extra month.

What must be paid for a section 107 first appeal?

Section 107(6) requires the appellant to pay, before the first appeal is entertained, the amount of tax, interest, fine, fee and penalty admitted as payable in full, plus a sum equal to 10% of the remaining disputed tax. The 10% figure applies to the disputed tax component described in the order; it is not a universal 10% of every amount listed in a demand.

Use the order’s own breakdown and obtain a checked calculation before paying. The correct amount depends on what you admit, what you dispute and how the order characterises tax, interest, fine, fee and penalty. This guide cannot calculate an individual pre-deposit without those documents and facts.

Effect of the payment

Once the section 107(6) payment is made, recovery proceedings for the balance are deemed stayed under the cited statutory framework. Keep the payment challan, transaction reference and portal acknowledgement with the appeal file. A stay of recovery does not decide the merits of the dispute or remove the obligation to comply with other directions in the order.

How to prepare and file FORM GST APL-01

The CBIC appeal rules describe FORM GST APL-01 for a first appeal. The filing should state the challenged order, grounds of appeal and verification. The rules text also describes submitting a certified copy of the order and supporting documents within seven days and explains the relationship between provisional and final acknowledgements. Portal screens and procedural requirements can change, so confirm the current instructions and applicable rules immediately before filing.

First-appeal preparation checklist

  • Complete copy of the adjudication order and every annexure.
  • Proof of the date and method by which the order was communicated.
  • Calculation of admitted tax, interest, fine, fee and penalty.
  • Calculation and proof of the 10% disputed-tax pre-deposit.
  • Draft grounds arranged in numbered paragraphs, with a separate ground for each legal or factual error.
  • Returns, invoices, ledgers, reconciliations, contracts, correspondence and payment records supporting each ground.
  • Authority letter or other representation document if a professional is filing for you.
  • Certified copy and any additional documents required by the current rules or portal.
  • Proof of submission, ARN, provisional acknowledgement and final acknowledgement when issued.

Writing effective grounds

Begin with jurisdictional or procedural defects only when the facts support them, such as an order dealing with a different tax period or failing to address a reply. Then address the substantive issue: identify the legal provision, explain the factual record, show the calculation and state the precise relief requested. Avoid copying the notice’s allegations without answering them. An appeal is easier to decide when each ground leads to a specific correction, deletion or remand request.

Common mistakes and how to avoid them

Assuming every notice is appealable

A notice normally requires a response, not an appeal. Confirm that an appealable order has actually been passed before selecting APL-01.

Using a generic deadline

Different GST provisions prescribe different procedures. The date printed on a notice and the period in its governing section must control your response plan.

Ignoring service evidence

Without a reliable communication record, you may not know when the three-month appeal period began. Save portal logs, downloads, emails and acknowledgements.

Submitting a narrative without a reconciliation

Where the dispute is numerical, provide a table or worksheet tying each disputed figure to returns, invoices and ledgers. A broad explanation does not replace proof.

Waiting for recovery action before appealing

Recovery activity is not the trigger to start the limitation period. Calculate the appeal deadline from communication of the order and file promptly.

Paying the wrong amount

The first-appeal pre-deposit is based on admitted amounts and 10% of remaining disputed tax. Do not calculate it as 10% of the total demand without separating those components.

Failing to keep acknowledgements

A successful upload is not the same as a complete procedural record. Retain the ARN, provisional and final acknowledgements, challans and copies of every uploaded file.

When professional help is sensible

Consider a GST practitioner, chartered accountant or tax lawyer when the demand is material to your cash flow, the order involves several tax periods, the allegation concerns classification or input-tax credit, records are incomplete, limitation is close, or a hearing has already occurred. Give the adviser the complete notice or order, communication proof, return data, reconciliations and submission history rather than only the first page.

Professional assistance does not replace your responsibility to monitor the portal and preserve deadlines. If a commercial relationship is involved in obtaining assistance, it should be disclosed separately and clearly.

A deadline-control checklist for a small business

  1. Download and authenticate the notice or order.
  2. Write down the section, form, authority, tax period, amount and communication date.
  3. Enter the response or appeal deadline in a calendar with reminders well before the due date.
  4. Separate notice-stage work from post-order appeal work.
  5. Map every allegation to a factual answer and supporting record.
  6. Use DRC-06 for a DRC-01 summary when rule 142(4) applies, or follow the specific form named in another notice.
  7. If an adverse order is communicated, calculate the section 107 three-month limit immediately.
  8. Prepare the admitted-amount payment and 10% disputed-tax pre-deposit before filing APL-01.
  9. Check current portal and rule instructions for certified copies, document uploads and acknowledgements.
  10. Save proof of every submission and seek qualified advice where the amount or limitation risk is significant.

What this guide cannot decide

Only the actual notice, governing provision, order and facts can establish whether a demand is valid, whether a particular document is appealable, which authority has jurisdiction or what amount is payable. GST statutes, rules, notifications, court decisions and portal workflows can change. Verify the current official instructions and obtain case-specific advice before relying on a deadline, form or payment calculation.
