Possibly. An order that does not appear in your income-tax portal account is a serious record and timing problem, but the missing display alone does not prove that the order is invalid, unserved, or automatically appealable. Find the underlying order, document every attempt to obtain it, request a copy from the issuing authority, and check the correct appeal route and service-based deadline immediately.
What a missing portal order does—and does not—mean
The e-filing portal is a delivery and record-keeping channel, not the legal test for whether an order exists. A missing entry may result from an e-Proceedings display issue, an account or access problem, an order issued through another workflow, or a record that has not yet been uploaded. It may also reflect a misunderstanding about which communication is the appealable order.

For that reason, do not assume that the order vanished legally, that limitation has stopped, or that every notice can be appealed. The first task is to identify the document, the issuing authority, the relevant assessment year, and the statutory provision under which it was made.
Official Income Tax Department guidance describes Form 35 for eligible appeals under the Income-tax Act, 1961 and Form 99 for proceedings governed by the Income-tax Act, 2025. The applicable form depends on the proceeding and transition rules, not simply on the date you notice a portal problem.

Check the portal record first
Use the e-Proceedings path
The Form 35 user manual gives this route for retrieving an order: Pending Actions > E-Proceedings. Open the relevant proceeding and try to download the order, intimation, notice of demand, and related communications. The manual states: “To download the order from e-filing portal, on the homepage go to the Pending Actions tab > E-proceedings.”
Save what you find
- Download the order and notice of demand in their original formats where available.
- Save portal messages, acknowledgement numbers, email alerts, and attached files.
- Record the tax or assessment year, order type, issuing authority, order number or DIN, and every date on which you checked the account.
- Take dated screenshots showing that the expected order was not available, including the account and e-Proceedings screen used.
These records can help explain how and when you tried to obtain the document. They do not, by themselves, establish the legal date of service or automatically suspend the appeal period.
Raise a grievance and request the record directly
Use e-Nivaran for the technical problem
The e-Nivaran manual describes grievance categories for e-filing and e-Proceedings issues and identifies the Assessing Officer among the departments served by the module. File a grievance that clearly states what is missing, the relevant year, the apparent proceeding, and the dates of your failed retrieval attempts. Keep the grievance number and every response.
Ask the issuing authority for a copy
Submit a separate written request to the Assessing Officer or other authority that issued the communication. Ask for a certified or otherwise official copy of the order, the notice of demand, the date and mode of service, and the DIN or order number. Attach a short chronology of your portal checks and include copies of any email or SMS alerts you received.

A grievance and a copy request are evidence-gathering steps, not substitutes for an appeal. Continue checking the limitation position while the requests are pending.
Identify the applicable appeal regime
| Question | Income-tax Act, 1961 | Income-tax Act, 2025 |
|---|---|---|
| Typical appeal form in the Department guidance | Form 35 | Form 99 |
| Forum described in the guidance | Joint Commissioner (Appeals) or Commissioner of Income Tax (Appeals), where the order is appealable | Appeal route described in the Form 99 manual for orders governed by the 2025 Act |
| How appealability is determined | Section 246A lists appealable orders | The relevant provision of the 2025 Act and the applicable procedure must be checked |
| Missing-order treatment in the manual | The workflow calls for the order and notice of demand | Form 99 includes a “Not Available” order selection, followed by identifying details |
| General period stated in the guidance | 30 days, with the trigger depending on the order | 30 days, with the trigger depending on the order |
The table does not mean that a Form 99 “Not Available” selection guarantees acceptance without an order. The manual also describes entering order or intimation details and attaching the order or intimation and notice of demand. Whether a particular filing can proceed depends on the facts, the authority’s requirements, and the governing law.
How the 30-day appeal period is calculated
Orders under the 1961 Act
The Form 35 manual states the usual limitation under section 249(2) as 30 days. For an assessment or penalty appeal, the period runs from service of the related notice of demand. For other cases, it runs from service of intimation of the order. The Form 35 FAQ expresses the principle this way: “The assessee has to file Appeal within 30 days from the date of service of order or demand as the case may be.”
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesThat is not the same as “30 days from the date the order appears on the portal.” The legally relevant event may be service of a demand notice or intimation, and the correct trigger depends on the type of order. Identify the document and preserve evidence of how and when it was served.

Orders under the 2025 Act
The Form 99 manual also describes a general 30-day period, with the trigger tied to service of the demand notice for assessment or penalty matters and service of intimation in other cases. The filing workflow calls for the order or intimation and notice of demand, even though it provides a “Not Available” selection.
Transition for earlier assessment years
The Department’s transition FAQ says proceedings related to an assessment year through AY 2026–27 remain governed by the Income-tax Act, 1961 even when the appeal is filed after 1 April 2026. Check the assessment year and the applicable transitional provision before selecting Form 35 or Form 99.
The same FAQ says that a right of appeal whose deadline had already expired under the old Act is not revived merely because the new Act commenced or provides a different limitation period. A possible condonation request under the old Act is a separate matter and requires its own showing.

You can challenge an appealable underlying order, but the portal defect is not itself a standalone conclusion that the order is void. Your filing should address the substantive grounds against the assessment, penalty, rectification, or other appealable action and separately explain the document-access problem if it affected preparation or timing.

For a 1961 Act proceeding, section 246A is the starting point for deciding whether the particular Assessing Officer order is appealable. The Department’s examples include certain processing adjustments, assessment or reassessment orders, and rectification orders. A communication that is merely an information request, preliminary notice, or non-appealable intimation may require a different response.
Ask a qualified Indian tax professional to review the order type, statutory section, service evidence, and limitation calculation when the facts are disputed or the amount is material. A portal grievance alone does not preserve an appeal right.

File or prepare the appeal without waiting for a perfect portal record
Once you can identify the order and forum, prepare the appeal promptly. If the form permits an unavailable-order entry, use it accurately and provide the DIN, order number, issuing authority, year, and other requested details. Do not invent a number or describe an order you have not identified.
Request condonation with a documented chronology
Official guidance says an appellate authority may condone delay in exceptional cases where the taxpayer had reasonable cause. Condonation is discretionary, not an automatic extension created by a portal outage. Explain the chronology precisely: when service was attempted or received, when the portal was checked, what was missing, when grievances and copy requests were filed, when the document became available, and how quickly you acted afterward.

Attach screenshots, grievance acknowledgements, correspondence, delivery records, and any other evidence supporting the explanation. State the number of delayed days accurately and address each period of inactivity. Do not rely on the bare statement that “the order was not on the portal.”
Documents and information to assemble
- The order, if retrieved, or the available DIN, order number, date, issuing authority, and statutory section.
- The notice of demand and evidence showing how and when it was served.
- The relevant assessment year and tax period.
- Portal messages, email or SMS alerts, and other communications about the proceeding.
- Dated screenshots of the missing record and a log of portal checks.
- e-Nivaran grievance numbers, copy requests, acknowledgements, and replies.
- A statement of facts and specific grounds of appeal.
- Documentary evidence supporting each ground.
- Tax-payment details, pending-appeal information, and appeal-fee details requested by the form.
- Proof of any fee payment and a clear limitation calculation.
The Form 35 manual expressly refers to the order copy, demand notice, appeal-fee details, pending appeal details, taxes paid, statement of facts, grounds, documentary evidence, and DIN or order number. Form 99 guidance similarly describes order details and attachments while offering the unavailable-order choice.
Form 35 filing sequence for an eligible 1961 Act appeal
- Confirm that the order falls within the appealable categories in section 246A and identify the proper appellate authority.
- Use the e-filing portal’s appeal workflow for Form 35 and enter the assessment year, order details, demand information, and DIN or order number.
- Upload the order and notice of demand if available. If a document cannot be retrieved, preserve the copy-request evidence and follow the portal’s instructions for the information you do have.
- Complete the statement of facts and grounds with numbered, order-specific objections rather than a general complaint about the portal.
- Enter tax payments, pending appeal details, documentary evidence, and fee information requested by the form.
- Calculate the deadline from the legally relevant service event. If late, include the condonation request and supporting chronology instead of assuming the portal issue excuses delay.
- Submit, complete any verification or digital-signature step required by the portal, and save the acknowledgement.
Form 99 considerations for a 2025 Act proceeding
- Verify that the proceeding is actually governed by the Income-tax Act, 2025 rather than preserved under the transition rule for an assessment year through AY 2026–27.
- Select the applicable appeal option in Form 99 and use the “Not Available” order selection only when the order cannot be obtained.
- Enter the order number or DIN and all other identifying information requested by the manual.
- Attach the order or intimation and notice of demand where available, and retain evidence of every attempt to obtain missing documents.
- Apply the service-based 30-day calculation, prepare any condonation explanation if necessary, and keep the filing acknowledgement.
Common mistakes that weaken a missing-order case
- Counting from portal upload: The official instructions describe service-based triggers, not a universal upload-date rule.
- Treating a grievance as an appeal: A technical complaint does not replace the prescribed appeal form.
- Assuming every communication is appealable: Identify the statutory order and section before drafting grounds.
- Waiting for a copy before protecting limitation: Continue the appeal analysis while the authority investigates the portal record.
- Claiming automatic condonation: Reasonable cause is assessed by the appellate authority and must be evidenced.
- Choosing the form from the current date alone: The assessment year and transition provisions can keep a proceeding under the 1961 Act.
- Confusing return-filing delay with appeal delay: They are separate procedures with different legal consequences.
A practical decision checklist
- Have you checked Pending Actions > E-Proceedings and saved the result?
- Do you know the assessment year, order type, issuing authority, statutory section, and DIN or order number?
- Do you have the notice of demand and evidence of its service?
- Have you filed an e-Nivaran grievance and separately requested the record from the issuing authority?
- Does the transition rule place the matter under the 1961 Act or the 2025 Act?
- Is the order appealable under the relevant law?
- What event starts the 30-day period in this particular case?
- If the period may have expired, have you prepared a dated, evidenced condonation explanation?
- Have you assembled grounds, facts, evidence, tax-payment details, fee information, and the filing acknowledgement?
When professional advice is especially important
Obtain case-specific advice quickly if the order concerns a large demand, reassessment, penalty, multiple years, disputed service, an expired deadline, or uncertainty about whether the communication is appealable. A professional can separate a portal-access issue from the substantive grounds, calculate limitation under the correct statute, and decide whether an available-order filing and condonation request should be made together.
Recommended Free Tools
The safest position is to treat the missing record as an urgent evidence and deadline problem: preserve proof, obtain the official document, identify the governing Act, and protect the appeal route without making assumptions about invalidity or automatic extension.
