Yes, it is possible, but it is not established as a common event. Mortgage fraud can involve stolen identity information, impersonation, or forged deeds and loan documents. The FBI’s 2010 Mortgage Fraud Report describes extreme cases in which a perpetrator sold a home or secured another loan against it without authorization.
If you see an unfamiliar mortgage, lien, deed, or lender notice, verify it with the lender and your county or state land-records office, preserve every document, and report suspected identity theft through the FTC’s IdentityTheft.gov process. The procedure for challenging a recorded document depends on local law.

What “a loan against your home” means
A mortgage, home-equity loan, or similar borrowing is usually secured by a lien or another legal interest recorded against the property. The lien gives the lender rights that can be enforced if the debt is not paid. A person listed as the borrower and the person who owns the property are not always the same.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsThat distinction matters when assessing an unfamiliar filing. A lender may require a spouse’s signature in some circumstances to create a valid lien or to pass clear title, according to the Consumer Financial Protection Bureau (CFPB). Marriage, community-property rules, the names on the deed, the type of loan, and state law can change the result. There is no nationwide rule that every owner or every spouse must sign every mortgage transaction.

An unfamiliar lien therefore needs to be examined in context. It could be a legitimate transaction involving another owner or spouse, a refinancing record you do not recognize, a clerical error, or a fraudulent filing.
How someone could borrow without the owner’s knowledge
Impersonation and stolen identity information
A criminal may use personal information to pose as the property owner during an application or closing. The information could be used to open an account, sign documents electronically, or answer identity-verification questions. The existence of a suspicious record does not by itself prove exactly how the information was obtained.
Forged deeds and transaction documents
The FBI’s 2010 Mortgage Fraud Report describes schemes involving forged deeds and other false documents. In an extreme example, the report says a perpetrator might sell a home or secure a second loan without the owner’s authorization. That report establishes that the method is possible; it does not provide a current rate for this specific type of fraud or show that it is typical.

Recording a document before the owner notices
Property records are maintained by local or state offices. A fraudulent deed or lien can therefore appear in the public record before the true owner receives a letter or sees an effect on a credit account. Recordation is a warning sign, not a determination that the document is valid. The land-records office, lender, courts, and other authorities follow jurisdiction-specific procedures to investigate and correct disputed filings.
How to check whether a mortgage or lien is recorded
Search the official land records
Start with the recorder, register of deeds, clerk, or comparable land-records office for the county where the property is located. Some jurisdictions provide an online index; others require an in-person request or a written order for copies. Search under the current owner’s name, the property address, and the parcel or assessor identification number if available.
Look for deeds, deeds of trust, mortgages, home-equity instruments, assignments, releases, and other liens. Read the recording date, document type, named borrower, lender or beneficiary, legal description, and recording number. An index entry can contain errors, so obtain a copy of the recorded document before drawing a conclusion.

Ask about free filing alerts
Many local governments offer an alert service that emails or texts when a document is recorded under a subscribed name or property. Availability, eligibility, and the data covered vary by jurisdiction. These alerts are useful for detection; they do not stop a fraudulent deed or lien from being submitted.
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Contact the named lender independently
Use a telephone number or website obtained from the lender’s official records, an existing statement, or a regulator—not only the contact details printed on a suspicious letter. Ask whether the lender has an application, account, closing, or lien associated with the property. Request the lender’s fraud or identity-theft department and record the date, representative, and case number for each conversation.
Review credit reports when identity misuse is possible
A new mortgage or home-equity account may appear on a credit report, although a property-record filing and a credit-report entry do not always appear at the same time. The FTC’s identity-theft guidance directs consumers to IdentityTheft.gov for a recovery plan and related steps. Review reports for unfamiliar inquiries, accounts, balances, and addresses, and preserve copies showing the disputed information.

| Check or alert | What it can reveal | Timing and cost | Important limit |
|---|---|---|---|
| County or state land-record search | Recorded deeds, mortgages, liens, assignments, and releases | One-time check; fees and online access vary locally | It detects a recorded change but does not prevent filing |
| Local recording alert | A notice when a covered document is recorded | Often free where offered; ongoing alerts | Coverage and enrollment rules vary, and notice may come after recording |
| Credit-report review | Unfamiliar credit inquiries or loan accounts | Review when a concern arises and periodically thereafter | A property lien may not appear immediately or at all as a separate credit entry |
| Paid title-monitoring service | Typically a notification after a title record changes | Recurring fee set by the provider | FTC says it is monitoring, not a lock or insurance, and it does not block fraud |
What to do when you find a suspicious lien or loan
- Keep the evidence. Save the notice, envelope, emails, text messages, credit-report pages, account statements, and copies of every recorded document. Do not alter originals. Write down when and where each item was obtained.
- Verify the lender or servicer. Ask whether an account, application, closing, or lien exists and state clearly that you did not authorize it. Request written confirmation of the lender’s findings and its fraud-dispute procedure.
- Contact the land-records office. Ask how to obtain certified copies, place a fraud or identity-theft notation if the jurisdiction permits one, and learn the process for disputing or correcting a document. The office may explain filing requirements but may not be able to cancel a document without a court order or another legally sufficient instrument.
- Use IdentityTheft.gov if personal information may have been misused. The FTC’s recovery process can organize reports, affidavits, and recommended follow-up. Follow the instructions that apply to the type of account and identity theft involved.
- Report suspected criminal conduct. Contact local law enforcement and provide the preserved records. Also ask the lender whether it has made, or needs, a report to its own fraud investigators or law-enforcement contacts.
- Get local legal advice. A lawyer who handles real-property records or title disputes can explain the remedy available in your state or county, including whether a court action, corrective instrument, or notice to subsequent purchasers is required. National guidance does not establish one universal method for invalidating a fraudulent lien.
- Escalate errors in a legitimate closing file. If the problem is an error in mortgage closing documents rather than an obvious identity theft, the CFPB advises contacting the lender or settlement agent promptly and describing the error in writing.
Does a title-monitoring service prevent deed or lien fraud?
No. In an August 2024 consumer alert, the Federal Trade Commission said that so-called “title lock insurance” is a misnomer. A monitoring service may notify a customer after a deed has been transferred or another record has changed, but it does not lock the title, stop a criminal from submitting a document, or reverse the transfer automatically.
Monitoring can be useful as an additional alert, but it should not replace checking the official records, enrolling in a free local alert when available, or responding quickly to a notice. Read the service’s contract to determine which records it watches, how alerts are delivered, and what assistance—if any—is included after an alert.
Title insurance is different from title monitoring
Title insurance is a financial contract issued in connection with a real-estate transaction; it is not an identity-verification service. The CFPB distinguishes the two main policies:

| Policy | Whose interest it primarily protects | What it may cover | What it does not do |
|---|---|---|---|
| Lender’s title insurance | The mortgage lender | Covered title problems that threaten the lender’s security interest | It does not protect the homeowner’s equity and does not prevent someone from applying for a fraudulent loan |
| Owner’s title insurance | The homeowner’s investment | Covered title claims affecting the owner, subject to the policy’s terms, exclusions, and limits | It is not a guarantee that identity theft or a forged filing will never occur |
Whether a particular forged document or lien is covered depends on the policy language, the timing of the event, exclusions, and the insurer’s claims process. Report a suspected title problem to the insurer promptly and continue the separate lender, land-record, law-enforcement, and legal steps.
Why a spouse or co-owner may appear in the paperwork
People often assume that an unauthorized loan is proven because they did not sign a document, or that fraud is disproven because a spouse signed. Neither assumption is safe without examining the deed and state law.
The CFPB explains that a lender may ask a spouse to sign documents even when the application is in only one spouse’s name. The signature may be needed to create a valid lien under local law or to pass clear title. In other situations, a spouse may sign only certain documents and not be personally liable for repayment. Ownership, community-property rules, tenancy arrangements, prior liens, and the precise document all matter.
For a co-owned property, compare the names and legal descriptions on the deed with the names on the mortgage or lien. If an owner’s signature appears forged, tell the lender, recorder, and attorney exactly which signature or authority is disputed rather than assuming that every related document is invalid.
Prevention and early detection checklist
- Know which county or state office records documents for the property and how to obtain copies.
- Enroll in that office’s free recording-alert program if one is available.
- Keep the deed, prior mortgage payoff or release, closing documents, and parcel number in a secure location.
- Review lender statements and credit reports for unfamiliar accounts, inquiries, addresses, or payment notices.
- Use IdentityTheft.gov promptly if personal information may have been exposed or misused.
- Contact institutions through independently verified contact details when a letter, call, or email is suspicious.
- Do not treat a paid monitoring subscription as a title lock, insurance policy, or substitute for legal action.
What is and is not established about the risk
Unauthorized borrowing secured by a home is a documented mortgage-fraud possibility, not a risk for which the cited sources provide a current prevalence rate. The FBI example is from 2010, and the national sources discussed here do not measure how often an owner discovers a fraudulent second loan or lien. A suspicious filing deserves prompt investigation, but one case should not be presented as evidence that the scenario is routine.
The practical standard is to verify the record, preserve evidence, notify the institutions involved, use the FTC’s identity-theft recovery process when appropriate, and obtain advice tailored to the property’s jurisdiction. Acting quickly can improve the chances of identifying the transaction and learning which correction or court procedure is available.
