Yes. An insurer in India can deny or dispute a term-insurance death claim, even when the claimant is the policy’s named nominee. Nomination identifies the person entitled to pursue the claim under the policy process; it does not by itself prove that the insurer’s repudiation is lawful or unlawful. The decision depends on the policy wording, the proposal and application record, the claim facts, and the law applicable to that policy.
The practical starting point is the insurer’s written repudiation or rejection letter. It should explain why the claim was denied. A nominee can then use the insurer’s grievance process and, where the eligibility conditions are met, escalate to the Insurance Ombudsman or the Insurance Regulatory and Development Authority of India (IRDAI).

What does it mean when a nominee’s claim is denied?
A death-claim decision can take several forms. An insurer may pay the claim, ask for further information, delay a decision while examining documents, offer only part of an amount that is disputed, or repudiate the claim entirely. “Repudiation” generally means the insurer has made a final decision not to pay under the policy. A partial repudiation or disputed amount can also be challenged through the recognised complaint process.
Being named as nominee gives the claimant a basis to submit and pursue the policy claim. It does not remove the insurer’s right to examine whether the policy was in force, whether the event falls within the cover, whether required information was supplied accurately, or whether an exclusion or other term applies. Conversely, the fact that an insurer has rejected a claim does not establish that the rejection is correct. The documents and applicable law have to be assessed together.

This article concerns policies issued in India and the Indian Insurance Ombudsman framework. Rules in another country, or a policy governed by another jurisdiction, may produce a different result.
Why might a term-insurance claim be disputed?
Official Ombudsman guidance identifies types of complaints that can be brought to the scheme. These categories describe disputes the forum may consider; they are not a complete list of every ground on which an insurer might deny a particular claim.
Partial or total repudiation
The insurer may say that no amount is payable (total repudiation) or dispute part of the amount claimed (partial repudiation). Ask for the precise contractual clause and factual basis rather than relying on a verbal explanation.

A dispute may concern information in the proposal or application, medical and financial disclosures, identity details, or answers recorded by an intermediary or insurer representative. Do not assume that any discrepancy automatically defeats a claim. The significance of a statement depends on what was asked, what was recorded, what the policy says, and the law applying on the relevant dates.
Interpretation of policy terms
The Ombudsman framework includes disputes about the legal construction of a policy insofar as that construction relates to a claim. This can include disagreement about an exclusion, the meaning of a benefit provision, or whether a condition was satisfied.

Policy issued contrary to the submitted proposal
Government financial-services guidance lists complaints where the policy issued does not match the proposal submitted. Preserve the proposal, policy schedule, endorsements and any messages confirming what was requested so that differences can be identified.
Delay and servicing problems
Failure to process a claim promptly, repeated requests for documents, or other servicing grievances may be complained about separately from the ultimate coverage decision. A delay is not the same as a final repudiation, so ask whether the insurer has actually made a final decision.

1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsWhy the written repudiation letter matters
The insurer’s written decision is the anchor for every escalation. A Government of India release summarising life-claim procedures said that reasons should be stated when a claim is rejected or repudiated and referred to prompt processing and applicable settlement timelines. That release dates from 2018 and summarises regulations in force at that time; it should not be treated as proof that every procedural detail remains unchanged.
Request a final letter if the insurer has only given a telephone explanation or a generic email. Check whether it identifies:
- the policy number, insured person and date of death;
- whether the decision is a delay, a request for information, partial repudiation or total repudiation;
- the specific policy terms or exclusions relied upon;
- the facts or documents the insurer says support its position;
- the complaint or grievance channel and any response deadline.
If the letter refers to a proposal answer, medical report or investigation finding that you do not have, ask for the relevant record or a clear description of it. Keep the original correspondence and note when each request was sent.

What should a nominee do after a rejection?
The following sequence is a general public-information guide, not a guarantee of payment or individual legal advice.
- Collect the claim file. Put the policy document and schedule, proposal or application copy if available, nomination details, claim form, death certificate and other death records, medical and hospital papers, identity and bank documents, every document sent to the insurer, requests for additional information, and all emails or letters in one file. Create a dated timeline of submission and responses.
- Obtain the final written reasons. Ask the claims department to confirm whether the decision is final and to identify the clause, evidence and calculation supporting it. If the insurer says the claim is pending, ask what remains outstanding and when a decision is expected.
- Use the insurer’s grievance or customer-complaint process. IRDAI’s life-insurance guidance says the insurer should be approached first. Submit a written complaint through the insurer’s stated grievance cell or other official channel, attach the repudiation letter and a focused response to each reason, and keep proof of delivery.
- Wait for the insurer’s response or the applicable period. If the response is unsatisfactory, or there is no response for 30 days, review whether the Insurance Ombudsman route is available. The 30-day condition is stated on IRDAI’s Ombudsman guidance page and should be checked against the current page when you act.
- Escalate through the appropriate forum. Depending on the facts and eligibility, this may include the Insurance Ombudsman and an IRDAI grievance escalation. The Ombudsman route has subject-matter and monetary limits; an IRDAI complaint is regulatory escalation, not an automatic order directing the insurer to pay.
When can the Insurance Ombudsman be used?
IRDAI describes the Ombudsman scheme as a way for individual policyholders to have complaints settled outside the courts in a cost-effective, efficient and impartial manner. Its guidance includes claim delay, partial or total repudiation, disputes about policy terms as they relate to a claim, servicing grievances and a policy issued contrary to the proposal.
The main screening questions are:
| Question | What to check |
|---|---|
| Have you approached the insurer? | Use the insurer’s grievance process first. The Ombudsman guidance refers to a rejection, an unsatisfactory response, or no response for 30 days. |
| Is the subject covered? | Confirm that the complaint concerns a listed matter such as repudiation, delay, servicing, or interpretation of a policy term connected with the claim. |
| Is the value within the limit? | IRDAI’s Ombudsman page states a maximum claim value of Rs 30 lakhs, including expenses claimed. Recheck this figure and all current eligibility rules before filing. |
| What result can the process produce? | The Ombudsman may attempt mediation and make a recommendation. If that does not resolve the matter, the process may lead to an award. |
The same IRDAI page states that an insurer has 15 days to comply with an accepted recommendation and 30 days after receipt of an award. Those periods describe compliance after the relevant outcome; they are not a promise that an initial claim will be decided within that time.
How is an IRDAI complaint different?
IRDAI is the insurance regulator and a point for grievance escalation. Its life-insurance guidance says a policyholder can approach the Authority’s grievance cell when the insurer has not responded within a reasonable period or when the response is unsatisfactory. The page lists the toll-free number 155255, but contact details can change, so verify the current number and online channel before submitting anything.
A regulator complaint can help record the problem and obtain a response from the regulated entity. IRDAI expressly states that the liabilities of regulated entities are not discharged by the Authority. In practical terms, sending a complaint to the regulator is not the same as receiving an adjudicated payment order. If the dispute requires evidence, legal interpretation or a remedy outside the Ombudsman’s jurisdiction, another forum may be necessary.

What about the law on early-policy disclosures?
Nominees often hear that an insurer can reject a claim because information was omitted from the proposal. That conclusion cannot safely be reached from a generic “non-disclosure” label. Read the exact allegation, the question asked on the proposal, the answer recorded, the underwriting documents and the policy wording.
India Code’s surfaced Insurance Act text notes a 2025 amendment with an effective date of 5 February 2026. The full current wording of the relevant provision on contesting a life policy, and the transition rules for policies issued at different times, were not available in the material used for this article. Therefore, do not rely on a fixed contestability period or assume a particular omission has an automatic statutory consequence. The applicable consolidated law and commencement provisions should be checked for the policy’s issue date and the date of the insurer’s action.

Answer each reason separately
Number your response to match the repudiation letter. For every allegation, state what the proposal or policy says, what document supports your position, and what remedy you seek. Avoid broad accusations that the insurer acted illegally without tying them to the record.
Distinguish facts from assumptions
Identify whether a fact is shown by a document, is disputed, or is unknown. If an intermediary completed an electronic form, say that clearly and provide messages, call records or witness details that may show how the answer was captured. Do not alter an original document or submit an explanation that conflicts with the medical record.
Ask for a specific outcome
Request withdrawal of the repudiation and settlement of the covered amount when that is your position. If the amount is disputed, ask for the calculation and the reason for any part not paid. If the issue is delay, ask for a decision date and a list of genuinely outstanding documents.

Common questions nominees ask
Can an insurer reject a claim simply because I am only the nominee?
No. Nominee status is not, by itself, a reason to reject a claim. The insurer still has to assess the policy and claim, and the nominee can challenge a decision through the available complaint routes. Nomination also does not make every repudiation invalid.
Does a rejection letter end the matter?
No. It records the insurer’s position. After obtaining the reasons, use the insurer’s grievance process and assess Ombudsman or regulatory escalation. Keep track of any forum-specific deadlines and eligibility conditions; the general sources described here do not establish every limitation period or the correct forum for every dispute.
Can I approach the Ombudsman without first complaining to the insurer?
IRDAI’s guidance says the insurer should be contacted first. It refers to approaching the Ombudsman after rejection, an unsatisfactory response, or no response for 30 days, subject to the scheme’s other requirements.
Will an IRDAI complaint automatically make the insurer pay?
No. IRDAI is a regulator and escalation point. Its guidance states that regulated entities’ liabilities are not discharged by the Authority, so a regulatory complaint is not the same as an automatic payment order.
Is the Rs 30-lakh Ombudsman limit a limit on the policy benefit?
No. It is the claim-value limit stated on IRDAI’s Ombudsman guidance page for that route, including expenses claimed. It does not rewrite the sum assured in the policy. Confirm the current amount and eligibility rules before relying on it.
Bottom line for a denied term-insurance claim
A nominee can be denied a term-insurance payout, but the denial is not validated merely because an insurer has issued it, and it is not invalid merely because a nominee was named. Obtain the written reasons, preserve the complete policy and claim record, challenge each stated ground through the insurer’s grievance channel, and then consider the Insurance Ombudsman or IRDAI route that fits the dispute. Because the governing law and procedural limits can change—including the Insurance Act amendment effective 5 February 2026—verify the current rules for the policy and claim before choosing a forum.
