Short answer: Yes—but only in proposed versions of the legislation. The House version of H.R. 1 proposed a 10-year block on many state and local AI regulations. A later Senate proposal tried to connect compliance with that approach to access to federal broadband funding. The Senate removed the AI moratorium on July 1, 2025, and the law signed on July 4 did not contain it.
What was the One Big Beautiful Bill?
H.R. 1, the budget-reconciliation package formally titled the One Big Beautiful Bill Act, was not an AI-specific bill. It was a broad tax-and-spending measure that became a vehicle for a major fight over whether states and local governments should be allowed to regulate artificial intelligence.
That distinction matters because the House proposal, later Senate versions, and the enacted law were not identical. Describing “the bill” as though one unchanged AI provision moved from introduction to enactment creates the wrong impression.

What the House version proposed
Section 43201 of the House version proposed a 10-year moratorium on many state and local laws regulating covered artificial-intelligence technology in interstate commerce. In broad terms, it would have prevented states and political subdivisions from enforcing rules that limited, restricted, or otherwise regulated:
- AI models;
- AI systems; and
- automated decision systems.

“GenAI deregulation” is therefore understandable shorthand, but it is not a precise description. The language was broader than chatbots, image generators, and other generative-AI products. Depending on the definitions and how courts interpreted the provision, the debate could have reached automated systems used in hiring, credit, insurance, education, housing, employment, content moderation, and autonomous vehicles.

That does not mean every state AI law would necessarily have been invalidated. The proposed language included exceptions and qualifying terms, including provisions involving AI deployment, generally applicable requirements, and other specified categories. The practical scope would have depended on the text, agency interpretation, enforcement decisions, and litigation.
How broadband funding became leverage
The House proposal was primarily a federal-preemption measure: it sought to stop states and localities from enforcing specified AI rules. During Senate negotiations, the approach was connected to the federal Broadband Equity, Access, and Deployment program, commonly called BEAD.
BEAD distributes federal support through states and territories for broadband infrastructure. For state officials, broadband eligibility is not an abstract technology issue. It affects whether communities can receive funding for networks, equipment, and deployment projects.

A Senate proposal would have added $500 million for BEAD-related activity and expanded the concept of an eligible project to include infrastructure supporting AI models, AI systems, or automated decision systems. It also proposed setting aside $25 million for master-services agreements intended to help subgrantees obtain AI infrastructure through purchasing and licensing arrangements. (Congressional Record)
The proposal also included language addressing state enforcement of covered AI laws. That created the leverage mechanism at the heart of the controversy: a state seeking federally supported broadband deployment could potentially face pressure to pause enforcement of certain AI regulations.
Was all $42 billion of BEAD funding conditioned on deregulation?
This is where the wording needs care.
Senate critics, including the office of Senator Maria Cantwell, characterized the proposal as holding approximately $42 billion in BEAD funding hostage. Their description was that states would be forced to choose between enforcing consumer protections and preserving access to broadband money. (Senate Commerce Committee criticism)
Supporters described the language more narrowly, arguing that the moratorium was tied to particular new funding or projects and was intended to prevent state rules from creating barriers to AI infrastructure. The safest conclusion is not that the statute definitively confiscated or conditioned every dollar of BEAD funding. Rather:
- existing BEAD funding was a much larger pool than the proposed new AI-related appropriation;
- the Senate proposal amended the BEAD framework and addressed AI infrastructure;
- critics said its enforcement condition put broader BEAD funding at risk; and
- the proposed 10-year AI moratorium was ultimately removed before the law was enacted.
Why the proposal mattered beyond generative AI
The fight was not simply about whether companies could build larger language models. It concerned who would set rules for automated decisions that affect ordinary consumers and workers.

Potentially relevant areas included:
- Employment: automated hiring, screening, or promotion systems;
- Credit and insurance: algorithmic underwriting, pricing, and eligibility decisions;
- Housing: tenant screening and advertising systems;
- Education: automated admissions, assessment, or disciplinary tools;
- Consumer protection: deceptive AI-generated communications, deepfakes, and robocalls;
- Transportation: autonomous or semi-autonomous systems; and
- Privacy and civil rights: rules aimed at discriminatory or unsafe automated outcomes.
Supporters argued that a patchwork of state laws could increase compliance costs and make it difficult for national technology companies to operate under consistent rules. Opponents argued that Congress had not enacted a comprehensive federal AI framework that could replace state protections, and that broadband infrastructure should not be used to force states to surrender regulatory authority.
The Senate vote that ended the moratorium
On July 1, 2025, the Senate voted 99–1 to remove the AI moratorium from the reconciliation bill. The amendment was co-sponsored by Senators Maria Cantwell and Marsha Blackburn. (Senate Commerce Committee announcement)

That vote is the dividing line between what lawmakers proposed and what the law does. The proposal was real and advanced far enough to generate a serious legislative fight. It did not, however, survive into the final statute.

President Donald Trump signed the legislation on July 4, 2025. The enacted law retained other broadband- and spectrum-related measures, including provisions involving renewed Federal Communications Commission auction authority and spectrum for commercial wireless and broadband uses. It did not retain the proposed Section 43201 10-year moratorium on state and local AI regulation. Nor should the withdrawn Senate AI-and-BEAD amendment be described as an enacted condition requiring states to deregulate AI.
For consumers, state officials, and technology companies, the practical takeaway is straightforward: the One Big Beautiful Bill did not end state AI regulation. States were not made to choose broadband funding over enforcement of covered AI laws under a provision in this statute.

Why the episode still matters
The proposal demonstrated how infrastructure funding can become a tool for national regulatory preemption. Instead of directly ordering every state to abandon AI rules, the Senate approach considered using eligibility for federally supported broadband projects as pressure to achieve a similar result.
That strategy creates different risks for different groups. State broadband agencies could face a conflict between protecting local regulatory authority and maximizing infrastructure funding. Attorneys general could have to weigh enforcement against possible federal funding consequences. AI companies could benefit from more uniform rules, while consumers could lose state-level protections if federal safeguards did not replace them.
The episode also showed the political difficulty of attaching a sweeping AI policy to a budget-reconciliation package. The moratorium attracted opposition from lawmakers who otherwise disagreed on technology policy, and it was removed by an overwhelming vote before enactment.

Calling the enacted law a ban on state AI regulation is false. Calling the proposal a generative-AI-only measure is too narrow. And saying that the Senate compromise passed confuses a withdrawn proposal with the statute that ultimately took effect.
