In most cases, the collector must sue you, obtain a court judgment (including a default judgment if you do not respond), and then secure a garnishment order. Your employer can withhold wages only after receiving that legal order. State law may limit garnishment more than federal law.
What must happen before wages can be garnished?
A collection letter or phone call does not authorize payroll deductions. The usual sequence is a lawsuit, a judgment, and a separate enforcement step.

- The account becomes delinquent. The creditor may assign or sell the balance to a debt collector, but delinquency alone does not let the collector take money from your paycheck.
- A lawsuit is filed and served. The complaint and summons tell you that a court case has started and give you a deadline to respond. Service requirements and response periods vary by state.
- The court enters a judgment. A judgment is the official result of the lawsuit. It can include the principal balance plus interest, permitted fees, and collection costs. If you ignore the case, the creditor may obtain a default judgment without presenting your side.
- The creditor requests a garnishment order or writ. This is the court process directing an employer to withhold part of your earnings and send it to the creditor or its lawyer.
- The employer receives the order. Payroll then calculates the legally permitted amount and continues deductions until the judgment, interest, and allowable costs are paid or the order ends.
The Federal Trade Commission summarizes the rule this way: “Yes, but the collector must first sue you to get a court order — called a garnishment — that says it can take money from your paycheck to pay your debts.”
What if you ignore the collection lawsuit?
Ignoring a summons is one of the fastest ways to turn a disputed account into an enforceable judgment. The court may accept the collector’s allegations as uncontested and enter a default judgment. After that, the creditor can seek wage garnishment or a levy against a bank account, subject to exemptions and limits.

If the amount, ownership, payment history, identity, or statute of limitations is wrong, state those defenses in the response rather than relying on a phone call.
How much of a paycheck can be taken?
The federal Consumer Credit Protection Act (CCPA) applies in all 50 states, the District of Columbia, and U.S. territories. For an ordinary consumer-credit judgment, the weekly maximum is the lesser of:
- 25% of your disposable earnings; or
- the amount by which your disposable earnings exceed 30 times the federal minimum wage.
“Disposable earnings” are what remains after deductions required by law, such as federal, state, and local taxes and your employee share of Social Security, Medicare, and state unemployment taxes. Voluntary deductions, including many retirement contributions, insurance premiums, union dues, and similar elections, generally are not subtracted when the garnishment calculation is made.

| Weekly disposable earnings | 25% calculation | Amount above $217.50 | Maximum under the federal lesser-of test |
|---|---|---|---|
| $200 | $50 | $0 | $0 |
| $250 | $62.50 | $32.50 | $32.50 |

| $400 | $100 | $182.50 | $100 |
These are federal ceilings, not guaranteed deductions. A state may prohibit wage garnishment for some consumer debts, protect a larger share of earnings, or use a different formula. When state law is more protective, the lower amount applies. The order or the notice from your employer should identify the authority being used, but you may need legal help to challenge an incorrect calculation.
Which debts use different garnishment rules?
The 25% CCPA limit described above is for ordinary debts such as credit-card judgments. It does not apply in the same way to several government or family-support categories.
| Debt or order | How it differs from ordinary credit-card collection |
|---|---|
| Child support or alimony | Separate federal and state formulas can allow substantially higher withholding. |
| Federal or state tax debt | Tax authorities can use special administrative collection powers and exemptions. |
| Certain Chapter 13 bankruptcy orders | Bankruptcy plan payments follow bankruptcy rules rather than the ordinary consumer-credit cap. |
| Credit-card or other consumer judgment | Generally subject to the CCPA lesser-of test, plus any stricter state protection. |
Do not apply a child-support, tax, or bankruptcy rule to a credit-card account, or assume that a credit-card collector has those broader powers.

| Feature | Paycheck garnishment | Bank-account levy |
|---|---|---|
| Who receives the order? | Your employer or payroll processor | Your bank or credit union |
| What is taken? | A portion of each pay period’s disposable earnings | Money already in the account when the levy is processed, subject to protected funds and exemptions |
| What notice may show? | A wage-garnishment notice, employer letter, or payroll statement | A levy, restraint, freeze, or turnover notice from the bank or court |
| Main timing issue | Future paychecks are reduced until the order ends | Funds can be frozen quickly, sometimes before you can spend them |
Inspect the notice to determine which process is being used. A wage order does not automatically authorize a bank levy, and a bank levy does not use the same disposable-earnings calculation.
Can collectors garnish Social Security, VA benefits, or other federal benefits?
Many federal benefits are generally exempt from court-ordered garnishment for ordinary credit-card debts. The FTC lists Social Security, Supplemental Security Income (SSI), veterans’ benefits, federal student aid, military annuities and survivors’ benefits, Office of Personnel Management benefits, railroad retirement benefits, and federal emergency disaster assistance among benefits that are usually protected.
Protection is not absolute. Exceptions can include delinquent federal taxes, child or spousal support, and federal student-loan obligations. State exemptions may also protect other funds or provide additional procedures.
Recommended Free Tools
When covered federal benefits are deposited directly into a bank account, banks generally must automatically protect two months of those deposits before freezing or garnishing additional money. The bank reviews the account history to identify the protected amount. Mixed funds, older deposits, and disputed ownership can require a court decision, so keep benefit statements and deposit records.

What collectors may not say or do
A collector cannot lawfully threaten wage garnishment when your wages cannot legally be garnished. The Consumer Financial Protection Bureau states that threatening garnishment in that situation violates the Fair Debt Collection Practices Act (FDCPA). The FTC also says collectors cannot falsely claim that legal action has been taken or threaten action they do not actually intend or have authority to pursue.
A threat is not the same as an order. Ask for the collector’s name, company, mailing address, account information, and the court case number if a lawsuit supposedly exists. Do not provide bank-account or employment details merely because a caller demands them. Save voicemails, letters, emails, caller-identification records, and notes of dates and statements.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.What to do at each stage
If you have received only threats or collection letters
- Request written validation information and compare the claimed balance with your records.
- Ask whether a lawsuit has actually been filed, and verify any case through the court named in the paperwork.
- Do not promise payment or make a small payment on an old debt until you check your state’s statute-of-limitations rules; in some states, an acknowledgment or payment can affect the limitations period.
- Report a false garnishment threat to the CFPB, the FTC, or your state consumer-protection authority, and consult a consumer-law attorney if the conduct continues.
If you have been served with a complaint and summons
- Calendar the answer deadline immediately.
- File an answer or other permitted response with the court and serve the plaintiff as required.
- Check whether the plaintiff can prove the account, the balance, its ownership of the debt, and your identity.
- Raise the statute-of-limitations defense if applicable; a collector may not sue on a time-barred debt, but you generally must assert the defense when sued.
- Seek help from a consumer-law attorney, your state bar’s referral service, or a legal-aid office if you cannot afford counsel.
If a judgment or wage order has already been entered
- Read the order for the judgment amount, interest rate, fees, start date, employer, and claimed exemption procedure.
- Compare the withholding with your disposable earnings and the federal lesser-of test.
- Check your state’s lower limits, protected-income rules, hearing rights, and deadline for filing an exemption claim or objection.
- Give payroll and the court accurate information if the order identifies the wrong person, employer, amount, or debt.
- Keep every paycheck stub showing the deduction so you can document over-withholding.
If your bank account has been frozen
- Identify whether the notice is a levy connected to a judgment or another legal process.
- Notify the bank promptly that the account contains Social Security, SSI, VA, or other potentially protected benefits.
- Gather two months or more of statements showing the source and dates of deposits.
- Follow the notice’s procedure for claiming exemptions or requesting a hearing; deadlines can be short.
- Ask legal aid or a consumer-law attorney to review mixed deposits, joint accounts, and any funds the creditor claims are nonexempt.
How old debt affects the risk
Each state sets its own statute of limitations, and the period can differ by debt type. A contract may also contain a governing-law clause that creates another issue. The limitations period is separate from the time a judgment remains enforceable.
Before admitting the debt, signing a payment agreement, or making a payment on an old account, check the law where you live. The FTC says a collector may not sue on a time-barred debt, but if you are sued, you should raise that defense in your answer. A collector’s statement that it plans to sue is not proof that the claim is still timely.

Why your state matters
Federal law supplies a baseline, not a single nationwide answer. State or territorial law can control:
- whether ordinary consumer wages may be garnished at all;
- the percentage or dollar amount protected;
- which earnings and benefits are exempt;
- the forms and deadlines for claiming an exemption;
- notice, service, and hearing requirements;
- which creditor receives priority when several orders exist; and
- how long a judgment can be enforced.
Before relying on a number, identify your state or territory, the type of debt, whether the case is pending or already reduced to judgment, and whether the money is wages, benefits, or funds in a bank account. Use current information from your court, attorney general, state bar referral service, or legal-aid program. Do not assume that a rule from another state applies to you.
Records to preserve
- Every complaint, summons, judgment, garnishment writ, levy notice, and exemption form
- Collection letters, emails, text messages, and detailed call notes
- Credit-card statements, payment history, settlement offers, and proof of payments
- Pay stubs showing required deductions and any withholding
- Bank statements identifying benefit deposits and account balances
- Proof of identity, address, employment, and any documents showing the debt is not yours
Organized records help a lawyer, legal-aid advocate, court clerk, or exemption hearing officer determine whether the debt, procedure, amount, and protected funds are correct.
