Can Merchants Add a Card-Payment Fee to a Customer’s Bill?

Sometimes. In the United States, a merchant may generally add a surcharge to a credit-card purchase in many jurisdictions, but there is no nationwide yes-or-no rule. The result depends on the state and locality, the type of card, the reason for the fee, the amount, and what the customer was told before paying.

Card-network permission is only one layer. A fee can satisfy a network rule and still violate state law, a local rule, or a disclosure requirement. To judge a particular charge, identify where the transaction occurred, whether the fee was for choosing a card or for using a special payment channel, whether the card was credit, debit, or prepaid, and whether the total price and fee were clearly disclosed.

What “card-payment fee” can mean

People use one phrase for several legally different charges. The label on a receipt is useful, but the trigger for the fee matters more than the label.

Credit-card surcharge

Visa defines a surcharge as “an additional fee or charge that a merchant adds to a consumer’s bill for using a particular form of payment.” In practical terms, the customer pays more because the customer selected a credit card rather than another accepted method. State law may prohibit this charge, limit it, or require a particular way of displaying the total.

Convenience fee for another payment channel

Visa describes a convenience fee as a flat fee, clearly disclosed, for paying through an alternate channel that is different from the merchant’s usual payment channel. For example, a business might normally take payment in person but charge a separate amount for paying through a telephone or online portal. That is conceptually different from adding a percentage simply because the customer used a credit card. Local law can still treat the charge differently, so Visa’s description is not a substitute for a legal definition in your jurisdiction.

Debt-collector “pay-to-pay” fee

The Consumer Financial Protection Bureau uses pay-to-pay or convenience-fee language for a debt collector’s charge for making a payment through a particular channel, such as a website or telephone line. CFPB guidance says a collector may charge that fee only when the underlying agreement expressly authorizes it or applicable law affirmatively permits it. Do not assume this debt-collection rule governs every convenience fee charged by an ordinary retailer.

A mandatory fee built into the price

A business that accepts only credit cards may be treating its processing charge as unavoidable rather than as an optional card surcharge. California guidance, for example, says an avoidable credit-card processing fee generally does not have to be included in the advertised price under its hidden-fees analysis, but a fee is mandatory when credit cards are the only accepted payment method. That California position should not be generalized to other states.

Why the answer changes from one purchase to another

Six questions usually determine the analysis:

  • Where did the transaction occur? The governing state, city, or other locality may regulate surcharges differently, and an online transaction can raise a separate question about which jurisdiction’s law applies.
  • What triggered the charge? A fee for choosing a credit card is not the same category as a fee for using an alternate online or telephone channel.
  • What card was used? Visa’s U.S. surcharge guidance permits surcharging credit cards, not debit or prepaid cards. Other networks and laws may impose additional conditions.
  • How much is the fee? Network rules and statutes can cap the percentage or tie it to the merchant’s actual card-processing cost.
  • When was the customer told? A charge disclosed only after the card is run is much more likely to be problematic than one shown before the customer chooses to pay.
  • Who is charging it? A retailer, landlord, government office, and debt collector may operate under different statutes and exceptions.

Jurisdiction Official statement Important limit
Florida The 2026 Florida Statutes say a seller or lessor in a covered sale or lease may not surcharge a buyer or lessee for choosing a credit card instead of cash, check, or a similar method, subject to statutory exceptions. The rule is scoped to covered transactions and exceptions; it does not automatically decide every type of payment fee.
Kansas A 2026 Kansas statute allows a surcharge on a customer using a credit card when the amount is clearly and conspicuously disclosed at the point of entry or sale, in advance. Advance disclosure does not eliminate network requirements or other applicable laws.
New York General Business Law § 518 requires the total credit-card price, including any surcharge, to be clearly and conspicuously posted. The surcharge may not exceed the amount the business is charged by the card company for that use. The legislature page identifies February 16, 2024, as the most recent revision shown there. Confirm the current statute and any later court or administrative developments before relying on it.
Colorado In a July 29, 2026 announcement, the Colorado Attorney General described a 2% overall-payment cap and a disclosure requirement. The state determined that a 3.25% fee charged to renters using credit or debit cards in a Domuso rent-payment arrangement was an illegal surcharge. This was an enforcement announcement about a specific rent-payment arrangement, not a complete statement of every Colorado exception.
California The Attorney General discusses the effect of the 2018 Italian Colors appellate decision on enforcement of the state surcharge statute and warns against misleading consumers about the actual price. Separate current guidance addresses when an avoidable card-processing fee is mandatory for advertised-price purposes. California’s surcharge and price-display rules are legally nuanced; “California allows” or “California bans” is too broad without stating the transaction and fee structure.

Visa’s conditions for a U.S. merchant that wants to surcharge

Visa’s U.S. merchant Q&A describes a compliance process that is separate from state-law analysis. A merchant choosing to surcharge should work through all of these requirements:

  1. Notify the acquiring bank. Visa’s merchant guidance calls for notice to the acquirer at least 30 days before starting. The public Visa Core Rules edition dated April 2026 says the acquirer must ensure written notice at least 30 calendar days before the merchant publicly announces or first assesses a surcharge, whichever happens first.
  2. Limit the card type. The Visa guidance applies the surcharge to credit cards only. Debit and prepaid cards may not be surcharged under that U.S. guidance.
  3. Stay within the cap. The surcharge may not exceed the merchant’s applicable discount rate or 3%, whichever is lower, according to the U.S. merchant Q&A. A state or locality may impose a lower limit or prohibit the fee altogether.
  4. Identify it as a merchant fee. The customer-facing language should make clear that the amount is a merchant-imposed surcharge rather than a government tax or a card-network charge.
  5. Display it at every required stage. Visa’s guidance calls for a clear notice at the business entrance, at the point of sale or transaction, and on every receipt. The amount or rate should be understandable before the customer commits to payment.

These are network conditions, not legal advice. Visa’s own materials caution that a state-law list and network guidance do not determine whether a fee is lawful in a particular place.

How to check a fee on your own bill

  1. Locate the transaction. Note the store, service address, delivery location, or online checkout terms and the date. The relevant jurisdiction can depend on the transaction structure.
  2. Read every price notice. Compare the advertised price, checkout screen, posted sign, invoice, and receipt. Record the exact wording, percentage or flat amount, and when it first appeared.
  3. Identify the trigger. Ask whether the fee appeared because you selected a credit card or because you used a separate online, telephone, or other payment channel.
  4. Identify the card. Check whether the instrument was a credit card, debit card, or prepaid card. A fee described as a credit-card surcharge may not be valid when the transaction actually ran as debit.
  5. Calculate the charge. Compare the fee with the disclosed rate and the underlying purchase amount. In a jurisdiction that ties the charge to the merchant’s processing cost, an unexplained amount above that cost may matter.
  6. Check for special parties. If the bill is from a debt collector, find the original agreement and any applicable law. CFPB guidance requires express contractual authorization or affirmative legal permission for a pay-to-pay fee.
  7. Ask for a written explanation. Request the merchant’s description of the fee, the payment method it applies to, and the rule or contract provision it relies on. Keep the response with the receipt and screenshots.

What to do when the fee appears improper

Start with the merchant or biller because an incorrect payment setting can sometimes be fixed without a formal dispute. State specifically whether the problem is a missing disclosure, a debit or prepaid transaction treated as credit, a percentage that exceeds a stated cap, or a fee that appeared only after payment.

If the business will not correct a charge, use the consumer-protection or attorney-general complaint process for the jurisdiction where the transaction occurred. California’s Attorney General, for example, accepts complaints about misleading or improperly charged fees while noting that its office cannot provide individual legal advice. A local regulator may be more appropriate for a city-specific rule.

Keep the original receipt, screenshots of the checkout page, photographs of posted notices, the card statement, and your written communications. Those records establish what the customer could see before paying, which is often as important as the amount itself.

What merchants should verify before adding a fee

A merchant should not install a surcharge setting first and investigate legality later. The safer sequence is:

  • Identify the state and local rules for the locations and channels in which the business sells.
  • Separate credit transactions from debit and prepaid transactions in the point-of-sale configuration.
  • Decide whether the proposed amount is a surcharge for card choice or a convenience fee for an alternate channel.
  • Check the applicable network rule, the merchant agreement with the acquirer, and any statutory cap. Under Visa’s cited U.S. guidance, the ceiling is the merchant discount rate or 3%, whichever is lower.
  • Prepare entrance, checkout, and receipt disclosures that state the fee before payment and identify it as a merchant fee.
  • Send the required written notice to the acquirer at least 30 calendar days before public announcement or first assessment, whichever occurs first, under the April 2026 Visa Core Rules edition.
  • Retain dated copies of signs, website language, receipts, and configuration changes so the business can show what customers were told.

Passing a network review does not prove compliance with state or local law. A merchant should obtain jurisdiction-specific legal advice when the transaction involves rent, government payments, regulated services, remote sales, or a disputed statutory exception.

Do not confuse merchant surcharges with the CFPB’s penalty-fee rule

The CFPB says its credit-card penalty-fee final rule was vacated by court order on April 15, 2025. That development concerns penalty fees charged by card issuers to cardholders. It does not answer whether a retailer, landlord, service provider, or debt collector may add a payment fee to a customer’s bill.

Bottom line

A merchant can sometimes add a card-payment fee, but legality depends on the jurisdiction, payment instrument, fee type, amount, and advance disclosure. Treat any nationwide yes-or-no answer as unreliable. Examine the bill and the transaction location first, then apply the specific state, local, network, or debt-collection rule that fits the charge.
