According to internal SpaceX documents reviewed by The New York Times, the rocket company most likely paid little to no U.S. federal corporate income tax for years. The documents reportedly showed more than $5 billion in accumulated tax losses by late 2021, along with tax credits and state-tax carryforwards that could reduce future liabilities.
That does not mean SpaceX paid no taxes at all, is tax-exempt, or broke the law. The evidence primarily concerns federal corporate income tax—not payroll taxes, property taxes, sales taxes, customs duties, or taxes paid by employees and suppliers.
What the reporting actually establishes
SpaceX is a privately held company, so it does not routinely publish the detailed annual financial and tax disclosures required of public companies. The central claims come from internal documents reviewed by The New York Times and reported in August 2025.

Those documents reportedly indicated that SpaceX:
- Had accumulated more than $5 billion in losses by late 2021.
- Held approximately $227 million in state-tax carryforwards.
- Had roughly $1.1 billion in federal and state tax credits.
- Told investors that it might never need to pay federal income tax because accumulated losses could offset future taxable income.
The loss, carryforward and credit figures were reported from company documents; they are not figures that can currently be independently reconciled against a publicly filed SpaceX tax return. The original reporting is summarized by The New York Times, with additional detail reported by Futurism.

How can a company with billions in revenue owe little income tax?
Revenue is not the same as taxable profit. A company can generate substantial sales while reporting little or no taxable income after deducting allowable business costs.
For a capital-intensive aerospace company, potential deductions and timing differences may include:
- Research and development spending
- Startup and development costs
- Capital investment and depreciation
- Interest expense
- Stock-based compensation and other book-tax differences
- Losses accumulated during years of heavy investment
The relevant calculation is broadly:
Revenue − allowable deductions and adjustments = taxable income.
If the result is negative, the company may have a net operating loss, commonly called an NOL. An NOL is not cash and does not mean the government handed the company the amount of the loss. It is a tax attribute that may reduce taxable income in later years.

How SpaceX could use tax losses in later years
Suppose a hypothetical company has $500 million in eligible federal NOLs and later generates $100 million in taxable income. The NOLs may reduce the income subject to tax, although the exact amount depends on when the losses arose and the rules that apply to them.
The Tax Cuts and Jobs Act, enacted in December 2017, generally removed the former 20-year expiration period for qualifying federal NOLs generated in taxable years beginning after December 31, 2017. However, it generally limited the amount of taxable income those post-2017 NOLs could offset in a single year to 80%. The statutory changes appear in Section 3302 of H.R. 1.
Indefinite carryforward therefore does not mean unlimited annual use. Other restrictions may also apply, including Section 382 limitations after certain ownership changes. State rules can differ substantially from federal rules, and tax credits have their own eligibility, expiration and utilization limits.

The reported statement that it was “more likely than not” that some or all deferred-tax assets would not be realized is an accounting judgment—not an admission of wrongdoing. It can mean the company was uncertain whether future taxable income would be large enough to use all its accumulated tax benefits.

How much of SpaceX’s business came from the federal government?
The reported internal figures showed federal contracts represented:
- $1.4 billion, or 83.8% of revenue, in 2020
- $1.7 billion, or 76% of revenue, in 2021
These are historical figures attributed to the documents and should not be treated as SpaceX’s current revenue mix. They also describe revenue, not profit.
A federal contract generally pays for goods or services such as launches, communications or national-security capabilities. It is not automatically a subsidy or a cash gift. Some public-sector arrangements can nevertheless involve development support, milestone payments, cost reimbursement or unusual risk allocation.

Public support can take several forms:

Calling all federal contracts “welfare” is a political characterization rather than a neutral description. The more precise accountability questions are whether the contracts were competitively awarded, whether the government received fair value, how much risk taxpayers assumed and whether public funding supported activities beyond ordinary procurement.

Does “basically no taxes” mean SpaceX paid no taxes?
No. The available reporting does not establish SpaceX’s total tax burden.
The company may still owe or remit:
- Payroll and employment taxes
- Property taxes
- Sales and use taxes
- Fuel taxes
- Customs and import duties
- Local taxes and fees
- Taxes withheld from employees
Taxes may also be paid by SpaceX subsidiaries, contractors, vendors and employees. Corporate tax attributes generally belong to the company and do not automatically reduce Elon Musk’s personal income-tax bill.
The defensible version of the headline is therefore little or no federal corporate income tax, not “no taxes of any kind.”
Is the reported tax treatment legal?
Based on the available reporting, the mechanism described appears to be a normal feature of the tax code. Using permitted deductions, credits and NOL carryforwards is generally tax avoidance or tax deferral, not tax evasion.

- Tax avoidance: Reducing tax through provisions allowed by law.
- Tax evasion: Concealing income or intentionally submitting false information.
- Tax deferral: Postponing tax to a later period.
- Loss utilization: Applying eligible prior losses against later taxable income.
Nothing in the supplied reporting establishes an IRS finding, criminal investigation or prosecutorial allegation that SpaceX illegally misstated its taxes. A company can use an aggressive or controversial tax strategy without that strategy being unlawful.
Why the government-contract connection matters
Legally, a company does not ordinarily owe extra income tax simply because the federal government is one of its customers. Tax is generally based on taxable income, not on the identity of the customer.
The connection is important for public-policy reasons. Critics may argue that a company substantially supported by taxpayers should not be able to shield future profits indefinitely while benefiting from public spending. Defenders may respond that NOL rules prevent the government from taxing revenue before a capital-intensive company has recovered years of genuine investment and losses.
The issue also raises transparency questions. Because SpaceX is private, the public cannot routinely examine its annual NOL balance, cash taxes paid, tax expense, revenue by customer or the effect of ownership changes on its tax attributes.
What remains unknown
The available evidence does not establish:
- The exact federal income tax SpaceX paid in each year
- Its total federal, state and local tax payments
- Its current NOL or credit balances
- Whether every reported tax attribute remains usable
- Whether Section 382 or other limitations apply
- SpaceX’s current taxable profitability
- Whether the company has faced an IRS audit finding related to these matters
- Whether the company ultimately used, lost or exceeded the reported tax benefits
The figures through late 2021 should not be presented as current 2026 tax data. As of the available reporting, no authoritative public SpaceX filing provides a complete update.
The bottom line
The evidence supports a narrower but still significant conclusion: internal documents reviewed by The New York Times reportedly showed that SpaceX had accumulated more than $5 billion in losses and substantial tax credits, potentially allowing it to defer or eliminate federal corporate income-tax payments for a prolonged period despite receiving billions in federal contract revenue.
It does not prove that SpaceX paid no taxes whatsoever, that it is tax-exempt, that it permanently escaped taxation or that it violated tax law. The most accurate description is a private, government-dependent company that appears to have accumulated enough legally usable tax attributes to greatly reduce—or potentially eliminate—its federal corporate income-tax liability for years.
