AI liability insurance is not one standardized policy. It is an emerging group of standalone policies and affirmative endorsements that can address losses caused by an AI model, an autonomous agent, or a company’s AI-related decisions. Coverage depends on the insured’s role, the policy’s trigger and causation wording, and whether an exclusion removes claims involving artificial intelligence.
Traditional cyber, technology errors and omissions (E&O), directors and officers (D&O), employment practices liability (EPL) and commercial general liability (CGL) policies may respond to some incidents, but none was designed specifically for every AI risk. A careful review must match each use case to a policy’s covered perils, defense obligations, sublimits, retentions, reporting rules and AI exclusions.

AI liability insurance transfers selected legal-defense, settlement, judgment and sometimes first-party restoration costs arising from the use, development or supply of AI systems. The market is still forming, so two policies with similar marketing names can have very different definitions of “AI,” covered parties and causation standards.
Businesses often assemble protection from several lines rather than buying one complete product. A developer building a model, a software vendor embedding a model, a company deploying a third-party chatbot and a professional relying on an AI assistant face different exposures. Ropes & Gray describes the common portfolio as cyber, technology E&O, D&O and CGL, with the exact response controlled by each insurer’s form.

Many dedicated forms are claims-made and reported. That means the claim generally must be first made against the insured and reported to the insurer during the policy period (subject to retroactive dates, extended reporting provisions and other conditions). An incident that occurred earlier can therefore present a reporting problem even when the resulting lawsuit arrives later.
What can a dedicated AI policy cover?
Dedicated forms can provide affirmative coverage for AI-specific liability that would otherwise fall between traditional policies. Publicly described offerings show the range of modules available, but the listed protections are not universal; the current policy wording controls.
AI-related management and employment claims
| Module | Examples of covered allegations | Typical claim target |
|---|---|---|
| AI-D&O | AI-washing, failed oversight and misleading statements about an AI program | Directors, officers and the company |
| AI-EPL | Discrimination caused by screening or ranking tools, or dismissals based on AI scores | Employer and responsible managers |
| AI-E&O | Hallucinated or inaccurate output, model errors, model drift and mistakes by AI agents | AI supplier, deployer or professional service provider |
| AI DIC excess | AI claims that fall outside existing D&O, EPL or E&O wording | Insured seeking difference-in-conditions protection |
These four modules are publicly listed by Mayflower Specialty. They illustrate why the insured’s role matters: a misleading investor statement is not the same peril as a hiring decision or an erroneous automated transaction.
Autonomous-agent execution losses
An autonomous-operations form described by Auxilium addresses losses when an agent sends a wrong payment or refund, makes an unauthorized commitment, runs up charges or corrupts records. It also lists response and restoration costs, defense of regulatory proceedings, financial-loss liability and a general-liability gap where a CGL or umbrella policy excludes AI. Check whether “loss” means the insured’s own money, a third party’s claim, or both; many policies distinguish first-party and third-party coverage.
What a policy may still limit
Even an affirmative AI grant can have separate aggregates or sublimits for intellectual property, privacy, discrimination, bodily injury, property damage, regulatory proceedings and restoration. A defense may be inside the limit, and consent-to-settle language can affect an insured’s ability to resolve a claim quickly. Treat the module description as a starting point, not as a promise that every AI incident is covered.
How do existing insurance policies respond to AI incidents?
Traditional policies can respond when an event fits their established trigger, but they leave important AI-caused liabilities uncovered. The same incident can activate one policy and miss another.

Cyber insurance
Cyber coverage usually requires a covered security or privacy incident. AI-powered phishing, voice cloning or a deepfake-enabled intrusion can therefore trigger cyber coverage when the attack causes the policy’s defined breach, network or funds-transfer loss. Gallagher identifies a major gap when AI is the source of liability rather than the attack method: hallucinations, discrimination, copyright or other intellectual-property infringement, defamation, financial loss from inaccurate output and disclosure of data through outputs generally do not satisfy a cyber trigger.
Technology E&O
Technology E&O is designed primarily for suppliers of technology products or services and third-party financial-loss claims. It may be relevant to a model developer, integrator or software company that promises a technical result. Gallagher cautions that it is generally not the right standalone answer for a business that merely deploys somebody else’s AI in its own operations; that company may need affirmative coverage tailored to its use.
CGL, D&O and EPL
CGL can address bodily injury, property damage or personal and advertising injury when its wording is met, but new generative-AI exclusions can remove those grants. CGL also commonly excludes first-party losses and does not ordinarily cover hallucinations, pure financial loss, discrimination, bias, data breaches or business interruption.
D&O may be implicated by shareholder allegations that directors failed to oversee AI or misrepresented its capabilities. EPL may respond to employment claims, but an AI-specific endorsement or exclusion can change the result. Aon’s peril map shows why a portfolio review is necessary: professional errors, output copyright or trademark claims, patent and trade-secret claims, employment discrimination, bodily injury, property damage, privacy, cyber, crime, D&O and EPL can sit in different lines or require endorsements.
| Policy line | Potential AI connection | Common boundary |
|---|---|---|
| Cyber | AI-assisted phishing, deepfake fraud or a covered data-security incident | Usually no cover for a model’s inaccurate answer or discriminatory decision without a security trigger |
| Technology E&O | Third-party financial loss caused by a technology supplier’s service | May not fit a company only using an outside AI tool |
| CGL | Bodily injury, property damage or personal and advertising injury if not excluded | Generative-AI exclusions and first-party-loss exclusions can remove the claim |
| D&O | Oversight failures, AI-washing or misleading corporate statements | Depends on insured-versus-insured terms, conduct exclusions and AI wording |
| EPL | Employment discrimination or termination allegations | May exclude automated-decision claims or require an endorsement |
Does cyber insurance cover AI hallucinations?
Usually not by itself. A hallucinated answer is an accuracy or professional-liability problem, not necessarily a security incident. Cyber insurance may become relevant if the hallucination results from a covered compromise, unauthorized access or privacy event, but the policy must still satisfy its loss definition and other conditions.
For example, an AI customer-service agent that invents a refund policy could create a financial-loss or consumer-protection claim without any network intrusion. An AI tool that exposes confidential records because an attacker obtained access may involve both a cyber event and an AI-output liability issue; one policy may pay breach response while another is needed for the resulting third-party allegations.

What do AI exclusions remove?
AI exclusions can eliminate both the duty to defend and indemnity. Dentons explains that wording ranges from narrow language requiring AI to be the direct cause to broad language applying when AI played any part in the loss. Read the operative verbs—“arising from,” “relating to” and “involving”—along with the definition of AI and any exception for approved tools.
Optional ISO/Verisk endorsements effective January 1, 2026 remove defense and indemnity for certain losses connected with generative AI. Gallagher also reports that new GenAI exclusions can remove CGL coverage for bodily injury, property damage and personal or advertising injury arising from generative AI. An exclusion may apply even when a human reviewed the output if the wording reaches any loss involving an AI system.

Questions to ask about an exclusion
- Does it apply only when AI is the direct cause, or whenever AI is involved?
- Does “AI” include a vendor’s embedded feature, a statistical model, automated decision rules and an autonomous agent?
- Does the exclusion remove defense costs, indemnity, or both?
- Are there exceptions for human supervision, approved vendors, security incidents or bodily injury?
- Does it override an affirmative endorsement elsewhere in the policy?
Who needs AI liability coverage?
The right insurance mix follows the insured’s role and the harm it could cause, not the novelty of the software’s brand name.
| Insured role | Primary exposures | Coverage focus |
|---|---|---|
| Model developer | Model error, drift, IP claims, privacy, unsafe output and customer financial loss | Technology E&O or AI-E&O, cyber, IP and regulatory defense |
| AI software vendor or integrator | Contractual performance, inaccurate output, agent mistakes and vendor-dependent failures | Technology E&O, AI endorsement, cyber and contractual-liability review |
| Business deploying a third-party tool | Discrimination, employment decisions, customer harm, confidentiality and operational mistakes | AI-EPL, AI-E&O, cyber, D&O and CGL gap analysis |
| Professional firm | Incorrect advice, missed duties and client reliance on generated work | Professional E&O with an AI affirmative grant and clear human-review conditions |
| Company using autonomous agents | Wrong payments, commitments, charges, record corruption and restoration | Autonomous-operations cover, crime/funds-transfer review and first-party restoration |
Professionals also need a process for checking generated work. Dentons states that the duty of competence requires professionals to understand the tools they use and verify AI-generated work before delivering it to clients. Insurance does not replace that obligation.
How should you compare AI liability policies?
Ask for the current policy form and every endorsement; do not rely on a brochure or a generic promise of “AI protection.” Use the following comparison sheet with your broker and insurer.
- Identify the insured role. State whether you develop, resell, integrate, deploy or merely use the system, and list each legal entity that needs protection.
- Classify the trigger. Determine whether coverage is affirmative, silent under an older form or exclusionary. Confirm whether a claim needs a wrongful act, security incident, bodily injury, property damage or financial loss.
- Read causation wording. Compare direct-cause language with “arising from,” “relating to” or “involving” standards.
- Map the perils. Check separate treatment of hallucinations, model error and drift, agent execution, IP, privacy, discrimination, defamation, bodily injury, property damage, regulatory proceedings and business interruption.
- Separate first- and third-party cover. Confirm whether your own restoration, re-training, data reconstruction and lost income are insured, or whether the policy only pays a claimant’s loss.
- Check defense mechanics. Ask who selects counsel, whether defense is inside the limit, how defense of regulatory proceedings works and whether the insurer’s consent is required before settlement.
- Review financial terms. Record each sublimit, retention, aggregate and any waiting period. A large headline limit may provide little practical protection if AI or IP has a small sublimit.
- Test vendor responsibility. Determine whether a third-party model’s error is covered, excluded as assumed contractual liability or recoverable only through the vendor’s insurance and indemnity.
- Confirm claims-made rules. Note the retroactive date, notice deadline, circumstances-notice procedure and extended reporting option.
- Verify geography. Check territorial scope, governing law and state availability; an endorsement offered in one jurisdiction may not be filed or available in another.
- Match governance conditions. Look for requirements concerning human review, access controls, testing, documentation and approved vendors. A breach of a condition can complicate a claim.
What records improve underwriting and claims handling?
Underwriters increasingly expect evidence that the company can identify and control its AI uses. NAIC says insurers using AI remain responsible for insurance-law compliance, fairness, accuracy, consumer protection and human oversight; commercial buyers should expect similar questions from their own insurers.

Preserve evidence and notify every potentially responsive insurer promptly. Do not wait for a lawsuit if the policy allows notice of circumstances that may give rise to a claim.
- Stop or contain the harmful process without destroying logs; suspend an agent that is issuing payments or changing records.
- Record the model version, prompts, outputs, human approvals, affected people, financial amounts and timeline.
- Notify cyber, E&O, D&O, EPL, CGL, crime and any dedicated AI insurer according to each policy’s notice clause.
- Ask for a written coverage position addressing defense, sublimits, retentions, exclusions and allocation among policies.
- Coordinate legal, privacy, employment, regulatory and technical response while preserving privilege and required notices.
- Document remediation, customer refunds, record restoration and changes to human-review controls for the claim file.
For a claims-made-and-reported form, late notice can be decisive. Follow the policy’s specified reporting channel and include known circumstances, even when the ultimate legal theory is not yet clear.
How much does AI liability insurance cost?
There is no reliable market-wide premium or claims-frequency benchmark that applies across jurisdictions. The market lacks a standardized form, so a single price comparison would be misleading.
Insurers may consider the insured’s role, revenue and industry, volume and sensitivity of data, number of users, autonomy of agents, limits requested, prior incidents, contractual indemnities, governance controls, jurisdiction and the breadth of IP, discrimination and regulatory protection. Obtain quotes on identical limits and retentions, then compare the actual forms and endorsements rather than the premium alone.
Which AI risks are most likely to fall between policies?
The following examples show why a portfolio review is more useful than asking whether one policy “covers AI.”

| Incident | Likely insurance question |
|---|---|
| A recruiting model ranks applicants unfairly | Does EPL or AI-EPL cover discrimination caused by screening or ranking, and is automated decision-making excluded? |
| A chatbot invents a contractual promise | Is inaccurate output a covered E&O wrongful act, or an excluded pure financial loss? |
| An agent sends an erroneous refund and corrupts accounting records | Are execution loss, restoration and records reconstruction covered, and is crime or funds-transfer insurance also implicated? |
| A deepfake convinces an employee to transfer funds | Does cyber or crime coverage respond to the security or social-engineering trigger, and what verification conditions apply? |
| Generated marketing text infringes a copyright | Is IP defense and indemnity affirmatively covered, or removed by an AI, media or intellectual-property exclusion? |
What is the practical takeaway for a buyer?
Start with an inventory of AI uses and the harms each could create. Then obtain the current wording for cyber, technology E&O, professional E&O, D&O, EPL, CGL, crime and any AI endorsement or standalone form. The decisive questions are whether the policy affirmatively covers the peril, whether an AI exclusion overrides it, who receives a defense, and whether limits and reporting terms are usable in your jurisdiction.
Frequently Asked Questions
Can a company insure an AI tool supplied by another vendor?
Sometimes, but the answer depends on the policy’s treatment of third-party models, assumed contractual liability and vendor indemnities. Ask whether the form covers your deployment decisions and resulting third-party claims, not just defects in technology you developed yourself.

Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Are AI-related regulatory investigations covered?
Some dedicated forms list defense of regulatory proceedings, while ordinary policies may restrict investigations to specific definitions or endorsements. Confirm which agencies, proceedings, defense costs and sublimits are included before assuming an investigation is insured.
Does human review guarantee that an AI exclusion will not apply?
No. A narrow exclusion might focus on direct automated causation, but broad wording can apply whenever AI played any part in the loss, even with a human approval step. The exact exception or causation language controls.
What should a small business document before buying AI coverage?
Create a simple inventory of tools, owners, data flows, uses, vendors, human approvals and incident contacts. Keep model versions, important prompts and outputs, bias tests and contracts so an insurer can evaluate both the exposure and your controls.
Can one policy cover bodily injury and an AI hallucination together?
Not necessarily. Bodily injury may fall under CGL or a dedicated AI extension, while a hallucinated answer may be an E&O financial-loss claim. Check whether the policy combines those perils or imposes separate grants, exclusions and sublimits.
