Is GST applicable on road maintenance charges? Sometimes. The invoice label is not enough: GST treatment depends on the actual supply, whether goods or replacement parts are included, who receives it, and whether the road is for general-public use. A qualifying public-road repair or maintenance works contract appears in the CBIC service-rate table at a combined 12% (6% CGST plus 6% SGST for an intra-state supply, or 12% IGST for an inter-state supply). A qualifying pure service to a government body or local authority may be exempt. Toll or road-access charges and deferred annuity payments for road construction are separate issues.

Use the classification process below before issuing an invoice or claiming an exemption. The final result must be checked against the current notification, place-of-supply rules and the exact contract.

Quick answer: classify the charge before applying GST

What the customer is paying for Possible GST treatment Conditions to verify
Repair or maintenance of a road, bridge, tunnel or road-transport terminal for general-public use under a composite works contract 12% combined rate: 6% CGST + 6% SGST for an intra-state supply, or 12% IGST for an inter-state supply The contract must fit the specific rate entry and the current notification; confirm the supply, recipient, location and road use.
Pure service supplied to the Central Government, a State Government, a Union territory or a local authority May be exempt There must be no supply of goods, and the service must relate to a function entrusted to a Panchayat under Article 243G or a Municipality under Article 243W.
Payment for access to a road or bridge, such as a toll CBIC guidance treats the cited toll/access service as exempt This is a road-access charge, not automatically a maintenance-service charge.
Deferred annuity paid for constructing a road Not exempt under the cited annuity entry CBIC distinguishes road construction under heading 9954 from the heading covered by that exemption.

The table is a starting point, not a blanket ruling. The Central Board of Indirect Taxes and Customs (CBIC) publishes the statutory framework in the Central Goods and Services Tax Act, 2017 and the applicable service entries in its GST Goods and Services Rates material.

Why the words “road maintenance charges” do not decide taxability

A contract described as “road maintenance” can contain very different supplies. A contractor may resurface a highway, supply bitumen and aggregates, replace guardrails, provide only labour, operate a toll plaza, or receive an annuity for a construction project. Those activities do not share one GST result.

Start with the work order, tender, bill of quantities, technical specifications and invoice. Identify what the supplier is actually obliged to do and what the customer actually receives. Then test the supply against the relevant rate or exemption entry. A label used by a department, contractor or accounts team cannot turn a taxable works contract into a pure service, or turn a toll into maintenance income.

The five classification questions

  1. What is the supply? Is it repair, resurfacing, routine upkeep, labour, road access, construction or a bundled package?
  2. Are goods supplied? Look for bitumen, aggregate, concrete, steel, replacement lights, signs, barriers, machinery supplied as part of the obligation, or any other transferred item.
  3. Who is the recipient? Record whether it is the Central Government, a State Government, a Union territory, a local authority, a private concessionaire or another customer.
  4. What is the road’s use? The specific 12% works-contract entry refers to roads and related infrastructure for use by the general public.
  5. What kind of payment is it? Separate a maintenance fee from a toll or access charge and from a deferred construction annuity.

When the 12% public-road works-contract rate can apply

CBIC’s service-rate table contains a combined 12% entry for certain works contracts involving the repair or maintenance of roads, bridges, tunnels or road-transport terminals for use by the general public. For an intra-state supply, that combined rate is ordinarily expressed as 6% CGST plus 6% SGST; for an inter-state supply, it is 12% IGST. Check the current table and notification before relying on the rate because classifications and conditions must be applied to the contract in front of you.

This entry is relevant where the supplier is performing a composite works contract rather than supplying an isolated professional or labour service. A typical example is a contractor engaged to mill and resurface a public highway, provide the specified materials, repair the road surface and hand over the completed work. Whether a particular agreement qualifies still depends on its legal scope and the applicable notification.

Conditions to document

  • Infrastructure: Identify the road, bridge, tunnel or road-transport terminal covered by the order.
  • Public use: Keep the tender or authority records showing that the facility is intended for general-public use.
  • Scope: Match the actual activities to repair or maintenance, rather than relying on a generic title.
  • Contract form: Establish whether the agreement is a works contract or another composite supply.
  • Tax type: Determine whether the supply is intra-state or inter-state before splitting CGST/SGST or charging IGST.

Do not quote “12% for all road maintenance” on an invoice. A private-site driveway, a supply of repair materials without the contracted works, a toll collection service, or a mixed agreement may require a different analysis.

When a pure-service exemption may apply

A separate exemption may cover a pure service supplied to the Central Government, a State Government, a Union territory or a local authority, when the service relates to a function entrusted to a Panchayat under Article 243G or a Municipality under Article 243W of the Constitution.

CBIC’s Sectoral FAQs explain the key boundary: In the context of the language used in the notification, supply of services without involving any supply of goods would be treated as supply of ‘pure services’. Read the full FAQ in CBIC’s Sectoral FAQs.

What “pure service” means in practice

A contract may be considered service-only where the supplier provides labour, supervision, inspection, cleaning or similar activity and does not supply goods as part of the contractual promise. The exemption is conditional: the recipient and the constitutional-function connection must also fit the entry.

For example, a local authority might engage a service provider to sweep a municipal road using the authority’s equipment, with no transfer of consumables, replacement items or other goods. That could warrant testing against the pure-services exemption. It is not enough that the work happens on a public road or that the customer is a government department.

Why a government customer alone is insufficient

  • The recipient must be one of the specified government bodies or a local authority.
  • The service must relate to a function entrusted to a Panchayat or Municipality under the relevant constitutional provisions.
  • The supply must be a service without a supply of goods.
  • A works contract or composite supply involving goods does not qualify merely because the customer is a municipality or department.

Obtain the recipient’s legal status and the department’s description of the function. Preserve the relevant tender clause or certificate rather than assuming that every public-sector maintenance order meets the exemption.

Materials and replacement parts can change the result

The most common classification mistake is calling a job “pure service” while the supplier is also providing materials. Bitumen, gravel, cement, steel, replacement lamps, signs, barriers and other items can be decisive when the contract makes the supplier responsible for supplying them.

CBIC’s FAQ illustrates the distinction with municipal street-light maintenance. It states: In this case, the scope of the service involves maintenance work and supply of goods, which falls under the works contract services. That example is not a road-maintenance ruling; it demonstrates CBIC’s distinction between service-only work and maintenance that includes replacement goods.

Questions to ask about supplied items

  • Does the supplier purchase and install the item, or does the customer provide it?
  • Does the bill of quantities price materials separately or include them in a lump sum?
  • Does ownership of an item pass to the customer as part of completion?
  • Are consumables and replacement parts included in the supplier’s obligation?
  • Does the contract make the supplier responsible for restoring the asset with new components?

If goods are included, do not claim the pure-services exemption without a contract-specific legal analysis. The presence of materials may instead point toward a works-contract or other composite-supply classification, for which the applicable rate must be checked.

Toll and road-access charges are not maintenance charges

A toll is paid for permission to use a road or bridge. It is not automatically consideration for repairing that road, even if the toll operator also has maintenance responsibilities. CBIC circular guidance treats access to a road or bridge for toll under the cited exemption entry. The exemption analysis for that access service should therefore be kept separate from the tax treatment of a contractor’s maintenance invoice.

Where one concession agreement contains both user access rights and obligations to build, operate or maintain infrastructure, map each payment to the obligation that earns it. A receipt identified as a toll should not be reclassified as a maintenance charge merely because maintenance is funded from toll collections. Conversely, a separate invoice to the concessionaire for resurfacing may still need to be tested under the works-contract rate entry.

Deferred annuity for road construction is a different issue

Road projects are sometimes paid through a deferred annuity rather than immediate milestone invoices. CBIC’s circular guidance clarifies that deferred annuity payments for road construction are not exempt under the cited annuity entry because road construction falls under heading 9954, rather than the heading covered by that entry. The point concerns construction annuities; it does not determine the rate for a separate road-maintenance service contract.

Before applying any annuity exemption, identify whether the payment relates to construction, access, operation or maintenance and locate the precise heading and entry in the current notification. Do not copy the tax treatment of a toll or of a construction annuity onto a maintenance invoice.

A step-by-step GST review for contractors and taxpayers

  1. Collect the controlling documents. Use the signed agreement, work order, tender, technical specifications, bill of quantities, change orders and invoice—not just the purchase-order title.
  2. Write a one-sentence supply description. For example: “Resurfacing and repairing a state highway, including contractor-supplied bitumen and aggregate,” or “Labour-only sweeping of municipal roads using authority-owned equipment.”
  3. Separate payment streams. Mark each amount as maintenance, construction, toll/access, operation, materials, supervision or another service. A bundled figure may need to be analysed by its contractual components.
  4. Test for goods. List every material, replacement part and other item the supplier must provide. Confirm whether the customer supplies it instead.
  5. Identify the recipient. Record the exact legal entity and whether it is the Central Government, a State Government, a Union territory, a local authority or another person.
  6. Check public use. For the 12% works-contract entry, retain evidence that the road, bridge, tunnel or terminal is for general-public use.
  7. Test the pure-services conditions. If claiming exemption, verify both the service-only nature and the required Panchayat or Municipality function.
  8. Check the current rate entry. Read the current CBIC service-rate table and notification, including exclusions, effective dates and any conditions.
  9. Determine the tax type. Apply the place-of-supply rules to decide whether the invoice is intra-state (CGST plus SGST) or inter-state (IGST).
  10. Make the invoice match the analysis. Describe the work accurately, identify the relevant service classification used by your adviser or tax team, state the exemption where applicable, or show the correct tax components.
  11. Keep an evidence file. Preserve the contract, public-use evidence, recipient status, material schedule, exemption analysis, notification version and approvals supporting the treatment.

Practical documentation for an audit or departmental query

A defensible position is easier when the commercial file tells the same story as the invoice. Contractors should maintain a scope matrix showing each activity, the responsible party, supplied goods and payment line. Taxpayers should retain the tender and acceptance documents that establish the recipient, asset and intended use.

For a claimed pure-service exemption, add a short written memorandum identifying why no goods are supplied and which Panchayat or Municipality function is involved. If the supplier uses its own tools, distinguish tools used to perform the service from goods transferred to the customer. If replacement parts are reimbursed or supplied under a separate line, analyse that line rather than describing the entire order as labour-only.

For a 12% works-contract position, keep the public-use evidence and the clause tying the contractor’s obligation to repair or maintenance. If the contract changes through variation orders, revisit the classification; a later materials package or construction extension can alter the original analysis.

Common mistakes and how to correct them

Using “maintenance” as a blanket exemption

Problem: The invoice says “road maintenance” and charges no GST without checking the supply.

Correction: Determine whether the work is a public-road works contract, a qualifying pure service, a toll/access payment or another supply. Use the matching entry only after testing its conditions.

Calling a materials-inclusive job pure service

Problem: The supplier replaces barriers, lights or road-surface material but relies on the pure-services exemption.

Correction: Identify who supplies each item and whether it forms part of the supplier’s obligation. Goods or replacement parts can move the work away from pure service.

Assuming every government order is exempt

Problem: The customer is a public authority, so the contractor treats all work as exempt.

Correction: Verify the recipient category, the constitutional-function connection and the absence of goods. A public-sector customer does not remove those conditions.

Confusing a toll with a maintenance fee

Problem: A concessionaire’s toll receipts and its contractor’s resurfacing invoice receive the same treatment.

Correction: Trace each payment to access or to the separate repair obligation and apply the relevant guidance independently.

Applying the 12% figure without checking the entry

Problem: A contractor quotes 12% for any road-related work, including private roads or construction annuities.

Worked examples

Example 1: State-highway resurfacing with contractor materials

A contractor is hired to mill and resurface a highway open to the public. The contractor supplies bitumen and aggregate, provides labour and equipment, and hands over the repaired surface. This is the type of fact pattern that should be tested against the public-road repair or maintenance works-contract entry. If the contract fits that entry, the listed combined rate is 12%, split as CGST and SGST for an intra-state supply or charged as IGST for an inter-state supply.

Example 2: Labour-only municipal sweeping

A municipality supplies the vehicles and consumables and hires a service provider solely for sweeping and supervision. The provider transfers no goods. The recipient, the exact municipal function and the notification conditions must all be verified, but the service-only facts make the pure-services exemption the relevant question rather than the works-contract rate.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Example 3: Replacement of road lights and fixtures

A contractor maintains street lighting and supplies replacement fixtures. The presence of supplied goods means the contractor should not describe the entire job as pure service merely because the customer is a local authority. The scope and classification should be analysed as a goods-involving maintenance or works-contract supply.

Example 4: Toll collected from road users

An operator collects a user fee from vehicles for access to a bridge. That receipt concerns road access. CBIC’s toll guidance is the relevant starting point, not the rate for a contractor separately engaged to repair the bridge.

Example 5: Deferred annuity under a construction concession

A project authority pays a deferred annuity for constructing a road. The cited annuity exemption does not apply merely because payment is deferred; CBIC distinguishes road construction under heading 9954. The construction agreement and current notification must be reviewed separately.

How to state the position on an invoice or tax file

Use a description that identifies the asset, activity and supplied items. “Repair and maintenance of [public road], including contractor-supplied bitumen and aggregate under work order [number]” is more informative than “road charges.” If claiming an exemption, state the relevant exemption basis in the invoice records and retain the analysis showing why the service is pure and functionally eligible.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not state that an amount is “GST-free” without identifying whether it is exempt, outside the scope of the supply being invoiced, or simply not the same payment as a taxable maintenance service. The accounting label should follow the legal classification, not replace it.

What to verify before finalising the rate

  • The latest CBIC rate notification and any amendments effective on the invoice date.
  • The exact service classification and whether the contract is a works contract or another composite supply.
  • Whether the road or facility is for general-public use.
  • Whether any goods, replacement parts or materials are supplied.
  • The recipient’s legal status and the relevant Article 243G or 243W function if exemption is claimed.
  • Whether the charge is for maintenance, toll/access, construction or an annuity.
  • The place of supply and whether CGST plus SGST or IGST applies.
  • Contract variations, subcontracting arrangements and separately billed materials.

For the statutory text and current rate material, consult CBIC’s CGST Act page, GST service-rate table, and CBIC circular guidance on road access and annuity issues. Those sources should be read with the contract and the notification in force for the relevant supply date.
