China’s Tech Workers Are Fighting Back Against Long Hours—but 996 Has Not Disappeared

China’s tech workers are challenging punishing schedules, but the resistance is fragmented: online campaigns, individual legal claims, public criticism and quiet refusals rather than a nationwide labor movement. The 2021 declaration that 996-style schedules violate labor protections raised the stakes for employers; it did not make excessive hours vanish. In 2026, the dispute increasingly concerns “invisible overtime”—work messages, remote meetings and assignments that continue after employees leave the office.

What 996 means—and what it misses

“996” describes working from 9 a.m. to 9 p.m., six days a week: a nominal 72 hours before commuting, meals or work at home. The term became closely associated with China’s internet, e-commerce, gaming and startup sectors. It is not a catch-all for every late night. Occasional compensated overtime, a temporary project crunch, a permanent six-day schedule and unpaid availability on a phone are different situations.

That distinction matters because the formal schedule is only the most visible version of the problem. Employees may face alternating “big week/small week” schedules, weekend availability, late-night group messages, or an expectation to stay until a manager leaves. A company can prohibit a written 996 timetable yet retain much of its workload through deadlines, staffing levels and informal performance expectations.

The 2026 debate over digitally mediated “invisible overtime” reflects this gap between clocking out and being free from work. China’s official court site reported on March 12, 2026, that lawmakers were calling for clearer recognition of work conducted through digital communication tools and stronger protection for rest time (Chinese judiciary, March 2026).

Why long hours became a tech-sector norm

Rapid product cycles and competition among internet companies created incentives to launch quickly and work intensely. In a crowded market for prestigious technology jobs, employees could feel that refusing extra hours would hurt their evaluations, promotion prospects or standing with a team. Some workers also saw a bargain: long hours in exchange for higher pay, faster advancement or the possibility of sharing in a company’s growth.

That bargain was never universal, and its appeal can weaken when salary growth slows or job security becomes less certain. Economic pressure cuts both ways: workers may be less willing to sacrifice personal time for employers that offer less in return, but layoffs and competition for jobs can also make it harder to say no.

Public defenses of 996 helped make the schedule a symbol of workplace culture. In 2019, Alibaba co-founder Jack Ma argued in favor of the practice, prompting criticism. That episode illustrates how some business leaders framed extreme work as commitment; it should not be taken as a view shared by every Chinese employer or worker (Associated Press).

From the 2019 online campaign to a legal turning point

In 2019, tech workers and supporters made resistance visible through the anti-996 campaign. The 996.ICU effort used GitHub to circulate discussion and information about employers’ working conditions, and an anti-996 software license sought to connect labor concerns to open-source distribution. The campaign drew attention well beyond China’s technology industry (U.S. Congress committee print; Freedom House).

Its methods were public exposure and networked pressure, not a conventional strike or a durable, nationwide union organization. Workers could share complaints and make an employer’s reputation a liability, but viral visibility could not by itself guarantee changes in schedules or protect a person who challenged a manager directly.

A major legal shift came on August 27, 2021, when China’s Supreme People’s Court and Ministry of Human Resources and Social Security made clear that employers could not use internal rules, contracts or claims of employee consent to evade statutory working-hour protections. The guidance treated 996-style arrangements as unlawful. It changed the legal and reputational risks of imposing such a schedule, but did not automatically produce consistent enforcement in every workplace (Congressional-Executive Commission on China, 2025 annual report).

In May 2025, seven official bodies issued coordinated guidance on protecting workers’ legitimate rights and interests, emphasizing cooperation across institutions including labor authorities, courts, prosecutors, justice bodies, unions and business organizations (Supreme People’s Procuratorate). Such measures indicate official concern and a wider enforcement framework; they are not proof that every employee can readily challenge overtime or that all employers comply.

How workers push back

Online exposure and public pressure

Workers use social platforms and online communities to describe demanding conditions, name employers and criticize executives who glorify overwork. A viral complaint can prompt a company response, apology or personnel change. In May 2024, a Baidu public-relations executive reportedly left her role after backlash over comments seen as defending punishing workloads and criticizing employees who resisted demanding assignments (Associated Press).

But public criticism is episodic. Research summarized by Cornell in 2025 found that social media can amplify worker voice while having limited capacity to produce lasting workplace improvements without institutions able to sustain pressure (Cornell ILR).

Individual legal claims

Depending on the circumstances, a worker may seek overtime pay, compensation for rest-day or holiday work, or remedies in a dispute involving dismissal, a contract or recorded hours. The practical challenge is often proving what happened. An employer may issue instructions verbally, characterize extra work as voluntary, or rely on informal messaging rather than a timekeeping system that records the work clearly.

Workers considering a dispute may find it useful to preserve start and end times, meeting invitations, messages assigning work after hours, weekend and holiday requests, payroll and attendance records, and evidence of consequences for refusing extra work. These materials may help establish the facts, but this is not legal advice: available remedies depend on location, employment status, contract and current local rules.

Refusal, job mobility and quieter choices

Some resistance is individual and low-visibility: leaving at the scheduled time, declining unofficial weekend work, not answering a non-emergency message late at night, avoiding employers known for extreme hours, or changing jobs for a more predictable schedule. Others may negotiate for written overtime policies or accept a less prestigious role, slower advancement or lower pay in return for more personal time.

These are meaningful choices, but they are not automatically activism or collective bargaining. Workers’ options also differ sharply by role and status. A software engineer, product manager, outsourced content moderator, customer-support employee, game developer, contractor and platform worker may face different pay, bargaining power and legal circumstances. Delivery and other platform workers belong in the broader technology-and-labor discussion, but their experience should not be conflated with that of salaried office employees.

Why the resistance remains constrained

Challenging overtime can carry personal costs: a stalled promotion, poor performance review or dismissal. Job-market volatility makes those risks harder to take. Even when a worker has a legal entitlement, a slow or uncertain dispute may be difficult to pursue, especially if the evidence is incomplete and the employee fears retaliation.

Collective action faces additional limits. China’s labor-relations system channels many disputes toward official unions, mediation, arbitration and courts rather than independent collective bargaining. Research on the system describes a combination of individual legal protections and institutional control over labor activism (Journal of Industrial Relations). The evidence supports a visible online campaign and individual or localized efforts more strongly than a nationwide, union-led anti-996 movement.

There is also a difference between extra work a person freely accepts and work labeled “voluntary” when refusal carries career penalties. The facts of a particular workplace matter. Not every late finish is a permanent 996 system, and not every extra hour is unpaid or coerced—but routine availability without clear boundaries can make those distinctions difficult to enforce.

Are companies actually shortening the workday?

There are signs of change: explicit 996 schedules face greater legal and reputational pressure; executives can draw public criticism for celebrating overwork; and some companies have announced earlier departure policies. In March 2025, Channel NewsAsia reported that firms were encouraging workers to leave earlier. It cited Midea’s reported requirement that employees clock out by 6:20 p.m., alongside restrictions on unnecessary overtime and after-hours meetings (Channel NewsAsia).

That is evidence of a changing climate, not proof that hours have fallen across the technology sector. To judge whether a policy changes workers’ lives, the relevant questions are operational: did the workload shrink, was staffing increased, were after-hours messages reduced, was overtime compensated, and can employees leave without a career penalty? A clock-out rule that shifts assignments to home or raises the same targets may change the appearance of work more than its total burden.

There is no single comprehensive, transparent current count in the supplied evidence showing how many Chinese tech workers still experience 996. Official and external reporting has continued to describe excessive overtime, while digital work is particularly difficult to capture in conventional time records. It would be inaccurate to say either that 996 is over or that it remains universal.

The measure of progress

The anti-996 backlash has made extreme schedules harder to defend openly and has given workers more tools and language to challenge them. The 2021 legal guidance, later official attention to labor rights and the 2026 focus on invisible overtime all matter. Yet rules, corporate announcements and social-media attention are not substitutes for enforceable protections and the ability to use them without retaliation.

The next test is whether the definition of working time catches up with work done through phones and online platforms—and whether companies change workloads and expectations, not just their posted office hours. For now, Chinese tech workers are fighting back, but largely through individual, online and low-visibility actions. Their pushback has changed the climate around 996 more clearly than it has ended the underlying pressure to work long hours.
