Yes—Amazon sued the U.S. Consumer Product Safety Commission (CPSC) on March 14, 2025. The case challenges a CPSC order requiring Amazon to notify customers and provide remedies for more than 400,000 hazardous products sold by independent merchants and handled through its Fulfilled by Amazon service. The dispute is about whether Amazon is legally a product “distributor” responsible for recall-related action—not whether Amazon made the products.
What Amazon’s lawsuit challenges
Amazon filed Amazon.com, Inc. v. Consumer Product Safety Commission et al., Case No. 8:25-cv-00853-LKG, in the U.S. District Court for the District of Maryland. It seeks judicial review of the CPSC’s January 16, 2025 decision and order approving a notification and action plan. The complaint asks the court for declaratory and injunctive relief, arguing that the agency exceeded its authority by treating Amazon as a distributor of products supplied by third-party sellers.
This was not the beginning of the dispute. The CPSC started an administrative enforcement proceeding in 2021. The Commission later determined that Amazon was responsible under federal product-safety law for specified products sold by third-party merchants through Amazon.com and issued a final remediation order in January 2025. Amazon then brought the separate federal lawsuit to challenge that order. The public federal docket identifies the case and filing date; the CPSC’s 2024 decision announcement describes the earlier agency action.

The CPSC proceeding concerned three product categories sold by third-party merchants:

- Carbon-monoxide detectors that allegedly failed to detect carbon monoxide.
- Hair dryers that lacked required protection against electrocution.
- Children’s sleepwear that allegedly did not meet federal flammability requirements.
The agency described the affected volume as more than 400,000 products. That figure refers to products, not necessarily 400,000 customers or households. The products were not necessarily Amazon-branded, and the proceeding does not mean that every third-party item sold on Amazon is covered. The CPSC’s final order contains the agency’s product and remediation details.
Why the CPSC says Amazon has recall responsibilities
Under Fulfilled by Amazon (FBA), a third-party seller can use Amazon’s infrastructure for storage, order processing, shipping, customer service and related logistics. The CPSC’s position is that Amazon’s marketplace and fulfillment activities went beyond merely transporting packages and made the company a statutory distributor under the Consumer Product Safety Act. On that view, the agency could require Amazon to help notify customers and remedy hazardous products even though independent merchants supplied them.

Amazon disputes that interpretation. It argues that it acted as a logistics provider, not the manufacturer or seller of record, and should not be treated as a distributor responsible for recall remedies for goods it did not make or sell. The central legal question is where the law draws the line between marketplace or fulfillment services and distribution. Neither side’s position should be treated as a settled rule while the challenge is being litigated. What the CPSC order required
The Commission’s final order, announced January 17, 2025 and effective January 26, called for Amazon to do more than remove product listings. It required Amazon to:

- Post the CPSC recall information on Amazon.com.
- Directly notify original purchasers.
- Show recall information through customers’ “Your Orders” pages.
- Offer refunds or other incentives to encourage customers to return or destroy affected products.
- Notify the broader public, including people who received products as gifts or bought them second-hand.
The agency’s aim was to reach products that might already be in homes and keep them from being used or resold. A message to an original buyer may not reach a gift recipient or a later owner. Likewise, taking a listing down does not remove an item already delivered. The order is a remediation requirement; it should not be read as proof that every required step was completed.
Amazon told the CPSC during the administrative proceeding that it had contacted initial purchasers, warned them about potential hazards, and issued credits or refunds. The Commission found those measures inadequate, saying the communications did not provide the specificity of formal recall notices, credits did not ensure products were returned or destroyed, and notices to original purchasers might miss later users. Those are the agency’s stated reasons, not a court finding that resolves the dispute.
How the case developed
- July 14, 2021: The CPSC authorized an administrative complaint against Amazon.
- 2021–2022: The administrative proceeding continued; an administrative law judge denied Amazon’s motion to dismiss in January 2022 and addressed summary-decision issues.
- July 10, 2023: An initial decision addressed remedies.
- July 29, 2024: The Commission determined that Amazon was a distributor responsible for the specified hazardous products and required a remedial plan.
- January 16–17, 2025: The Commission approved the final notification and action plan; it became effective January 26.
- January 24–31, 2025: Amazon sought a stay while pursuing judicial review, and the CPSC granted a stay of its order pending that review.
- March 14, 2025: Amazon filed its federal lawsuit in Maryland.
- June–August 2025: The federal case moved into summary-judgment proceedings; Amazon filed its summary-judgment motion on August 20, according to the publicly indexed docket.
- October–December 2025: A 2026 legal reference reports further briefing and a joint request for more time.
What this means if you bought one of the products
The lawsuit does not mean a product is safe, cancel a product-safety warning, or establish that Amazon has completed a recall. If you think you own one of the affected carbon-monoxide detectors, hair dryers or children’s sleepwear, check the specific CPSC recall information and any notice in your Amazon account. Do not rely only on the fact that a listing disappeared or that you received an account credit: neither tells you whether the item in your possession is covered or whether it was returned or destroyed.
If the item was a gift or bought second-hand, the original purchaser’s Amazon account may not help you find a notice. Look for the product and recall details in the CPSC’s recall and adjudicative-proceedings listings. Follow the safety instructions in the applicable notice. The case concerns a defined group of products in a specific agency proceeding—not all products sold by third-party sellers on Amazon.

Why the case matters beyond these products
The outcome could help define how far federal product-safety obligations reach across online marketplaces and fulfillment networks. If Amazon’s view prevails, the CPSC could face limits on imposing direct recall duties on platforms or logistics providers, potentially leaving the agency to pursue manufacturers, importers, sellers or retailers individually. If the CPSC’s view prevails, marketplaces with substantial involvement in listing, storing and shipping products could face broader notification and remediation duties, including costs for customer outreach, refunds and product removal.
Either result could influence how platforms structure seller requirements, product screening, recordkeeping and recall procedures. These are possible implications, not established outcomes. The lawsuit does not decide whether Amazon manufactured the products, and a ruling about Amazon’s role would not automatically resolve every platform’s obligations under every set of facts.
Case status
As of the latest status that can be stated from the cited materials, the case was in federal summary-judgment litigation; the materials do not establish a final judgment, settlement, or whether the court ultimately upheld or overturned the CPSC order. The public docket page may not reflect later filings.
