The Dutch Data Protection Authority (Autoriteit Persoonsgegevens, or Dutch AP) fined Clearview AI €30.5 million after finding that the company unlawfully processed personal and biometric data relating to people in the Netherlands for its facial-recognition service. The decision, dated May 16, 2024, also ordered Clearview to stop specified unlawful processing and delete relevant data. It is a regulatory decision—not a criminal conviction—and the available sources do not establish that the fine was paid or that later legal challenges have been resolved.
Clearview AI markets facial-recognition and image-search services, particularly to law-enforcement and public-sector customers. Its system compares a face submitted in a search with images indexed in a large database gathered from online sources. The Dutch AP concluded that Clearview’s processing of data relating to people in the Netherlands violated the EU General Data Protection Regulation (GDPR).
The decision was publicized on September 3, 2024, by the European Data Protection Board (EDPB). The EDPB’s summary describes the findings and enforcement measures; the Dutch AP’s decision provides the detailed legal reasoning and fine breakdown.

The EDPB identifies GDPR Articles 5, 6, 9, 12, 14, 15, 27 and 84 among the provisions involved. In plain language, the decision concerned the lawfulness and handling of the processing, special-category biometric data, transparency, access rights and the EU-representative requirement.

Why a photo being online did not settle the issue
The central distinction is between being able to view an image on a webpage and being entitled to collect, retain, analyze and use it for biometric identification. A photograph can be personal data. When a system analyzes facial features to identify or distinguish a person, it can generate biometric data subject to additional GDPR restrictions.
That does not mean GDPR requires consent for every photograph found online, or that every public image is automatically biometric data. The legal question is whether the specific processing has a valid legal basis and satisfies the additional rules that apply to biometric data, including transparency and data-subject rights. The Dutch AP found that Clearview’s practices failed those requirements.
Facial search also changes the practical privacy risk. A person may have shared an image in one context, but indexing it for searches by face can make it easier to connect that image to other information and identify the person. The source image, a biometric representation derived from it, a search result and a human investigator’s conclusion are distinct things; a search result is not, by itself, proof of identity.

How the €30.5 million was calculated
The Dutch AP divided the administrative fine into two parts:
- €20 million for the core infringements involving unlawful processing, biometric data and inadequate information.
- €10.5 million for failures involving access requests and procedures for exercising access rights.
The authority also imposed four orders subject to penalty payments if Clearview failed to comply. These are separate from the €30.5 million fine: conditional penalty payments are enforcement measures, not an additional amount already imposed and collected. The orders included requirements to stop specified unlawful processing and remove unlawfully obtained personal data relating to people in the Netherlands. They should not be described as an order to erase Clearview’s entire worldwide database.
The decision states that the Dutch AP would not proceed with collection until related proceedings had concluded. Accordingly, “fined €30.5 million” accurately describes the authority’s decision; it does not establish that Clearview has paid the amount.

Why GDPR applied to a U.S. company
A company does not have to be headquartered in the EU for GDPR to apply. The regulation’s territorial scope can reach some processing by companies outside the EU, depending on the activity and the people and data involved. The Dutch AP treated Clearview’s processing concerning people in the Netherlands as within the regulation’s scope and found that the company should have appointed an EU representative under Article 27.

Clearview disputed the decision and argued that EU data-protection law did not apply because it lacked a place of business in the Netherlands or the EU. The company characterized the ruling as unlawful, according to contemporary reporting. That is Clearview’s position, not the Dutch AP’s conclusion. The available sources verify the regulator’s decision and its 2024 publication, but do not establish a later final court outcome or collection status.
Earlier European enforcement against Clearview
The Dutch action followed separate decisions by other European authorities. Italy’s data-protection authority imposed a €20 million fine, prohibited further collection and processing concerning people in Italy, ordered deletion of relevant data and required an EU representative. Greece’s authority also imposed a €20 million fine, alongside measures concerning an access request, collection and processing, and deletion.

The decision is a reminder that a public profile photo is not necessarily free for any company to repurpose. Depending on the law that applies and the circumstances, people may have rights to information, access, deletion, objection or restriction. Those rights are not a guarantee that every copy of every photo can be removed: the data must fall within the relevant processing, the request must be handled under applicable rules, and identity verification or other legal exceptions may matter.
If you are concerned that a service holds information about you, look for its privacy or data-rights process and make a clear request for access or deletion under the law applicable to you. Keep a copy of the request and response. If the company does not respond or you cannot identify a workable contact route, you may be able to contact the data-protection authority in your jurisdiction. A regulator’s findings about Clearview do not automatically decide the status of other companies or guarantee an individual outcome.

What it means for law enforcement and AI vendors
The Dutch decision concerns Clearview’s collection and processing practices and its handling of people’s rights. It does not establish a blanket ban on all facial recognition or decide that every law-enforcement use is unlawful. The lawfulness of a particular agency’s search can depend on separate questions: the agency’s legal authority, procurement and use rules, the purpose of the search, retention, human review and safeguards for people affected.
There is also a difference between an investigative lead and reliable proof. Image quality, pose, lighting, camera angle and other factors can affect a match; error rates may vary across groups. A responsible deployment therefore needs appropriate testing, human verification, auditability and due-process protections—not unquestioning reliance on a system output. For vendors, the case underscores that a useful service still needs a defensible legal basis, meaningful transparency, workable rights processes and a lawful approach to biometric data.
What is known about the case’s status
The verified record covered here is the Dutch AP decision dated May 16, 2024, and its public announcement in September 2024. The sources cited here do not establish whether a later court upheld, overturned or changed the decision, whether the fine was collected, or whether Clearview’s objections have been finally resolved. The €30.5 million figure is the amount imposed by the regulator, not proof of payment or an unappealable judgment.
