Can a GST Appeal Pre-Deposit Unblock Input Tax Credit?

No—not by itself. A GST appeal pre-deposit is a statutory payment required to get an appeal admitted and, after admission, can help protect the disputed demand from recovery. It does not automatically release input tax credit (ITC) that has been blocked, reverse an ITC denial, or create a re-credit entry in the electronic credit ledger.

There are two separate questions: whether eligible electronic credit can be used to pay the pre-deposit, and whether paying it makes disputed ITC usable again. CBIC guidance addresses the first question only in limited circumstances. Restoration of credit depends on the appellate decision or a specific re-credit mechanism applicable to the case.

What a GST appeal pre-deposit actually does

Under the CGST Act, the pre-deposit is an admission condition. For a first appeal, the taxpayer must pay all admitted dues and the prescribed portion of disputed tax before filing. The Appellate Authority can then confirm, modify or annul the challenged order. The payment does not decide whether the underlying ITC claim is legally valid.

The GST Portal appeal FAQ describes a related recovery effect: when the appeal is admitted, the balance disputed amount is flagged as non-recoverable. That status concerns collection of the demand while the appeal is pending. It is not an order allowing the taxpayer to use the disputed credit.

Think of the process as three distinct events:

  1. Payment for admission: admitted amounts and the required disputed-tax deposit are paid so the appeal can be filed.
  2. Recovery treatment: once the statutory conditions and admission process are satisfied, recovery of the balance disputed demand receives the protection provided by the appeal framework.
  3. Credit restoration: any release, re-credit or recognition of ITC follows the decision on the dispute or a separate statutory or administrative process. The payment itself is not an automatic trigger.

Can you pay the pre-deposit with ITC?

Sometimes, but only when the liability being paid is an eligible output-tax liability and the electronic credit ledger may lawfully be used for it. CBIC Circular 172/04/2022-GST explains that eligible credit balances can be used for output-tax liabilities arising from proceedings, subject to the statutory order-of-utilization rules.

The same guidance excludes reverse-charge liability and other liabilities that do not qualify as output tax. Consequently, the answer cannot be determined from the words “appeal pre-deposit” alone. You must identify what the challenged demand represents and whether the payment is treated as output tax under the applicable provisions.

When ledger use may be relevant

If an order creates an eligible output-tax demand and sufficient credit is available, the taxpayer may be able to use the electronic credit ledger for the permitted portion, following the prescribed utilization sequence. The ledger balance must be available at the time of payment, and using it reduces that balance; it does not preserve the credit for later use.

When ITC cannot fund the payment

Credit ledger use is not available for reverse-charge tax. It is also unavailable for a liability that falls outside the definition of an eligible output-tax payment under the circular and the Act. A cash payment may therefore be required even when the taxpayer has a large ledger balance.

Do not treat a portal acceptance of a challan or debit as proof that the underlying credit was legally available. Retain the order, payment details, ledger extract and the legal basis for the utilization so the entry can be reconciled if the appeal is questioned.

First appeal under Section 107

Payment requirement and percentage

The current displayed Section 107 text requires full payment of admitted dues plus a pre-deposit of 10% of the disputed tax, subject to the statutory cap. The displayed text reflects a 2024 amendment effective 1 November 2024. Because the law applicable to an order and filing can depend on the relevant effective date, verify the provision in force for the particular matter rather than applying the percentage mechanically.

Deadline and filing route

An appeal to the Appellate Authority is filed within three months from communication of the decision or order. A further one-month period may be allowed when sufficient cause prevented filing within the original period. The GST Portal FAQ describes filing FORM GST APL-01 electronically.

  1. Confirm the date on which the decision or order was communicated and calculate the three-month period.
  2. Separate admitted dues from disputed tax. Pay admitted dues in full and calculate the Section 107 pre-deposit on the disputed-tax portion.
  3. Determine whether the liability is an eligible output-tax liability that can be paid from the electronic credit ledger. Exclude reverse-charge and other non-eligible liabilities from any credit-funded calculation.
  4. File FORM GST APL-01 through the GST Portal with the order and supporting grounds.
  5. If the order has not been uploaded on the portal, submit a self-certified copy within seven days as described in the portal FAQ.
  6. Keep the final acknowledgment, FORM GST APL-02, showing the appeal number. The FAQ treats the appeal as filed when that final acknowledgment is issued.

What protection follows admission

The portal FAQ states that the balance disputed amount is flagged non-recoverable if the appeal is admitted. This protects against recovery of that balance during the appeal process under the applicable rules. It does not convert a disputed ITC denial into accepted credit, and it does not require the ledger to be re-credited merely because APL-02 has been issued.

Tribunal appeal under Section 112

An appeal to the Appellate Tribunal is a separate stage with a separate payment calculation. The current displayed Section 112 text requires payment of admitted amounts and an additional 10% of the remaining disputed tax, in addition to the amount paid under Section 107, subject to the statutory cap. The relevant amendment and effective date should be checked for the matter before payment.

Section 112(8) provides a distinct recovery consequence: after the required payment is made, recovery proceedings for the balance are deemed stayed until disposal of the Tribunal appeal. That stay is still a recovery remedy, not a finding that the disputed ITC is allowable.

Issue First appeal Tribunal appeal
Forum Appellate Authority Appellate Tribunal
Payment before filing Admitted dues in full plus 10% of disputed tax, subject to the statutory cap Admitted dues plus an additional 10% of remaining disputed tax, in addition to the Section 107 payment, subject to the statutory cap
Primary recovery effect Portal FAQ describes the balance disputed amount as non-recoverable after admission Section 112(8) deems recovery of the balance stayed after the required payment
Effect on disputed ITC No automatic restoration or re-credit No automatic restoration or re-credit

The two percentages are not interchangeable. A Tribunal appellant must account for the earlier Section 107 payment and the additional amount required at the Tribunal stage.

Why payment does not “unblock” disputed ITC

An ITC block or denial can arise from an assessment order, a restriction in the electronic credit ledger, a reversal requirement, or another statutory control. A pre-deposit addresses the money required to challenge the order and the collection of the resulting demand. It does not amend the order, alter return data, or instruct the portal to create a credit entry.

Only an outcome or procedure that legally changes the credit position can restore usability. Depending on the case, that may be a favorable appellate order, a consequential order giving effect to the decision, or a specific re-credit process. The cited Section 107 and Section 112 provisions, CBIC Circular 172/04/2022-GST and the portal FAQ do not establish an automatic restoration rule triggered solely by paying the pre-deposit.

Illustrative distinction

Suppose an order denies a portion of ITC and raises a corresponding tax demand. Paying the required deposit may allow the appeal to proceed and may protect the unpaid balance from recovery. The denied credit remains disputed until the authority decides the merits and the department gives effect to that decision. If the order instead concerns a reverse-charge liability, an electronic credit balance cannot be used for that tax merely because the payment is labelled an appeal deposit.

DRC-03 payments and the Tribunal issue

CBIC Circular 224/18/2024-GST deals with two specific situations: recovery where an appeal against an Appellate Authority order could not be filed under Section 112 because the Tribunal had not yet been constituted, and adjustment of certain amounts paid through DRC-03 against an appeal pre-deposit.

That circular is a fact-specific administrative clarification. It is not a blanket rule that every voluntary DRC-03 payment counts as a pre-deposit. Eligibility depends on the payment category, the order, the timing and the circumstances covered by the circular. Before treating a DRC-03 debit as satisfying a Tribunal condition, match the payment to the circular’s conditions and retain evidence of the relevant order and dates.

Practical checklist before filing

  • Identify the order: record the issuing authority, communication date, tax period and whether the matter is at Section 107 or Section 112 stage.
  • Classify the demand: separate output-tax demand, reverse-charge tax, interest, penalty and other amounts. The ability to use credit depends on the liability, not on the fact that an appeal is being filed.
  • Calculate each component: admitted dues, disputed tax, the first-appeal percentage and, where applicable, the additional Tribunal percentage. Apply the statutory cap and the version of the law effective for the case.
  • Check the ledger: verify the available balance, prior debits, utilization order and whether the proposed debit is legally permitted.
  • Meet the portal steps: file APL-01, provide a self-certified order copy within seven days when the order is not uploaded, and obtain APL-02 with the appeal number.
  • Preserve records: save challans, ledger statements, the filed form, attachments, acknowledgment and any communication about admission or recovery.
  • Track the credit separately: do not assume that the recovery flag or a successful filing has restored ITC. Follow the appellate order and any consequential re-credit instruction.

Common mistakes and how to correct them

Assuming any ledger balance can be used

A balance is not automatically spendable for every government demand. Reclassify the liability and apply the output-tax and reverse-charge restrictions before debiting credit. If the payment was made incorrectly, obtain professional advice promptly on correction and disclosure; do not create a second debit without reconciling the first.

Confusing a recovery stay with a credit release

A non-recoverable flag or deemed stay prevents or pauses collection of the balance under the appeal rules. It does not change the amount of eligible ITC in the ledger. Keep recovery correspondence and credit-ledger records as separate files.

Missing the acknowledgment event

Preparing APL-01 is not the same as completing filing. The portal FAQ identifies the final APL-02 acknowledgment with an appeal number as the filing event. Monitor the portal until that acknowledgment is available, and address any requirement for a self-certified order copy within seven days.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Treating DRC-03 as universally equivalent

Circular 224/18/2024-GST covers specified circumstances. A DRC-03 payment outside those circumstances may not satisfy the statutory pre-deposit. Check the circular against the exact payment and order before relying on it.

What outcome should you expect?

If your objective is to stop recovery while challenging a demand, the statutory pre-deposit and proper admission can provide that procedural protection. If your objective is to make blocked ITC usable immediately, the pre-deposit alone is insufficient. The credit position changes only when the dispute is resolved or a separate legal re-credit mechanism applies.

Statutory text, effective dates and portal workflows can change. For a live matter, reconcile the order date and filing date with the current CGST Act text, applicable notifications, GST Portal instructions and the relevant CBIC circulars before paying or filing.
