California does not give capital gains a lower state tax rate. The Franchise Tax Board (FTB) says all capital gains are taxed as ordinary income. The harder question when you move is not a simple state-rate ranking. It is whether California still considers you a resident, whether the gain is California-source, when the gain is recognized, and how the destination state treats that particular asset and transaction.
A move can change the tax result, but changing your mailing address shortly before a sale does not automatically end California exposure. Use the framework below for the specific tax year, asset, sale date and residency facts involved.

California’s basic capital-gains rule
The FTB’s “Capital gains and losses” guidance, updated January 28, 2026, states: “California does not have a lower rate for capital gains. All capital gains are taxed as ordinary income.” That is California’s state treatment. It is separate from federal law, where qualifying net long-term capital gains may receive preferential rates.
In practical terms, California generally starts with the gain reported for the transaction and taxes it through its ordinary individual income-tax structure. Holding an asset for more than one year may matter for federal classification, but it does not create a special lower California rate. A federal long-term capital-gain result should therefore not be copied into a California calculation.

The phrase “California capital-gains tax” can hide several different questions:
- Were you a California resident when the gain was received or recognized?
- If you were not a resident, was the income still from a California source?
- What asset produced the gain: publicly traded stock, a private-business interest, real estate, an option or other compensation-linked property?
- Was the transaction a completed sale, an installment sale, an exercise or vesting event, or another recognition event?
- Does the destination state use its ordinary income tax, an exclusion or deduction, or a separate capital-gains regime?
Those answers matter more than a national list that labels one state “high tax” or another “no income tax.”
Residency determines how much income California can tax
Full-year California residents
California residents are generally taxed on worldwide income. That includes investment gains even when the brokerage account, company or buyer is outside California. The key issue is whether the taxpayer was a California resident under the facts for the period in which the income was received or recognized.

FTB guidance describes the part-year rule in two parts: “All worldwide income received while a California resident” and “Income from California sources while you were a nonresident.” Thus, a move during the year requires a period-by-period allocation rather than a single annual assumption.
For the California-resident portion, worldwide income is generally included. After the change to nonresident status, California generally continues to tax California-source income. The return may need resident and nonresident schedules or a part-year filing that separates the periods and sources.
Nonresidents after departure
A nonresident is generally taxed by California on California-source taxable income. The FTB identifies California real property and services physically performed in California as examples of source connections. Investment property that is not California-source may be treated differently, but the asset and transaction have to be examined rather than assumed.

Domicile, residence and continuing ties
California distinguishes domicile and residence. A new lease or a change of address is evidence, not an automatic legal switch. The complete facts can include where you live, work, maintain a home, keep personal and business ties, register vehicles, vote, hold licenses, and spend time. No single day count or statement of intent decides every case.
Before relying on a pre-sale move, document the actual change in living arrangements and the date you believe California residency ended. Also determine when the destination state considers its residency to begin. The two states’ tests and effective dates may not match perfectly.
Use the asset and transaction to determine source
“Capital gain” is not one uniform California category. The asset, the rights being sold and the recognition method can change the source analysis.
Publicly traded stock and other investment securities
For ordinary stock sales, the sale date, the taxpayer’s residency at recognition and the nature of the property are central facts. A person who sells after becoming a nonresident cannot assume the gain is either entirely taxable or entirely exempt without reviewing those facts. The FTB’s examples distinguish stock sales from other transactions and show why residency and recognition timing matter.
California real estate
California real property remains a strong California-source connection after an owner leaves. Publication 1100 gives examples in which later capital-gain installments from California real property remain taxable to a nonresident because the property is located in California. A departure before the buyer’s final payment does not erase that source connection.
Do these 3 things before closing this tab:

Publication 1100 also illustrates circumstances in which gains from property outside California may not be California-source after the taxpayer is a nonresident. That is an example tied to its facts, not a blanket rule for every asset or sale. Confirm the property’s location, the seller’s status and the applicable recognition rules.

Equity compensation and options
Restricted stock, options and other equity compensation can combine compensation sourcing with a later capital gain. Publication 1100 describes situations in which compensation or a gain is taxable because it is recognized while the taxpayer is a California resident and directs readers to separate equity-compensation guidance. Vesting, exercise, sale and work-location dates may all matter. Keep grant documents, vesting schedules, exercise records and work-location records together before filing.
Installment sales
An installment sale spreads recognition over payment dates under the applicable tax rules. Each payment can require a fresh look at the taxpayer’s residency and the asset’s source. For California real estate, the FTB’s examples keep later gain installments within California’s tax base for a nonresident because the property is in California. For property outside California, the result can differ in the illustrated circumstances. Do not extend either example to a different asset or contract without checking the facts.
The comparison checklist for a move
Compare California and the destination state along each of these axes before choosing a sale date or filing position.
| Comparison axis | What to establish | Why it changes the result |
|---|---|---|
| Residency and domicile | When California residency ended, when the new state’s residency began, and evidence of the move and continuing ties | California residents generally report worldwide income; nonresident taxation generally turns on California source |
| Gain character and holding period | Short- or long-term status and whether federal classification is relevant to the state calculation | Federal preferential treatment does not create a lower California rate |
| Asset and location | Stock, private-business interest, real estate, business property, options or other compensation-linked asset; location and use of the property | Sourcing and special rules differ by asset and transaction |
| Sale and recognition timing | Sale date, installment payment dates, exercise or vesting dates and the residency status at each event | The tax year and the period in which income is recognized can change the filing and source analysis |
| Destination-state structure | Ordinary income-tax treatment, separate capital-gains tax, exclusions, deductions, exemptions, thresholds and local taxes | A “no broad income tax” label does not describe every capital-gains rule |
| Filing and double-tax relief | Resident, part-year or nonresident returns, source allocation and possible credits | The same income may appear on more than one state return, but credit eligibility is fact-dependent |
How to compare another state without relying on a slogan
Start with the destination state’s official guidance for the tax year in which the gain is recognized. Answer these questions in order:
- What is the tax mechanism? Determine whether capital gains enter the ordinary income-tax base, receive an exclusion or deduction, or are subject to a separate excise or capital-gains tax.
- Which gains are covered? Check whether the rule applies to short-term gains, long-term gains, particular assets, business interests, real estate or only a defined class of adjusted gains.
- What deductions, exclusions or thresholds apply? Read the statute and current instructions rather than assuming a headline rate applies to the entire gain.
- How does the state define residency and source? A destination may tax residents on worldwide income and nonresidents only on in-state income, but its definitions and allocation rules are its own.
- Are local taxes or special filings involved? County, city or other local rules can add a separate obligation even when the state rule appears simple.
- What return and payment deadlines apply? A separate tax or information schedule may be required even when the gain is excluded from the ordinary income-tax return.
Use the state’s statute, revenue department instructions and current-year forms. A national ranking is not a substitute for this asset-specific review.
Washington shows why “no income tax” is not the whole answer
Washington is a useful contrast to California. Washington law imposes a separate excise tax on individuals with certain adjusted long-term capital gains and sets out deductions and exclusions. That is a distinct statutory regime rather than California’s broad ordinary-income approach.

Washington’s provisions have been amended, so the operative tax year matters. Verify the current statute, definitions, covered assets, deductions, exclusions, filing requirements and any applicable thresholds before quoting a rate or estimating liability. The Washington example does not establish that the state is always cheaper, that every gain is covered, or that a person moving there escapes California tax on a California-source transaction.
The broader lesson is to replace labels with a side-by-side worksheet:
- California treatment of the gain while resident or nonresident.
- Destination treatment under the destination’s current law.
- Any separate state excise or capital-gains return.
- Potential local tax.
- Credit or other relief if both states tax the same income.
Federal and state calculations are separate
Federal law may classify a qualifying net gain as long-term and apply a preferential federal rate. California does not provide the corresponding state-level preference; its FTB rule taxes capital gains as ordinary income. The destination state may follow federal definitions, modify them, or impose a separate system.
Prepare the federal calculation and each state calculation as related but distinct work. Do not infer a state result from the federal Schedule D classification alone, and do not assume that a federal exclusion or rate automatically carries into a state return.
What a move-year analysis should document
For a substantial gain, assemble a timeline before filing:
Recommended Free Tools
- List the asset, acquisition date, basis records and expected gain.
- Mark the contract date, closing date, settlement date or other recognition event.
- For installment transactions, list every expected payment and the gain recognized with each payment.
- For equity compensation, list grant, vesting, exercise, work-location and sale dates.
- Record where you lived and worked during each period, along with the date of any permanent move.
- Gather evidence of domicile and continuing ties in both states.
- Identify California-source components, especially California real estate and services performed in California.
- Read the destination state’s current-year rules for the exact asset and gain type.
- Determine which resident, part-year and nonresident returns and schedules are required.
- Check whether an Other State Tax Credit or another relief provision may apply, and calculate it under the relevant instructions.
Keep the records that support the timeline. A return position based only on a forwarding address or a sale date is difficult to defend if the residency facts point elsewhere.

Common scenarios and the questions they raise
“I moved out of California before selling stock. Is the gain automatically exempt?”
No automatic exemption follows from the move. Confirm when California residency actually ended, whether the stock gain was recognized after that date, and whether any California-source rule applies. The FTB’s guidance treats residency and source as separate questions.
“I sold California property after moving. Why would California still tax me?”
California real property is a California-source connection. Publication 1100’s installment examples show that later gain payments can remain taxable to a nonresident because the property is located in California.
“I received an installment payment after leaving. Which state gets it?”
Identify the asset, the payment’s gain component, the recognition date and your residency on that date. California’s treatment can continue for California real estate, while an out-of-state asset may have a different result in the illustrated circumstances.

Equity compensation can involve separate vesting, exercise and sale events. Publication 1100 describes cases where income is taxable because it is recognized while the taxpayer is a California resident and points to separate equity-compensation guidance. Review the grant and work-location history rather than using only the sale date.
“Does Washington have a capital-gains tax?”
Washington law includes a separate excise tax on certain adjusted long-term capital gains, with statutory deductions and exclusions. Because the law has been amended, check the current tax year and the specific gain before deciding whether it applies.
When professional help is justified
A California multistate tax professional or tax adviser for a move from California can be useful when the gain is large, the move occurred near the sale, California real estate is involved, payments will arrive over several years, or equity compensation spans multiple work locations. The adviser should analyze the residency timeline, source allocation, destination-state rules, filing obligations and any credit calculation—not simply apply a headline state rate.
This framework is for comparison and planning, not an individualized residency determination or tax calculation. State statutes and administrative guidance change, so use the rules and forms for the year in which each item is recognized.
