Yes—sometimes. In a state that permits voter initiatives on tax legislation or constitutional amendments, voters can approve a measure that creates, raises, lowers, or restructures a tax without lawmakers first voting on that specific tax change. California’s official 2018 voter guide states that “The voters—through the initiative process—can pass new taxes or increase existing taxes without the Legislature’s involvement.” That is a California explanation, not a rule for every state. Your answer depends on the state constitution, election statutes, the type of ballot measure, the level of government, and the vote threshold.
What “without a legislative vote” actually means
A citizen initiative is the clearest example. Eligible voters draft or sponsor a proposal, collect the required signatures, qualify it for the ballot, and then vote on it. If the measure passes, it can become a statute or constitutional amendment under that state’s rules. The legislature need not approve the tax language beforehand.

That is different from a legislative referral. In a referral, lawmakers adopt a proposal or vote to place it before voters. Voters make the final decision, but legislative action was part of the process. It is also different from an ordinary tax bill, in which lawmakers change the law directly and voters may have no role at all.
| Route | Who starts it? | What voters decide | Is a legislative vote on the tax required? |
|---|---|---|---|
| Voter initiative | Eligible voters, petition sponsors, or an initiative committee | Whether to enact the proposed statute or amendment | Not necessarily; state law controls |
| Legislative referral | The legislature | A proposal lawmakers referred to the ballot | Yes, to refer the measure |
| Legislative tax bill | Lawmakers | Usually nothing, unless the state separately requires voter approval | Yes |
“Tax” also has a legal meaning that may differ from everyday usage. California’s 2018 official voter guide noted that some charges called fees can fall within the state constitutional definition of a tax. A measure described as a fee increase therefore may still trigger tax-related approval rules.

Why the answer differs from state to state
States write their own rules for initiatives, tax enactment, constitutional amendments, signature collection, ballot language, and vote thresholds. Some states allow initiatives only for statutes; others permit constitutional initiatives as well. Some restrict tax initiatives, require a supermajority, or reserve particular subjects for the legislature.
Before deciding whether a measure can change your taxes, identify four things:
- Government level: state, county, city, school district, or another special district.
- Legal text: a statute, a constitutional amendment, or a rule that controls future tax votes.
- Initiator: citizens, legislators, or both.
- Approval rule: the required legislative vote, voter percentage, signature threshold, and any special timing rules.
A nationwide “yes” or “no” is therefore misleading. The reliable answer comes from the state constitution, current election code, official ballot text, and the nonpartisan fiscal analysis for the particular measure.

California illustrates how a direct voter tax change works
California provides a well-documented example. In the Legislative Analyst’s analysis in the California Secretary of State’s 2018 Official Voter Information Guide, voters were told that the legislature could pass a new or increased state tax with a two-thirds vote and generally did not need voter approval. The same guide explained that voters, through the initiative process, could pass new taxes or increase existing taxes without legislative involvement.
In practical terms, California can have two separate paths:

- Lawmakers pass a state tax bill, subject to the state’s legislative vote requirement.
- Voters qualify and approve a tax initiative, without the legislature first passing that tax.
Those paths should not be confused with a legislative referral, where the legislature still acts before the public votes.
Statutory initiative versus constitutional initiative
The legal form matters after election day. A statutory initiative adds or changes ordinary statutory law. A constitutional initiative changes the state constitution and can establish rules that later legislatures must follow.

A 2009 California Assembly Revenue and Taxation Committee reference explains the basic mechanics: constitutional amendments may reach the ballot through a legislative proposal or a voter initiative, and an initiative constitutional amendment takes effect when approved by a majority of voters voting on it. The same reference described signature thresholds of at least 8% of votes cast in the previous gubernatorial election for an initiative constitutional amendment and at least 5% for an initiative statute. Those percentages are historical figures from that 2009 reference, not current filing instructions; anyone qualifying a measure should verify today’s thresholds with the California Secretary of State.
The reference also explains an important durability distinction. A voter-enacted initiative tax statute generally can be changed only by another vote of the people, although some initiative statutes expressly permit specified legislative amendments. A constitutional tax provision requires a constitutional amendment to change. The actual text of the measure controls, so readers should not assume every initiative has the same amendment protection.
What a tax ballot measure can change
A measure does not have to be a simple “raise” or “cut.” It may change the tax rate, base, exemptions, collection date, distribution formula, authorization for borrowing, or the vote needed for later tax changes. It can also repeal an existing tax or impose voter approval on future increases.

California Proposition 6 (2018): repeal plus a future-vote requirement
California Proposition 6 was an initiative constitutional amendment on the 2018 ballot. The official voter guide described it as eliminating specified fuel and vehicle taxes enacted after January 1, 2017, while requiring voter approval for certain future fuel and vehicle taxes. It was a proposed measure at that time, so its fiscal numbers describe the Legislative Analyst’s 2018 estimate—not current revenue.
| Figure in the 2018 official analysis | What it described |
|---|---|
| $4.4 billion falling to $2 billion | Estimated reduction in then-current-fiscal-year revenues from the transportation funding law known as SB 1 if the measure passed |
| $2.4 billion | The estimated difference between those two amounts in that fiscal year |
| $5.1 billion annually | Projected annual reduction two years later |
| $35 billion | Estimated California transportation funding in the analysis: $16 billion local, $12 billion state, and $7 billion federal |
Proposition 6 shows why readers must examine the full text. The measure would not merely alter a rate; it also would have changed who had to approve certain future taxes. A measure can therefore affect both the tax itself and the rules governing later tax votes.
A proposal is not the same as enacted law
California’s Legislative Analyst analyzed another proposed design in January 2022. Under that proposal, a legislatively proposed state tax increase would need two-thirds approval in each legislative house and majority statewide voter approval, while voters could still increase taxes by statewide majority vote without legislative action. That was an analysis of proposed language, not evidence that the proposal became law. Always check whether a measure qualified, appeared on the ballot, passed, was defeated, or was later amended.
Local taxes follow a separate set of questions
A state ballot initiative is only one layer of tax law. Counties, cities, school districts, and special districts may have different authority and approval requirements. California’s Legislative Analyst explained in a 2017 overview that local general taxes and local special taxes are treated differently. A general tax supports ordinary governmental purposes; a special tax is dedicated to a specified purpose. The category can affect the required voter threshold and the permitted use of revenue.
Do not transfer the rule for a statewide tax to a city measure. Read the local measure’s title, summary, tax-purpose language, district boundaries, and stated vote requirement. Charter-city provisions can add another layer.

A California Secretary of State notice issued in 2026 described a proposal that would raise the approval threshold for certain voter-proposed local special taxes from a simple majority—more than 50%—to two-thirds and would restrict certain charter-city real-estate-transfer taxes. The notice estimated possible annual local-government revenue losses of up to a couple of billion dollars. That is an official estimate for a proposal, not an observed loss or a statement of current law. Its final status and text must be confirmed before relying on it.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How to determine whether a specific measure can change your bill
- Locate the jurisdiction. Confirm whether the measure applies statewide or only to a county, city, school district, or special district.
- Read the official text. Identify the tax, rate or formula, tax base, exemptions, effective date, revenue destination, and enforcement provisions.
- Classify the measure. Determine whether it is a citizen initiative, legislative referral, statute, constitutional amendment, or a proposal changing future approval rules.
- Check the required vote. Look for a simple majority, two-thirds, or another threshold, and determine whether it applies to voters, legislators, or both.
- Check amendment and repeal rules. Initiative statutes may restrict later legislative changes; constitutional provisions may require another constitutional amendment. Look for exceptions written into the measure.
- Read the official fiscal analysis. Separate one-time effects, recurring annual effects, and estimates tied to a particular fiscal year. Note the assumptions and whether the measure is only proposed.
- Confirm status and dates. A circulated petition, a qualified ballot measure, an enacted measure, and an operative tax are different stages. Verify certification, election results, effective date, and implementation notices.
The state election authority’s voter guide is usually the best starting point for ballot language and impartial analysis. For tax mechanics, consult the state constitution, current election code, legislative counsel or revenue committee explanations, and the nonpartisan fiscal office. Older background documents can explain a mechanism but should not be treated as current procedural instructions without verification.
What happens after voters approve a tax measure?
Approval does not always mean the tax appears on the next bill. The measure may specify a future effective date, require agencies to write regulations, change collection systems, or apply only to transactions occurring after a stated date. A constitutional amendment may take effect under a different rule from a statute.
Implementation can also expose details that are easy to miss in campaign summaries: whether existing contracts are protected, whether refunds are required, how revenue is allocated, and whether a tax applies to all taxpayers or only a defined class. The official text, not a slogan or fiscal estimate, determines those consequences.

Common misconceptions
“Every state lets voters raise taxes directly.”
No. States differ widely. Some allow tax initiatives, some restrict them, and some distinguish sharply between statutory and constitutional initiatives.
“If voters decide, the legislature was not involved.”
Not necessarily. A legislative referral requires lawmakers to act before voters decide. Only a qualifying citizen initiative can bypass a legislative vote on the proposed tax itself.
“Every tax increase must go to voters.”
No. California’s 2018 guide described a two-thirds legislative vote as the route for a new or increased state tax passed by the legislature, without generally requiring voter approval. Other states use different rules.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitches“A proposal’s revenue estimate tells me what will happen.”
No. Estimates describe a modeled outcome under stated assumptions. They are not proof that the measure passed, took effect, or produced that amount.
“A ballot measure always imposes a tax.”
No. It may repeal a tax, cap a rate, require future voter approval, change a constitutional rule, or alter local authority without directly collecting a new tax.
The practical answer for taxpayers
A state ballot measure can change your taxes without a legislative vote when the state permits a voter initiative covering that subject and the measure satisfies the applicable qualification and approval rules. Whether it actually changes what you owe depends on the measure’s legal text, its government level, its effective date, and any implementation conditions.
For a particular election, do not rely on the words “tax initiative” alone. Read the official ballot text and impartial fiscal analysis, identify whether the proposal is statutory or constitutional, confirm the required threshold, and verify its final status after the vote. That process is the only dependable way to determine whether a measure changes your tax rate, your tax base, a local tax, or merely the rules for future tax decisions.
