Reddit filed a challenge in Australia’s High Court on December 12, 2025, contesting its inclusion in the country’s under-16 social-media account restrictions. The company argues that the rules raise privacy and political-expression concerns and says Reddit should not be covered. The case has not, on the information available as of August 18, 2026, produced a verified final judgment. The filing did not suspend the law: covered platforms still have to take reasonable steps to prevent under-16s ordinarily resident in Australia from holding accounts.
What Reddit asked the High Court to decide
Reddit’s application seeks declarations that the Social Media Minimum Age legislation is invalid, or alternatively that Reddit does not fit the definition of an age-restricted social-media platform. Those are distinct arguments: the first challenges the legal framework, while the second asks whether the framework applies to Reddit. The application is the underlying filing; ABC News reported the December 12 filing.
Reddit’s case does not itself overturn, pause, or exempt the company from the rules. Until a court or regulator changes the position, Reddit remains on eSafety’s list of services it considers age-restricted. The legal challenge should therefore be understood as a dispute over validity and classification—not a ruling that the law is unconstitutional or that Reddit is exempt.
What the law requires—and what it does not
Australia passed the Online Safety Amendment (Social Media Minimum Age) Act 2024, and the obligations took effect on December 10, 2025. They require providers of covered services to take “reasonable steps” to prevent Australians under 16 from creating or keeping accounts. The duty is on platforms, not children or parents. A child is not criminally punished or personally fined simply for having an account, and the law does not require every website to block all access to its content. The test concerns people ordinarily resident in Australia, not only Australian citizens. The rules do not set a simple number of days that determines ordinary residence, so a person’s circumstances may matter—for example, for international students, temporary residents, or families moving across borders.
An account restriction is not the same as a total reading ban. Reddit said Australians under 16 could still browse without an account. That does not provide the same access as a logged-in account: posting, commenting, messaging, subscriptions, personalized features, and other account-dependent functions may be unavailable.
Why Reddit objects
Privacy and age assurance
Reddit argues that compliance can require platforms to assess users’ ages, potentially affecting adults as well as children. Age checks need not mean uploading an identity document: possible approaches include age inference from account or usage signals, age estimation, account-history checks, location signals, identity checks, or combinations of methods. Each approach has different risks, including false results, data collection, security exposure, and friction for users.

The law does not allow platforms to compel Australians to use a government-issued identity document or an Australian Government-accredited digital identity service specifically to prove age. That safeguard does not rule out every other form of age assurance. The Office of the Australian Information Commissioner’s privacy guidance explains the privacy framework; eSafety notes that assurance may involve multiple measures over time rather than a single universal check.
Reddit’s concern is consequently broader than whether users must show a passport. Inference and estimation can still involve personal information or affect access, while broad checks may impose inconvenience on adults. Conversely, narrower checks may be easier to evade. The statute leaves implementation to platforms within a reasonable-steps standard rather than prescribing one technology for every service.
Political communication and participation
Reddit also argues that restricting accounts burdens political discussion and expression, including young people’s ability to read, join, or organize around public issues. The relevant Australian constitutional principle is the implied freedom of political communication. It is not an unlimited personal right equivalent to the First Amendment in the United States. A court considering such a claim would examine whether the law burdens political communication and, if so, whether the burden is justified and proportionate to a legitimate purpose. Reddit’s argument is a claim for the court to assess, not an established conclusion.

Whether Reddit belongs in the covered category
Reddit has said under-16s are not a substantial market segment for the service and that it has not marketed itself to young people. But user numbers or marketing alone do not settle the legal question: the issue is whether Reddit meets the statutory and regulatory definition. Reddit has said it supports youth safety while disputing both the approach and its own inclusion.

The government’s case and the central trade-off
The government’s rationale is to reduce children’s exposure to social-media harms, including risks associated with engagement-maximizing design, and to give them more time to develop digital literacy and resilience. The framework places the compliance burden on providers and calls for reasonable steps, rather than promising that no under-16 user can ever evade a check. It also restricts the use of age-related information and operates alongside Australian privacy law.
The policy trade-off is not simply child safety versus freedom of access. Account restrictions may reduce underage participation, but checks can create privacy and usability costs for adults, incorrectly restrict people, or collect information that presents security risks. Reddit says device- or app-store-level age assurance could be more privacy-preserving than repeated platform checks; that is its policy position, not a settled finding that an alternative would work better. Account-free reading also preserves some access to information while removing participation and account-based features. Reddit argues that losing those tools may make young users harder to protect, a point that remains part of its case rather than independently established fact.

Which services are covered?
In its April 2026 materials, eSafety considered Facebook, Instagram, Kick, Reddit, Snapchat, Threads, TikTok, Twitch, X, and YouTube age-restricted. This is the regulator’s current assessment, not a permanent list written into the law; services may be reassessed as their features and use change. eSafety said Discord, GitHub, Google Classroom, LEGO Play, Messenger, Pinterest, Roblox, Steam, Steam Chat, WhatsApp, and YouTube Kids were not currently age-restricted. Not every online service is covered. A service’s features, purpose, accessibility in Australia, and any relevant exclusions matter. Messaging, education, professional-development, health, email, calling, and some gaming services may fall outside the rules, depending on the service and its features.

What Australian users and parents should know
- Under 16 and ordinarily resident in Australia: A covered platform must take reasonable steps to prevent you from holding an account. Reddit account-free browsing may still be possible, but it lacks account functions.
- Age assurance is not necessarily an ID upload: Platforms may use different signals or methods. Government ID or accredited government digital ID cannot be compelled for this purpose.
- False positives can happen: An adult incorrectly assessed as under 16 may need to use the platform’s age-review or appeal process, where available.
- Turning 16 does not guarantee instant restoration: A user may need to complete the service’s age-review process.
- Temporary presence is not the whole test: Ordinary residence, rather than citizenship alone or simply being physically in Australia, is the statutory focus. Individual cases can be uncertain.
- Parents are not fined merely because a child has an account: The compliance obligation and potential corporate penalties are directed at providers or other liable entities.
What enforcement evidence shows so far
Early figures show both substantial account action and continuing work to assess compliance. eSafety said platforms had removed access to 4.7 million under-16 accounts by mid-December 2025. Its March 2026 review nevertheless found that some under-16s retained accounts, created new ones, or passed age-assurance systems. The regulator identified compliance concerns involving Facebook, Instagram, Snapchat, TikTok, and YouTube; that focus did not include Reddit at that stage.

Those figures are not a simple pass-or-fail score. Large-scale removals can coexist with evasion, newly created accounts, and mistaken age assessments. In May 2026, eSafety said investigations remained ongoing and that it had not made final determinations on whether platforms had taken reasonable steps. The regulator’s age-restrictions hub collects its implementation updates.
Current eSafety material says court-imposed fines can reach 150,000 penalty units, then valued at A$54.6 million. Penalty values and legislative settings can change; this is a possible maximum for liable companies, not a fine imposed on a child or parent merely because a child has an account.
What happens next
As of August 18, 2026, the available authoritative material confirms Reddit’s challenge but does not establish a final High Court judgment. The court’s eventual decision could address the validity of the framework, Reddit’s classification, or both; until there is a judgment or other formal change, the rules remain in effect for covered services.

On July 1, 2026, the Senate referred the Strengthening Enforcement for the Social Media Minimum Age Bill 2026 to committee. Its scheduled reporting date was August 25, 2026—after the date of this update—so it should not be treated here as enacted law. Parliamentary material describes proposals to broaden enforcement and information-gathering powers. The committee page tracks that bill separately from Reddit’s court case.
For users, the immediate distinction is practical: the litigation has not removed Reddit from eSafety’s covered-platform list, and the account restriction is not a complete block on public browsing. For the broader debate, the case tests how far governments can require platforms to restrict accounts by age while managing privacy, political participation, and the risk of inaccurate or circumvented checks.
