Yes. A person aggrieved by an adjudicating authority’s decision or order under the Central GST Act, a State GST Act, or the Union Territory GST Act can file a first appeal with the prescribed Appellate Authority. For a taxpayer, the normal limit is three months from the date the order is communicated. A further period of only one month may be allowed when the authority is satisfied that sufficient cause prevented timely filing.
The first appeal is filed in FORM GST APL-01. Before filing, the appellant generally must pay the amount admitted from the order and a statutory pre-deposit of 10% of the remaining tax in dispute. Once the required payment is made, recovery of the balance is deemed stayed under section 107(7). The exact authority, limitation date, amount and portal steps depend on the order, jurisdiction, current amendments and whether the order has been uploaded to the common portal.

GST first appeal: the key rules at a glance
| Question | Rule for a taxpayer’s first appeal |
|---|---|
| Who may appeal? | Any person aggrieved by a decision or order passed by an adjudicating authority under the applicable GST law. |
| Where is it filed? | With the prescribed Appellate Authority for the order’s jurisdiction. |
| Form | FORM GST APL-01, using the route currently notified or available for that jurisdiction. |
| Normal deadline | Three months from communication of the decision or order. |
| Late-filing relief | Up to one additional month, only when sufficient cause is shown to the satisfaction of the Appellate Authority. |
| Payment before appeal | All admitted dues arising from the order, plus 10% of the remaining tax in dispute under section 107(6). |
| Effect of payment | Recovery of the balance amount is deemed stayed under section 107(7), subject to the statutory conditions. |
These are the central statutory rules. State and Union Territory legislation generally corresponds to the central framework, but an individual filing must be checked against the law and portal instructions in force for that order.

Section 107(1) covers an aggrieved person, not just the registered taxpayer named in a demand. The order may concern a registered person, a person liable to register, or another person directly affected by the adjudication. The appeal must be directed to the Appellate Authority prescribed for the officer and jurisdiction that issued the order.

The statutory wording is: “Any person aggrieved by any decision or order passed under this Act or the State Goods and Services Tax Act or the Union Territory Goods and Services Tax Act by an adjudicating authority may appeal to such Appellate Authority as may be prescribed within three months from the date on which the said decision or order is communicated to such person.” This is section 107(1) of the Central Goods and Services Tax Act, 2017.
Check the order itself for the issuing officer, legal provision, tax period and appeal instructions. An order under a different statute, or an order that is not an adjudicating authority’s decision, may follow another remedy.
What is the time limit to appeal a GST order?
The clock starts on communication, not merely the order date
The taxpayer’s three-month period runs from the date the decision or order is communicated. The date printed on the order and the date you actually received or were served with it can therefore be different. Preserve the portal record, email, download history, physical service record and any other evidence showing when communication occurred.

Use the legally relevant communication event and verify how the applicable limitation rules count the first and last days, including any holiday or portal issue.
Condonation is limited to one month
Section 107(4) permits the Appellate Authority to accept an appeal filed within a further period of one month if it is satisfied that sufficient cause prevented filing during the original three months. This is a limited condonation power, not an open-ended extension. A late appeal should explain the complete period of delay, attach evidence for the cause and request condonation expressly.
Taxpayer deadline versus departmental application
| Proceeding | Ordinary period | Possible additional period |
|---|---|---|
| Taxpayer’s appeal under section 107(1) | Three months from communication of the order | Up to one month for sufficient cause |
| Commissioner-directed departmental application under section 107(2) | Six months | Up to one month where the statutory conditions are met |
The six-month departmental period is not the ordinary deadline for a taxpayer. Treating it as your filing period can make an otherwise arguable appeal time-barred.

What is the GST appeal pre-deposit?
Separate admitted dues from disputed tax
Section 107(6) requires payment in full of the amount admitted from the order, including the admitted tax, interest, fine, fee and penalty arising from the order. In addition, the appellant pays 10% of the remaining amount of tax in dispute.
A useful working formula is:
Amount to arrange before filing = admitted tax + admitted interest + admitted fine + admitted fee + admitted penalty + 10% of the disputed tax.
For illustration only, if an order contains ₹20,000 of admitted tax and ₹2,000 of admitted interest, and ₹100,000 of tax remains disputed, the statutory components would be ₹22,000 of admitted dues plus ₹10,000 (10% of ₹100,000) on the disputed tax. The figure must be reconciled to the actual order, payments already made, applicable cess and current legislation; this example is not a calculation for any particular taxpayer.
What the payment does—and does not do
After the specified section 107(6) payment is made, section 107(7) deems recovery of the balance amount to be stayed. The stay relates to recovery of the balance covered by the statutory mechanism; it does not erase the demand, decide the merits or guarantee that every other proceeding is suspended.
The cited statutory wording does not establish one universal calculation for every penalty-only dispute, jurisdictional variation or later amendment. If the order has no disputed tax, or combines tax with penalties and other charges, obtain a head-by-head reconciliation before paying. Keep the challan, payment reference and electronic receipt with the appeal file.
Prepare before opening APL-01
1. Identify the order and the correct authority
- Record the GSTIN, temporary ID or UIN, legal name, trade name and address.
- Note the order number, order date, issuing officer, statutory provision and date of communication.
- Confirm which Appellate Authority has jurisdiction and whether the order was issued under the central, State or Union Territory framework.
- Mark the last day of the three-month period and, if necessary, the one-month condonation window. Do not wait for the condonation period to become your plan.
2. Build a tax-wise dispute schedule
Reconcile the demand with the order rather than relying on a summary screen. List the tax period, goods or services, classification or valuation issue, and each amount under tax, cess, interest, penalty, fee and other charges. Show what is admitted, what is disputed and what has already been paid. If the form calls for a seized-goods value or another specific field, use the figure and description that match the order.

3. Draft the three core pleadings
FORM GST APL-01 has distinct fields for Statement of facts, Grounds of appeal and Prayer. The form also asks whether the appellant wishes to be heard in person.
- Statement of facts: give a chronological, document-supported account of registration, returns, notices, replies, hearing opportunities and the adjudication order.
- Grounds of appeal: number each legal and factual error separately. Tie every ground to the finding, evidence and relief sought; avoid a single undifferentiated narrative.
- Prayer: state precisely what should happen, such as setting aside or modifying the disputed portion, allowing a specific claim, deleting an amount or granting another relief available to the authority.
Set out the admitted and disputed portions consistently in the narrative, tax schedule and payment records. A mismatch can create avoidable clarification requests.
How to file an appeal in FORM GST APL-01
- Collect the identity and order particulars. Enter the GSTIN or other identifier, legal and trade names, address, authorised representative details, order number and date, issuing officer and communication date.
- Describe the dispute. Complete the period, issue, goods or services and tax-wise amounts. Distinguish tax and cess from interest, fine, fee, penalty and other charges.
- Upload or enter the statement of facts, grounds and prayer. Use numbered grounds that correspond to the documents and the order’s findings. Select the in-person hearing option if that is the appellant’s request.
- Make the required payment. Pay the admitted amount and the 10% pre-deposit on the remaining disputed tax as reconciled from the order and current law. Save the payment reference.
- Submit APL-01 through the currently notified route. Portal screens and jurisdictional workflows can change. Review every field before filing and retain the submission receipt.
- Handle the order copy within the rule’s time limit. The appeal rules address submission of supporting documents and a certified copy of the order within seven days. Where the order is not uploaded on the common portal, the current rules contain a separate self-certified-copy procedure. Follow the wording applicable to the actual order.
- Keep both acknowledgements. Retain the provisional acknowledgement, proof of order-copy submission and the final acknowledgement in FORM GST APL-02, including the appeal number.
The filing date can depend on timely submission of the appeal and order copy under the applicable rule. A provisional acknowledgement is not a reason to ignore a later document requirement.
Documents needed for a GST appeal
There is no single evidence bundle that fits every dispute. The documents should prove each ground and answer the findings in the order. A practical checklist is:
- Complete adjudication order, including annexures, calculations and relied-upon documents.
- Evidence of communication: portal download, email, service record or other relevant proof.
- Show-cause notice, statement of demand, audit or inspection records and written reply.
- Records of personal-hearing notices, adjournment requests and submissions already made.
- Returns, invoices, e-way bills, ledgers, contracts, reconciliation statements, payment records or classification material relevant to the disputed issue.
- Authority letter or authorisation for a representative, where applicable.
- Challan and electronic payment proof for admitted dues and the statutory pre-deposit.
- Any document specifically required by the current rule or portal for the order-copy process.
Organise the bundle by ground of appeal, with an index and page references. Do not attach irrelevant records merely to increase volume; explain why each material document addresses a finding or supports relief.
Uploaded and non-uploaded orders follow different copy procedures
| Portal status | What to check | Why it matters |
|---|---|---|
| Order uploaded on the common portal | Confirm the order is accessible, save the electronic copy and follow the prescribed certified-copy and acknowledgement steps. | The filing date and document sequence are governed by the applicable appeal rule. |
| Order not uploaded | Use the current rule’s procedure for a self-certified copy and any required submission through the notified route. | The rules specifically address how an unuploaded order is handled; do not assume the uploaded-order workflow applies. |
Because portal functionality and rule text can change, check the live instructions at the time of filing and keep screenshots or receipts showing what was submitted and when.

What happens after filing?
The Appellate Authority gives the appellant an opportunity of being heard. APL-01 records whether an in-person hearing is requested. The statutory materials do not establish one fixed hearing date or decision deadline for every matter, so monitor the portal and communications for notices, deficiency memos and hearing dates.
Recommended Free Tools
The authority may examine the order, grounds, evidence and statutory payments before deciding the appeal. Respond to any request within the stated time and preserve delivery proof. A payment that creates a recovery stay does not replace the need to prosecute the merits of the appeal.
Common mistakes and how to prevent them
Counting three months from the order date
Use the communication date and preserve proof. If there is uncertainty, file as early as possible while seeking clarification rather than assuming the later date will be accepted.
Treating condonation as an automatic extension
The extra month is discretionary and requires sufficient cause. File within the original period whenever possible; if late, include a specific condonation request and evidence for every day of delay.
Paying 10% of the entire demand
The statutory percentage applies to the remaining tax in dispute, while admitted tax and other admitted dues are paid in full. Prepare a signed reconciliation so the payment basis is clear.

Using a generic written objection instead of APL-01
An appeal needs the form’s identity, order, issue, amount, facts, grounds and prayer fields. A letter alone may not satisfy the prescribed filing route.
Assuming the first appeal is the tribunal appeal
Section 107 and APL-01 concern the first appeal to the Appellate Authority. A later challenge to an order under section 107 or section 108 is a separate section 112 proceeding with a different forum, deadline and pre-deposit framework.
First appeal versus the next appellate stage
| Feature | First appeal | Later appeal |
|---|---|---|
| Statutory route | Section 107 | Section 112 for an appeal from an order under section 107 or section 108 |
| Form discussed here | FORM GST APL-01 | Different statutory and procedural route |
| Forum and deadline | Prescribed Appellate Authority; three months for the taxpayer, subject to limited condonation | Separate forum, limitation period and payment conditions |
Do not combine section 112 instructions with the APL-01 filing. First establish whether the order is still at the adjudication stage or has already been decided by the Appellate Authority.

A practical filing timeline
- Day of communication: save the order, record the communication event and start the limitation diary.
- Early preparation: obtain the complete record, reconcile the demand and decide the relief sought.
- Before three months expire: calculate and pay admitted dues and the disputed-tax pre-deposit, complete APL-01 and submit it.
- Within the applicable seven-day order-copy window: provide the certified or self-certified copy required by the rules and retain proof.
- After acknowledgement: monitor for the FORM GST APL-02 appeal number, hearing notices and any deficiency or document requests.
If the original deadline has passed, act immediately within the possible one-month condonation period, but understand that acceptance depends on the Appellate Authority’s satisfaction about sufficient cause.
Bottom line for a taxpayer
You can appeal a GST adjudication order, but the process is deadline-driven. Start with the date the order was communicated, not just the date printed on it. File FORM GST APL-01 within three months, pay admitted dues plus 10% of the remaining disputed tax, and complete the order-copy and acknowledgement steps required by the current rules. Keep the order, communication proof, payment records and a ground-by-ground evidence bundle together. Before relying on a calculation or portal instruction, confirm the law and workflow applicable to the order’s date, jurisdiction and upload status.
