In India, the Chief Commissioner of Income Tax (CCIT) or Director General of Income Tax (DGIT) may consider reducing or waiving interest charged under Sections 234A, 234B and 234C when the facts fall within the administrative framework issued by the Central Board of Direct Taxes (CBDT). Relief is not automatic, and a difficult financial situation by itself is not a general exemption.
The official guidance reviewed for this article was accessed on 13 October 2026. The relevant assessment year, version of the Income-tax Act and current administrative instructions must be checked before a request is made.

What a waiver under Sections 234A, 234B and 234C actually means
Interest under these provisions is normally calculated when a taxpayer files late, pays too little advance tax or pays advance-tax instalments late or in insufficient amounts. A waiver request asks the competent authority to reduce or remove some or all of that interest under specified administrative circumstances. It is not the same as disputing the underlying tax, and it is not an automatic right that follows whenever a taxpayer can show hardship.

CBDT’s clarification says that requests are to be considered within the parameters of its order dated 23 May 1996, read with the order dated 30 January 1997. It also makes clear that a claim based only on the earlier press note dated 21 May 1996 is not sustainable. The referenced administrative material includes CBDT Order F. No. 400/234/95-IT(B), dated 30 January 1997, and Circular No. 783 dated 18 November 1999.
Identify which section created the interest
Your demand notice or tax computation should show the section involved. The three provisions address different defaults, so a request should explain the particular charge instead of referring generally to “tax interest.” The statutory wording and calculation rules can change by assessment year; verify the law applicable to the year in question before recalculating anything.
| Section | Default generally covered | What to examine |
|---|---|---|
| 234A | Furnishing the income-tax return after its due date, or not furnishing it by the due date | The prescribed return due date, the actual filing date and the period for which interest was charged |
| 234B | Failure to pay sufficient advance tax | Whether the advance-tax requirement was met and how the shortfall was calculated |
| 234C | Deferment or shortfall in one or more advance-tax instalments | Which instalment was short or late and whether a statutory exception applies |
Because the triggers differ, evidence that explains a late return may not explain an advance-tax shortfall. Match the facts, dates and records to the section shown in the demand.

Books or cash seized in a search
If books of account or cash were seized during a search and the seizure caused a delay in filing the return or paying advance tax, the resulting interest may be considered for reduction or waiver. The request should connect the seizure to the specific delay and identify the assessment year and tax affected.
Unexpected income after an advance-tax instalment date
Income that was received or accrued unexpectedly after the due date of an advance-tax instalment is another listed circumstance. The relevant issue is timing: the income could not reasonably have been included when that instalment was due, and the later receipt or accrual increased the eventual liability.
Retrospective law or a later court decision
A retrospective amendment, or a Supreme Court or High Court decision, can produce a higher tax liability after the taxpayer’s earlier payment decisions were made. The guidance allows the resulting interest to be examined within the prescribed limits. A taxpayer still has to establish the legal change, the date it took effect for the assessment and the additional tax attributable to it.
Unavoidable circumstances preventing a timely return
The Department also lists unavoidable circumstances that prevented timely filing of the return. This is not a blanket relief for inconvenience or cash-flow difficulty. The explanation should show what happened, why it could not reasonably be avoided, how it prevented timely filing and when the obstacle ended.

Authority and conditions that apply
The authority identified for considering a reduction or waiver is the CCIT or DGIT. The guidance does not say that an Assessing Officer can routinely waive these charges. The designated authority acts under the CBDT framework and prescribed conditions.
The Department’s summary states that the taxpayer must:
- File the return for the relevant assessment year.
- Disclose the relevant income.
- Pay the tax due, including the amount attributable to the disclosed income.
These conditions are separate from the factual ground for relief. Showing that income arose unexpectedly, for example, does not replace the requirement to file, disclose and pay. Keep proof of the filing date, disclosure in the return and payments made, because the authority must be able to determine both the underlying liability and the interest affected.
Special treatment where a court order creates the income
The Department describes a specific way to examine interest when income arises because of a court order after the end of the relevant year. The potentially relevant period differs by section:

- Section 234A: from the return’s due date through the end of the month in which the relevant court order is made.
- Section 234B: from 1 April of the assessment year through the end of that same month.
- Section 234C: the specific period referred to in Section 234C for the applicable advance-tax instalments.
The amount described by the guidance is the difference between interest calculated on total income including the income arising from the court order and interest calculated on total income excluding that income, for the relevant period. This is a method for identifying the potentially affected amount, not a guarantee that the authority will grant relief or that every case will be treated identically.
Section 234C can have a statutory exception, not just a waiver request
Section 234C contains statutory exceptions for certain income that could not be estimated in time for the relevant advance-tax instalment. The categories identified in the Department’s material include:
- Capital gains.
- Specified casual income.
- Income from a business or profession begun for the first time.
- Dividend income.
The exception is subject to the statutory conditions, including timely payment of the tax attributable to that income. This route is analytically different from discretionary relief: an exception operates because the section itself provides for it when its requirements are met, while a waiver request asks the CCIT or DGIT to exercise administrative discretion. Check the wording for the relevant assessment year before relying on an exception.
How to prepare and submit a request
The official material establishes the competent authority and the circumstances and conditions it should consider. It does not establish one universal application form, a single portal workflow, a standard mailing address, a mandatory document checklist or a guaranteed processing time. Do not assume that an online request or a form used in one jurisdiction is accepted everywhere.

A prudent preparation sequence is:
- Confirm the assessment year and demand. Obtain the intimation, assessment order or demand notice that shows the interest amount, the section or sections involved and the tax that remains payable.
- Separate the charges. Break the demand into 234A, 234B and 234C components. Record the dates and amounts used for each calculation and identify whether any part may instead be a Section 234C statutory exception.
- Write the factual explanation. State the event, its date, how it affected filing or advance-tax payment and why it fits one of the Department’s listed categories. For a court-order case, identify the order and the income it created or increased.
- Reconcile the tax. Show that the return was filed, the relevant income was disclosed and the due tax was paid. Include payment dates and challan or other payment references that allow the figures to be checked.
- Calculate the amount at issue. Use the assessment-year rules to show the interest charged and, where relevant, the difference attributable to the income or period covered by the request. Do not use a historical interest rate without verifying that it applies to the year.
- Retain supporting records. Keep search or seizure records, correspondence, financial statements, payment evidence, documents showing when income accrued, the relevant court order or legal amendment and records of circumstances said to be unavoidable.
- Confirm the correct submission route. Contact the competent tax office or a qualified Indian tax professional to confirm where and how the request should be lodged for that assessment year and jurisdiction. Treat that confirmation as procedural guidance for the particular case, not as a Department-wide form requirement.
- Monitor the matter and keep proof. Preserve a copy of the request and delivery or acknowledgement evidence. Because no uniform processing time is established in the official material, do not rely on an assumed deadline for a decision when managing an outstanding demand.
Records that make the explanation verifiable
The authority’s decision is discretionary, so a clear chronology is more useful than a general statement that the delay was unavoidable. Organise records around the element you must prove:
- Search-related delay: search and seizure documentation, dates on which books or cash were unavailable, and the resulting filing or payment timeline.
- Unexpected income: agreements, orders, receipts or other records showing when the income was received or accrued and why it was not known by the instalment date.
- Retrospective change or judgment: the amendment or judgment, its effective date and a computation isolating the additional liability.
- Unavoidable filing obstacle: contemporaneous records showing the event, its duration and the steps taken to file once it ended.
- Compliance conditions: the filed return, disclosure of the relevant income and proof that tax due was paid.
This list is practical preparation, not a published mandatory checklist. The exact records requested can depend on the case and the office handling it.
Common mistakes to avoid
- Calling hardship an entitlement: the framework lists specific circumstances; it does not create a general waiver for financial difficulty.
- Applying to the wrong authority: the Department identifies the CCIT or DGIT for this relief. Do not assume an Assessing Officer can routinely cancel the interest.
- Ignoring the section: the explanation for a late return under 234A may not address an instalment shortfall under 234C.
- Using the 21 May 1996 press note alone: CBDT’s clarification says that such a claim is not sustainable; the 23 May 1996 and 30 January 1997 orders must be considered.
- Leaving tax or disclosure incomplete: filing, disclosure and payment of due taxes are stated conditions.
- Confusing a statutory exception with discretion: a Section 234C exception must satisfy the section’s own requirements; it is not the same as asking for a discretionary waiver.
- Assuming current procedures from an old case: forms, offices and filing channels can vary. Confirm the current route for the assessment year and jurisdiction.
Check the law for the particular assessment year
Interest rates, due dates, statutory language and advance-tax rules are year-specific. The Department’s public guidance is a starting point, but the applicable Income-tax Act provisions and administrative instructions should be checked for the assessment year shown on the demand. This is especially important when a court order, retrospective amendment or Section 234C exception is involved.
Recommended Free Tools
No published approval percentage or application count is established in the official material. Consequently, nobody can responsibly promise that a listed circumstance will succeed or quote a standard success rate. The safest approach is to file a fact-specific explanation only after the return, disclosure and tax-payment conditions have been met and the correct authority and submission route have been confirmed.
