Approval is not automatic: your loan or consolidation date controls the legal standard, and your application must connect specific school conduct to your enrollment decision and financial injury.
Start by checking the dates for each federal loan, gathering firsthand records, and describing who said or failed to say what, when it happened, why it mattered, and how it harmed you. The U.S. Department of Education reviews your allegations and evidence, obtains a school response, and may take years to decide. Confirm the current application before filing; a PDF used in prior guidance displayed a July 31, 2026 expiration date, so its form and instructions may have changed.

What borrower defense to repayment can do
Borrower defense is a federal process that may cancel (“discharge”) all or part of eligible federal student-loan debt when a school’s qualifying misconduct induced enrollment or continued enrollment and caused financial harm. It is not a general remedy for an unsatisfying education, poor grades, a difficult instructor, or disappointing career results. The conduct must fit the rule that applies to the loan, and the application must explain the causal chain from school conduct to your enrollment decision to your harm.
Relief is tied to applicable federal loans. The process does not create a private-loan discharge program, and approval does not automatically mean a refund of every payment or erase unrelated debts. The Department evaluates the loans and facts covered by each claim.

Check the loan and consolidation dates first
The Department’s application divides claims into three regulatory periods. A consolidation date can place a loan in a different period from the dates of the underlying loans, and separate loans in one account can be evaluated under different rules. Do not rely only on the date you first attended school.
| Loan or consolidation period | Rule named in the application | Core conduct described | State-law requirement | Intent or knowledge | Harm described |
|---|---|---|---|---|---|
| On or before June 30, 2017 | 34 C.F.R. § 685.206(c) | Untruthful or misleading statements or acts used to induce enrollment or continued enrollment; the information had to matter to the decision. | The application describes a basis to successfully sue under applicable state law. | The summary focuses on the untruthful or misleading nature of the statement or act; apply the regulation and facts carefully. | You must show resulting harm. |
| July 1, 2017 through June 30, 2020 | 34 C.F.R. § 685.222(a) | Material misleading statements or acts; certain information concealed, suppressed, or omitted; some failures to perform important enrollment-contract obligations; and certain qualifying favorable contested judgments. | The application’s routes have different elements; a settlement agreement alone does not satisfy the judgment route described there. | The application emphasizes materiality and the applicable conduct category. | The misleading conduct or other qualifying breach must have caused harm. |
| On or after July 1, 2020 | 34 C.F.R. § 685.206(e) | A misleading statement or act that was important to the decision to enroll or remain enrolled. | The application summary does not state the same state-law-suit element used for the earliest period. | The school must have made the statement or act with knowledge of its false, misleading, or deceptive nature. | You must show resulting financial harm. |
This table is a practical orientation, not a substitute for the regulation or individualized legal advice. If you consolidated, list the original and consolidation dates and ask how each loan will be treated rather than assuming one standard controls the entire account.
How to verify the dates
- Download your federal loan history from your official federal-aid account and identify the disbursement, origination, and consolidation dates for every loan.
- Separate loans that were never consolidated from loans created or re-created through consolidation.
- Match each loan to the period above and keep a copy of the date information with your claim file.
- If your records conflict, ask your servicer for a written transaction history and preserve both versions while you resolve the discrepancy.
What kind of conduct by the school can lead to an approved application?
The application asks that exact question. Examples below illustrate the kinds of facts the Department identifies; none guarantees eligibility. Your account should identify the representation, omission, or other act and explain why it was important to your decision.
Employment, salary, or placement claims
A school may have represented that graduates would obtain a particular job, salary, placement rate, or career outcome. Explain the source, such as an admissions employee, advertisement, website, brochure, or written communication; what was promised or implied; when you saw it; and how it influenced enrollment. A disappointing job search by itself is not enough. The issue is whether the school’s statement was materially misleading under the period that applies and whether it caused the covered harm.

Licensure, certification, and program eligibility
Some programs must meet licensing, certification, accreditation, clinical-hour, or examination requirements. If the school represented that the program qualified you for a license or certification when it did not, identify the credential, the governing requirement you later encountered, and the school’s statement or omission. Include notices from a licensing authority when available.
Instructors and program delivery
Claims can involve statements about instructor availability or qualifications, or other central features of how the program would be delivered. Describe the promised faculty or access, what actually occurred, the dates, and why the difference mattered when you enrolled. A single scheduling inconvenience is not automatically qualifying misconduct; the facts must fit the applicable rule.
Transferability of credits
If the school represented that credits would transfer to a named institution or broadly to other programs, document the representation and the receiving institution’s refusal or limitation. State whether the school made a specific guarantee, used unqualified language, or failed to disclose a restriction that was important to your decision.

Concealed, suppressed, or omitted information
For the July 1, 2017–June 30, 2020 period, the application separately describes certain information that a school concealed, suppressed, or omitted. An omission is not automatically actionable: explain what was withheld, why it was material, how the school had a duty or opportunity to disclose it under the applicable standard, and how the missing information changed your decision.
Enrollment-contract failures and contested judgments
For the middle period, the application describes some failures to perform important obligations in an enrollment contract and certain favorable contested judgments. Identify the exact contractual promise and the school’s failure. If relying on a judgment, provide the court document and show that it fits the application’s described route. A settlement agreement alone does not meet that judgment route.
Build an evidence file before you write
The Department strongly encourages detailed information. Gather what you actually possess and label each item by date and source. The goal is a truthful, chronological record—not a larger file for its own sake.
| Record | What it can establish | How to use it |
|---|---|---|
| Emails, text messages, letters, and other direct communications | The speaker, wording, date, and context of a representation or response. | Save the complete thread, including sender addresses, attachments, and surrounding messages. |
| Advertisements, brochures, websites, and social-media promotions | Public statements about jobs, salaries, licensing, credits, costs, instructors, or aid. | Preserve dated copies or screenshots with the page address and surrounding language; do not crop away qualifying terms. |
| Course catalogs and student manuals | Program requirements, policies, faculty descriptions, transfer language, and promised services. | Mark the edition or academic year and the pages that mattered to enrollment. |
| Enrollment agreements and other contracts | Promises, disclosures, fees, refund terms, and obligations relevant to a contract-performance theory. | Submit the signed version if available and identify the clause, not merely the document title. |
| Transcripts, diplomas, and program records | What you attended, completed, or received and the timing of events. | Use them to anchor the timeline; they do not by themselves prove deception. |
| Licensing or certification notices | Why a program or credential did not qualify as represented. | Include the issuing authority, date, and exact reason given. |
| Invoices, account statements, award notices, and loan histories | Tuition, fees, borrowing, payments, and financial consequences. | Reconcile amounts and explain which costs resulted from the alleged conduct. |
| Court judgments | A potentially relevant contested judgment for the middle-period route. | Provide the judgment and explain why it matches the application’s requirements; a settlement alone is not enough for that route. |
These are examples, not a checklist requiring every item. If a record is unavailable, say so and explain what you remember without inventing wording. Do not present another student’s informal account as a school representation unless you have a factual basis for attributing it to the school.

How to write a clear borrower-defense claim
Organize the narrative so a reviewer can test each element against the correct date period. Use separate sections for separate loans or materially different events.
- Identify the loan. State the loan type, school, attendance dates, original disbursement information if known, and any consolidation date. Explain which regulatory period you believe applies and flag uncertainty.
- Name the actor. Give the person’s name and title when known—for example, an admissions representative, financial-aid employee, instructor, or school publication. If you do not know the name, describe the office, communication channel, and date.
- Quote or accurately summarize the conduct. Use exact words only when you have a record. Otherwise identify the substance and make clear that it is your recollection. Include the communication’s date and location.
- Explain materiality and reliance. State what decision you were making, why the information mattered, and what you did because of it: enrolled, stayed enrolled, selected a program, borrowed, or declined another option.
- Describe the truth and the harm. Explain what you later learned, when you learned it, and the financial loss that followed. Tie amounts to records where possible, distinguishing tuition, fees, loan balances, payments, lost opportunities, or costs of corrective education.
- Attach and index evidence. Use simple labels such as “Exhibit A—April 2019 email” and refer to each exhibit in the narrative. Keep originals and submit copies or electronic files in the format the current application accepts.
- Separate firsthand facts from inference. Say “I was told,” “the catalog stated,” or “the licensing board notified me” rather than asserting an unsupported conclusion about the school’s intent.
- Review the certification. The application requires certification that your information is true and complete and warns against knowingly false statements. Correct errors, disclose uncertainty, and never guess at a detail merely to make the claim sound stronger.
How the Department reviews a claim
The Department reviews the allegations and evidence, requests a response from the school, considers the available material, and notifies the borrower when it reaches a decision. The process can take years depending on application volume. No universal processing time or average has been promised, so keep your contact information current and retain a complete copy of what you submitted.
What a school response means
A school may dispute your account or provide its own records. Read the response carefully and preserve it. If the Department requests additional information, answer the specific questions with documents and a chronological explanation. Do not expand the claim with unrelated complaints that you cannot connect to enrollment and harm.
Possible outcomes and limits
A decision may grant or deny relief for particular loans or claims. Because loans from different periods can receive different determinations, one result does not necessarily resolve every loan in a consolidated or multi-loan history. The application and decision should control what is discharged and whether any related payment or balance adjustment is made.

Payment, forbearance, and collections while a claim is pending
The application offers a choice about forbearance or stopped-collection status while a claim is pending. You do not have to choose forbearance to apply, and you may continue making payments. The choice has financial consequences: if the claim is denied, the amount owed may be higher, and borrowers who want to make interest payments should contact their servicer.
- Continuing payments: Ask your servicer how payments will be applied and keep confirmations.
- Requesting the available pending status: Read the current form’s terms, including how interest and capitalization are handled, before selecting it.
- Needing interest-only or other arrangements: Contact the servicer and obtain written instructions tailored to your loan type.
Do not stop paying solely because an application was filed unless the current form and your servicer confirm the status that applies to you. A pending claim is not an approval.
Common mistakes that weaken an application
- Using the wrong date period: A borrower may cite the rule for the original loan while a consolidation date changes the applicable analysis.
- Describing only a bad outcome: “I could not find a job” does not identify what the school said, why it was misleading, or how it induced enrollment.
- Relying on general dissatisfaction: A poor experience must be connected to qualifying conduct and financial harm.
- Leaving out the actor or timing: Without a person, office, date, or communication, the Department has less to evaluate.
- Overstating certainty: Do not turn a recollection into a quotation or claim knowledge of an employee’s intent without evidence.
- Submitting irrelevant volume: Hundreds of unrelated pages can obscure the records that prove your elements.
- Treating a settlement as a qualifying judgment: The middle-period judgment route described in the application requires more than a settlement agreement alone.
- Ignoring financial causation: Identify the debt, payment, or other financial injury that resulted from the enrollment decision.
- Assuming silence always qualifies: An omission must fit the applicable period’s standard and be material to your decision.
- Forgetting the certification: Knowingly false statements can damage the claim and create separate consequences.
Practical next steps
- Confirm that the debt is an eligible federal student loan and list every loan and consolidation date.
- Check the current Department application and instructions; do not use a form after its displayed expiration date without confirming that it remains accepted.
- Create a timeline from recruitment through enrollment, attendance, discovery of the problem, and financial consequences.
- Collect the strongest firsthand records and preserve their dates, complete context, and original files.
- Map each alleged statement, omission, or contractual failure to the rule period for the affected loan.
- Calculate the financial harm conservatively from account records and explain assumptions.
- Write separate, factual narratives for distinct events or loans and index the exhibits.
- Review every sentence for accuracy, mark uncertain memories as such, and complete the truth-and-completeness certification.
- Submit through the current channel, save confirmation, and monitor messages from the Department and your servicer.
- While waiting, decide deliberately whether to keep paying or request an available pending status, after reviewing the consequences with your servicer.
FAQ
Can I qualify if the school was simply disappointing?
Not necessarily. The claim must identify qualifying misconduct under the rule tied to the loan or consolidation date, show that it mattered to enrollment or continued enrollment, and establish resulting harm.

No. Original and consolidation dates can place loans in different regulatory periods, so separate loans may receive separate determinations.
Do I need every document listed in the application?
No. The listed emails, catalogs, contracts, transcripts, advertisements, judgments, and other records are examples. Submit what you have, explain gaps, and avoid guessing or embellishing.
How long will a decision take?
The Department warns that adjudication may take years depending on volume. It does not promise a fixed timeline.
Must I enter forbearance to file?
No. The application says you may apply without choosing forbearance and may continue payments, but the available pending-status choice can affect interest and the amount owed if the claim is denied. Review the current form and contact your servicer.
