Google agreed in December 2023 to settle a class action over Chrome’s Incognito mode, but the deal did not create a $5 billion fund for users. The detailed agreement, filed in April 2024, focused on privacy disclosures, remediation of certain historical data, and technical changes—not direct payments. Google continued to dispute the plaintiffs’ claims.
What the lawsuit was about
The case, Brown v. Google LLC, was filed in June 2020 in the U.S. District Court for the Northern District of California. The plaintiffs alleged that Google collected and used information about people’s browsing even when they used Chrome Incognito or comparable private-browsing modes in other browsers. They pointed to Google Analytics, cookies, applications, and related services, and argued that Google’s disclosures gave users a misleading impression about what Incognito prevented.
Those were allegations, not a court finding that Google was liable. Google denied the plaintiffs’ characterization of the case. It said the data covered by the settlement was old technical data, was not associated with individuals, and was not used for personalization.

The parties reached a preliminary settlement in December 2023, avoiding a trial scheduled for February 5, 2024. The detailed agreement was filed on April 1, 2024. Reuters reported the preliminary agreement; the settlement agreement sets out the proposed terms.

What Google agreed to change
The agreement centered on non-cash relief. Its main provisions addressed disclosures, historical data, and Incognito’s technical behavior:
- Clearer disclosures: Google agreed to revise privacy-related disclosures to explain that websites using Google services may collect data regardless of the browser or browsing mode, and that Incognito does not block such collection, including by Google. The agreement also called for deprecating the Chrome Privacy Notice and Chrome White Paper identified in the settlement.
- Historical-data remediation: Google agreed to substantially remediate covered private-browsing records, including deletion or other treatment under the agreement’s conditions. The deadline was the later of final court approval or 275 days after Google completed specified disclosure changes. This is not the same as evidence that every relevant record was erased immediately. Plaintiffs’ lawyers described the data at issue as potentially involving hundreds of billions of records; that figure was their filing’s characterization, not an independently audited total.
- Incognito-detection bits: Google agreed to remove four identified technical bits used to infer that someone was browsing privately, and represented that it had made a good-faith effort to determine that no other such bits existed.
- Third-party cookies: The agreement required Google to maintain default blocking of third-party cookies in Incognito for five years. Plaintiffs said Google had already rolled out this change and described the lawsuit as a substantial catalyst for it.
The provisions apply according to the agreement’s definitions and conditions; they should not be read as a guarantee that all forms of online tracking stopped. See the plaintiffs’ motion for final approval for their account of the relief.

What the “$5 billion” figure means
The figure in many headlines does not describe money Google agreed to distribute to Chrome users. Three different amounts or concepts are easy to conflate:

In short, Google did not agree to pay users $5 billion. The estimated value of changes is not interchangeable with a cash award. The Associated Press summarized the non-cash terms and lack of consumer payments.

Will Chrome users get a check or need to file a claim?
No. The reported agreement did not provide an automatic payment or a claims process for users to collect damages from a settlement fund. The case involved a class certified for injunctive relief, while the court had declined to certify a damages class. Its settlement was directed at changes to disclosures and data practices, not a nationwide damages payout.
That does not answer whether a particular person could bring a separate claim. Any individual case may depend on the claim, jurisdiction, limitation periods, arbitration provisions, and whether the claim is covered by a release. Do not assume that being a Chrome or Incognito user automatically makes you eligible to sue or receive money. The 2026 Ninth Circuit opinion stated that the named plaintiffs could pursue individual monetary claims in arbitration and that absent class members’ damages claims were not released by the settlement described there.

What Incognito mode does—and does not—protect
Incognito is primarily a local privacy feature, not an anonymity service. It generally limits what Chrome keeps on the device after a private session, such as browsing history, cookies, and form information. It can be useful when you do not want activity retained in the browser’s ordinary history on a shared device.

Google services may receive data when you visit sites or use products that include Google technology. Protection varies with the browser, device, account use, site, and network. The lawsuit focused on whether Google had adequately explained these limits—not on a claim that Incognito was meant to make users anonymous.

Case timeline and latest legal development
- June 2020: Five plaintiffs filed the putative class action.
- December 2022: The district court certified an injunctive-relief class but declined to certify a damages class.
- March 2023: The Ninth Circuit declined interlocutory review of the damages-class certification issue.
- August 2023: The district court rejected Google’s effort to obtain summary judgment, according to the settlement-approval filing and contemporary coverage.
- December 2023: The parties reached a preliminary settlement, avoiding the trial set for February 5, 2024.
- April 1, 2024: The detailed settlement agreement and motion for final approval were filed.
- July 2024: A final-approval hearing was scheduled for July 30. Other plaintiffs sought to intervene on July 2.
- April 20, 2026: The Ninth Circuit affirmed the denial of that intervention attempt. The ruling addressed the late effort to intervene and related appellate rights; it was not a new merits finding that Google unlawfully tracked Incognito users or a new settlement.
The appellate court’s opinion is available as a Ninth Circuit decision. The supplied case materials establish the proposed settlement and this later intervention ruling; they do not establish the district court’s final-approval order or the settlement’s effective date. The agreement’s data-remediation deadline depends in part on those events, so the terms should not be described as proof that all remediation has been completed.
What the settlement means for users
The practical lesson is narrower than either “Incognito does nothing” or “Google paid users billions.” Incognito can reduce traces left in Chrome on a device, but it does not prevent all collection by websites, networks, or online services. The settlement sought clearer explanations and specified changes to Google’s practices; it did not make private browsing universally anonymous or settle every possible privacy claim.
