Sometimes, but not everywhere. Whether a business may add a card-payment surcharge depends on the transaction’s country, the U.S. state if applicable, the card type, the payment network, whether a genuine no-fee alternative exists, and how the fee is disclosed. The European Union generally bans surcharges on credit and debit cards. Australian network rules generally prohibit them from October 1, 2026. In the United States, some credit-card surcharges remain possible, but federal price-transparency rules, state and local law, and network requirements all apply.

The answer changes with the jurisdiction and the fee

“Card fee” is not a single legal category. A charge added only because a customer uses a particular card can be a surcharge. A fee that applies to every customer regardless of payment method, a booking or service charge, and a fee for using an alternate payment channel may be treated differently. Calling a charge a “convenience fee” does not make it lawful by itself.

Before deciding whether a fee is permitted, identify five facts:

  • Where the transaction occurs, including the U.S. state or local jurisdiction.
  • Whether the instrument is a credit card, debit card, prepaid card, or another payment method.
  • Whether the charge is tied specifically to card use or applies to the transaction generally.
  • Whether the customer has a genuinely usable, no-fee way to complete the same purchase.
  • What the law and the card network require for price display, advance notice, receipts, caps, and registration.

Jurisdiction General position Important qualification
European Union Credit- and debit-card surcharges are generally not allowed in shops or online. This summary is EU-wide; other European countries require separate checks.
Australia Network rules generally prohibit surcharges on covered cards and PayPal from October 1, 2026. Charges unrelated to payment method, such as a weekend surcharge, are treated differently.
United States Some credit-card surcharges may be allowed. Federal disclosure and total-price rules, state and local restrictions, and network rules apply. Debit and prepaid cards are not automatically covered by credit-card permissions.

United States: when a card fee may be lawful

The FTC’s total-price rule

The Federal Trade Commission’s May 2025 fee-rule FAQ distinguishes a mandatory fee from an optional payment choice. If a business requires card payment, or there is no viable no-fee payment method for the offered transaction, a card-related fee is mandatory. The mandatory amount must be included in the displayed total price rather than revealed only at the end.

For example, an online ticket seller that accepts only credit cards cannot advertise a ticket at one price and add a separate required credit-card fee at checkout. Because the customer has no workable no-fee way to buy that offered ticket online, the fee is part of the total price that must be shown.

When a no-fee alternative makes the card fee optional

If the same transaction can be completed through a viable no-fee payment method on the same platform or at the same location, the customer’s card use can be optional for purposes of the FTC fee rule. The fee may then be left out of the initial advertised total, but the business must disclose its nature, purpose, and amount before the customer agrees to pay. The final amount must include the fee.

“Available somewhere” is not enough. A cash option that requires an online shopper to travel to a different location may not be a viable alternative to the online offer. The alternative must be practical for the transaction and presented before consent, not improvised after the customer has committed.

State and local law can be stricter

The FTC says merchants must also follow applicable state and local requirements. If a state or local rule gives consumers stronger protection and does not directly conflict with the federal rule, the stricter rule still applies. There is no single current state-by-state answer in this overview, so a merchant or consumer must check the law where the sale occurs before relying on a general statement that surcharging is allowed.

What Visa and Mastercard rules add in the United States

Visa: legal permission comes first

Visa’s U.S. merchant overview says credit-card surcharging is permitted in most states subject to its merchant rules, but network permission is not a substitute for legal permission. Its general rule is that a merchant must not add an amount above the advertised or normal price unless applicable law expressly allows the surcharge.

Visa describes a convenience fee as a clearly disclosed flat charge for paying through an alternate channel that is different from the merchant’s usual payment channel. A fee is not automatically a qualifying convenience fee merely because the merchant labels it that way. The channel, the disclosure, and the law governing the transaction all matter.

Mastercard: credit cards only and a stated cap

Mastercard’s U.S. merchant guidance applies its surcharge permission to Mastercard-branded credit cards. It excludes Debit Mastercard and prepaid cards. The guidance requires point-of-interaction disclosure and requires the surcharge amount to appear on the receipt.

The current merchant guidance accessed October 13, 2026, states a 4% maximum surcharge cap. Mastercard also says the merchant’s cost of acceptance can impose a lower limit, so 4% is not an automatic entitlement to charge 4%. A merchant must still comply with applicable federal, state, and local law and any required network notice or registration process.

Credit, debit and prepaid cards must be separated

A rule that allows a surcharge on a credit card does not automatically allow one on a debit or prepaid card. A point-of-sale system should identify the eligible card type and avoid applying a credit-card surcharge to excluded instruments. If the system cannot distinguish them reliably, the merchant needs a compliant configuration or a different pricing approach.

European Union: card surcharges are generally prohibited

The European Union’s official Your Europe business guidance states that a business may not charge customers extra for using a credit or debit card. The prohibition applies to purchases in physical shops and online. A merchant therefore cannot solve the problem by moving the surcharge to the checkout page or by describing it as a processing fee when it is still triggered by card payment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The EU-wide statement should not be extended automatically to every country in Europe. A transaction outside the EU needs the rules of that country, its payment instrument, and any applicable consumer-protection regime checked separately.

Australia: no-surcharge rules from October 1, 2026

Payment methods covered

From October 1, 2026, Australian network rules generally prohibit a card-payment surcharge for Visa, Mastercard, eftpos, American Express, UnionPay, and PayPal transactions. The Reserve Bank of Australia explains that the designated networks—eftpos, Mastercard, and Visa—introduced no-surcharge rules from that date, while American Express, UnionPay, and PayPal also announced removal of surcharging. Network decisions and exceptions can change, so merchants should confirm the current position with their payment service provider.

Charges that are not based on payment method

The Australian change targets an amount added because the customer pays by card. A weekend or public-holiday surcharge, a booking fee, or a general service fee is outside that definition when it applies independently of how the customer pays. A payment provider’s fee charged to the merchant for a terminal or processing service is likewise not itself a consumer card surcharge.

Those distinctions do not permit misleading pricing. Businesses must explain prices accurately and must not claim that a general fee is a card fee, or imply that a card-specific charge is unavoidable when it is not. The RBA directs merchants to their payment service provider for implementation help. The Australian Competition and Consumer Commission advises consumers who believe pricing was misleading to contact the business first.

How to tell what kind of fee you are seeing

Card-specific surcharge

The amount appears only when a customer selects a card, or changes with the card network or card type. This is the category most directly controlled by surcharge laws and network rules.

Mandatory processing or payment fee

The customer must pay it because the business offers no viable no-fee method for the same transaction. In the United States, the FTC treats that amount as part of the total price that must be displayed up front.

General service, booking or holiday fee

The fee applies regardless of whether the customer pays by card, cash, bank transfer, or another method. In Australia, such a fee is not a card surcharge when payment method does not determine it, although ordinary price-transparency rules still apply.

Alternate-channel convenience fee

A business may charge for using a payment channel that is genuinely different from its usual channel if the applicable law and network rules recognize that structure. Visa’s description emphasizes a clearly disclosed flat fee and an alternate channel. The label alone is not decisive.

  1. Locate the transaction. Identify the country and, in the United States, the state and any relevant local rule.
  2. Identify the instrument. Check whether the payment was a credit card, debit card, prepaid card, or another method.
  3. Read the fee description. Note the exact wording, percentage or dollar amount, and whether it appeared before payment.
  4. Check for a viable no-fee option. For an online sale, the alternative should be available on the same platform; for an in-person sale, it should be usable at the same location for the same purchase.
  5. Compare the advertised and final totals. If the fee was mandatory, the advertised total should have included it under the FTC’s rule.
  6. Check network and state limits. A Mastercard credit-card surcharge, for example, must stay within the applicable cap and the merchant’s cost of acceptance, while debit and prepaid cards are excluded from that Mastercard permission.
  7. Ask for an explanation. Request the fee’s purpose, amount, and legal basis in writing before disputing the charge.

A fee that was not disclosed before consent, was applied to an excluded card type, or was presented as optional when no practical alternative existed deserves closer review.

Merchant compliance checklist

  1. Map the sale. Record the selling location, online or in-person channel, card brands accepted, and the jurisdictions that govern the transaction.
  2. Classify the charge. Decide whether it is card-specific, mandatory because no viable alternative exists, a general fee, or an alternate-channel fee. Do not rely on a marketing label.
  3. Verify legal authority. Check current federal, state, local, and territory rules. A network rule cannot legalize a surcharge that local law prohibits.
  4. Separate card types. Configure the point-of-sale or checkout system so any permitted surcharge applies only to eligible cards, not automatically to debit or prepaid instruments.
  5. Calculate the permitted amount. In the United States, compare the proposed amount with the applicable network cap and the merchant’s actual cost of acceptance. The lower limit controls.
  6. Show the fee early. If the fee is mandatory, include it in the advertised total. If it is optional under the FTC framework, disclose its nature, purpose, and amount before the customer agrees to pay.
  7. Show it at the point of interaction and on the receipt. Mastercard’s guidance specifically requires point-of-interaction disclosure and the surcharge amount on the receipt.
  8. Review the setup periodically. Network rules and exceptions are time-sensitive. In Australia, contact the payment service provider about removing surcharge functionality after October 1, 2026, and review pricing plans separately from card-fee decisions.

What a consumer can do about a disputed fee

Save the advertisement, checkout screen, receipt, and the card statement. Write down the payment method, date, location, and the exact fee name. Ask the business whether a no-fee method was available for the same transaction and why the amount was charged.

For a U.S. transaction, compare the explanation with the FTC’s total-price and disclosure requirements, then check the state or local rule and the relevant card network’s current guidance. A card issuer may have a dispute process, but a chargeback does not replace the need to document whether the merchant disclosed the fee or applied it to an eligible card.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For an Australian transaction, ask the business to explain any card-specific amount. If the response does not resolve the concern, use the relevant payment network or state or territory consumer-protection channel; the ACCC’s guidance says the business should be the first contact when pricing may have been misleading.

For an EU transaction, the official guidance says a surcharge for using a credit or debit card is not allowed. Present the receipt and the card-payment details to the merchant and, if necessary, the appropriate national consumer authority.

Why the wording on a sign or checkout page matters

A sign that says “3% card fee” communicates a different legal fact from “$5 booking fee applies to all orders.” The first ties the amount to payment method; the second describes a general charge. Regulators and networks look at how the fee operates, not only what the merchant calls it.

The safest disclosure states the amount or calculation, the payment methods affected, when it is added, and whether a no-fee alternative is available. A customer should be able to know the final cost before agreeing to pay. Hiding a required fee until the last screen, applying a credit-card rule to debit cards, or offering a theoretical alternative that cannot complete the same purchase creates avoidable compliance risk.

Bottom line for customers and businesses

There is no worldwide yes-or-no rule. EU businesses generally cannot add a credit- or debit-card surcharge. Australian businesses generally cannot surcharge the covered payment methods from October 1, 2026. U.S. businesses may have a lawful path for some credit-card surcharges, but only after checking state and local law, card eligibility, the availability of a viable no-fee option, advance disclosure, total-price treatment, and network caps. When any one of those facts is unclear, the fee should not be treated as automatically permitted.
