California’s Senate Bill 53, the Transparency in Frontier Artificial Intelligence Act, is no longer merely moving toward enactment. Governor Gavin Newsom signed it on September 29, 2025; it became Chapter 138 of the Statutes of 2025 and took effect on January 1, 2026. Several recurring reporting obligations begin in 2027. California’s official bill record confirms its enacted status.
SB 53 is not a law regulating every AI product. It creates a transparency, incident-reporting, governance, and whistleblower regime for a defined class of developers building highly compute-intensive frontier foundation models.
What SB 53 does
The law requires covered developers to publish safety frameworks and model-related transparency reports, document how they assess catastrophic risks, report certain serious incidents to California officials, and protect employees who disclose covered safety concerns.
It is primarily an accountability law. It does not create a universal safety certification, require California to approve every model before release, ban dangerous AI capabilities outright, or require companies to publish model weights and proprietary code.

Who is covered?
SB 53 defines a frontier model as a foundation model trained using more than 1026 integer or floating-point operations. The calculation also includes later fine-tuning, reinforcement learning, or other material modifications.
A large frontier developer is a frontier developer whose affiliates collectively had more than $500 million in annual gross revenue during the preceding calendar year.
Those definitions mean the law is aimed at the largest developers of the most compute-intensive general-purpose models—not ordinary companies using AI software and not necessarily every prominent AI startup. The thresholds are statutory proxies, however. They do not perfectly measure a model’s capabilities or potential harms. More efficient or specialized systems could present significant risks without fitting neatly within them.
What developers must publish
Frontier AI frameworks
Large frontier developers must create, implement, follow, and prominently publish a frontier AI framework. The framework must explain, among other things, how the company:
- uses applicable national, international, and industry standards;
- identifies capability thresholds associated with catastrophic risk;
- selects mitigations after risk assessments;
- reviews risks and mitigations before deployment or extensive internal use;
- uses third-party assessments;
- protects unreleased model weights;
- identifies and responds to critical safety incidents;
- governs safety decisions internally; and
- addresses risks from internal use, including attempts to evade oversight.
Frameworks must be reviewed and, where appropriate, updated at least annually. Material modifications generally must be published with a justification within 30 days.
Transparency reports
Before or at the same time as deploying a new frontier model—or a substantially modified existing model—a developer must publish a transparency report containing information such as:

- the developer’s website and a contact method for a natural person;
- the release date;
- supported languages;
- output modalities;
- intended uses; and
- generally applicable use restrictions.
For large frontier developers, the report must also summarize catastrophic-risk assessments, their results, the role of third-party evaluators, and other steps taken under the company’s framework. A model card or system card can contain the required information.
Companies may redact information to protect trade secrets, cybersecurity, public safety, national security, or compliance with other laws. Where permitted, they must describe the nature and justification of redactions. As a result, the public may see the structure and conclusions of a safety process without seeing every underlying test, vulnerability, or proprietary detail.
Incident reporting deadlines
Large frontier developers must send the California Office of Emergency Services a summary of catastrophic-risk assessments arising from internal use of their frontier models every three months, unless they establish and communicate another reasonable schedule.
A developer must report a critical safety incident to the Office of Emergency Services within 15 days of discovering it. If an incident creates an imminent risk of death or serious physical injury, disclosure to an appropriate law-enforcement or public-safety authority is required within 24 hours.

What counts as a catastrophic risk?
SB 53 defines catastrophic risk as a foreseeable and material risk that a frontier model could materially contribute to either:
- the death of, or serious injury to, more than 50 people; or
- more than $1 billion in property damage or loss.
The risk must arise from a single incident involving conduct such as expert-level assistance in creating or releasing a chemical, biological, radiological, or nuclear weapon; certain serious cyberattacks or criminal conduct carried out without meaningful human oversight; or evasion of the developer’s or user’s control.

The statute includes exclusions and qualifications. For example, some information substantially available from non-foundation-model sources, lawful federal-government activity, and harm to which the model did not materially contribute may fall outside the definition.

What is a critical safety incident?
The law covers incidents including:
- unauthorized access to, modification of, or exfiltration of model weights that results in death or bodily injury;
- harm resulting from a catastrophic risk becoming real;
- loss of control of a frontier model causing death or bodily injury; and
- deceptive techniques used outside an evaluation to subvert controls or monitoring when the conduct demonstrates materially increased catastrophic risk.
These are high statutory thresholds. A model’s ordinary error, a contentious output, or a financial loss will not automatically qualify as a critical safety incident.
Employee and whistleblower protections
SB 53 prohibits covered frontier developers from preventing or retaliating against employees who disclose information about covered catastrophic risks or violations to authorized recipients. Those recipients include the California Attorney General, a federal authority, a supervisor or other person with authority over the employee, or an employee authorized to investigate or correct the issue.
The law preserves other whistleblower rights and remedies under California law. Its separate labor-code provisions are listed in the California Labor Code.
Enforcement and confidentiality
The California Attorney General may enforce SB 53 through civil penalties. The Attorney General and the Office of Emergency Services may transmit certain reports to the Legislature, Governor, federal government, or appropriate state agencies, while considering trade secrets, cybersecurity, public safety, and national-security concerns.

SB 53 emerged after the Governor’s Joint California Policy Working Group on AI Frontier Models issued recommendations in June 2025. Legislative materials describe the enacted law as narrower and more focused on transparency than SB 1047. The Assembly policy analysis records both the bill’s rationale and objections.
Why the law was controversial
Supporters’ argument
Supporters say frontier developers know more about their systems’ capabilities and risks than governments or the public can independently discover. They argue that published frameworks, deployment disclosures, incident reporting, and whistleblower protections can create accountability while avoiding the more prescriptive structure of SB 1047.
Governor Newsom described the measure as a balance between innovation and public safety and called it first-in-the-nation frontier-AI safety legislation. That characterization should be understood as the Governor’s description, not as an independently verified global ranking. His signing announcement is available on the Governor’s website.
Opponents’ argument
Opponents argued that terms such as “catastrophic risk,” “foreseeable,” and “evasion of control” could be difficult to interpret consistently. They also warned that:
- compute is an imperfect proxy for danger;
- documentation, testing, reporting, governance, and cybersecurity requirements could be costly;
- public disclosures could expose trade secrets or security weaknesses; and
- legal uncertainty could discourage development or move work outside California.
Those claims are policy predictions and opposition arguments, not established outcomes. The law’s actual effect will depend on regulatory interpretation, enforcement, company disclosures, and how the thresholds perform as AI systems become more efficient.
What companies should assess
A developer evaluating potential coverage should begin with practical questions:
- Does it train a foundation model, or only deploy or fine-tune another company’s system?
- Does the relevant training or modification exceed the statutory compute threshold?
- Did the developer and its affiliates exceed $500 million in preceding-year gross revenue?
- Is a planned modification substantial enough to require a new transparency report?
- Is the system being deployed to third parties or used extensively internally?
- Does a suspected event meet the statute’s definition of catastrophic risk or critical safety incident?
- Can information be redacted because disclosure would create trade-secret, cybersecurity, public-safety, national-security, or legal problems?
These are classification and compliance questions, not simply questions of whether a company markets itself as an “AI company.” Companies may also need to coordinate legal, safety, security, public-policy, human-resources, and incident-response teams.
What happens next
Beginning in 2027, the Office of Emergency Services must issue annual public reports containing anonymized and aggregated information about reviewed critical safety incidents. The Attorney General must likewise report anonymized and aggregated information about covered-employee reports reviewed by the office.
Those reports will be an important test of the law. They may show whether SB 53 produces useful public accountability or mainly creates confidential internal processes and paperwork. Key unresolved questions include how regulators interpret ambiguous terms, whether companies publish substantive or boilerplate frameworks, how comparable reports will be, and whether the compute and revenue thresholds remain appropriate.
