Yes. A technical resignation can affect whether your earlier service counts toward pension, but it does not automatically preserve every pension benefit. The result depends on the governing service rules, the reason and destination of the move, whether you obtained permission through the proper channel, and how the gap between appointments was authorised.
The evidence discussed here concerns Indian Central Government service under Department of Personnel and Training (DoPT) guidance. State-government employees, private-sector workers, employees covered by another country’s system, and members of a different pension arrangement must check their own rules.

What “technical resignation” means
In DoPT training material, a technical resignation is described as leaving one government appointment to take another appointment in government, a public-sector undertaking (PSU), a bank or an autonomous body after obtaining the required permission. The application is handled through the proper channel, and the employee is relieved for the new appointment.

That description is important because the label on a resignation letter is not decisive. A departure for personal reasons, a move to an unrelated employer, or an application submitted without the permission required by the service rules may be treated as an ordinary resignation instead. The receiving organisation, the employee’s cadre and service rules, and the documents issued by the original employer all matter.

Technical resignation is also distinct from lien. DoPT reports discuss the two subjects together, but a reference to lien does not by itself prove that an employee has a right to retain a post or a pension benefit. Any lien entitlement must be checked under the current rules for the employee’s service.
Ordinary resignation versus technical resignation
The DoPT training explanation draws a sharp distinction between the two situations. Use the table as a framework, not as an individual pension determination.
| Issue | Ordinary resignation | Technical resignation |
|---|---|---|
| Reason and destination | Leaving without the qualifying move described in DoPT material, or without the required permission. | Moving to another government, PSU, bank or autonomous-body appointment with proper permission, as described in the training material. |
| Past qualifying service | DoPT training material says resignation ordinarily entails forfeiture of past qualifying service. | Eligible past qualifying service may be counted as an exception, subject to the applicable rules and conditions. |
| Permission and records | No qualifying permission or an incomplete record can undermine the technical-resignation treatment. | The forwarding permission, relieving order and receiving appointment should establish that the move was authorised. |
| Gap between appointments | There is no special technical-resignation treatment to rely on. | Joining time, leave and any formal condonation must be dealt with under the governing rules; an unauthorised interval may not count. |
| Certainty of pension outcome | The stated forfeiture rule is subject to the pension scheme and service rules in force. | Not guaranteed. The individual record and the current consolidated instructions determine the result. |
Why qualifying service is the key pension issue
Pension calculations generally depend on service that the applicable rules recognise as qualifying service. If an ordinary resignation causes earlier qualifying service to be forfeited, that earlier period may no longer be available for whatever pension entitlement is based on service length. The DoPT material presents technical resignation as an exception that can allow eligible earlier service to remain countable.

This does not mean that technical resignation fixes the pension amount, preserves every allowance, or guarantees immediate payment. The evidence available does not establish a universal formula for pension amounts, treatment of every contribution, or the rules of every pension arrangement. It supports a narrower conclusion: the classification of the resignation can determine whether earlier qualifying service is retained for consideration under the applicable scheme.

Check whether the new appointment is covered by the same pension framework, a different government framework, or another arrangement entirely. A service period can be recognised for one purpose while a separate benefit, contribution or retirement-age rule is governed elsewhere.
How the interval between jobs can change the result
The DoPT training illustration treats the break between appointments as a separate issue. Permissible joining time and authorised leave can cover parts of the interval. Where leave was not granted, the illustration describes formal condonation of the interruption. The intervening period itself is not counted as service in that example.
That illustration should not be read as a universal entitlement to have any gap condoned. The authority competent to grant leave or condonation, the maximum period allowed, the reason for the delay and the wording of the applicable rules all have to be verified. A technical-resignation classification does not erase an unapproved absence automatically.

Which DoPT instructions are relevant
DoPT’s Annual Report 2013–14 refers to earlier consolidated instructions on technical resignation and lien under Office Memorandum (OM) 28020/1/2010-Estt(C), dated 26 December 2013. DoPT’s Annual Report 2022–23 refers to consolidated instructions under OM 1669266628362, dated 24 November 2022.
Rank #3
The 2022–23 report identifies the OM number and date but does not reproduce the memorandum’s operative text. Because the full text and any later amendments must be checked before a decision is made, do not rely on a summary, an old office order or an informal description as the final authority. DoPT induction material current as of 1 July 2025 lists technical resignation and lien among the department’s personnel-policy responsibilities; that confirms the subject remains within DoPT’s remit, but it does not replace the applicable rule.
What to do before submitting a resignation
- Confirm the jurisdiction. Establish that you are in Indian Central Government service and identify your department, cadre and pension arrangement. If you are in state service or another system, stop and obtain the corresponding rules.
- Read the current consolidated OM. Obtain the complete text of OM 1669266628362 dated 24 November 2022 and check whether a later instruction, amendment or departmental order applies. Compare it with the rules governing your pension scheme.
- Verify the destination appointment. Keep the offer or appointment order and confirm that the receiving organisation falls within the category recognised by the applicable rules.
- Check proper-channel permission. Ensure that the original employer accepted and forwarded the application in the required manner. Keep the permission, forwarding endorsement and any department-specific approval.
- Ask for the correct relieving wording. Before you leave, ask the personnel section how the order will describe the resignation and whether it will identify the move as technical resignation under the relevant rule.
- Plan the joining dates. Obtain written information about permissible joining time, leave and the date by which you must report to the new post.
- Resolve any expected gap. If the dates cannot connect, apply for the relevant leave or condonation before the gap occurs where the rules require advance approval. Do not assume that a later explanation will regularise an unauthorised absence.
- Request a service-record check. Ask the personnel and pension sections to confirm how your earlier qualifying service and the interruption will be entered in the service book and related records.
Documents that can protect your position
Keep a single file, physical or electronic, containing the documents that prove both the purpose of the move and the treatment of the service interval:
- The new appointment or selection letter.
- Your application and the original department’s proper-channel forwarding or permission.
- The resignation letter and the relieving order.
- Orders granting joining time, leave or condonation, if applicable.
- The old employer’s service-book entries or certified service statement.
- Your joining report at the new organisation.
- Written replies from the personnel, accounts or pension authority explaining how qualifying service is being carried forward.
- Any later correction or clarification issued by either employer.
These records do not create an entitlement on their own. They make it possible for the competent authority to apply the rules consistently and give you evidence if the service history is recorded incorrectly.
How the process can fail
The resignation is called “technical” but permission is missing
An employee may accept a new appointment first and then describe the departure as technical resignation. If the original application was not forwarded through the required channel, the facts may fit ordinary resignation instead. Ask the personnel section to identify the permission rule and confirm compliance in writing.

The receiving employer is outside the recognised category
A move to an organisation that is not covered by the applicable definition may not receive the exception described in DoPT training material. Do not infer coverage merely because the organisation is government-owned, regulated or funded by public money; obtain a rule-based determination.
The dates leave an unregularised interruption
Even where the move itself qualifies, an unauthorised break can affect how service is counted. Reconcile the relieving date, joining date, sanctioned leave and any condonation order before pension papers are prepared.
The record uses inconsistent wording
If the resignation order, service book and new joining report describe the move differently, the pension authority may seek clarification. Request correction while both personnel offices can still verify the underlying documents.

Questions to put to your personnel or pension authority
- Does my appointment and destination fall within the current technical-resignation rule?
- Was my application forwarded through the proper channel, and is that permission recorded?
- Will the relieving order explicitly record technical resignation under the applicable provision?
- Which parts of my interval are covered by joining time or sanctioned leave?
- If a remaining interruption exists, who can condone it and what order is required?
- Will my earlier service be entered as qualifying service in the new record?
- Which pension rules govern the new post, and do they change how the earlier service is used?
- Which current OM, amendment or departmental order supports the answer?
Request written answers rather than relying on an oral assurance. If the authority cannot decide the issue, ask which competent office must issue the determination and submit the complete record there.
If you are not in Indian Central Government service
The DoPT material does not establish rules for state governments, private employers, overseas public services or every pension arrangement in India. A phrase such as “technical resignation” may have a different legal meaning elsewhere, or may not exist at all.
Identify four things before applying the DoPT explanation to your case: your country and level of government, the employer you are leaving, the employer you are joining, and the pension or retirement scheme that covers each period. Then obtain the current service rules and ask the relevant personnel or pension authority how a transfer, resignation or break is treated. Do not assume that a Central Government rule follows you into a state service or a non-government job.
A practical decision checklist
Your earlier service is most likely to receive the technical-resignation treatment described by DoPT only when all of the following are documented:
- The move is to an appointment recognised by the applicable rule.
- The application was made and forwarded with the required prior permission.
- The original employer formally relieved you for that appointment.
- The new employer’s appointment and joining records match the dates.
- Joining time and leave cover the authorised parts of the interval.
- Any remaining interruption has a valid condonation order.
- The current consolidated instructions and pension rules confirm that the earlier period is eligible to count.
If one item is uncertain, treat the pension outcome as unresolved until the competent authority reviews the documents. The safest course is to obtain that review before submitting an irreversible resignation or allowing a service gap to arise.
