FTC Amazon Prime settlement explained: What the “hard-to-cancel” allegations mean now

The FTC alleged that Amazon used confusing enrollment designs to sign up consumers for automatically renewing Prime memberships and made cancellation unnecessarily difficult. The case ended on September 25, 2025, when a federal court entered a stipulated final order requiring Amazon to pay $1 billion in civil penalties and $1.5 billion in consumer redress—a combined $2.5 billion settlement.

Eligible consumers could receive up to $51, but not every Prime customer qualified. The July 27, 2026 claims deadline has passed. Automatic refunds were sent in November and December 2025, while the official settlement administrator says remaining payments should be made by September 2026. The FTC describes the timing more generally as late 2026.

What the FTC said Amazon did

The FTC’s case focused on two related practices: allegedly enrolling people in Prime without informed consent and allegedly making it difficult to cancel.

According to the FTC, Amazon steered consumers toward Prime through several enrollment routes, including:

  • the universal Prime decision page;
  • the shipping-selection page;
  • single-page checkout; and
  • Prime Video enrollment flows.

The agency alleged that these screens emphasized accepting Prime while making the non-Prime alternative less clear. It also alleged that important subscription terms—including automatic renewal and charges—were not presented in a sufficiently clear way.

The FTC described the alleged design choices as “dark patterns,” a term for interfaces that can steer people toward an option they might not otherwise choose. The original complaint also alleged that Amazon executives knew about problems with the enrollment process.

On cancellation, the FTC alleged that Amazon created a multi-step experience involving warnings, alternative offers and repeated confirmation screens. The complaint referred to Amazon’s internal name for the cancellation process—the “Iliad” flow—and claimed that the process was designed to discourage cancellation rather than simply complete it.

These were allegations made by the FTC in an enforcement action. The settlement resolved the case without a trial verdict establishing every allegation.

Amazon settled the case—there was no trial finding of guilt

The FTC alleged violations of the FTC Act and the Restore Online Shoppers’ Confidence Act. Amazon and the FTC later reached a settlement, which was embodied in a stipulated final order entered by the U.S. District Court for the Western District of Washington on September 25, 2025.

That distinction matters. Amazon was not found “guilty” after a criminal trial, and the settlement is not the same as a judgment proving every disputed allegation after contested litigation. It is, however, a court-entered order with the force of law.

The FTC’s case page still displays a “Pending” case-status label even though it records the September 25, 2025 stipulated order. For consumers, the practical issue is now settlement administration and payment—not whether the original lawsuit is still headed toward trial.

What the $2.5 billion settlement includes

Amount Purpose
$1 billion Civil penalty paid to the government
$1.5 billion Consumer redress for qualifying Prime customers
$2.5 billion Combined settlement value

The entire $2.5 billion is not a refund pool divided equally among all Prime customers. The $1.5 billion consumer-redress component funds payments to qualifying consumers, while the separate $1 billion civil penalty goes to the government.

The FTC said the redress component was expected to cover an estimated 35 million consumers. That estimate does not mean every Prime customer automatically qualified or that every eligible consumer would receive the same amount.

The order also requires Amazon to change aspects of its Prime enrollment and cancellation practices. The FTC says Amazon must:

  • provide a clear and conspicuous way to decline Prime;
  • avoid presenting language such as “No, I don’t want Free Shipping” as the non-enrollment choice;
  • clearly disclose the Prime price;
  • state when and how often charges will occur;
  • disclose that the subscription automatically renews;
  • explain how consumers can cancel;
  • offer an easy cancellation method;
  • make cancellation available through the same method used for signup; and
  • ensure cancellation is not difficult, costly or time-consuming.

The settlement also requires an independent third-party supervisor to monitor the consumer-redress process. These requirements do not, by themselves, verify that every current Prime screen works identically across every device, account type or signup route.

Who could qualify for an Amazon Prime refund?

The settlement was aimed at U.S.-based Amazon Prime customers who met specific conditions during the period from June 23, 2019, through June 23, 2025.

A consumer generally needed to fall into at least one of these categories:

  • They were unintentionally enrolled in Prime through one of the challenged enrollment flows; or
  • They tried to cancel through Amazon’s online cancellation process but could not complete the cancellation or inadvertently accepted a retention offer.

Amazon—not the consumer—was responsible for determining which enrollment flow was involved. Consumers did not have to identify whether they used the universal Prime decision page, shipping-selection page, single-page checkout or Prime Video flow.

Benefit use also mattered. The settlement treated consumers differently depending on how many Prime benefits they used after enrollment or after an unsuccessful cancellation attempt. Benefits could include delivery, shopping, streaming, music and reading services.

Automatic-refund criteria versus claims criteria

The automatic-refund group generally involved consumers who used no more than three Prime benefits in any 12-month period after enrollment.

The separate claims process covered qualifying consumers under different criteria, including a higher limit of no more than 10 Prime benefits in any 12-month period. That difference helps explain why some people were paid automatically while others received a notice inviting them to submit a claim.

Simply having Prime, disliking the service or believing that the membership cost too much was not enough by itself to establish eligibility. A person could have knowingly joined Prime and still potentially qualify based on an unsuccessful cancellation attempt, but ordinary dissatisfaction alone did not qualify someone for a settlement payment.

How much was the refund?

Eligible consumers could receive reimbursement for qualifying Prime membership fees, capped at up to $51 per person.

The payment was not necessarily a flat $51. Under the order:

  • for unintentional enrollment, the payment was tied to qualifying Prime fees paid during the applicable membership period; and
  • for an unsuccessful cancellation, the payment was tied to qualifying fees paid after the first unsuccessful cancellation attempt.

The order allows for payments below the cap based on the qualifying fees and settlement methodology. It also permits pro-rata reductions if available funds are insufficient. Therefore, “up to $51” is accurate; “everyone gets $51” is not.

What happened to the refund process?

  • November and December 2025: Automatic refunds were sent to qualifying consumers who met the applicable criteria without submitting a claim.
  • January 2026: Claim notices began going by email or mail to eligible consumers who did not receive automatic refunds.
  • July 27, 2026: The published deadline to submit a claim passed.
  • September 2026: The official settlement FAQ says payments should be made by this month. The FTC’s refund page uses the more cautious wording “late 2026.”

Payments could be made through methods including PayPal, Venmo or a check through the claims process. If you already filed a claim, monitor the email address or mailing address connected with the claim, check the payment method you selected and rely on updates at the official settlement website.

A person who did not submit a claim by July 27, 2026 generally should not assume that a new first-time claim can still be filed. Do not rely on older articles that describe the deadline as upcoming.

How to avoid Amazon Prime settlement scams

Refund programs attract phishing attempts. The FTC says it is not contacting consumers directly about individual Amazon refunds.

Use these safeguards:

  • Visit only SubscriptionMembershipSettlement.com for settlement information.
  • Do not pay a fee to “release” or accelerate a refund.
  • Do not give unsolicited callers or texters your bank-account details, payment-card number, password or other sensitive information.
  • Be suspicious of anyone who guarantees a payment, claims to represent the FTC or demands immediate action.
  • Report suspected fraud at ReportFraud.ftc.gov.

The FTC and legitimate settlement administrators do not require consumers to purchase gift cards, send cryptocurrency or pay an upfront charge to receive money.

Why the case matters for subscription services

The Amazon case illustrates why consumer-protection agencies examine the design of subscription interfaces—not just the fine print.

A lawful subscription flow should make the price, renewal frequency, charge date and cancellation terms clear before enrollment. Consumers should have a meaningful way to decline, and cancellation should not be materially harder than signing up. A company can offer a retention discount or ask whether a customer wants to reconsider; the concern arises when those offers and warnings turn cancellation into an obstructive process.

The settlement therefore addresses both sides of the subscription relationship: informed consent at signup and a usable exit afterward. It does not mean every customer who struggled with a subscription automatically qualifies for money, and it does not establish that every current Amazon interface violates the order.
