Apple did not receive a final ruling clearing it of the iCloud allegations. In February 2025, Apple won dismissal of the first version of a proposed antitrust case. But after the plaintiffs amended their complaint, the court allowed the core claims to proceed in June 2025. The latest located U.S. docket development, dated July 14, 2026, concerned a lead plaintiff’s conditional withdrawal—not a final judgment, settlement, or consumer payout.
What is the iCloud lawsuit about?
The case is Gamboa v. Apple Inc., No. 5:24-cv-01270, in the U.S. District Court for the Northern District of California. The plaintiffs allege that Apple restricts third-party cloud-storage providers from accessing certain iPhone and iPad data needed to offer a full-device backup comparable to iCloud.
The complaint argues that this limits competition and allows Apple to charge what it describes as supracompetitive iCloud prices. Those claims—including alleged overcharges, margins, and market share—are allegations by the plaintiffs, not findings that Apple illegally overcharged customers.
Storage is not the same as device backup
The dispute is more specific than whether users can store files outside Apple’s ecosystem.

Users can generally install services such as Google Drive, OneDrive, Dropbox, or other providers for file storage and photo uploads. The plaintiffs’ theory is that these services may not receive enough access to provide an equivalent, automatic full-device backup and restoration experience.
Why headlines said Apple won
On February 28, 2025, Judge Eumi K. Lee partially granted Apple’s motion to dismiss the first amended complaint. The court found that the plaintiffs had not plausibly pleaded an unlawful tying arrangement.
Among other points, the court noted that customers were not contractually required to buy iCloud when purchasing an iPhone or iPad and could use other cloud-storage services. The dismissal was with leave to amend, meaning the plaintiffs were permitted to revise their claims. It was not a final decision that Apple’s conduct complied with antitrust law.

How the case survived
The plaintiffs filed a second amended complaint on March 21, 2025. On June 16, 2025, the court denied Apple’s motion to dismiss that revised complaint. The court concluded that the allegations plausibly supported claims involving:
- a relevant market for cloud storage available on Apple mobile devices;
- Apple’s alleged monopoly power, or a dangerous probability of obtaining it;
- restrictions that allegedly weakened rivals’ ability to provide full-service storage; and
- a connection between the alleged conduct and consumer injury.
That ruling allowed the case to continue into litigation and discovery. It did not establish that Apple violated antitrust law, that iCloud has an illegally high price, or that customers are entitled to damages.
What does the alleged 88% market share mean?
The second amended complaint alleges that iCloud accounts for more than 88% of cloud storage available on Apple’s mobile devices, measured by users. That is a pleading allegation—not a court-certified market-share finding.

The parties disagree about how the relevant market should be defined. Apple’s position is that broader cloud-storage alternatives should be included, while the plaintiffs focus on services capable of providing full functionality on Apple devices. The distinction can materially change any market-share calculation.

What happened in July 2026?
In an order dated July 14, 2026, the court allowed lead plaintiff Julianna Gamboa to withdraw as a class representative, subject to conditions involving specified discovery requests. The order said the parties had conducted more than a year of fact discovery and required them to file dismissal papers or a status report after the discovery responses.
That order did not dismiss the entire case or decide the antitrust claims. It addressed one plaintiff’s withdrawal. The public docket material used for this explanation was current through July 14, 2026; later filings should be checked through the court docket or PACER.

There is also a separate U.K. case
The U.K. matter brought by consumer group Which? is separate from the U.S. federal case. The Competition Appeal Tribunal materials describe allegations that Apple favored iCloud through technical restrictions, choice architecture, and conduct that allegedly disadvantaged actual or potential rivals.
A Reuters report described the U.K. action as a proposed multibillion-pound claim involving nearly 40 million U.K. iCloud users. That figure and the proposed claim size are allegations or reported case details—not an awarded amount. The U.K. proceedings should not be described as an Apple victory or combined with the U.S. case.

Will iCloud prices fall?
Not because of the rulings discussed here. No immediate price reduction follows from a motion-to-dismiss decision or from the U.K. proceedings.

Possible eventual outcomes could include damages if liability and class claims were established, an order requiring technical or user-choice changes, a settlement, or no relief if Apple ultimately prevails. The available rulings do not require Apple to lower iCloud prices.
Is there a payout or claim form?
No verified settlement, refund program, or automatic compensation should be inferred from these rulings. A class-action advertisement is not proof that a settlement exists, and a surviving lawsuit does not mean customers can currently file for money.
What should iCloud customers do?
Do not cancel iCloud solely because of a headline saying Apple won or lost. First identify what you need:

A general-purpose cloud-storage subscription may not replicate system backup.
- Photos and files: Google One, OneDrive, Dropbox, Sync.com, and pCloud may be useful, depending on features, privacy terms, and platform needs.
- Computer and external-drive backup: IDrive or a local Mac or PC backup may provide broader coverage, but setup and maintenance are your responsibility.
- More control and capacity: A NAS can reduce reliance on a cloud provider, but it adds hardware, remote-access, security, and off-site-backup responsibilities.
Compare more than storage capacity. Check automatic backup scope, restoration support, family sharing, encryption, retention, device limits, cross-platform access, and current terms in your country. Using multiple services can also create duplicate files, fragmented searches, and separate privacy policies.
