The September 16, 2024 hearing that TikTok was preparing for is over: the D.C. Circuit and then the U.S. Supreme Court upheld the federal law requiring ByteDance to divest TikTok’s U.S. operations or face restrictions on the app. TikTok nevertheless remained available in the United States after enforcement was delayed and a new U.S. operating entity was established in January 2026. The dispute matters to users, creators, advertisers and small businesses because a restriction on one platform can affect audience access and income—but it did not amount to a simple, immediate deletion of every TikTok account.
What the 2024 hearing was about
The original “gearing up for court hearing” report was published in September 2024. It concerned oral arguments on September 16 before the U.S. Court of Appeals for the D.C. Circuit, not the Supreme Court. TikTok and its parent company, ByteDance, were challenging the Protecting Americans from Foreign Adversary Controlled Applications Act, signed into law on April 24, 2024.
The statute set a deadline of January 19, 2025, for ByteDance to divest TikTok’s U.S. business, with a possible 90-day presidential extension if statutory conditions were met. If the required divestiture did not occur, the law restricted app stores from distributing or updating TikTok and internet-hosting services from supporting its distribution or maintenance in the United States. It was therefore commonly called a “ban,” but its legal mechanism was divestiture backed by distribution and hosting restrictions—not an order to erase users’ accounts on the deadline.

A central practical question was whether a sale could separate TikTok’s U.S. operations from ByteDance’s control while addressing the app’s data systems, software, recommendation technology and infrastructure. Selling a U.S. corporate shell alone would not necessarily resolve those issues.

What TikTok, ByteDance and creators argued
TikTok and ByteDance’s case centered on the First Amendment and the law’s effect on a major communications platform. They argued that restricting the app would burden the speech of U.S. users, limit their access to other speakers, and target one platform rather than establish a generally applicable data-security regime. TikTok said the law affected about 170 million U.S. users; that was the company’s figure, not an independently verified count in the legal dispute.
The companies also challenged Congress’s decision to single out ByteDance and TikTok through legislation, the process and factual basis for that decision, and the government’s assessment of less restrictive safeguards. They stressed that a divestiture might be impracticable if it required transferring or materially changing the recommendation algorithm, source code, data systems and other technology tied to ByteDance.

Creators brought a separate challenge. Their claims focused on their ability to communicate with audiences and earn income through TikTok. That gave the case a direct speaker-and-business dimension distinct from ByteDance’s corporate and ownership interests. TikTok also cited its own estimates that a month without the platform could cost U.S. small businesses more than $1 billion in revenue and creators nearly $300 million in earnings. Those were company estimates, not established forecasts. TikTok’s court filings and public statements are available through its May 2024 filing announcement and its emergency-injunction announcement.
What the government argued
The Justice Department defended the law as a national-security measure aimed at risks arising from ByteDance’s ownership and control, rather than a restriction on particular viewpoints. The government argued that ByteDance’s relationship with China could expose U.S. user data to access or create opportunities to influence content distribution. Those concerns were the government’s stated risk rationale; they should not be read as proof that the Chinese government had accessed every U.S. user’s data or controlled every recommendation.

The government maintained that Congress could address ownership, data access and operational control, and that divestiture was less restrictive than shutting down TikTok permanently: the service could continue under different ownership and control. The Justice Department’s position is summarized in its court arguments, reported by Reuters.
The dispute thus involved a real tension: TikTok’s platform carried protected speech, while the law was framed around ownership and national security. A law aimed at control of a platform can still have major consequences for the speech and livelihoods built around it.

Why the September hearing mattered
The D.C. Circuit was hearing the challenge on an expedited schedule, with the January 2025 deadline approaching. Its ruling would shape whether the deadline remained in place and whether the parties needed to seek Supreme Court review before it arrived. The hearing itself did not decide that TikTok would disappear immediately: judges heard arguments about the law and requested relief, and the court still had to issue a decision. For users and businesses, the possible consequences were broader than whether a download button remained visible. Restrictions on new downloads and updates could be different from restrictions on hosting and ongoing service. If hosting and technical support were cut off, the app could degrade or eventually stop functioning; the statute did not itself delete individual accounts or content. Creators could lose access to audiences and income, while businesses relying on TikTok for discovery, advertising or sales might need to find other channels. Instagram Reels, YouTube Shorts and Snapchat were possible alternatives, but none could guarantee the same audience or economics.

What happened after the hearing
- December 6, 2024: The D.C. Circuit upheld the law.
- January 10, 2025: The Supreme Court heard oral arguments.
- January 17, 2025: The Supreme Court upheld the law in TikTok Inc. v. Garland. The Court did not issue a simple order to delete TikTok; it rejected the constitutional challenge to the statute, which required divestiture or restricted U.S. distribution and hosting.
- January 19, 2025: The statutory deadline arrived, and TikTok briefly went offline in the United States. The Trump administration then delayed enforcement repeatedly.
- January 22, 2026: The U.S. operating arrangement was finalized through a new entity, TikTok USDS, intended to separate U.S. operations, data and algorithm oversight from ByteDance’s Chinese parent structure, according to Associated Press reporting.
As of August 16, 2026, TikTok remained available in the United States under the later arrangement. The original appellate challenge is no longer a pending hearing, and the Supreme Court’s ruling remains in place. Later restructuring and enforcement decisions changed the practical outcome, but did not reverse the Court’s decision. A U.S. operating entity, by itself, does not answer every question about who controls data, recommendation systems, software updates or corporate decisions. The arrangement’s implementation is distinct from the constitutional ruling.
What this means for personal finances
For a creator or small business, the case is a reminder that platform access can be a financial risk even when a platform is popular and functioning. If customers, leads or sales depend on one service, a legal or technical disruption can interrupt that channel. Diversifying an audience through a website, email list, or more than one social platform can reduce reliance on any single company, though it cannot guarantee replacement reach or income. This is a general risk-management point, not a prediction that TikTok will become unavailable again.
Do not treat a VPN as a dependable way around a U.S. restriction. The law addressed U.S. distribution, hosting and service-provider activity, not just a user’s apparent IP address; technical effectiveness and legal consequences would depend on circumstances. Government-device bans or permissions are also separate from nationwide rules for consumer access. For example, reported Justice Department guidance in July 2026 addressed federal employees’ government devices after the new arrangement; that is not the same question as whether ordinary users may access the app.
