Can a GST Officer Inspect Goods Vehicles at Checkpoints or During Transit?

Yes. Under section 68 of India’s Central Goods and Services Tax Act, 2017 (CGST Act), an authorised proper officer may intercept a qualifying conveyance carrying goods and require the person in charge to produce prescribed documents and electronic devices for verification and to allow inspection of the goods. Rule 138B of the CGST Rules covers interception for e-way-bill verification during both inter-State and intra-State movement. The power is not unlimited: the officer must be authorised under the rules, the documents requested must be relevant to the movement, and repeated physical checks are restricted unless later, specific information about tax evasion becomes available.

What section 68 permits when a goods vehicle is stopped

Section 68 applies to conveyances carrying consignments for which the Government has prescribed movement documentation. Its key legal effect is that an interception during transit is contemplated by the GST law, not treated as automatically unlawful. Once a conveyance is intercepted by the proper officer, the person in charge must produce the prescribed documents and devices and allow the goods to be inspected.

The statutory wording is precise: “Where any conveyance referred to in sub-section (1) is intercepted by the proper officer at any place, he may require the person in charge of the said conveyance to produce the documents prescribed under the said sub-section and devices for verification, and the said person shall be liable to produce the documents and devices and also allow the inspection of goods.” Read the official text of section 68 of the CGST Act.

  • Interception and verification: stopping the conveyance, checking the e-way-bill data and supporting documents, and deciding whether the movement appears compliant.
  • Physical inspection: opening or examining the consignment to verify the goods themselves. This is a separate step and is subject to authorisation and reporting requirements.

Not every checkpoint stop is a full physical search. Verification may end after the documents and electronic records are checked, with the vehicle allowed to continue when no discrepancy is apparent.

Who is allowed to intercept or inspect?

Rule 138B of the CGST Rules provides the framework for interception of conveyances for e-way-bill verification. The relevant officer must be authorised by the Commissioner or by an officer empowered by the Commissioner for that purpose. Physical verification is likewise carried out by an officer authorised by the Commissioner or empowered officer.

The authorisation requirement matters because section 68 does not give every government employee a general power to stop and search any truck. The person stopping the vehicle must be acting as the proper officer within the GST framework and within the jurisdiction and authority assigned to that officer.

The rules also recognise a specific-conveyance exception. Where specific information indicating possible tax evasion is received, the required approval can permit action against that particular conveyance. This exception should not be read as eliminating the need for the prescribed approval or as converting ordinary suspicion into an unrestricted search power.

Which documents and devices can be requested?

The documents depend on the nature of the movement and the applicable GST requirements. The rules refer to an invoice, bill of supply or bill of entry. For goods moved for reasons other than supply, a delivery challan may be the relevant document. The e-way-bill information and the electronic device or system used to produce it may also be checked.

That list does not mean that every driver must carry every document in every journey. For example, a bill of entry is relevant to an import movement, while a delivery challan may be relevant when goods are moved for a purpose other than a taxable sale. The correct document set depends on the consignor, consignee, reason for transport, route, and whether the movement is inter-State or intra-State.

A practical document set should be accessible before the vehicle leaves:

  • the invoice or bill of supply, where the movement is a supply;
  • the bill of entry, where the movement relates to imported goods;
  • the delivery challan where goods are transported for a non-supply reason covered by the rules; and
  • the e-way-bill number and the electronic device or records needed to display the current details.

Keeping the documents available does not remove the officer’s power to verify them, but it can prevent an avoidable delay caused by searching for papers or trying to obtain login access after interception.

How a lawful transit verification normally proceeds

CBIC Circular No. 41/15/2018-GST describes an operational sequence for officers. The circular is dated 13 April 2018, so its form numbers and procedural details should be checked against later notifications before being relied on in a current dispute. Its described workflow is useful for understanding the difference between a routine check and a physical inspection.

  1. Designation of officers: the jurisdictional Commissioner, or an officer authorised by the Commissioner, designates officers to conduct interception and inspection in the specified jurisdiction.
  2. Initial verification: the officer checks the transport documents, the e-way-bill information and the details shown for the consignment and conveyance.
  3. Release where no discrepancy appears: if the records are in order and no discrepancy is apparent, the conveyance may be allowed to proceed.
  4. Statement when documents are missing or inspection is proposed: the circular describes recording a statement in Form GST MOV-01 where the required documents are not produced or where inspection is intended.
  5. Order for physical verification: Form GST MOV-02 is described as the form used for physical verification or inspection of the goods.
  6. Inspection report: the officer prepares the prescribed inspection report, records the result and follows the applicable process if a discrepancy is found.
  7. Extension where permitted: the circular also describes an extension process when the inspection cannot be completed within the initial period.

The circular is administrative guidance, not a substitute for the Act and Rules. If a live matter turns on whether a particular form, deadline or workflow is still current, consult the latest CBIC notifications and the applicable jurisdictional instructions.

Physical inspection is not the same as an ordinary document check

An officer may verify the e-way bill and documents without opening the packages. Physical inspection involves checking the goods against the description, quantity, value or other particulars relevant to the movement. The legal basis and procedural safeguards differ, so a driver should ask what stage the officer is carrying out while remaining cooperative.

Rule 138C creates an important protection against repeated physical checks. If physical verification of goods on a conveyance has already been carried out at one place during transit, further physical verification should not be carried out again in the same State or Union territory unless specific information relating to tax evasion becomes available subsequently. The rule states: “no further physical verification of the said conveyance shall be carried out again in the State or Union territory, unless a specific information relating to evasion of tax is made available subsequently.” The wording and exception appear in the CGST Rules compilation.

This safeguard concerns repeat physical verification. It does not mean that the vehicle can never be intercepted again, that documents cannot be checked again, or that a later lawful action is barred when specific tax-evasion information is received. A second document check and a second physical opening of the consignment are legally different events.

Reporting deadlines and a detention lasting more than 30 minutes

Rule 138C sets online reporting steps for inspection. The figures below are procedural requirements stated in the CBIC-hosted 10 November 2020 compilation of the CGST Rules; confirm any later amendment before using them in a current proceeding.

Event Requirement described in the rules Practical significance
Inspection summary Summary report within 24 hours The inspection outcome must be entered online within the stated period.
Final inspection report Final report within three days, subject to the stated extension provision A completed report records the inspection result and any discrepancy identified.
Vehicle detained for more than 30 minutes Transporter may upload information in Form GST EWB-04 This is a portal reporting facility; the threshold alone does not declare the detention unlawful or create automatic compensation.

The 30-minute figure is often misunderstood. Rule 138D identifies when the transporter may upload information about an interception and detention through Form GST EWB-04. It does not, by itself, establish that every detention beyond 30 minutes is illegal, nor does it automatically award damages. The underlying reason for detention, the officer’s authority and compliance with the statutory process still matter.

  • Ask which verification is being conducted: politely clarify whether the officer is checking documents and e-way-bill data or ordering physical inspection.
  • Cooperate with a lawful inspection: section 68 expressly requires the person in charge to allow inspection of the goods.
  • Record the detention particulars: note the time and place of interception, vehicle and e-way-bill numbers, the officer’s designation, forms issued, documents requested and the time the vehicle is released.
  • Use the reporting facility when appropriate: where the vehicle is detained for more than 30 minutes, the transporter can consider the Form GST EWB-04 upload facility described in rule 138D.
  • Escalate through the business’s GST adviser: if goods are detained, a discrepancy is recorded or a demand is proposed, obtain advice promptly rather than refusing access or attempting to leave.

What happens when the officer finds a discrepancy?

A discrepancy may concern the absence of a required document, a mismatch between the e-way bill and the goods, an expired or incorrect document, or information suggesting that the movement is not what it claims to be. The inspection record and any statement or form issued become important evidence of what was checked and when.

The driver should read forms before signing, request copies or note the document numbers, and make factual corrections if a statement inaccurately records what was produced. Signing receipt of a document is not the same as admitting tax evasion, but a signature on an inaccurate factual statement can create avoidable difficulty. Do not obstruct the officer or conceal goods; instead, preserve the records and obtain professional assistance.

Inter-State and intra-State movements

Rule 138B’s interception framework applies to e-way-bill verification for both inter-State and intra-State movement. The same basic distinction therefore applies whether a truck is crossing a State border or travelling wholly within one State: an authorised officer may intercept a qualifying conveyance, verify the prescribed information and, where authorised and procedurally justified, inspect the goods.

State-specific administrative orders can affect which officers are empowered and how local checkpoints operate. The central rules do not make every local practice identical, so the jurisdiction through which the vehicle is travelling remains relevant.

How current are the cited forms and procedures?

The legal answer that an authorised proper officer may intercept and inspect is grounded in section 68 and the CGST Rules. The operational details in CBIC Circular No. 41/15/2018-GST are older, and the consolidated rules document cited here is dated 10 November 2020. Those materials are not demonstrated to include every amendment effective on 13 October 2026.

For a current dispute, verify the latest official Gazette notifications, CBIC circulars and instructions, and the orders applicable in the State or Union territory where the stop occurred. The facts of the consignment, the officer’s authorisation, the documents available and whether specific tax-evasion information existed can change the legal analysis. A qualified Indian GST professional should review a detention or proposed demand.
