Alphabet, YouTube’s parent company, agreed on September 29, 2025, to pay $24.5 million to settle Donald Trump’s lawsuit over the platform’s suspension of his channel after the January 6, 2021, Capitol attack. The agreement is a negotiated settlement—not a court ruling that YouTube unlawfully censored Trump. It also does not mean Trump personally receives the full amount.
The settlement says $22 million resolves Trump’s claims and that he directed that money to the Trust for the National Mall to support construction of a White House State Ballroom. The remaining $2.5 million is allocated among other named plaintiffs.

How the $24.5 million is divided

Under the filing, Alphabet was to transfer the total to the attorney trust account of plaintiffs’ counsel, John Coale, for distribution under the settlement agreements. The public notice does not state how the $2.5 million will be divided among the other plaintiffs: the American Conservative Union, Andrew Baggiani, Austen Fletcher, Maryse Veronica Jean-Louis, Frank Valentine, Kelly Victory and Naomi Wolf.
That makes “YouTube paid Trump $24.5 million” an understandable shorthand, but not the most precise description. Alphabet agreed to pay $24.5 million to resolve the litigation; $22 million relates to Trump’s claims, and Trump directed that amount to a specified nonprofit and project rather than taking the entire sum as a personal payment.

Why Trump sued YouTube
YouTube suspended Trump’s channel in January 2021 following the attack on the U.S. Capitol. The platform initially prevented new uploads and disabled comments, citing concerns about further violence during the presidential transition. Contemporary reporting described the suspension as indefinite at the time (Ars Technica).
Trump filed his lawsuit in 2021 against YouTube and its chief executive. His complaint alleged that the suspension and the platform’s moderation practices amounted to unlawful censorship. It raised claims involving the First Amendment and Section 230 of the Communications Decency Act and sought remedies including declaratory and injunctive relief. Those were allegations in Trump’s complaint, not findings by a court. The case was filed in the U.S. District Court for the Northern District of California as Case No. 4:21-CV-08009-YGR (government case record; complaint).

The channel was restored before the settlement
YouTube restored Trump’s channel on March 17, 2023, allowing new uploads subject to the platform’s policies, according to Axios. That restoration occurred more than two years before the settlement and was a separate event. It does not establish that Trump’s lawsuit was valid or that YouTube admitted wrongdoing.

The settlement notice says the case would be dismissed with prejudice, meaning the resolved claims cannot simply be brought again in the same form. It also says the agreement was reached to compromise the dispute and avoid the costs, risks and uncertainty of continued litigation.

Most importantly, the filing expressly states that the settlement is not an admission of liability or fault. No court judgment in the settlement establishes that:
- YouTube violated Trump’s First Amendment rights;
- YouTube was legally a government actor;
- Section 230 is unconstitutional or inapplicable;
- the suspension caused compensable damages; or
- private platforms are required to carry Trump’s speech.
Trump or his supporters may describe the agreement as a win, and the payment has political significance. Legally, however, it is a negotiated resolution rather than a merits victory or constitutional precedent.

Why the lawsuit faced legal obstacles
The First Amendment generally restricts government conduct, not content decisions by private companies. A central issue would therefore have been whether Trump could overcome the state-action problem and show that YouTube’s conduct was attributable to the government.
The case also raised questions about Section 230, which generally protects online services from liability for third-party content while allowing them to moderate material. YouTube and other platforms have separately argued that forcing a private service to host or promote speech could interfere with the service’s own editorial discretion.

Trump would also have needed to establish a legally recognized injury, connect it to the challenged conduct and obtain appropriate relief. Legal commentators quoted in contemporary coverage identified these as substantial hurdles, but those assessments were predictions—not a court ruling on this case (Axios legal analysis).

How the deal fits with Trump’s other platform lawsuits
The YouTube agreement was reported as the final major settlement in Trump’s litigation against large platforms that suspended his accounts after January 6. Meta agreed to a roughly $25 million settlement in January 2025 over Trump’s Facebook and Instagram suspensions, while X, formerly Twitter, separately agreed to a reported $10 million settlement. The companies’ agreements had different terms and legal circumstances, so the amounts should not be treated as identical precedents (Associated Press; Ars Technica).
The practical takeaway
Alphabet’s $24.5 million payment ends the YouTube litigation without answering the underlying constitutional and Section 230 questions. Trump’s $22 million allocation is directed to the Trust for the National Mall for the White House State Ballroom project, while $2.5 million is distributed under separate agreements with the other plaintiffs. The settlement is financially significant and politically notable, but it does not prove that YouTube violated Trump’s rights or create a new legal rule for platform moderation.
