Generally, no. A GST officer cannot ordinarily use statutory recovery to collect a disputed tax demand before it becomes payable through the required process, normally a notice followed by adjudication and service of an order. The position is different if you make a qualifying voluntary payment, if an order has already been served and its payment period has been shortened for recorded reasons, or if the Commissioner provisionally attaches property to protect revenue. An attachment can restrict access to assets, but it is not final recovery of the disputed tax.

What “recovery before an assessment order” means

The word recovery has a specific legal significance under the Central Goods and Services Tax (CGST) Act. Section 79 provides methods for recovering amounts that are payable under the Act or its rules but remain unpaid. A tax officer identifying a possible short payment during an inspection, search or investigation has not automatically created an amount recoverable under section 79.

In many GST disputes, the relevant document is an adjudication order confirming a demand under the applicable demand provision, rather than an “assessment order” in the narrow sense. The practical question is whether a legally payable amount exists, whether the order has been served, and whether the statutory payment period has expired or has been validly shortened.

When ordinary recovery under section 79 can start

A demand must ordinarily become payable first

Section 79 is a collection mechanism for an amount that is already payable and remains unpaid. The Central Board of Indirect Taxes and Customs (CBIC), in Instruction 01/2022-23-GST (Investigation), states that recovery of disputed tax must follow due process, including notice and confirmation of the demand by an adjudication order, unless the amount has otherwise become payable under the Act.

That means an investigation finding, a discrepancy pointed out by an officer, or a proposed calculation is not by itself the same as a confirmed debt that can be recovered through section 79. The department must identify the legal basis on which the amount became payable.

What section 79 recovery looks like

Once an amount is legally payable and remains unpaid, section 79 permits statutory methods such as recovery from money owed to the taxpayer, action against property, or other mechanisms specified by the Act and rules. The exact method depends on the circumstances and the recovery notice issued. Those powers should not be used as a substitute for deciding a disputed liability that has not yet been adjudicated.

The normal payment period after an order: section 78

Three months is the general rule

Section 78 generally gives a taxable person three months from service of the order to pay an amount payable in pursuance of that order. The period runs from service, so retain the order, covering letter, electronic notice and delivery details. A demand may be difficult to challenge on timing if the taxpayer cannot establish when it was served.

When the officer can require earlier payment

Section 78 allows the proper officer to require payment within a period shorter than three months where the officer considers an earlier deadline expedient in the interest of revenue. CBIC Instruction 01/2024-GST, dated 30 May 2024, explains that the reasons for shortening the period must be recorded in writing.

A reasoned direction made after an order is therefore an exception to the ordinary three-month period. It does not convert an unadjudicated disputed demand into a recoverable amount. Ask for the written direction and the reasons supporting it; an oral request for immediate payment is not the same thing as a properly documented section 78 direction.

Voluntary payment before notice: section 73(5)

What the provision permits

Before a notice is issued, a person chargeable with tax may pay tax and applicable interest based on the person’s own ascertainment or the proper officer’s ascertainment, and inform the officer. This is a statutory route for resolving an acknowledged liability without waiting for a notice.

CBIC’s investigation instruction expressly distinguishes this voluntary option from an officer compelling a deposit during an investigation. A payment made simply because an officer demanded money should not automatically be described as an ordinary section 79 recovery. If you use a DRC-03 or another payment process, preserve the calculation, the communication requesting payment, and the explanation of whether the payment was self-ascertained or disputed.

Questions to ask before paying

  • Is the amount admitted by you, or is it only an allegation that you contest?
  • Which tax period, tax head, interest and other components are included?
  • Has a notice already been issued, and if so, under which demand provision?
  • Does the payment document state that the amount is voluntary, or does the surrounding correspondence show pressure to pay?
  • Have you kept proof of payment and a written reservation of your position where appropriate?

Voluntary payment can be commercially sensible in a genuine admitted-liability case, but it is not a licence for compulsory collection of a disputed amount before adjudication.

Can the department freeze a bank account before an order?

Section 83 provisional attachment is different from recovery

Section 83 allows the Commissioner, after proceedings under the chapters specified in that section have begun, to provisionally attach property, including a bank account, by written order where necessary to protect government revenue. The purpose is preservation of assets while proceedings continue, not final collection of the tax.

The attachment can have an immediate practical effect: funds may be blocked, transactions may be disrupted, and access to property may be restricted before the demand is finally adjudicated. That does not mean the attached amount has been recovered or that the underlying tax liability has been decided.

Duration and paperwork

Under the CGST Act text, a provisional attachment under section 83 ceases to have effect after one year. Check the attachment order, the property identified, the date it was made, and the proceedings said to support it. If the order is vague, exceeds the property reasonably needed to protect revenue, or continues beyond the statutory period, obtain advice promptly about the available challenge.

What officers should not do during search or investigation

CBIC Instruction 01/2022-23-GST says there should be no recovery of tax dues during search, inspection or investigation merely because an issue was detected. The instruction recognizes that a taxpayer may voluntarily pay an ascertained liability, but it does not authorize an officer-led collection of a disputed amount without due process.

The instruction also says complaints alleging force or coercion should be examined and wrongdoing addressed under law. If payment was demanded during a visit, create a contemporaneous record: note the date, location, officers present, words used, amount requested, documents shown, and whether you were told that non-payment would lead to immediate consequences. Preserve messages, emails, payment challans and witness details. Do not alter or destroy records, and do not sign a statement you do not understand.

Classify the action before deciding how to respond

Action described by the officer Relevant mechanism Does it require a confirmed payable demand? What it does
Collecting an unpaid confirmed amount Section 79 recovery Ordinarily yes, unless the amount has otherwise become payable under the Act Uses statutory methods to collect money or property after non-payment
Requiring payment sooner than three months after an order Section 78 shortened payment period An order creating the amount payable must exist Changes the deadline; it is not itself a new adjudication
Payment of an amount you or the officer have ascertained before notice Section 73(5) voluntary payment No adjudication order is required for the payment option Allows the taxpayer to pay and inform the officer; it should remain genuinely voluntary
Blocking a bank account or other property to protect revenue Section 83 provisional attachment Specified proceedings must have begun and a written attachment order is required Restricts property temporarily; it does not finally recover or decide the tax

What to do if an officer demands immediate payment

  1. Request the legal basis in writing. Ask whether the communication is a notice, an order, a section 78 direction, a section 79 recovery notice, a section 83 attachment order, or a request for voluntary payment.
  2. Ask for the calculation. Separate tax, interest, penalty and any other amount. Check the tax periods, registration number and tax heads.
  3. Check whether an order exists and when it was served. Download the order and service record from the GST portal where available, and keep copies in a secure folder.
  4. Do not confuse willingness to cooperate with admission. You can provide records and attend proceedings while stating in writing that a disputed liability is not admitted.
  5. If considering payment, document its character. Record whether the amount is voluntarily self-ascertained, paid under protest where legally appropriate, or made pursuant to an existing order.
  6. If property is attached, identify the order and date. Check the statutory basis, the property covered and the one-year limit. Notify your bank or other holder only through documented channels and obtain professional advice quickly.
  7. Meet procedural deadlines. File replies, attend hearings and consider statutory appeal remedies within the applicable time. Missing a response deadline can create avoidable enforcement risk.

If an assessment or adjudication order has already been served

Start with the service date, not the date printed on the order. Calculate the general three-month period under section 78 and look for any separate written direction requiring earlier payment with recorded reasons. Then check the demand amount, interest calculation, payment instructions and whether the order identifies the statutory provision used.

An appeal, application for stay or other challenge may affect enforcement, but the effect depends on the statute, the order and the procedural posture. The general principles above do not decide every stay or recovery scenario. Obtain advice on the specific remedy rather than assuming that filing an appeal automatically suspends collection.

Limits of this answer

This explanation concerns the CGST Act and CBIC central instructions, including Instruction 01/2022-23-GST (Investigation) and Instruction 01/2024-GST dated 30 May 2024. State GST and Union Territory GST enactments generally operate alongside the central law but may involve different notices, officers or local instructions. Later amendments, the precise demand provision, and case-specific court orders can change the analysis.

The statutory periods mentioned here are legal deadlines, not estimates: three months is the usual post-service payment period under section 78, subject to a valid reasoned shorter direction, and one year is the stated outer period for a section 83 provisional attachment. For a live dispute, verify the current legislation and the exact documents served before acting.
