Pocket Guide: How to Create, Sell, and Buy AI NFTs

Short answer: An AI NFT is a blockchain token associated with AI-generated or AI-assisted art, music, video, animation, or another digital asset. Minting the token records ownership of that token and its transaction history. It does not automatically transfer copyright, commercial rights, exclusivity, or ownership of the underlying work.

Before spending money, document your rights, understand storage and licensing, calculate gas and platform fees, and assume that resale is uncertain. Buyers should treat an AI NFT as a speculative, potentially illiquid purchase—not as guaranteed appreciation or automatic ownership of the associated artwork.

What an AI NFT actually includes

The phrase “AI NFT” combines several separate things:

  • AI-generated or AI-assisted artwork: The image, animation, audio, video, 3D model, or other creative output.
  • NFT: A unique or editioned blockchain token associated with that output or with a stated entitlement.
  • Marketplace listing: An offer to sell the token. A listing is not itself proof that the seller owns the copyright or has cleared every source asset.
  • Metadata: Information such as the item name, description, traits, external links, and a reference to the media file.
  • License: The permissions, if any, granted to the buyer. These may cover personal display, commercial use, downloads, membership, or nothing beyond token ownership.
  • Provenance: The token’s minting and transfer history on the blockchain.

Buying an NFT does not automatically mean buying copyright in the associated artwork. The token may be unique while the image or audio remains publicly viewable and copyable. The U.S. Copyright Office and USPTO discuss this distinction, including the relationship between NFTs, unauthorized copies, and intellectual-property rights, in their joint NFT and intellectual-property report.

Where is the artwork stored?

The media may be stored directly on-chain, through IPFS or another content-addressed system, or at a conventional centralized URL. The token can remain on the blockchain if the linked file is moved, deleted, or replaced. That means “on-chain” is not automatically synonymous with permanent media storage.

Creators should disclose the storage method, backup arrangements, and whether metadata can change. Buyers should save the contract address, token ID, transaction hash, license, and a copy of the purchased file where permitted.

Before creating an AI NFT

Clear the rights first

Review the AI generator’s current terms for:

  • Commercial use of outputs.
  • Restrictions on reselling or licensing generated material.
  • Differences between free and paid plans.
  • Use in merchandise, advertising, or collectibles.
  • Terms covering cancellation or expiry of a subscription.
  • Prohibited content and model-specific restrictions.

Also check every input and component: reference images, photographs, music, voices, fonts, stock assets, logos, trademarks, fictional characters, recognizable people, and protected designs. Permission to use an AI platform does not automatically clear those materials.

Be particularly cautious when promising exclusive commercial rights, using a recognizable person or brand, or closely imitating a living artist. Copyright, publicity-rights, trademark, and unfair-competition rules vary by jurisdiction.

Is AI-generated art copyrightable?

There is no single worldwide answer. Copyright law differs by country. In the United States, purely machine-generated output may face copyright-protection problems because copyright generally requires human authorship. Human selection, arrangement, compositing, editing, retouching, writing, animation, or other creative contributions may affect the analysis.

The careful formulation is: copyright protection may depend on the amount and nature of human creative contribution, the jurisdiction, and the facts of the work. Registering or minting an NFT does not create copyright.

Keep evidence of your contribution, including prompts, sketches, rejected generations, source files, editing layers, compositing steps, and production notes. Training-data disputes and an AI provider’s terms are separate questions from whether the final work receives copyright protection.

For a high-value collection or an exclusive commercial license, consult a qualified intellectual-property lawyer in the relevant jurisdiction rather than making a blanket ownership promise.

What you need to mint

Artwork checklist

  • Final image, animation, audio, video, or 3D file.
  • A marketplace-friendly preview.
  • A high-resolution master stored separately.
  • Consistent formats across the collection.
  • File-size and dimension checks.
  • Clear filenames and version numbers.
  • A record of the model, tool, prompt, edits, and source materials.

OpenSea Studio currently requires NFTs created in the same collection to use the same file type, so decide your format before uploading.

Metadata checklist

  • Collection and item names.
  • Description and edition size.
  • Traits or attributes.
  • External website.
  • Creator wallet address.
  • AI-use disclosure.
  • Storage and delivery instructions.
  • Personal-use, commercial-use, or other license terms.
  • A clear statement of what the buyer does not receive.

Wallet and security checklist

You need a self-custodial wallet compatible with the selected blockchain and enough of that blockchain’s native currency for applicable transactions. Consider a separate wallet for experimentation and a hardware wallet for valuable holdings. Keep the seed phrase written down and offline.

A dedicated browser profile can reduce exposure to unrelated extensions and accounts. Verify contract addresses and transaction details before signing.

Never give a seed phrase or private key to a marketplace, buyer, promoter, or supposed support agent. No legitimate support representative needs it to release a sale or fix a transaction.

How to mint an AI NFT with OpenSea Studio

OpenSea’s interface can change, so treat the following as the current published workflow rather than a permanent UI guarantee. The no-code process is documented in OpenSea’s NFT creation guide.

1. Choose a collection or a drop

Use Create Collection when you want to mint items directly into your own wallet. A drop is designed for public or community minting, where buyers mint from the collection. An individual NFT is a single item; a collection is a creator-controlled group of items.

2. Open Studio

  1. Open the official OpenSea website.
  2. Select Studio from the left sidebar.
  3. Choose Create new.
  4. Select Create Collection.

Connect only through the official domain. Bookmark it rather than following links sent by strangers.

3. Deploy the smart contract

Provide the collection logo, contract name, token symbol, and EVM-compatible blockchain, then approve the wallet transaction. The contract name and token symbol are visible on-chain and cannot be changed after deployment. Deployment requires a blockchain transaction and gas.

If deployment appears to fail, first check whether the transaction is pending, rejected, or confirmed on a block explorer. Confirm the wallet network and native-token balance, and check whether the contract was already deployed. Do not repeatedly approve transactions or send money to someone claiming they can unlock it.

4. Configure creator earnings

OpenSea’s current workflow allows collection owners to add an earnings percentage and payout address. For collections created in OpenSea Studio after April 2, 2024, OpenSea says creator earnings can be enforced through its supported contract structure; older or incompatible custom contracts may support only optional earnings. Do not describe royalties as guaranteed forever. Earnings may be optional, marketplace-specific, or dependent on contract compatibility. Enforcement on OpenSea does not guarantee enforcement on every other marketplace.

5. Upload media and metadata

In Media & Metadata, upload the artwork, name the item, choose its supply, and add the description, external links, and traits. A supply of 1 creates a one-of-one edition. A higher supply creates multiple copies of the same item.

Disclose whether editions are identical, subtly varied, or algorithmically generated. A large supply can reduce scarcity and collector appeal, particularly if the collection contains minimally reviewed or repetitive outputs.

6. Mint and verify

Select Mint and approve the wallet transaction. Afterward, verify the contract address, token ID, owner wallet, media preview, metadata, traits, external links, explorer record, and collection placement. Do this before promoting the item.

How much does it cost?

Minting is not necessarily free. Your cost may include:

  • AI-generation or editing software.
  • Contract deployment gas.
  • Minting gas.
  • Gas for a first listing or accepting an offer.
  • Marketplace fees.
  • Promotion and storage.
  • Currency-conversion, exchange, or withdrawal charges.
  • Tax reserves.

A practical break-even worksheet is:

Break-even price = AI-tool cost + editing cost + deployment gas + minting gas + listing or acceptance gas + marketplace fee + promotion + tax reserve

Do not treat the wallet balance received as profit. A creator’s earnings may be paid to another wallet, and a sale may create taxable income or a capital transaction depending on the facts and jurisdiction.

OpenSea’s published help page currently lists these typical signals:

  • 1% typical NFT sale fee.
  • 10% fee for NFTs minted in primary drops.
  • 0% OpenSea fee for swaps, although a third-party provider may charge separately.
  • Private listings typically have a 0% OpenSea fee on the cited page.
  • Blockchain gas is separate and variable.

These are not permanent rates. Check OpenSea’s current fee page immediately before committing funds. OpenSea says sellers may pay gas when listing for the first time or accepting an offer, while buyers generally pay gas when purchasing; exact costs vary by network and transaction.

How to sell an AI NFT

Choose the sale format

  • Fixed price: Simple and predictable, but the price may be too high or too low for uncertain demand.
  • Timed auction: Can reveal market demand, but requires enough interested bidders.
  • Offer: Useful when buyers propose prices, but accepting can require gas.
  • Private sale: May suit a known buyer, but verify the transaction through the official marketplace.
  • Primary drop: Lets a community mint directly, but adds launch, support, and fee complexity.

Price according to the work’s concept, human contribution, provenance, scarcity, audience, and costs—not according to claims of guaranteed appreciation. Avoid fake scarcity, manufactured bidding, and promises of passive income.

A smaller, coherent, well-documented release may be more credible than thousands of minimally reviewed outputs. “AI-generated” by itself is not a value proposition; curation, story, utility, technical execution, or a genuine collector community may matter more.

How to buy an AI NFT safely

Check before connecting your wallet

  1. Confirm the marketplace domain.
  2. Match the collection’s contract address with the creator’s official website and authenticated channels.
  3. Verify the creator profile and token history.
  4. Look for copied artwork or an impersonated collection.
  5. Check the token ID, media, metadata, traits, and external links.
  6. Confirm that the seller owns the token or is authorized to sell it.
  7. Read the license instead of inferring rights from the price or artwork.
  8. Review the exact price, currency, marketplace fee, creator earnings, and gas.
  9. Reject unexplained token approvals or wallet permissions.

What might the buyer receive?

The purchase may provide only token ownership, or it may include personal display rights, a downloadable high-resolution file, commercial-use rights, access to future materials, membership, an event benefit, or a physical product. These promises are not interchangeable, and some may not be technically enforceable.

The collection’s written license should state what is included. If it is silent, do not assume commercial rights, exclusivity, copyright, or control over future editions.

Generic buying process

  1. Fund a compatible wallet with the blockchain’s native currency.
  2. Connect it to the official marketplace.
  3. Open the verified collection.
  4. Inspect the contract address and transaction history.
  5. Select the item and review all costs.
  6. Buy or make an offer.
  7. Confirm the exact transaction in the wallet.
  8. Verify ownership on-chain afterward.
  9. Save the transaction hash, receipt, and license.

OpenSea warns that it will not first contact users through social media or ask them to send funds to solve a selling or transaction problem. Screenshots are not proof of payment; verify transactions in the wallet and on the blockchain explorer.

Storage, scarcity, and resale risk

Questions about durability

  • Is the media stored on-chain, on IPFS, or at a centralized URL?
  • Is the metadata immutable or changeable?
  • Does the creator maintain backups?
  • What happens if the marketplace closes or stops displaying the collection?
  • Is the promised download actually embedded or available?

A marketplace may make an item easier to discover, but its display or verification process is not a complete investigation of copyright or authenticity.

One-of-one versus collection

A one-of-one can suit a single finished artwork and establish clear provenance, but minting and promotion costs may be disproportionate to the likely sale price. A collection offers multiple price points and a broader release plan, but requires more metadata work, quality control, and disclosure about future supply.

Check whether supply is fixed on-chain, whether new editions may be added later, whether traits are genuinely varied, whether reserved copies exist, and whether the mint schedule is transparent.

NFTs can be difficult to resell. A low floor price does not guarantee a buyer. Be prepared for the possibility that the NFT never resells, the media link fails, the collection loses visibility, the creator stops maintaining it, or the token’s market value falls substantially or to zero.

Common scams and failure modes

Fake buyer or support scam

A stranger may claim to want your work, send a link, say the NFT cannot be purchased, or demand an upfront payment. Do not click the link or send cryptocurrency to complete a sale. Require payment through the official listing and verify it on-chain. Ignore requests for seed phrases, private keys, remote access, or “unlock” fees.

Wrong network

If the wallet shows no funds, the item does not appear, or an unexpected currency is requested, stop before signing. Confirm the collection’s chain, the wallet network, and the marketplace instructions. Bridging funds can introduce additional fees and risks.

Stuck or failed transaction

  1. Check the wallet status and chain explorer.
  2. Determine whether the transaction is pending, rejected, failed, or confirmed.
  3. Do not send a replacement transaction blindly.
  4. Confirm whether the item actually minted.
  5. Use only the wallet’s documented replacement-transaction function if changing gas.
  6. Contact support through the marketplace’s official website.

Broken media or metadata

Test the item in multiple browsers before promotion. Inspect the metadata, external links, and storage behavior. Keep a local master copy and avoid promising permanent availability unless the storage design supports that promise.

Copyright complaint

Pause promotion, preserve generation and editing records, identify every source asset and license, and remove disputed material if necessary. An NFT sale does not cure infringement. Obtain legal advice for a significant commercial dispute.

Creator earnings not received

Possible explanations include optional earnings, an incompatible contract, a sale through a route that does not enforce earnings, an incorrect payout address, a policy change, or a transfer that was not a sale. Review the collection’s contract configuration and the marketplace’s current policy.

Taxes and recordkeeping

For U.S. readers, the IRS treats digital-asset activity as potentially reportable depending on what happened—for example, receiving digital assets for property or services, selling or exchanging them, or otherwise disposing of them. The tax result can differ among business income, compensation, property sales, and capital transactions. Consult the IRS digital-assets guidance and a tax professional.

Readers elsewhere should consult the tax authority and adviser applicable to their jurisdiction. Keep:

  • Wallet addresses and transaction hashes.
  • Date and time of every transaction.
  • U.S.-dollar or local-currency value at the transaction time.
  • Gas, marketplace, exchange, and withdrawal fees.
  • AI subscriptions and production costs.
  • Sale proceeds, refunds, and transfers.
  • License agreements and buyer or seller records where available.

When creating or buying is worthwhile

Consider creating when you have a clear concept, documented rights, meaningful human contribution, a realistic audience, and a budget that covers costs even if nothing sells.

Consider buying when you value the art or clearly defined utility independently of expected appreciation, understand the license, can verify provenance, and can afford to lose the purchase amount.

Walk away when the pitch relies on guaranteed returns, easy passive income, pressure to act immediately, anonymous private payment, unexplained wallet approvals, copied art, unclear rights, or promises that royalties and storage will last forever.

For a beginner creator, OpenSea Studio is a relatively accessible no-code route to deploy a collection and mint directly to a wallet. A custom smart contract offers more control over token behavior and specialized logic, but adds development, testing, auditing, security, deployment, and maintenance risks. Use custom development only when those requirements justify the complexity.

  • There is no assumption that the NFT will appreciate or resell.
