The European Commission is investigating Pornhub, Stripchat, XNXX and XVideos under the Digital Services Act (DSA), and on March 26, 2026, it announced preliminary findings that all four breached the law’s child-protection requirements. That is not yet a final infringement decision, however. The companies can inspect the Commission’s file and submit written responses before the proceedings conclude, and no fine has been established in the official material reviewed.
Which platforms are involved?
The four services named by the Commission are:
- Pornhub
- Stripchat
- XNXX
- XVideos
The case concerns suspected failures to protect minors from pornographic content, including whether the platforms used sufficiently effective age-assurance measures and properly assessed and mitigated risks created by their services.
The Commission opened formal proceedings on February 20, 2026. It later said that its preliminary view was that each platform had breached the DSA. “Preliminary” is important: the companies still have procedural rights, and the findings could change before a final decision.

What exactly is the EU investigating?
The investigation is broader than asking whether a user clicked an “I am over 18” button. The Commission is examining whether the platforms:
- Protected minors adequately from exposure to pornography.
- Used effective age-assurance or age-verification systems.
- Assessed the risks their services create for users, including children.
- Took proportionate steps to reduce those risks.
- Met the enhanced obligations that apply to very large online platforms.
The official material reviewed does not provide a complete public, platform-by-platform breakdown of the technology used by each service, the Commission’s detailed test results, or the number of minors allegedly able to access particular content. Those details should not be inferred from the existence of the proceedings.
Why is the European Commission handling the case?
The DSA—Regulation (EU) 2022/2065—sets platform obligations according to a service’s size, reach and risks. The largest services are classified as very large online platforms, or VLOPs, when they exceed the EU threshold of 45 million average monthly users.
VLOPs face additional duties, including systemic-risk assessments, risk mitigation, transparency and stronger user-protection measures. The European Commission directly supervises VLOPs, while national Digital Services Coordinators supervise many other online services.

Pornhub, Stripchat and XVideos were designated VLOPs on December 20, 2023. XNXX was designated on July 10, 2024, according to the Commission’s designation records. The designations explain why these services are subject to Commission-level scrutiny, rather than only ordinary national enforcement.

What does “preliminary finding” mean?
It means the Commission has reached a provisional view based on the evidence gathered so far. It does not mean that the companies have been finally found in breach or that a penalty has already been imposed.

The four platforms can:
- Inspect documents in the Commission’s investigation file.
- Submit written responses.
- Challenge the Commission’s interpretation of the facts or the DSA.
- Ask the Commission to amend or withdraw its provisional conclusions.
These stages should be kept separate:
- Request for information: Regulators ask a company to provide data or documents.
- Formal proceedings: The Commission opens an official DSA investigation into suspected non-compliance.
- Preliminary findings: The Commission states its provisional conclusions and gives the company a right to respond.
- Final infringement decision: The Commission adopts a final legal decision after considering the response.
- Penalty or binding remedy: If appropriate, the Commission may require corrective action or impose a fine.
Is the EU banning pornography?
No. This case is about platform compliance and protecting minors, not an EU-wide ban on legal adult content for adults.
Adults may still be able to access lawful adult services, but stronger age assurance could change how they do so. The case could also influence the design of access controls and the amount of information users must provide.
National laws may impose additional requirements. A country could pursue a separate action involving age checks, online pornography or access restrictions, while the Commission conducts its DSA proceeding. A national regulator’s action is not proof that the Commission has reached a final DSA finding, and a platform’s withdrawal from one country would not necessarily resolve the EU-level case.

The policy challenge is to prevent children from accessing pornography without forcing every adult to hand sensitive identity or sexual-interest data to an adult-content platform.

A simple age declaration is generally considered weak age assurance because it relies on self-attestation. Stronger approaches can be more effective, but each has trade-offs:

Age assurance is not automatically the same as identity verification. A system can, in principle, prove that someone is over a threshold without revealing their full name. But the privacy outcome depends on how the system is implemented, what data is collected, how long it is retained and whether activity can be linked across sites.
The Commission’s case does not establish that all four platforms must use government-ID uploads, nor does the official material reviewed identify one mandatory technical method for every service.

Even a stronger age check is not a complete child-safety strategy. Users may try to bypass controls through VPNs, foreign or mirror domains, unregulated sites, shared accounts, stolen credentials, sideloaded applications or direct file-sharing channels.

That makes the DSA’s broader risk-management duties important. Regulators are not examining only the presence of a button or a single verification step; they are also concerned with whether platforms understand the risks of their services and take effective measures to reduce them.
What happens next?
The immediate next step is the companies’ right-of-defence process. The platforms can review the evidence and respond to the preliminary findings. The Commission may then continue its exchanges with the companies and decide whether to:
- Close the matter without a final infringement decision.
- Adopt a final decision confirming some or all of the alleged breaches.
- Require corrective measures, such as changes to age-assurance or risk-mitigation systems.
- Impose a fine if the legal conditions are met.
The DSA allows fines of up to 6% of a company’s worldwide annual turnover for serious non-compliance. That is a statutory maximum, not a fine imposed in this case and not a prediction of the eventual outcome. The Commission’s general DSA overview and penalty framework is available here.
What this could mean for users
- More age checks: Users could encounter stronger controls if the platforms change their systems or regulators require corrective measures.
- Different experiences by country: EU member states may apply separate national rules in addition to the DSA.
- Privacy trade-offs: The effect on privacy will depend on whether a system uses identity documents, biometric analysis, a third-party token or another method.
- Potential access friction: Some adults may be unable or unwilling to use a particular verification method.
- No automatic EU-wide shutdown: The proceedings do not, by themselves, establish that these sites are being shut down across Europe.
What remains unknown
The official material reviewed does not yet establish:
- The exact age-assurance technology each platform used.
- Whether one platform was materially worse than another under the Commission’s analysis.
- The Commission’s detailed platform-by-platform test results.
- The number of minors allegedly able to access each service.
- The precise corrective action the Commission may ultimately require.
- Whether a final infringement decision or fine will follow.
- Detailed company-by-company responses to the preliminary findings.
Bottom line
The headline that EU regulators are investigating Pornhub and three other sites is broadly accurate but now incomplete. The four platforms are Pornhub, Stripchat, XNXX and XVideos; the Commission opened formal DSA proceedings in February 2026 and announced preliminary breach findings in March 2026. The case is not an EU-wide pornography ban, and the latest official status located does not show a final infringement decision, a confirmed penalty or a requirement that every user upload government identification.
