Yes, an Australian can potentially acquire a lawful interest in an off-plan property in Bali or Lombok, but an English-language promise of “freehold” or “ownership” is not proof of what you will receive. Before paying a reservation fee, identify the Indonesian land right, the eligible holder, the project approvals, and the contract’s protection if construction or registration fails. Foreign individuals cannot hold Hak Milik (the Indonesian freehold title) in their own name, and nominee arrangements carry legal risk. An independent Indonesian lawyer and, where relevant, a PPAT (land-deed official) must assess the proposed structure against the actual parcel and your intended use.
This checklist is a transaction-screening guide, not individualized legal, tax, immigration or investment advice. Indonesian rules and local administrative practice can change; the information below reflects official material available on 13 October 2026. Treat every unresolved item as a condition to verify before signing or releasing substantial funds.

Start with the decision gate: what exactly are you buying?
Off-plan marketing often describes a villa, house or apartment as an investment without stating the legal interest that will be delivered. Your first task is to turn the advertisement into a written specification. Ask the seller or developer for:
Recommended Free Tools
- the exact parcel address, village, regency and province, plus a site plan and coordinates;
- the land-certificate number and certificate type;
- the registered landholder’s full legal name and the developer’s legal entity name and registration details;
- the proposed building use (private residence, holiday home, long-term rental, short-term accommodation or business premises);
- architectural drawings, floor area, specifications, facilities and promised completion date; and
- the draft purchase, lease, binding sale, construction or other agreement you would sign.
Do not evaluate projected rental returns or a discount before these facts are available. The legal route, permits and operating permissions can differ according to your use and the parcel’s planning status. This general checklist cannot establish your eligibility, a site’s lawful use or the validity of any particular developer’s documents.

Understand the land right instead of relying on “freehold” or “leasehold”
Indonesian land rights are distinct legal interests. Obtain the precise right, its registration evidence, duration, transfer and renewal terms, permitted use and expiry consequences in writing. The official framework is Government Regulation (PP) 18/2021 on management rights, land rights, apartment units and land registration; the ATR/BPN record identifies it as in force from 2 February 2021 and notes that it revoked earlier regulations including PP 40/1996 and PP 103/2015: ATR/BPN PP 18/2021 record.
| What the sales material says | Evidence you must obtain | Why the label is insufficient |
|---|---|---|
| Freehold or ownership | The certificate type, registered holder, parcel details, encumbrances and the legal instrument that would put the promised interest in your name or otherwise make it enforceable. | “Freehold” is an English marketing term. It does not establish that an Australian individual can receive Hak Milik. |
| Leasehold | The registered land right being leased, lease term, commencement date, renewal formula, assignment rules, permitted use, registration or recording method and what happens to the building when the term ends. | A lease may be a contract over land held by someone else; its duration and enforceability depend on the actual documents and law. |
| Foreign ownership or investment structure | A written opinion from independent Indonesian counsel identifying the lawful right, eligible holder, corporate or personal requirements, approvals and exit route for your facts. | There is no universal structure that is safest for every buyer, project or intended use. |
Have an independent lawyer or PPAT inspect the original or verifiable documents and the current land-office record. Ask for a written discrepancy report, not merely a translation of the seller’s brochure.
Can an Australian hold Indonesian freehold land?
An official Central Lombok Prosecutor Service explanation states that foreign individuals cannot hold Hak Milik in their own names and warns that nominee arrangements create legal risk: HaloJPN response on foreign property rights and nominees. A Ministry of Finance government explainer also summarizes limits on foreign property rights and cites PP 18/2021: DJKN ownership explainer.

1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteThat does not answer which alternative, if any, fits your circumstances. Eligibility can depend on the buyer, the right, the property, the intended use and current administrative requirements. Do not let a seller solve the restriction by asking you to sign a private nominee declaration, power of attorney or side letter. Have counsel explain who would legally control the land, who could mortgage or transfer it, what happens if the relationship ends, and whether the arrangement could be challenged or leave you without the promised control.
Require the proposed structure in the contract and supporting deeds, with the responsible Indonesian professional identified. If the seller refuses to disclose the right or insists that a nominee is “standard” and needs no independent review, stop the transaction rather than treating that refusal as a minor paperwork issue.
Step 1: Define your buyer profile and intended use
Write a one-page brief before instructing professionals. Include:
Rank #2
- Ideal for Gifting
- Ideal for a bookworm
- Compact for travelling
- your nationality, whether you will buy personally or through an entity, and who will occupy or operate the property;
- personal residence, occasional holiday use, long-term rental, short-term accommodation or another business purpose;
- whether you expect to resell, assign, refinance or transfer the interest;
- your target completion date and maximum exposure before handover; and
- any need for staff accommodation, a pool, commercial events, signage, restaurant activity or other features beyond a private home.
Give this brief to your independent lawyer, planner or permit adviser. The right to hold or use land does not itself authorize the advertised rental business or every building activity. A use that appears acceptable in a brochure may require separate local approvals or conflict with spatial planning.

Inspect the land record
Ask the lawyer or PPAT to obtain and reconcile the certificate and current land-office information. The review should cover:
- certificate type and registered holder;
- parcel number, boundaries, measured area and map;
- mortgages, liens, seizure notices, leases, easements or other registered rights;
- disputes, overlapping claims, inheritance issues or pending transfers;
- legal and physical access from a public road;
- the relationship between the parcel and the developer’s site plan; and
- whether the promised right can be registered, recorded or otherwise enforced in the way the contract describes.
Visit the boundaries with an independent surveyor when area, access or neighboring construction matters. A glossy certificate copy does not show whether the marketed villa sits wholly inside the parcel or whether a driveway crosses land controlled by somebody else.
Confirm who may sign and receive money
Match every name in the land documents, company records, building approvals, contract and payment instructions. Confirm the signatory’s authority through the company’s constitutional documents, board or shareholder resolutions and any power of attorney. The account receiving staged payments should belong to the contracting entity or be explained and documented; do not pay an individual agent because the brochure uses the developer’s logo.
Ask whether the land is already mortgaged or used as security for project finance. If so, obtain the lender’s release or consent arrangements for your unit or lease. Your lawyer should state what document proves that the interest promised to you will not remain subordinate to an undisclosed encumbrance.

Step 3: Check planning, zoning and parcel-specific constraints
Obtain written confirmation from the proper local authority that the exact parcel permits the proposed building and your intended use. Bali and Lombok contain multiple regencies and local planning authorities, so a statement that a project is “in a tourism zone” is not parcel-level evidence.
Rank #3
Ask the independent reviewer to verify:
- spatial-use or zoning compatibility for the building and any rental or commercial activity;
- road access, setbacks, boundary conditions and utility connections;
- coastal, river, slope, flood, protected-area or other environmental constraints where applicable;
- required environmental or local approvals for the scale and use proposed;
- water, wastewater, electricity, internet and rubbish arrangements; and
- local cultural, heritage or community restrictions that could affect design, construction or operation.
Keep this as a signing gate. The broad legal framework cannot certify a specific site’s zoning, access, environmental approval or local construction status. Require the parcel reference and authority response in writing rather than relying on a map pin or an agent’s verbal assurance.
Step 4: Confirm the building approvals before construction
PBG: permission to build
Under the current building framework, the Persetujuan Bangunan Gedung (PBG) is the government approval for building work, including proposed construction or alteration. Ministry of Public Works guidance explains that plans are assessed against technical standards: Ministry of Public Works building-law and SIMBG guidance. The official OSS portal provides the basic requirements for building-construction approval and a PBG application guide: OSS PBG requirements and OSS PBG application guide.
Request the project-specific PBG, approved drawings, site plan, structural and utility specifications, and any conditions attached to the approval. Have your professional confirm that:
The Tool Desk
Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →- the PBG names the same parcel and legal project entity shown in your contract;
- the approved building count, floor area, height, setbacks and use match what you are buying;
- your villa is included, not merely a generic approval for a different phase; and
- later design changes will be approved before construction departs from the plans.
The former IMB label is older terminology. Do not assume an IMB copy, a screenshot or a permit for another building proves that a current project has the required PBG. Verify authenticity and coverage with the relevant authority.
SLF: evidence the completed building is fit for use
The Sertifikat Laik Fungsi (SLF) is the government-issued statement that a completed building is fit for use, according to the Ministry guidance above. Before final payment, ask which SLF and other completion documents the project requires, who applies for them, and how issuance will be confirmed with the local authority. A PBG before construction is not a substitute for completion and fitness documentation at handover.
Set a contract condition that you receive copies of the required approvals and that the building is not represented as ready for occupation or rental until the applicable completion documents are issued.
Rank #4
Step 5: Make the contract a risk-control document
Have independent Indonesian counsel review the contract in the Indonesian version that will govern. Ask for a bilingual version only if the lawyer confirms which text controls. The contract should identify the land, right, building and parties precisely, and should answer these questions:
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- What is being transferred or leased? State the land-right type, certificate details, term, commencement date, permitted use, renewal or extension mechanics, registration steps and expiry consequences.
- Who controls the land and project? Name the registered holder, developer, builder, sales entity and any security holder. Require notice and consent for a change of control that could affect delivery.
- What are you buying? Attach approved plans, specifications, finishes, furniture schedules, area tolerances, shared facilities, access rights and utility responsibilities.
- When and how do you pay? Link each instalment to objective evidence such as verified construction milestones, authority documents or an independent inspection. State the payment recipient and account.
- What if work is late or never completed? Define the practical completion date, narrowly drafted extension events, notice requirements, termination rights, refund timing, interest or other agreed remedies, and what happens if the developer becomes insolvent.
- How are defects handled? Include inspection rights, a defects list, rectification deadlines, retention or holdback if negotiated, warranty periods and a process for unresolved defects.
- How do registration and handover occur? List the documents, responsible party, deadlines, costs and cooperation required to document the land right, building and utilities.
- Can you sell or assign? State assignment, resale, subletting, management and transfer restrictions, including any consent or fee.
- Where are disputes resolved? Identify governing law, forum, language, notices, interim remedies and enforcement practicality. Your lawyer should explain whether a foreign judgment or arbitration award would be useful against the actual parties and assets.
Do not assume staged payments are held in escrow or insured. No universal escrow protection for private off-plan villa purchases was established here. If the seller proposes an escrow, ask who controls it, the release conditions, insolvency treatment and governing documents; have counsel verify rather than relying on the word “escrow.”
A regulation recorded in the official BPK database concerns preliminary sale or binding sale agreements for public housing and public apartment units, effective 1 April 2021. Its stated scope does not establish that the same protections govern every private villa project: BPK record for Permen PUPR 16/2021.
Step 6: Control construction while the villa is being built
Nominate an independent local architect, engineer or building inspector if the project’s scale and your exposure justify it. The inspector should be engaged by you, not only recommended and paid by the seller. Agree the inspection scope and reporting format before the first construction draw.
At each milestone, compare the site with the approved plans and contract:

Step 7: Treat handover as a separate approval stage
Do not make final payment merely because the villa looks complete. Use a handover checklist that reconciles the physical property, documents and legal interest:
- Walk the property against the signed plans and specification schedule.
- Test water pressure, drainage, hot water, electricity, air-conditioning, internet provision, appliances, pool systems, locks and safety equipment.
- Verify access roads, parking, shared facilities, boundaries and any promised management services.
- List every defect, incomplete item and substitution, with photographs and a rectification deadline.
- Obtain the required SLF and other completion or occupancy documents, and confirm them with the responsible local authority.
- Receive the agreed land-right certificate, deed, lease or registration evidence, plus proof of any release from project financing that must occur.
- Collect utility account information, warranties, manuals, keys, security deposits and building-management rules.
- Sign acceptance only with reservations for unresolved items and only after your lawyer confirms that the contractual handover conditions are met.
Documents to keep in one transaction file
Maintain an indexed digital and paper file. At minimum, retain:
- advertisement and every later representation about ownership, returns, completion or use;
- passport and buyer-entity documents supplied for compliance;
- land certificate copies, land-office searches, maps, survey and access evidence;
- company authority documents for the seller, developer and signatories;
- PBG, approved plans, technical reports and correspondence with authorities;
- zoning or spatial-use confirmation and environmental or local approvals where applicable;
- the signed contract, Indonesian-language version, amendments and notices;
- invoices, bank confirmations and milestone inspection reports;
- construction photographs, variations, defect lists and handover minutes; and
- SLF, registration or deed documents, utility records and evidence of any mortgage release.
Keep originals or properly verified copies with your Indonesian counsel. A translation helps you understand a document but does not replace checking the source document and the authority record.
Red flags that justify stopping or escalating the review
- The seller will not disclose the certificate number, registered holder or exact parcel.
- “Freehold” is promised to you personally even though no lawyer has explained the eligible Indonesian right.
- A nominee is presented as a risk-free workaround, or you are asked to sign a side agreement hidden from the landholder or authorities.
- The contract names a different company from the entity receiving deposits or holding the land.
- Payments are requested in cash, to an individual account or before objective milestones without a documented protection.
- The project has only an old IMB reference, a generic permit or a screenshot that does not identify your building.
- The developer says zoning, environmental clearance or rental licensing will be “sorted out later.”
- Plans, floor area, completion dates or facilities change without a signed variation and remedy.
- You are discouraged from using an independent Indonesian lawyer, PPAT, surveyor or inspector.
- The seller refuses to state what happens to your money, lease and building if construction stops or the developer fails.
Questions this checklist cannot answer without the actual parcel
Do not fill these gaps with generic internet advice. The available official material does not establish:
- your personal eligibility for a particular foreign-held right or visa/residency route;
- the exact zoning, access, environmental approval or permit status of a Bali or Lombok parcel;
- tax, notary, registration, management or operating costs for your transaction;
- the developer’s solvency, title history, construction quality or ability to deliver;
- current property-price thresholds, market returns or failure rates; or
- a universally safe ownership, lease, company or nominee structure.
Ask independent Indonesian counsel to answer each item in writing for your facts, and obtain specialist tax or immigration advice where those issues affect the decision. A seller’s projected return is an assumption, not evidence that the use is authorized or the income will occur.
A practical go/no-go sequence
- Define the use and buyer. Write the personal, rental or business purpose and the intended exit.
- Collect the core documents. Obtain the parcel, certificate, parties, plans and draft contract before paying more than a fully refundable reservation, if any.
- Instruct independent professionals. Use an Indonesian lawyer and PPAT; add a surveyor, planner or building inspector as the documents and construction risk require.
- Clear the land-right gate. Confirm the right, holder, encumbrances, access, duration, transfer route and expiry result.
- Clear the planning gate. Verify parcel-specific zoning, intended use, environmental and local constraints.
- Clear the building gate. Verify the project PBG and approved plans, then define the SLF and handover evidence required.
- Negotiate payment and failure protections. Tie instalments to evidence, specify delay and termination remedies, and document insolvency and refund mechanics.
- Monitor and inspect. Record construction, approve variations and withhold disputed milestone payments under the contract process.
- Complete handover only after evidence. Reconcile the finished building, defects, completion documents and land-right registration before final acceptance.
If any gate fails, pause. The cost of a second legal opinion or site inspection is usually easier to quantify than the cost of discovering after completion that the promised right, use or approval was never available.
Bottom line for Australian buyers
The central question is not whether a brochure says you can buy a villa in Bali or Lombok. It is whether an identifiable Indonesian land right and building can lawfully be granted to an eligible holder, for your intended use, on the exact parcel, with approvals and a contract that gives you a realistic remedy if the project fails. Verify the land record, reject nominee shortcuts, confirm PBG before construction and SLF at handover, and make independent Indonesian review a condition of signing and payment.
