“Employee monitoring” describes several different types of software. A time tracker may record when someone starts and stops a timer. A workforce-analytics platform may classify application use and report workload trends. A security platform may record screens, capture keystrokes, inspect file transfers, and alert on suspected data theft.

Common data types include:

  • Time and attendance: logged hours, schedules, clock-ins, overtime, and attendance patterns.
  • Application and website use: which programs and sites are used, for how long, and sometimes whether they are categorized as productive or unproductive.

3. Map the data flow

Document devices, employee groups, locations, data categories, storage regions, administrators, retention periods, deletion processes, and any international transfers. Include contractors and personally owned devices.

4. Configure privacy boundaries

  • Limit collection to scheduled work periods.
  • Exclude personal applications and websites where possible.
  • Disable camera, audio, and keystroke features unless specifically justified.
  • Use aggregated or anonymized reports for workforce trends.
  • Restrict individual-level access to people with a defined need.

5. Publish a clear policy

7. Measure outcomes, not activity scores

Use cycle time, project completion, billable-hour accuracy, support response time, workload balance, error rates, or reduced administrative work. An increase in active minutes is not, by itself, a productivity improvement.

8. Remove useless collection

Review the deployment after launch. If a data category never leads to a legitimate decision, disable it.

Is employee monitoring legal?

There is no universal yes-or-no answer. The legal position can depend on the employer’s location, the employee’s location, device ownership, data type, industry, collective-bargaining obligations, and the stated purpose of monitoring.

Before deployment, ask counsel to review:

  • Federal, state, and local workplace-monitoring rules.
  • Electronic-communications and wiretap restrictions.
  • Written-notice requirements.
  • Biometric, audio, video, and location-monitoring rules.
  • GDPR and other data-protection requirements for workers outside the United States.
  • Works-council or collective-consultation requirements.
  • Data-processing agreements and international transfers.

They do not automatically make a customer’s specific monitoring program lawful or compliant. The customer remains responsible for purpose, notice, configuration, access, retention, contracts, and operational safeguards.

Questions to ask vendors before buying

  • Exactly what data is collected, and is it content or only metadata?
  • When does collection start and stop?
  • Can employees view their own records?
  • Can screenshots be blurred, disabled, scheduled, or deleted?
  • Can personal sites and applications be excluded?
  • Can reports be aggregated or anonymized?
  • Where is data stored, and how is it transferred?
  • Who can access raw data and investigation reports?
  • Are access logs and administrator audit trails available?
  • How long is data retained, and can it be deleted on schedule?
  • What operating systems, mobile devices, BYOD scenarios, and contractors are supported?
  • Are SSO, SCIM, RBAC, APIs, payroll, project-management, HRIS, or SIEM integrations included in the plan you need?
  • Are screenshots, recording, GPS, DLP, workforce planning, or extended retention charged separately?
  • What is the minimum seat commitment, and is support included?

Alternatives to employee monitoring software

Monitoring is not the only way to improve productivity or accountability. Depending on the problem, a less intrusive option may be better:

  • Project-management analytics: track cycle time, blocked work, missed handoffs, and completion rates.
  • Goal and outcome tracking: measure deliverables, customer results, revenue, quality, or service levels.
  • Capacity planning: compare planned work with available staffing without inspecting every screen.
  • Pulse surveys and one-to-ones: uncover workload, process friction, and burnout risk directly.
  • Time tracking without screenshots: preserve billing accuracy while minimizing visual surveillance.
  • SIEM tools: investigate security events using security telemetry rather than general productivity monitoring.
  • Focused DLP: protect sensitive files and destinations without recording all ordinary work activity.

Final recommendation

For most organizations trying to understand workload and improve processes, start with ActivTrak or another workforce-analytics platform configured around team-level trends and clear privacy boundaries. Choose Hubstaff when the central need is time, projects, billing, payroll, contractors, or field operations. Choose Teramind only when the organization has a genuine insider-risk or DLP requirement and the governance needed to manage highly sensitive monitoring data.

Time Doctor, Insightful, DeskTime, Monitask, and WorkTime can make sense for narrower needs, but compare their current plans, data controls, integrations, and legal documentation before committing.
