Yes—parents can generally provide the purchase money while an NRI or OCI child is named as the buyer, provided the property and payment comply with India’s foreign-exchange rules. The crucial distinction is that the person who supplies funds is not necessarily the person who holds legal title. A registered sale deed naming the child usually establishes the recorded owner, but the official rules do not resolve every beneficial-ownership, trust, family-arrangement, income-attribution or succession question that can arise from parent-funded purchases. Treat the arrangement as a documented legal and tax decision, not an informal family transfer.
What the arrangement means in practice
There are two separate events in a parent-funded purchase:
As an Amazon Associate I earn from qualifying purchases.
- Funding: a parent transfers money, pays the seller, or otherwise makes the consideration available.
- Acquisition: the sale agreement and registered conveyance identify the person who buys and owns the property on the public title record.
If the child is the purchaser named in the agreement and registered sale deed, the child is the recorded buyer even when the parents supplied all or part of the money. The payment trail can show where the consideration came from, but payment alone does not automatically put the parents on title or answer whether a court would recognise another beneficial interest. India’s foreign-exchange rules address who may acquire specified property and how consideration may be paid; they do not settle every family-arrangement or trust question.
Before signing, decide whether the money is intended as an unconditional gift, a repayable loan, a contribution in exchange for co-ownership, or another arrangement. Put that intention in writing and obtain advice that covers the child’s residence status, the state where the property is located and the family’s succession position.

Can an NRI or OCI child buy the property?
The Reserve Bank of India’s Foreign Exchange Management (Non-Debt Instruments) Regulations, 2019 framework, including FEMA 21(R)/2018-RB provisions, generally permits an NRI or an OCI to acquire immovable property in India other than agricultural land, a farm house or plantation property. The buyer’s exact status matters: “NRI” and “OCI” are defined categories, and a person’s passport, residence and status documents should be checked before relying on the permission.
For an ordinary residential or commercial property, confirm all of the following before paying a deposit:
- The child qualifies as an NRI or OCI under the applicable FEMA rules on the transaction date.
- The asset is not agricultural land, a farm house or plantation property.
- The purchase is not subject to a special restriction or approval that changes the general rule.
- The consideration will move through a permitted banking route and all Indian taxes, duties and levies are addressed.
The RBI regulation is a permission framework, not a substitute for checking title, local land-use rules, building approvals or state registration requirements.

How parents should fund the purchase
The safest approach is a traceable transfer that matches the written family arrangement and the sale documents. The RBI regulation permits consideration to be paid through inward remittance via banking channels or from funds held in eligible non-resident accounts. It also requires transactions to go through banking channels in India and remain subject to applicable taxes, duties and levies.

The regulation expressly rules out informal cash-style methods. Its wording states that “no payment for any transfer of immovable property shall be made either by traveler’s cheque or by foreign currency notes or by any other mode other than those specifically permitted under this clause.” A parent should therefore avoid handing over foreign currency, using an unrecorded cash payment or routing money through an account that cannot demonstrate the source and purpose.
| Funding route | What it can show | Points to verify |
|---|---|---|
| Parent remits money through a bank to the child or the transaction account | A documented source of purchase funds and transfer date | Use a permitted banking channel; retain remittance advice, account statements and the gift or loan letter. |
| Parent pays from an account in India | That the consideration was paid from a traceable Indian account | Confirm the account and payment route are consistent with the child’s NRI/OCI status and FEMA requirements. |
| Child uses funds already held in an eligible non-resident account | That the consideration came from a permitted account | Keep statements showing the balance, transfer and payment to the seller. |
| Cash, traveller’s cheque or foreign-currency notes | No reliable permitted banking trail | Do not use these methods for the property consideration. |
The bank, conveyancing professional and tax adviser may request additional declarations or identification. Ask them what they need before the first transfer, rather than trying to reconstruct the trail after registration.
Three common ownership structures
| Structure | Who appears on the initial title? | Main issue to resolve |
|---|---|---|
| Parents gift money; child buys directly | The child, if the sale deed names only the child | Document whether the transfer is a gift or loan. Funding alone does not establish every possible beneficial-ownership consequence. |
| Parent buys first and later gifts the house | The parent until a later conveyance | A gift of immovable property requires a registered instrument, donor signature and at least two witnesses, plus state-specific stamp and registration compliance. |
| Parent and child are both named as purchasers | Both, in the shares and form recorded in the deed | Obtain advice on FEMA eligibility for each buyer, funding proportions, sale decisions, income reporting and succession. |
Do not choose a structure solely to obtain a tax result. The deed, payment records, declarations and the parties’ conduct should tell the same story. If the parent expects repayment, use a written loan with repayment terms instead of calling it a gift. If the parent expects an ownership share, discuss co-ownership before the sale deed is signed.

Income-tax treatment depends on what the transfer legally is and on the later use of the property. Income Tax Department guidance on deemed income from gifts identifies gifts from specified relatives as an exception to the general gift-income treatment. A parent is within the usual specified-relative category, so a genuine parent-to-child gift of money is generally treated differently from a gift received from an unrelated person.

That conclusion is narrow. It does not make every payment from a parent tax-free, and it does not eliminate documentation or later tax questions. The parties should be able to demonstrate:
- Who transferred the money and who received it.
- Whether the transfer was intended as a gift, loan or investment contribution.
- The amount, date, currency and banking route.
- How the money was applied to the purchase price, taxes, duties or other costs.
A gift letter should describe the relationship and state whether the transfer is irrevocable and without consideration, if that is the actual intention. Keep remittance records, bank statements and the executed sale documents together. Rental income, a future sale, deductions, reporting in the child’s country of residence and any income-attribution rule are separate questions; the relative-gift exception does not decide them.
Giving the house itself is different from giving purchase money
A parent who already owns the property and wants to transfer the house to the child is making a gift of immovable property, not merely giving cash. Section 123 of the Transfer of Property Act, 1882, as published by the Income Tax Department, states: “For the purpose of making a gift of immovable property, the transfer must be effected by a registered instrument signed by or on behalf of the donor, and attested by at least two witnesses.”

That means an informal letter, an unregistered family note or a bank transfer cannot by itself complete a gift of the house. The parties must arrange the conveyance and registration process required in the state where the property is situated. Stamp duty, registration charges, identity documents, powers of attorney and any local forms vary by state and should be confirmed with the registering authority or an India property lawyer.

The formal gift rules should not be misapplied to an initial purchase in which the child buys directly from a seller. In that scenario, the relevant instrument is the seller’s sale deed; the parent’s payment is a separate funding event.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Inheritance and what happens if a parent or child dies
Foreign-exchange rules contain provisions dealing with certain acquisitions, transfers and inheritance involving non-residents, but they do not determine who inherits a particular home or the shares each heir receives. Succession can depend on the parties’ personal law, domicile, a valid will, existing co-ownership and the facts of the family.
A parent-funded purchase can therefore produce different outcomes:
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitches- If the child owns the property alone, the child’s death may bring succession under the applicable personal law or will, even if the parents paid the price.
- If a parent remains on title, the parent’s death may affect the parent’s estate and the rights of other heirs.
- If the funds were a loan, the estate may have a repayment claim; if they were a gift, the estate may not have the same claim. The written evidence and surrounding conduct matter.
- If the property is jointly owned, the deed and applicable succession rules govern what happens to each share.
Prepare or update wills and retain the purchase-funding documents. A will cannot cure an invalid conveyance, and a family understanding that was never documented can be difficult to prove years later.

Do not confuse this issue with TDS on a non-resident seller
Tax withholding on the seller’s status is a separate analysis. Current e-filing guidance says Schedule E of Form 141 applies from 1 October 2026 to a reportable purchase by a resident individual or Hindu Undivided Family from a non-resident seller under section 393(2). The buyer being an NRI does not, by itself, establish that this seller-side rule applies.
For any withholding decision, establish both parties’ residential status, the seller’s status, the transaction date, the property and the applicable tax provision. Do not use a parent-funded purchase as a shortcut for deciding whether a filing or withholding obligation exists.
A practical process before signing
- Confirm the child’s status. Collect the passport, overseas residence evidence and NRI or OCI documentation relevant to the transaction.
- Confirm the property category. Check that the land is not agricultural, a farm house or plantation property and that local approvals permit the intended use.
- Choose the legal arrangement. Decide whether the parent’s transfer is a gift, loan, co-ownership contribution or another arrangement. Obtain advice before money moves.
- Open the permitted payment trail. Ask the bank which remittance or eligible non-resident account route applies and what declarations it requires.
- Write the funding document. State the amount, currency, date, purpose, relationship, repayment terms if any, and whether the transfer is a gift without consideration.
- Match the sale documents. Ensure the agreement, sale deed, payment schedule and registration application identify the intended buyer or buyers consistently.
- Record every payment. Keep remittance confirmations, bank statements, tax challans, invoices and correspondence showing how the consideration was paid.
- Review tax and succession separately. Ask a chartered accountant about the gift, rental income, sale and reporting consequences, and ask a property lawyer about title, co-ownership, wills and local registration.
Pitfalls that create disputes
- Assuming “who paid” equals “who owns.” The title deed and the parties’ documented intention must be analysed together.
- Calling every transfer a gift. A repayment expectation or ownership bargain may point to a loan or investment instead.
- Using an untraceable payment method. Cash and prohibited instruments can create FEMA, tax and evidence problems.
- Ignoring the excluded property classes. The general NRI/OCI permission does not cover agricultural land, farm houses or plantation property.
- Relying on a family letter to transfer a house. An immovable-property gift needs the registered instrument and witnesses required by section 123.
- Leaving other heirs out of the plan. A parent-funded arrangement can affect estates and expectations even when the child is the only name on the deed.
- Assuming one state’s charges apply everywhere. Stamp duty and registration procedures are state-specific and require a local check.
When professional advice is essential
Get India-specific advice before payment when the parent wants repayment or a share, more than one person will be on title, the property is inherited or jointly held, the child’s status is changing, the family has potential heirs in different jurisdictions, or the seller is non-resident. A qualified property lawyer can examine title and the conveyance; a chartered accountant can address the gift, income, sale and reporting questions. Also ask about tax or disclosure duties in the parents’ country of residence, which Indian rules do not answer.
