Fannie Mae and Freddie Mac are still government-sponsored enterprises (GSEs). They remain shareholder-owned, federally chartered business corporations—not federal agencies—while operating under Federal Housing Finance Agency (FHFA) conservatorship, a status that has continued since 2008. The U.S. Treasury supports them through Senior Preferred Stock Purchase Agreements. In one accurate sentence: they are GSE corporations under federal conservatorship.
What “government-sponsored enterprise” means
“Government-sponsored enterprise” describes a company’s legal and institutional form. The Bureau of Economic Analysis (BEA) defines a GSE as a private company established and chartered by the federal government. Its explanation specifically lists Fannie Mae and Freddie Mac as GSEs and distinguishes them from government enterprises that are owned and operated by the government. See the BEA explanation of where GSEs appear in the GDP accounts.
That definition is why “government-sponsored” should not be read as “government-owned.” The sponsorship refers to a federal charter and a public-policy role, while the entities themselves remain corporations. BEA classifies them as private financial corporations in the national economic accounts.
Are they government-owned or federal agencies?
No. Fannie Mae and Freddie Mac are not federal agencies, and the available official descriptions do not classify them as government-owned enterprises. FHFA says they continue to operate as business corporations. That corporate status exists alongside extensive federal oversight, which is the source of much of the confusion.
They are also not ordinary independent companies at present. Since 2008, FHFA has served as their conservator. Conservatorship gives the regulator powers that reach management, the boards of directors and shareholders, together with ultimate authority over Enterprise operations. The companies’ corporate form and their federal control therefore describe different aspects of the same arrangement.

What conservatorship means today
FHFA placed both Enterprises into conservatorship on September 6, 2008, with the consent of each company’s board. FHFA’s history says the action followed deteriorating housing markets and damage to the Enterprises’ financial condition. The placement was not a conversion of either company into a government department; it was a legal intervention under which FHFA exercises conservator powers.
FHFA’s current conservatorship description states that Fannie Mae and Freddie Mac continue to operate under conservatorship. The agency’s institutional description is explicit: “Fannie Mae and Freddie Mac continue to operate as business corporations.” In practical terms, FHFA—not the companies’ normal corporate governance alone—has ultimate authority over their operations while conservatorship remains in force.

Conservatorship and GSE status are not competing labels. “GSE” identifies the federally chartered corporate structure; “under conservatorship” identifies the current control arrangement. Both are true at the same time.
How Treasury support fits into the picture
The Treasury Department supports the Enterprises through Senior Preferred Stock Purchase Agreements. FHFA identifies those agreements as the mechanism for Treasury’s financial support. This is a specific contractual and capital-support arrangement; it is not evidence that Fannie Mae or Freddie Mac became federal agencies.
The agreements are part of the post-2008 conservatorship framework. Official FHFA materials describe the support and the continuing conservatorship, but the sources do not establish a date for release from conservatorship or a settled final ownership structure. Any statement that an exit is scheduled, guaranteed or complete goes beyond the established status.
What Fannie Mae and Freddie Mac do
The Enterprises operate in the secondary mortgage market. They buy mortgages from lenders, then may hold those loans in their portfolios or package them into mortgage-backed securities that can be sold. FHFA says these activities help provide liquidity to lenders and support a stable supply of mortgage funding. A lender that sells eligible mortgages can replenish its funds and make additional loans rather than holding every mortgage indefinitely.
This function explains why Congress created and maintains federally chartered GSEs, but it does not alter their corporate identity. Their mortgage-market purpose, federal charter, conservatorship and Treasury support are related facts—not interchangeable descriptions.

Why people understandably use conflicting descriptions
“Government-sponsored” sounds like government ownership
In ordinary conversation, sponsorship can imply ownership or direct operation. In the GSE context, it does not. The BEA definition separates privately held, federally chartered GSEs from government enterprises. Calling Fannie Mae and Freddie Mac “government-sponsored” is therefore compatible with calling them private corporations.
Conservatorship looks like nationalization
Conservatorship gives FHFA unusually broad authority, including authority over management, boards and shareholders. That level of control can make the companies appear to be government entities. The official description is narrower and more precise: they remain business corporations while FHFA acts as conservator. Control has changed; the underlying corporate classification has not been replaced.
Treasury support is mistaken for agency status
Treasury’s support through the Senior Preferred Stock Purchase Agreements is another reason readers may assume the companies are part of the government. The agreements explain how financial support is provided; they do not change the entities into federal agencies. Their charter, corporate form and conservatorship should be stated separately.
Three concepts that should not be collapsed into one
Charter: Their federal charters and statutory mission explain why they are called government-sponsored enterprises. The charter is the institutional foundation.
Conservatorship: FHFA’s role describes who exercises governing authority now. FHFA has the powers of management, the boards and shareholders, plus ultimate authority over Enterprise operations.
Treasury agreements: The Senior Preferred Stock Purchase Agreements describe the channel for Treasury’s financial support. They are neither a new corporate charter nor a declaration that the companies are federal agencies.
Keeping those concepts separate prevents two opposite errors: treating the companies as ordinary private firms with no federal involvement, or treating them as government departments. Neither description captures the full arrangement.

Timeline of the current arrangement
- September 6, 2008: FHFA placed Fannie Mae and Freddie Mac into conservatorship, with each board’s consent, after worsening housing-market conditions and deterioration in the Enterprises’ financial condition. The FHFA history of the conservatorships records the placement.
- Since 2008: FHFA has continued as conservator, exercising the statutory powers associated with management, boards and shareholders.
- Current status: FHFA says the Enterprises continue to operate under conservatorship as business corporations, with Treasury financial support provided through Senior Preferred Stock Purchase Agreements.
The official materials establish the continuing arrangement. They do not establish a final end date for conservatorship or a definitive future ownership model, so those issues should be treated as unresolved rather than reported as settled outcomes.
What this means for a borrower or homeowner
For a consumer, the most useful distinction is between the company handling a mortgage and the Enterprise role in the secondary market. Fannie Mae and Freddie Mac buy mortgages from lenders and can hold or securitize them. A mortgage may therefore be funded by a lender, later sold to an Enterprise, and serviced under an arrangement that differs from the entity that originally approved the loan.
The GSE label does not mean a borrower is dealing with a federal agency. It also does not mean that every mortgage is automatically eligible for purchase by either Enterprise; the sources here explain the market function, not individual underwriting eligibility. Questions about a particular loan’s owner, servicer or eligibility require the documents and disclosures for that loan.
In practical terms, a borrower generally encounters the GSEs indirectly. The lender originates the loan, and the loan may later be sold into the secondary market. The servicer that collects payments can remain the borrower’s main contact even when an Enterprise owns or guarantees the mortgage. That chain is consistent with GSEs being market participants rather than walk-in federal offices.

- It tells you that both companies retain their GSE identity and federally established mortgage-market role.
- It tells you that FHFA conservatorship remains in force and that FHFA has ultimate operational authority.
- It tells you that Treasury support is structured through Senior Preferred Stock Purchase Agreements.
- It does not tell you that either company is a federal agency or a government department.
- It does not provide a confirmed release date from conservatorship or a settled final ownership structure.
- It does not by itself determine whether a specific mortgage meets Fannie Mae or Freddie Mac purchase requirements.
A reliable way to describe them
Use the following formulation when accuracy matters: “Fannie Mae and Freddie Mac are shareholder-owned, federally chartered government-sponsored enterprises that remain under FHFA conservatorship.” If financial support is relevant, add: “Treasury support is provided through Senior Preferred Stock Purchase Agreements.”
Avoid these shortcuts:
- “They are federal agencies.” This contradicts the official descriptions of them as business corporations and the BEA’s classification as private financial corporations.
- “They are government-owned.” The GSE definition distinguishes private companies from government enterprises.
- “They are no longer in conservatorship.” FHFA says conservatorship continues.
- “Their exit and final ownership are settled.” The cited official materials do not establish either a release date or a final future structure.
- “GSE status and conservatorship mean the same thing.” One describes institutional form; the other describes federal control.
Frequently asked questions
Are Fannie Mae and Freddie Mac still GSEs in 2026?
Yes. FHFA and BEA continue to describe them as federally chartered GSE corporations. Their conservatorship does not erase that classification.

The bottom line on their status
Fannie Mae and Freddie Mac still qualify as GSEs because they remain private, federally chartered corporations serving a federally established mortgage-market purpose. They are not federal agencies. At the same time, they remain under FHFA conservatorship, which gives FHFA ultimate authority over their operations, and Treasury support continues through Senior Preferred Stock Purchase Agreements. The clearest current description combines all four facts rather than substituting one for another.
