Can Nonresidents Use TurboTax to File U.S. Taxes? What Form 1040-NR Filers Need to Know

Usually not if you are required to file Form 1040-NR. The TurboTax materials reviewed for this article list Form 1040 and describe online products around Form 1040 returns, but they do not list Form 1040-NR. That means the published evidence does not establish that TurboTax can prepare the return a nonresident alien is required to file. Confirm your federal tax status and filing obligation first; “nonresident” in everyday speech is not enough to select a tax product.

The short answer depends on your required tax form

U.S. tax software must support the return you are legally required to submit. A nonresident alien who has a federal filing obligation generally files Form 1040-NR, U.S. Nonresident Alien Income Tax Return. A product that advertises Form 1040 support is not automatically suitable for Form 1040-NR.

TurboTax’s published Desktop forms page reviewed for this article lists Form 1040 and many related schedules, but not Form 1040-NR. TurboTax’s online filing descriptions likewise discuss Form 1040 returns. TurboTax’s tax guide, updated for tax year 2025 on August 3, 2026, distinguishes resident and nonresident returns and names nonresident-oriented software as a separate category. On that public evidence, you should not assume TurboTax can prepare or e-file Form 1040-NR.

This is a bounded product conclusion, not a statement about undisclosed workflows or every future edition. Forms, filing seasons and product capabilities change. Before paying for any software, check the supported-forms list for the exact tax year you are filing and look specifically for “Form 1040-NR.”

“Nonresident” is a tax classification, not a description of where you live

The Internal Revenue Service uses “alien” for an individual who is not a U.S. citizen or U.S. national. An alien is generally a nonresident alien for federal tax purposes if the person has not passed either the green card test or the substantial presence test. Citizenship, a foreign mailing address, a temporary visit, or owning property outside the United States does not by itself decide the result.

Green card test

A person who is a lawful permanent resident under U.S. immigration law generally meets the green card test. That person is ordinarily treated as a resident alien for tax purposes, even if they spend substantial time abroad, unless a specific rule changes the result.

Substantial presence test

The substantial presence test counts days of physical presence in the United States over a multi-year period using the formula in the applicable IRS guidance. The calculation can make someone a resident alien even without a green card. Exempt individual rules, closer-connection rules, and treaty provisions can affect the calculation, so do not decide from a simple day count copied from a travel calendar.

Exceptions, treaties and dual status

Some people who would otherwise meet a test are treated differently under an exception or an income-tax treaty. A person can also have dual-status treatment in a year that includes both a resident and nonresident period. These cases may require forms or statements beyond the ordinary resident or nonresident workflow. If your status changed during the year, check the instructions for that specific tax year or obtain professional advice before choosing software.

When a nonresident alien generally must file Form 1040-NR

The IRS states that a nonresident alien who is required to file an income tax return must use Form 1040-NR. Whether filing is required depends on the year, the type and source of income, tax withheld and any applicable exception.

U.S. trade or business activity

Engaging in a U.S. trade or business is a major filing trigger. This can include employment or independent business activity carried on in the United States. The tax treatment of connected income, expenses and treaty positions can require schedules that a basic Form 1040 product does not provide.

U.S.-source income not fully covered by withholding

A return may be required when you received U.S.-source income and the tax was not fully satisfied through withholding. The source and character of the income matter. Wages, scholarships, investment income, rental income and other payments can follow different rules, and a payer’s withholding does not necessarily settle the final liability.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Refund, deduction or credit claims

A nonresident may need to file to claim a refund of excess withholding or to claim a deduction or credit that is allowed under the applicable rules. A refund claim is not limited to people who owe additional tax; filing can be necessary to recover money already withheld.

Student, teacher and trainee exceptions

The instructions for Form 1040-NR describe an exception for some people in F, J, M or Q visa categories who are students, teachers or trainees and have no income subject to the specified U.S. tax provisions. This is not a blanket exemption for every international student or foreign citizen. Visa category, income, treaty terms and the tax year all matter. Read the relevant year’s instructions rather than relying on a general rule of thumb.

What TurboTax’s published forms information does—and does not—prove

The strongest evidence is the product’s own supported-forms information. The reviewed TurboTax Desktop list includes Form 1040 but omits Form 1040-NR. Its online product pages describe filing simple Form 1040 returns and its do-it-yourself page discusses Form 1040 filing. Those statements support the conclusion that the published materials do not show 1040-NR coverage.

They do not prove that every TurboTax product, hidden professional workflow or future tax-year release lacks the form. Nor does a general statement that software handles “U.S. taxes” establish nonresident support. Treat the omission as a reason to stop and verify, not as permission to substitute Form 1040 for Form 1040-NR.

Why filing the wrong form is a serious problem

Form 1040 and Form 1040-NR use different residency assumptions, income allocation rules and schedules. Filing a resident return when you were required to file as a nonresident can misstate taxable income, deductions, treaty benefits and tax withheld. It can also create correspondence or an amended-return burden. A software interview that accepts a foreign address or asks about a visa does not, by itself, demonstrate that the completed return is Form 1040-NR.

How to check a product before you buy or enter data

Use this verification sequence for the exact tax year, not a generic product homepage:

  1. Find the supported-forms page. Search the vendor’s official documentation for the precise label “Form 1040-NR.” Do not treat “international,” “expat,” “foreign address” or “nonresident” marketing language as equivalent.
  2. Confirm the income situations. Check coverage for your actual income, such as wages, scholarships, investment income, rental income, self-employment, effectively connected income and income subject to treaty positions.
  3. Check treaty and statement support. If you intend to claim a treaty article or attach an explanatory statement, verify that the product generates the required entries and attachments for your situation.
  4. Verify filing delivery. Determine whether the product supports electronic filing of Form 1040-NR for your year, or whether it produces a paper return and mailing instructions. Do not infer this from the product’s ordinary Form 1040 e-file option.
  5. Confirm identification and address handling. Check how the software handles an Individual Taxpayer Identification Number (ITIN), an application for an ITIN where allowed, a foreign address and U.S. withholding documents. A foreign address field alone is not evidence of 1040-NR support.
  6. Price the complete job. Include state returns, required attachments, ITIN services, professional review and any separate fees for amended or paper filings. A low advertised entry price may not cover a nonresident return.
  7. Save the evidence. Keep a copy or dated record of the supported-forms statement you relied on. Product pages can change during a filing season.

What to use if Form 1040-NR applies

If you determine that Form 1040-NR is required, choose a nonresident-focused tax service or a preparer that explicitly confirms support for your tax year and facts. TurboTax’s tax guide mentions Sprintax as software that can guide preparation of nonresident returns. That mention is an example from the guide, not an independent confirmation of current availability, price, partner status or coverage for your circumstances. Verify those details directly before entering personal information or paying.

Questions to ask a software provider or preparer

  • Will you produce Form 1040-NR for my exact tax year?
  • Can you handle my income types, treaty claim and required schedules?
  • Is electronic filing available for my situation, and if not, what paper-filing steps apply?
  • Can you help with an ITIN application or a return filed before an ITIN is issued?
  • How are foreign addresses, foreign tax information and U.S. withholding documents entered?
  • What review, support and amendment services are included in the total price?

Documents to assemble

  • Passport or other identity information needed for an ITIN process, if applicable.
  • Forms reporting U.S. wages, scholarships, interest, dividends, rents or other payments.
  • Records of days present in the United States and immigration or visa category.
  • Prior-year returns, withholding records and any treaty or residency statements.
  • Receipts and records for deductions or credits that a nonresident is permitted to claim.

E-file rules are not the same as software eligibility

The Form 1040-NR instructions state that paid preparers generally must electronically file returns for tax years ending on or after December 31, 2020. Exceptions include certain dual-status taxpayers, fiscal-year taxpayers, trusts and estates. This is a mandate directed at covered preparers; it does not mean every individual taxpayer must e-file in every circumstance.

Within a Form 1040-NR workflow, IRS instructions may say that e-file software determines which schedules are required. That statement assumes software that actually supports Form 1040-NR. It is not evidence that TurboTax supports the form. Ask who is responsible for transmission, what happens if e-file is unavailable, and how proof of timely filing is retained.

Common situations and the safer decision

Example facts Issue to resolve Safer software decision
Foreign visitor with no U.S. income and no filing trigger A return may not be required, but residency and income facts still control Do not buy software solely because you lived outside the United States; confirm whether a return is due
F-1 student with campus wages or scholarship income Visa exceptions may apply only to specified income and circumstances Check the year-specific 1040-NR instructions and use software that handles the applicable forms
Nonresident with U.S. wages and excess withholding A refund claim can require Form 1040-NR Verify 1040-NR and withholding support before filing
Person who became a resident during the year Dual-status rules may apply Confirm dual-status capability and professional review options
Nonresident with rental or business income Income allocation, expenses and connected-income rules can require multiple schedules Use a provider that lists your income type and required schedules explicitly

Mistakes to avoid and how to correct course

Assuming a foreign address makes you a nonresident

Address and tax residency are different questions. Apply the green card, substantial presence, exception and treaty rules before selecting a return.

Assuming every foreign student is exempt

The F, J, M and Q visa exception is limited. Review income and the exact wording of the applicable instructions.

Starting with the product instead of the form

First identify whether Form 1040, Form 1040-NR, a dual-status filing or no return applies. Then select software whose documentation names that form.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Relying on a prior year’s answer

Residency, filing thresholds, forms and software support can change. Recheck the instructions and supported-forms page for every tax year.

Submitting a Form 1040 because the interview allowed it

Stop before transmitting if the generated return does not match your required status. Ask the provider to confirm the form or move to a nonresident-capable preparer.

A practical decision path

  1. Determine whether you are a resident alien, nonresident alien or dual-status taxpayer under the IRS rules for the year.
  2. Determine whether income, business activity, withholding, refund, deduction or credit rules require a return.
  3. Identify the required return, usually Form 1040-NR for a filing nonresident alien.
  4. Check the prospective product’s official forms list for that exact form and tax year.
  5. Validate income, treaty, ITIN, address, e-file and review capabilities.
  6. Only then create the return, compare the generated form to your determination and retain a complete copy of the filing.

Bottom line

If you are required to file Form 1040-NR, the TurboTax materials reviewed do not show documented support for that return. Do not substitute a Form 1040 product because you are a U.S. taxpayer, have a foreign address or see an international-tax question in the interview. Establish your tax residency and filing obligation first, then choose software or a preparer that explicitly supports Form 1040-NR, your income and treaty circumstances, and the filing method required for the relevant year.
