Kaiser Permanente reported in April 2024 that online tracking technologies on its websites and apps may have sent information about users’ activity to third-party vendors. The reported breach involved approximately 13.4 million people, but public reporting does not establish that hackers broke into Kaiser’s medical-record systems or that complete medical records were taken. A later class-action settlement covers a narrower group of people; its official website says claims are being processed.
What happened in the Kaiser data breach?
Kaiser Foundation Health Plan reported the incident to the U.S. Department of Health and Human Services (HHS) on April 12, 2024. Public reporting followed on April 25. Kaiser said an investigation found that certain online technologies previously installed on its websites and mobile applications may have transmitted personal information to third-party vendors, including Google, Microsoft and X. The incident was reported as affecting approximately 13.4 million individuals. TechCrunch’s account of Kaiser’s report describes the disclosed data categories and the vendors named.
This was principally a privacy disclosure involving tracking technologies—not a publicly documented attack in which hackers broke into Kaiser’s core medical-record database. “Data breach” is still an appropriate description: HIPAA’s breach-notification rules can apply to impermissible disclosures of protected health information, not only to cyberattacks. HHS explains the notification framework in its Breach Notification Rule.
How tracking technology can send information
Websites and apps may use scripts, pixels, cookies or similar code to record events such as page visits, searches and interactions. In a simplified flow, a user opens a Kaiser page or app, a tracking tool records an event or identifier, and information is transmitted to an outside analytics or advertising vendor. The public reporting does not establish that each named vendor received every data category, or that data was necessarily sold.

HHS describes how these tools can collect information about users’ actions, devices and interactions in its guidance on online tracking technologies and HIPAA. That guidance also has an important legal limit: following a June 20, 2024 federal district-court ruling, HHS says the portion treating an IP address linked to a visit to an unauthenticated public webpage about a specific health condition or provider as PHI was vacated. The legal treatment of tracking therefore depends on the context and the information involved; the guidance is not a blanket rule that every healthcare-site tracker is unlawful.
What information was reportedly involved?
Categories Kaiser identified
According to the original reporting of Kaiser’s statement, information that may have been transmitted included members’ names, IP addresses, whether users were signed in, activity navigating Kaiser websites and apps, and search terms entered in Kaiser’s health encyclopedia. These categories can reveal something about a person’s relationship with a health plan or interests in health topics, but they are not the same as proof that a complete medical chart was disclosed.

What the lawsuit alleged
The later lawsuit alleged that tracking tools may have transmitted broader sensitive information, including patient status, medical histories and communications with healthcare professionals. Those are allegations in the case, not a finding that every listed category was disclosed to every vendor. The settlement resolves claims; the official settlement website says it does not necessarily constitute an admission of wrongdoing.
Why browsing activity can raise a health-privacy issue
An IP address or page-view event may seem like ordinary web data in isolation. When connected to an identifiable person’s use of a health plan or authenticated patient portal, however, the context may make the information health-related. HHS notes that tracking tools on authenticated services can potentially encounter information associated with diagnoses, treatment, prescriptions, billing or appointments. Whether a particular disclosure is protected health information and permitted under HIPAA depends on the facts and applicable law.

HHS also says that simply mentioning tracking in a privacy policy, notice or terms of use does not by itself authorize a disclosure of PHI under HIPAA. That general guidance does not decide Kaiser’s liability in this matter; the settlement is a resolution of disputed claims rather than a court finding on each allegation.
What the later Kaiser privacy settlement covers
The federal class action over alleged tracking disclosures reached a settlement for $46 million, with the possibility of increasing to $47.5 million. The class is not every Kaiser member nationwide. Under the official settlement information, it generally covers current or former Kaiser Foundation Health Plan enrollees who accessed authenticated pages of specified Kaiser websites or mobile apps between November 2017 and May 2024 while residing in California, Colorado, Georgia, Hawaii, Maryland, Oregon, Virginia, Washington or Washington, D.C. The settlement notice estimated payments of roughly $20 to $40 per eligible claimant. That is an estimate, not a guaranteed payment; actual payments depend on the settlement’s terms and claims process. As of August 18, 2026, the official site says claims are being processed. Use its claim-process information for current instructions and status rather than relying on an unsolicited message or third-party claim service.
How to check a notice and protect yourself from scams
- Go to the official settlement site directly. Type kaiserprivacysettlement.com into your browser instead of following a link in an unexpected email or text.
- Compare the notice with the class definition. The 2024 breach population and the settlement class are not interchangeable. A breach notice alone does not establish that you meet the settlement’s state, authenticated-use and date requirements.
- Keep breach and settlement notices separate. A Kaiser privacy-breach notice and a court settlement notice serve different purposes. Review the event and dates described in each document rather than assuming they refer to the same incident.
- Do not pay to file through the court-authorized administrator. Be wary of anyone demanding a fee or promising a guaranteed payment in exchange for personal details.
- Consider an HHS complaint if you believe your health privacy rights were violated. HHS provides an OCR complaint route for individuals who believe a covered entity violated HIPAA privacy rights.
The publicly described tracking incident does not establish exposure of passwords, Social Security numbers or payment-card information, so it does not by itself show that a full identity-theft response is needed. Follow any separate instructions in an individual notice if it identifies other data or risks.
