For a conventional loan, the lender normally arranges private mortgage insurance (PMI) and may present the insurer or coverage structure it offers. Whether a lender may insist on one particular company depends on the loan documents, the program, and applicable law. Ask for the requirement and every available alternative in writing before you commit.
Start by identifying what “mortgage insurance” means
The answer changes depending on the coverage attached to your loan. Mortgage insurance is designed primarily to reduce the lender’s loss if you default; it does not insure your furniture, roof, or other personal property. It raises the cost of borrowing. The three terms most often confused are private mortgage insurance, homeowners insurance, and title insurance.

Private mortgage insurance on a conventional loan
PMI is commonly required on a conventional mortgage when the down payment is below 20 percent, although the exact requirement comes from the loan’s underwriting and terms. The Consumer Financial Protection Bureau (CFPB) explains that the lender arranges the coverage and that private insurance companies provide it. Its consumer guidance tells prospective borrowers to ask lenders what PMI choices they offer. That supports comparing the packages available from different lenders; it does not state that a borrower can select any PMI company independently after choosing a loan.

FHA and USDA financing typically includes mortgage-insurance or guarantee charges under the applicable government program. Those charges are not interchangeable with conventional PMI, and the program rules may determine the provider or the way the fee is collected. A VA loan, for example, uses a different guarantee structure rather than conventional PMI. Read the program name and fee descriptions on the Loan Estimate and loan documents before asking who the “insurer” is.

Homeowners insurance is a separate product
Homeowners insurance covers the property against covered damage and generally includes liability protection. A lender can require specified coverage limits, deductibles, and policy features, but CFPB guidance says you can choose the homeowners-insurance company that supplies a policy meeting those requirements. That consumer choice does not establish an equivalent right to choose a PMI provider.
Title insurance is different again
Title insurance protects against certain title defects and is treated as a settlement or closing service in the RESPA framework. A rule addressing a seller’s ability to condition a home sale on use of a particular title insurer should not be converted into a rule about a borrower’s choice of PMI company. The products protect different interests and are governed by different provisions.
What federal guidance says about choosing a PMI company
Current CFPB explanations establish three practical points for conventional loans:
- The lender arranges PMI and obtains it from a private insurer.
- A down payment under 20 percent commonly triggers PMI, but that threshold is a general description rather than a guarantee for every loan.
- You should ask each lender what PMI choices it offers before agreeing to a mortgage.
None of those statements promises that the borrower may shop the entire market and substitute a preferred insurer after selecting a lender. A lender’s “choice” may mean different coverage structures, such as borrower-paid PMI or a lender-paid arrangement, rather than a menu of insurers. The lender may also use an insurer approved for its underwriting, servicing, or investor requirements.
The CFPB’s broader mortgage-insurance explanation, reviewed August 28, 2026, says mortgage insurance typically applies when the down payment is below 20 percent and is also typically required for FHA and USDA loans. It describes the coverage as protection for the lender that increases the borrower’s cost. The PMI explainer reviewed August 28, 2023, uses the lender-arranged model for conventional financing. Product availability, underwriting rules, and lender practices can change, so the documents for your transaction control.

Why RESPA and Regulation Z do not give a simple yes-or-no answer
Two federal disclosure provisions are sometimes cited in arguments about a lender’s preferred provider. They are important, but neither one expressly creates a universal right to choose a PMI insurer.
Regulation X § 1024.15
The affiliated-business-arrangement rule in Regulation X says that a person making a referral must not require, subject to listed exceptions, the use of a particular provider of settlement services or a business incident to those services. The relevant text states: “No person making a referral has required (as defined in § 1024.2, ‘required use’) any person to use any particular provider of settlement services or business incident thereto.” The provision addresses required use in the settlement-service and referral context. The cited rule does not state that mortgage insurance is a settlement service, so it does not by itself resolve whether a lender can require a named PMI insurer.
Regulation Z § 1026.19
When a consumer is permitted to shop for a settlement service, the creditor identifies the services for which shopping is allowed and supplies a written provider list that says the consumer may choose another provider. This disclosure rule operates when the service is one the consumer is permitted to shop for. It does not independently classify PMI as such a service or create a provider-selection right where the loan program or contract does not provide one.
For that reason, do not rely on a broad statement that “RESPA lets me pick any insurance company.” Ask the lender to identify the exact coverage, the contractual or program requirement, and the provision it believes makes a named company mandatory.
When a lender names one company, ask what is actually mandatory
A named company on a worksheet can reflect several different arrangements. It may be the insurer used for borrower-paid PMI, the provider behind lender-paid mortgage insurance, or an administrator associated with a government-backed program. It may also be a preliminary quote that changes when the lender completes underwriting. The name alone does not prove that the company is legally the only option.

Request written answers to these questions:
- Is the charge borrower-paid PMI, lender-paid mortgage insurance, FHA mortgage insurance, USDA guarantee-related coverage, or another product?
- Which insurer, agency, or program provides the coverage?
- Is the named provider mandatory, or is it simply the lender’s standard option?
- What other coverage structures or loan programs are available?
- How would each alternative change the interest rate, monthly payment, upfront charges, cash needed at closing, and cancellation or termination terms?
- Which loan document, investor rule, or program requirement supports the claimed restriction?
Have the lender place the answers in an email or revised disclosure. Oral assurances are difficult to compare later with the Loan Estimate, closing disclosure, and final loan commitment.
How to compare the alternatives the lender offers
Compare the complete cost over the period you expect to keep the loan, not just the insurance line on the first monthly-payment estimate. The following framework uses the factors that matter when a lender offers more than one structure.
| Comparison point | What to request | Why it matters |
|---|---|---|
| Who pays | Borrower-paid PMI or lender-paid mortgage insurance | A lender-paid structure can be reflected in a higher interest rate even when a separate monthly PMI line is absent. |
| Upfront cost | Premium or fee due at closing, if any | An upfront charge changes the cash you need and may be financed at additional interest. |
| Monthly cost | Insurance amount and the payment schedule | A lower initial payment may not be the lowest total cost over your expected holding period. |
| Interest-rate effect | Note rate and annual percentage rate for each option | Replacing a monthly premium with a rate adjustment can affect every payment for as long as the loan remains outstanding. |
| Ending the charge | When and how borrower-paid coverage can be canceled or terminated under the applicable rules | Different structures can have different paths for ending the insurance cost. |
| Eligibility | Credit, loan-to-value, property, and program conditions | An alternative is useful only if you qualify for it and the lender will deliver it on the promised terms. |
Ask for side-by-side Loan Estimates or other written disclosures so that rate, payment, closing costs, and insurance treatment are shown on the same assumptions. A lender’s offer is not a universal market comparison: another lender may use a different insurer or loan structure and still meet the same broad financing goal.
Step-by-step response to a specific-company demand
- Read the disclosures. Check the Loan Estimate, mortgage insurance section, projected payments, and any program or commitment documents. Note whether the charge is labeled PMI, FHA mortgage insurance, USDA-related coverage, or something else.
- Send a written request. Ask the lender to identify the provider, explain whether the provider is mandatory, list alternatives, and state the cost effect of each alternative.
- Ask for the authority. If the lender says the company is required, request the loan-document clause, investor guideline, or government-program rule it is relying on.
- Compare another loan offer. A different lender may arrange coverage through another insurer or offer a different combination of rate, premium, and down payment. Compare the full terms rather than the company name alone.
- Verify before closing. Reconcile the final Closing Disclosure and insurance documents with the terms you accepted. Raise discrepancies promptly with the lender and settlement professionals.
- Escalate a disputed explanation. Keep the written demand, responses, disclosures, and calculations. If the issue remains unresolved, seek advice from a qualified housing counselor or attorney familiar with your state and loan type. The outcome can depend on jurisdiction and the exact contract.
Common mistakes that lead borrowers astray
- Confusing PMI with homeowners insurance. The right to choose a homeowners insurer does not automatically carry over to PMI.
- Treating 20 percent as a universal switch. Less than 20 percent down commonly leads to PMI on conventional loans, but loan terms and program rules determine the actual requirement.
- Assuming a named insurer is automatically unlawful. A lender-arranged provider can be part of the loan structure; the key question is whether the lender can show the contractual or program basis for making it mandatory.
- Using a title-insurance rule as a PMI rule. Title insurance is a different settlement service with different protections.
- Comparing only the monthly payment. Include the rate, upfront charges, total payment path, and the terms for ending borrower-paid coverage.
Examples of how the answer can change
Conventional loan with borrower-paid PMI
You put less than 20 percent down. The lender arranges PMI and lists one private insurer. You can ask what other PMI choices that lender offers and compare another lender’s offer, but the available guidance does not establish a right to force your chosen insurer into the existing loan.
Conventional loan with lender-paid mortgage insurance
The lender says there is no separate monthly PMI bill but quotes a higher interest rate. Ask which coverage arrangement supports the rate, whether borrower-paid PMI is available instead, and how the long-term payment and cancellation features differ.

FHA or USDA financing
The insurance or guarantee charge follows the government program’s rules. A request to substitute a conventional private insurer may not fit that program. Compare an eligible alternative loan rather than assuming a private PMI policy can replace the program charge.
Questions borrowers often ask
Does choosing my own homeowners insurer let me choose my PMI insurer?
No. CFPB guidance expressly discusses consumer choice for homeowners insurance, subject to the lender’s coverage requirements. Its PMI guidance describes lender-arranged private coverage and does not create a parallel right to name the PMI company.
Can I avoid PMI simply by asking the lender to remove the named company?
Removing the company name does not remove the underlying mortgage-insurance requirement. Ask whether a different loan-to-value, loan program, or payment structure is available and obtain the resulting terms in writing.
What if the lender refuses to identify the basis for the requirement?
Ask again in writing for the coverage type, provider, alternatives, and document or program rule supporting the demand. Preserve the disclosures and responses. If the explanation remains inadequate, obtain advice specific to your state and loan before signing.

No. Regulation X § 1024.15 addresses required use of providers in the settlement-service referral context, and Regulation Z § 1026.19 addresses disclosures when a consumer is permitted to shop. The cited provisions do not expressly classify PMI or establish a universal PMI-provider selection right.

The practical bottom line
A lender may require mortgage insurance under the loan’s terms and may arrange conventional PMI through a private insurer. Current federal consumer guidance does not establish a general right for a borrower to select any PMI company. If a lender insists on a named provider, demand a written explanation, distinguish PMI from homeowners and title insurance, compare the full cost of every available structure, and verify the final documents before closing.
Frequently Asked Questions
Is a lender allowed to require mortgage insurance on a conventional loan?
A lender may require it under the loan’s underwriting terms; PMI is common on conventional loans with down payments below 20 percent, but the exact requirement depends on the transaction.
Who does mortgage insurance protect?
Mortgage insurance generally protects the lender against loss if the borrower defaults. Homeowners insurance protects the property, which is a separate function.
What should I get in writing from the lender?
Request the coverage type, provider or program, whether the provider is mandatory, available alternatives, and the effect of each option on the rate, payment, closing costs, and ending terms.
