The 2022 Nelnet Servicing data breach was real, but it did not affect every Nelnet borrower. Nelnet said about 2.5 million people associated with EdFinancial Services and the Oklahoma Student Loan Authority (OSLA) had personal information accessed; it said Nelnet- and Great Lakes-serviced borrowers were not affected. The related $10 million class-action settlement received final approval on May 21, 2026, but the deadline to file an ordinary claim passed on March 5, 2026.
What happened in the Nelnet data breach?
Nelnet Servicing reported that an unauthorized party accessed account-registration information held on systems it controlled. Nelnet said it discovered a vulnerability and notified affected servicing clients on July 21, 2022. Its forensic investigation determined on August 17 that information had been accessed, and customer notifications began August 26. The access reportedly occurred from early June through about July 22, 2022. Nelnet’s incident notice describes its findings.
The incident involved roughly 2.5 million borrowers. The court-defined settlement class later included 2,502,916 people. Those figures describe the incident estimate and the certified settlement class, respectively; they are not evidence that every record was copied or misused.

Who was affected?
The affected group was tied to borrowers whose loans originated with EdFinancial Services or OSLA and whose information was in the affected systems. Having had a student loan—or seeing Nelnet branding on a site—does not by itself establish that you were affected or eligible for settlement benefits.

Nelnet said borrowers serviced by Nelnet and Great Lakes were not affected. If you are unsure, rely on an actual breach or settlement notice, or ask the settlement administrator to check a submitted claim; do not infer eligibility solely from having borrowed federal student loans. Nelnet said financial-account numbers and payment information were not affected. Its public notice does not identify loan balances, bank details, or payment information as exposed. “Accessed” does not necessarily mean that every listed item for every person was downloaded or used.
Was the information misused?
Nelnet’s initial notice said there was no known misuse at that time. That is not a guarantee that the risk was zero, and it does not establish whether any later identity theft was connected to this incident. Exposed contact information and Social Security numbers can make phishing or impersonation attempts more convincing, so treat unexpected messages cautiously.

What did the lawsuit allege, and what did the settlement decide?
The consolidated lawsuit alleged that Nelnet and related servicing entities failed to use reasonable safeguards. It asserted claims including negligence, breach of implied contract, unjust enrichment, breach of confidence, invasion of privacy, and state consumer-protection violations. Those were plaintiffs’ allegations, not findings that the defendants broke the law. The defendants denied wrongdoing and settled to avoid the expense and uncertainty of continued litigation. The court’s final approval order states that the settlement is not an admission of fault, wrongdoing, or liability.
Is the Nelnet settlement still open?
No. The court granted final approval on May 21, 2026, for a $10 million settlement. The ordinary claim deadline was March 5, 2026; the settlement website says a timely, valid claim was required to receive benefits. If you did not file by the deadline, you generally cannot start a new standard claim now.

The court order reported that the administrator had received 1,035,674 claim forms by May 4, 2026, of which 308,531 had been verified as of that date. A submitted form was not automatically an approved claim. Late claims were rejected, although a claimant disputing a rejection could request court review under the process described in the order.

How much could an eligible claimant receive?
The settlement fund pays for administration, court-approved attorneys’ fees and expenses, service awards, credit monitoring and identity-theft protection, and approved claims. Potential benefits included reimbursement for eligible documented out-of-pocket losses, compensation for qualifying lost time, a pro-rata cash payment, or two years of credit monitoring and identity-theft protection. The monitoring benefit was described as including identity-restoration services and up to $1 million in identity-theft insurance.

There is no guaranteed cash amount. Remaining funds are distributed pro rata among eligible claimants who filed valid claims and did not receive documented-loss or lost-time compensation. The amount depends on approved claims, benefit choices, costs, and the settlement’s distribution rules. The final order approved $3,333,333.33 in attorneys’ fees, $65,000 in litigation costs, and $1,500 service awards for each class representative; these are part of the fund’s structure, not additional payments to ordinary claimants. Do not rely on older articles that quote a proposed payment as a guaranteed payout.
If you already filed a claim
- Keep your submission confirmation and any related claim number.
- Check the email address and postal mailbox associated with the claim for a deficiency notice or eligibility decision.
- If you received a Notice of Deficiency, use the settlement site’s Fix My Claim portal and follow the notice’s instructions.
- For a claim-specific issue, contact the administrator using the details on its official contact page: 1-877-388-1763, [email protected], or Nelnet Data Security Settlement, c/o A.B. Data, Ltd., P.O. Box 173032, Milwaukee, WI 53217.
Do not assume that an email or a submitted claim guarantees approval or a particular payment date. Verify unexpected requests using contact information from the official settlement site, not a link in a message.
What affected borrowers should do now
- Consider a credit freeze. A freeze with Equifax, Experian, and TransUnion is free and can make it harder for someone to open new credit accounts in your name. The FTC explains how to place and lift freezes in its guidance on credit freezes and fraud alerts. A freeze does not block every type of identity theft.
- Review your credit reports and financial accounts. Look for unfamiliar accounts, inquiries, transactions, or changes to account details. Contact the institution through a known, official channel if something looks wrong.
- Be skeptical of urgent messages. Scammers may impersonate Nelnet, EdFinancial, OSLA, the settlement administrator, a government agency, or a credit bureau. Never give an unsolicited caller your password, Social Security number, or one-time security code. Do not pay a fee to receive settlement benefits.
- Secure existing accounts. Use unique passwords and multifactor authentication where available, especially for email and financial accounts. A credit freeze does not prevent someone from taking over an existing account.
- Document and report suspected identity theft. Save dates, messages, account details, and records of losses. Contact affected lenders or creditors and report identity theft through IdentityTheft.gov.
A credit freeze addresses new-credit applications; it does not by itself prevent phishing, takeover of existing accounts, tax or benefits fraud, or misuse of accounts already open in your name. Monitoring can alert you to some activity, but an alert is not proof of fraud and no monitoring product replaces careful account security.
Settlement trade-offs
Settlement participation involved a release of covered claims arising from the incident. The settlement materials described opting out as the way to preserve the ability to pursue an individual case, but someone who opted out gave up settlement benefits. Doing nothing meant no settlement payment and, unless excluded, remaining bound by the settlement release. The applicable election deadlines have passed; this distinction is useful when understanding the settlement, not as a current opportunity to make an election.
For current case administration, use the official settlement site and its FAQ. Free credit freezes and report reviews are sensible first steps; a paid monitoring subscription is not required to respond to this breach and may duplicate monitoring provided through an approved settlement claim.
